1 ECLAC CONTRIBUTION FOR THE REGIONAL IMPLEMENTATION OF THE MADRID INTERNATIONAL PLAN OF ACTION ON AGEING ( ) This report was prepared by the Latin American and Caribbean Demographic Centre (CELADE) - Population Division of the Economic Commission for Latin America and the Caribbean (ECLAC) January 2011 This report has been prepared by the Latin American and Caribbean Demographic Centre (CELADE) Population Division of ECLAC with the aim of presenting, before the member States of the Commission of Social Development, the technical support activities that it has carried out in order to promote the regional implementation of the Madrid International Plan of Action on Ageing for the period. II. THE MANDATE FOR THE PERIOD ON THE ISSUE OF AGEING AND DEVELOPMENT In Resolution 616 (XXXI) of 2006, the member States of ECLAC requested the Secretariat to organize a regional intergovernmental conference in the year 2007, intended to examine and evaluate the progress of the countries in the region on the application of the Implementation Strategy for Latin America and the Caribbean for the Madrid International Plan of Action on Ageing (LC/G.2318/E). In pursuance of this mandate, from 4 to 6 December of 2007, ECLAC carried out the Second Regional Intergovernmental Conference on Ageing in Latin America and the Caribbean: Towards a Society for all Ages and Social Protection based on Rights in Brasilia. In the said conference, the Brasilia Declaration was adopted (LC/G.2359), whose importance was reaffirmed in Resolution 644 of the 32 nd session period of ECLAC, which took place in June 2008 in Santo Domingo (LC/G.2395). At this conference, the Secretariat was requested to provide technical assistance for conducting follow-up meetings of the Declaration, in particular regarding the international mechanisms protecting the rights of older persons, and also to strengthen its activities in the areas of public policies, information, research, human rights and ageing. The results of the work carried out starting from this mandate were presented in the meeting of the Ad Hoc Committee on Population and Development of ECLAC in The Ad Hoc Committee is the intergovernmental organ in charge of the regional followup of the Madrid International Plan of Action on Ageing. During its latest session - held from 12 to 14 May of 2010 in Santiago, Chile - reference was made to the follow-up activities of the 1

2 Brasilia Declaration ( ), among them those related with ageing and development in the work program of ECLAC, the work areas that were addressed and the results obtained, as well as emerging issues and their future projections. Technical support actions were also referred to in particular for the follow-up meetings proposed by the Governments of Argentina, Brazil and Chile and the national progress reports prepared by 19 countries of the region to document the actions taken in the national and international fields on the issue of human rights. With regard to the support for the implementation of the Brasilia Declaration, the activities carried out were detailed in the areas of public policies, information and training and, in that referred to interinstitutional collaboration, the close collaboration between some members of the Interinstitutional Group on Ageing was mentioned. Along with this, in response to the request made by the 25 participating countries in the third follow-up meeting of the Brasilia Declaration, the CELADE Population Division of ECLAC presented a strategy proposal to advance, from the Latin American and Caribbean perspective, in an international convention on the rights of older persons, in which it is suggested the strengthening of instances of negotiation and of civil society organizations dealing with this issue and to promote the adoption of an international treaty. It was also said that it was of great importance the creation, within the United Nations General Assembly, of a working group to lead the process towards an international treaty on the rights of older persons. The event concluded with the approval of the agreements on population and development: priority issues for , 1 in which specific actions were identified and proposed in order to concentrate efforts during the coming years. These agreements were ratified by Resolution 657 of the XXXIII session period of ECLAC, held in Brasilia from 30 May to 1 June In the agreements, the Committee called upon all member and associate States of ECLAC that they continue making efforts with the aim of reinforcing the international protection of the rights of older persons, and valued the development of a regional meeting for the celebration of the second cycle of review and evaluation of the Madrid International Plan of Action on Ageing in III. WORK AREAS AND DEVELOPED ACTIVITIES The following describes the three work areas in relation to the issue of ageing and development which, in the last two years, have been implemented by ECLAC, through its Population Division, and executed mainly thanks to the financial support of the United Nations Population Fund (UNFPA) and the Swedish International Development Cooperation Agency (SIDA) (see diagram 1). 1 See the meeting report, [online], < 2

A. Regional Follow-up of the Brasilia Declaration During , several follow-up activities of the Brasilia Declaration have been promoted in the national and regional fields, and broad participation of the member States was achieved in each of the actions developed to date. Among the more important activities undertaken in this framework are the following: 1. Follow-up meetings on the issue of human rights. Three regional follow-up meetings of the Brasilia Declaration were carried out during the period. The first took place on 16 and 17 September 2008 in the city of Rio de Janeiro. It was organized by the Special Secretariat for Human Rights and the Foreign Ministry of Brazil, with the technical support of CELADE Population Division. This activity brought together representatives of 13 ECLAC member States, civil society organizations and international organizations. 2 2 See the meeting report, [online], Idoso_2008.pdf. 3

4 The second meeting brought together the representatives of 14 countries and took place on 21 and 22 May 2009 in Buenos Aires. It was organized by the Ministry of Social Development and the Ministry of Foreign Affairs, International Trade and Worship of Argentina, with the technical support of CELADE and the Pan-American Health Organization (PAHO). As the main result, a list of issues was agreed on that would form part of a convention text. 3 The third meeting took place at ECLAC headquarters in Santiago on 5 and 6 October It was organized by the Government of Chile, through the National Service of Older Persons (SENAMA), with the technical support of CELADE and PAHO, as well as the collaboration of the Iberoamerican Intergovernmental Technical Cooperation Network (RIICOTEC), UNFPA and the Iberoamerican Social Security Organization (OISS). It brought together 25 countries, several of which from the English-speaking Caribbean. 4 In 2010, two sub regional seminars took place in Argentina (Buenos Aires, 16 to 18 June 2010) 5 and in El Salvador (San Salvador, 16 to 18 June 2010), promoted by the national administrations, and a special meeting took place at the OAS to analyze the rights of older persons, which was promoted by member countries. Furthermore, the Southern Common Market (MERCOSUR) created the Permanent Commission of the Rights of Older Persons with the aim of favoring the exchange of experiences on the issue and broadening the protection of the rights of older persons. 2. National progress reports on the implementation of the Brasilia Declaration. In April of 2009, the Secretariat requested member States to respond to a survey on the issue of the human rights of older persons, which was responded to by 19 of them. The analysis of the survey demonstrated that 15 countries had carried out diffusion actions with regard to the Brasilia Declaration in the national field and 11 had carried out national seminars on the human rights of older persons. In accordance with the information provided by countries, the issue was promoted by the respective administration in several regional and international forums. B. Technical Assistance for the Implementation of the Brasilia Declaration To collaborate with the countries of the region on the compliance with the commitments made in the Brasilia Declaration, the Secretariat has carried out various technical support activities, of which the following should be pointed out: 1. Technical assistance on the matter of ageing and development. CELADE Population Division has provided technical collaboration to several countries on the areas of institutionality, legislation and evaluation of programs directed towards older persons. In the first of these areas, it has collaborated with the Ministry of Social Development of Panama, the Ministry of the Family, Adolescence, and Childhood of Nicaragua, the Social Welfare Institute of Paraguay, the National Council of Older Persons of the Dominican Republic and the Ministry of Social Development of Uruguay. 5 technical assistance to the Nicaraguan Legislative Assembly on the formulation and regulation of Law 720 enacted in May It also carried out activities in the field of evaluation of public policies, working jointly with the Ministry of Social Development of Argentina in the review of the National Home Care Program. Finally, on the positioning of the issue of ageing it collaborated with Argentina, the Plurinational State of Bolivia, Brazil, Chile, Colombia, Costa Rica, Mexico, Nicaragua, Panama, the Dominican Republic and Uruguay, among other countries. 2. Systemization and diffusion of socio-demographic information. CELADE has continued developing the Regional System of Indicators on Ageing (SISE) 6 which contains comparable information for 20 Latin American and Caribbean countries, permitting the processing of data for two census periods (1990 and 2000) and disaggregate them by sex, age groups and zone of residence. In 2010, the system was updated through the incorporation of a module with information on population estimates and projections elaborated by CELADE on the issues of the population number of those 60 years of age and older, percentage of the population 60 years and older and indicators of population ageing. Also, a specific module was introduced on dependence and care which includes indicators on dependence on care, care in old age and the distribution and evolution of care load. The new version of the system is available on compact disc. Currently, the online version is being finished. Assistance has also been provided to perform national studies on the phenomenon of ageing and the situation of older persons in Chile, Costa Rica, Ecuador and Uruguay, among other countries and the Guidelines for the Elaboration of Modules on Ageing in Household Surveys (LC/L.2969-P) 7 with the aim of broadening the areas of collection and data analysis on older persons. Also, the book Socio-demographic indicators for Latin America and the Caribbean (LC/L. 2987) 8 and its respective SEPARATA 9 were published. Both documents have the purpose of broadening the diffusion and knowledge of indicators on ageing and older persons. 3. Research on public policies, ageing and development. ECLAC, through its Population Division, has worked on research projects on care, human rights and future scenarios on matters of ageing policies, a framework within which it has elaborated a theoretical and methodological body and case studies of selected countries. Newsletter N 6 appeared in December In December 2009 N 7 19 was published and N o 8 20 in December Finally, in 2010, CELADE coordinated the regional version of the project entitled Understanding our Ageing World, which was carried out by the United Nations Population Fund (UNFPA) in collaboration with HelpAge International. As a result, it elaborated a Regional Panorama of the Implementation of the Madrid International Plan of Action in Latin American and the Caribbean and five case studies (Argentina, Belize, the Plurinational State of Bolivia, Nicaragua and Uruguay). 4. Research on intergenerational transfers and social protection systems. Within the framework of the global National Transfer Accounts project (NTA) 21, ECLAC, through CELADE, coordinated a project on population ageing, intergenerational transfers and social protection in Latin America and the Caribbean, with main financial support from the Canadian International Development Research Centre (IDRC), and contributions from the University of California, Berkeley and the United Nations Population Fund (UNFPA). The first stage of the project has recently concluded with the participation of five countries: Brazil, Chile, Costa Rica, Mexico and Uruguay. 22 The second phase has begun, with the incorporation of four new countries: Argentina, Colombia, Jamaica and Peru. 23 The general objective of the project is to improve fiscal sustainability and equality of social protection systems in Latin America in the face of population ageing. There are four specific objectives: (i) To strengthen the capacities of the participating national centres to develop, implement and utilize the NTA methodology, (ii) To provide optimal information for decision-making on social protection policies, through the impact analysis of demographic 13 See its electronic version in Spanish, [online], < and its electronic version in English [online], < 14 Véase su versión electrónica, [online], < 15 See its electronic version, [online],< 16 See its electronic version in Spanish, [online],< and its electronic version in English [online] < 17 See its electronic version, [online],< 18 See its electronic version, [online], 19 See its electronic version, [online], 20 See its electronic version, [online], < 21 More than 30 countries from five continents currently participate in the global NTA Project. These countries differ in terms of demography, level of development, support systems for older persons, their capacity to invest in human capital and the saving ability of their population. Comparative analysis of the NTA between these countries not only would shed light on these differences, but also illustrate the economic implications that population ageing could have under different institutional arrangements. 22 Brazil, Costa Rica, Mexico and Uruguay were financed by IDRC, while Chile was financed by the University of California, Berkeley. 23 Argentina, Colombia and Jamaica were financed by IDRC, while Peru was financed by UNFPA. 6

7 ageing on economic growth, fiscal sustainability and equality; (iii) To better inform politicians on the importance of long-term transformations that come from population ageing, and (iv) To foster comparison and collaboration between countries, and the inclusion of a regional perspective. On the basis of these objectives, CELADE has made great use of new information on generational economy in Latin America and has carried out various studies in this area, many of them in collaboration with other organizations such as the United National Population Fund, the Pan-American Health Organization and the World Bank. 24 In October 2009, CELADE, in collaboration wit the Population Division of the United Nations Department of Economic and Social Affairs (UNDESA) organized a conference, in which government representatives along with experts from various regional and international organizations, analyzed the consequences of population ageing on the sustainability of transfer systems in Latin America and economic growth, beginning with the information produced in the first phase of the project. The minutes of this conference have been published in the Population Notes Magazine N o In November of 2010, CELADE had a regional meeting in Havana, Cuba, in the context of the second phase of the Project, that was attended by all national teams, as well as some invited guests, among them the coordinator of the global NTA Project. The general objective of the meeting was to share the progress achieved up until now in countries participating in the project and to discuss products and future activities, including the global NTA meeting that will take place in Rio de Janeiro in The results of the aforementioned meeting are available on the project website ( 5. Training of national teams. In 2010, thanks to the support of SIDA, CELADE held the international course Ageing and Social Protection Strategies in Latin America from 15 November to 7 December 2010 through two modalities. The first, long-distance, took place from 15 to 26 November 2010; the second, in person, took place from 29 November to 7 December 2010 at ECLAC headquarters in Santiago. 27 professionals took part (9 men and 28 women) from 17 countries of the region (Argentina, the Plurinational State of Bolivia, Brazil, Chile, Colombia, Costa Rica, Cuba, Ecuador, El Salvador, Guatemala, Mexico, Nicaragua, Panama, Paraguay, Peru, Dominican Republic and Uruguay). Of these, 15 participated in long-distance and 22 completed both long-distance and in person modalities. Nicaragua is also being provided with technical assistance, through the Interuniversity Group for Dialogue on Public Policies on Population and Development of the National Council of Universities, in the execution of the postgraduate degree in Ageing and Development that began in August Furthermore, two national courses were taught on Ageing, Human Rights and Public Policies in the last two years. The first was organized by the National Institute for Older Persons (INAPAM) and the Mexican Legislative Assembly which brought together 140 professional from various states in the country. The second was organized by the Costa Rican Gerontological Association (AGECO) and brought together 72 professionals of governmental and non-governmental sectors. 8 C. Interinstitutional Collaboration for the Implementation of the Brasilia Declaration The Interinstitutional Group on Ageing composed of ECLAC, UNFPA, PAHO, the International Labor Organization (ILO), the World Bank and the United Nations Ageing Programme was created in 2002 and has undertaken several interinstitutional cooperation and coordination activities. During the last two years, ECLAC has continued to maintain close collaboration with PAHO in the activities that the OAS has celebrated, through that agency, in compliance with the agreements of the Brasilia Declaration. The same has occurred with UNFPA, through the Regional Office for Latin America and the Caribbean and the different offices of the countries, and with the United Nations Department of Economic and Social Affairs (DESA), through the United Nations Ageing Programme. Some of the more important collaboration activities undertaken in the last two years have been the following: joint technical assistance to the follow-up of the Brasilia Declaration, the elaboration of reports on ageing presented in different regional forums and the execution of advocacy activities to improve the positioning of the issue on the public agenda. In particular, and in accordance with Resolution 46/1 of 2008 and 47/3 of 2009, ECLAC has actively collaborated with DESA on the provision of inputs for the report that the Secretariat has presented in the 48 th y 49 th session periods of the Social Development Commission. Also during this period, technical collaboration has been provided to civil society organizations. Special mention is deserved for its participation in the planning and realization of the Regional Meeting Civil Society+10: Contributions and Challenges for the Rights of Older Persons, in which 137 organizations from 15 countries participated. IV. MAIN RESULTS OF THE PERIOD AND FUTURE PROJECTIONS During the period to which this document informs, the technical assistance work provided to the countries in the region demonstrated some evident results in the evolution and treatment on the issue of ageing and development. Broadly speaking, these results can be grouped into four main areas: a) visibility of the rights of older persons in the national, regional and global fields; b) inclusion and strengthening of social services as part of the agenda on ageing; c) development of public institutionality for the current socio-demographic situation, and d) regional contribution for the second cycle of follow-up and evaluation of the Madrid International Plan of Action on Ageing. A. Visibility of the Rights of Older Persons in the National, Regional and Global Fields At various moments, international organizations as well as governments and civil society have called attention to the failure of available mechanisms to protect the rights of older persons in the world, and have presented proposals to advance the creation of international instruments of protection of the rights of older persons. The Brasilia Declaration is part of this process and represents a fundamental contribution to include the issue on the XXI century human rights agenda, which the recommendations arising from the three review meetings mentions in previous paragraphs has achieved impact on the debate on ageing and the national, regional and global levels. 8

9 In the national arena, diffusion and discussion initiatives have been undertaken on an international convention for the rights of older persons in Argentina, the Plurinational State of Bolivia, Chile, Costa Rica, El Salvador, Peru and Uruguay, among other countries. At the sub regional level, the seminar of the Broader MERCOSUR on Best Practices in Gerontological Policies taken place in mid 2010 served as an update on the matter of public policies oriented towards ageing and old age. In its declaration, the representatives of Argentina, Brazil, Paraguay and Uruguay, as well as Chile, manifested their willingness to reiterate their request to designate a special rapporteur on the rights of older persons in the United Nations Human Rights Council. Along with this, the necessity to confirm the creation of a working group on the rights of older persons was confirmed. Both purposes were reaffirmed by the Presidents of the States of MERCOSUR and Associated States, gathered together in the city of San Juan, Argentina, on 3 rd August 2010, on the occasion of the XXXIX Meeting of the Common Market Council. In San Salvador, during the meeting called Guidelines for a Convention on the Rights of Older Persons of June 2010, representatives of Costa Rica, Guatemala, Nicaragua, Honduras, Panama, Dominican Republic, Belize and the host country, concluded a document of twenty recommendations and agreed to continue promoting a specific treaty. In October 2010 a special session of the Permanent Council of the Organization of American States (OAS) was held which counted on the participation of representatives of member States, experts on the issue of human rights and civil society. In compliance with the mandate of the OAS General Assembly, the viability of creating an instrument that protects and promotes the rights of older persons in the Americas was discussed. In this framework, the greater part of Latin American and Caribbean countries agreed on the necessity of a convention. One month late, in November of 2010, the United Nations General Assembly decided to establish a working group with the purpose of increasing the protection of the human rights of older persons. Member States would be able to participate in it, according to the provision of the Third Commission of the 65 o session period of the General Assembly, in charge of social, humanitarian and cultural affairs in its Resolution A/C.3/65/L.8/ Rev.1. Under this framework, it will correspond to member States to define future activities to develop the issue in order to strengthen the initiatives that have taken place in the region since the adoption of the Brasilia Declaration. B. Inclusion and Strengthening of Social Services as part of the Ageing Agenda In the last few years, population ageing and the transformations of the demographic structure have been gaining space in public policy debates, especially in those more aged countries, not only for reasons of equality and social cohesion, but also for the growing effect the increase in older persons has on social protection systems. This has translated to the practical work of CELADE Population Division, given that it has received technical assistance requests on the issues of care, attention to the dependence in old age and public policies by Argentina, Chile, Colombia, Costa Rica, and Uruguay with greater frequency that earlier periods. Care is an issue that crosses multiple areas of development: human rights, social protection, gender equality, inequality, to only mention a few. Nevertheless, despite the existence of academic literature and international organizations, in previous years this issue had not reached sufficient visibility to become a public issue that received attention by part of the different actors that intervene in welfare. 9

10 The countries of the English-speaking Caribbean, demonstrate a broader development of the socio-sanitary services; while the need for care begins to earn more space each time on the agenda of Latin American governments. This has led to gradually move beyond a health perspective in these types of services to progress towards more comprehensive initiatives and, in various cases, at the community level. Nevertheless, the few evaluations conducted show that they are generally insufficient and of low quality. 26 On this issue there are two initiatives that stand out: (i) the progressive attention network for the comprehensive care of older persons in Costa Rica, through which it seeks to implement a model with a basis in all the actors intervening in care (community, government, businesses, families, etc.) in order to offer an organized and articulated system of services and benefits; and (ii) the national care system that is being developed in Uruguay, in which the older persons population in a state of dependence is one of the priority groups. In this situation it is of great importance to continue strengthening research on the issue of ageing and care, to develop and share useful decision-making indicators, to exchange practical experiences on the matter and to take concrete actions to strengthen its position as a transcendental matter of social protection. CELADE has been advancing in this area through the development of indicators and the production of documentation in this respect. 27 C. Development of Public Institutionality for the Current Socio-Demographic Situation Currently, a great many of the countries of the region have integrated an organization in charge of the policies and programmes for older persons in the organization chart of the public apparatus. It refers to directorates within a ministerial section such as in Argentina, Ecuador, the Plurinational State of Bolivia, Paraguay, Peru and Honduras; of institutes and services such is the case of Chile, the Bolivarian Republic of Venezuela, Mexico and most recently Uruguay, or of a Council such as that of Brazil, Costa Rica and the Dominican Republic. There are also other countries that have a Programme (Cuba and Guatemala), or an area of social welfare in which older persons are considered part of the vulnerable populations such as in Colombia and Panama. In some case, these organizations count on decentralized instances at the level of lesser territorial units, and many of them were created by a special law, reaching a level of formality that should enable them to have continued and guaranteed access to the instruments and resources of the State. Nevertheless, and with notable exceptions, a great deal of these mechanisms does not achieve a real level of practical consolidation and continues constituting administrative units of medium or low level of hierarchy within the state apparatus. Although it has contributed to incorporating the needs and interests of older persons within the specific sectional actions, it is still an institutional mission relatively separate within the work of the government. The current situation forms part of the construction and strengthening process of institutionality and, as background, of the issue of ageing in general. As in the case of social services, as well as on the issue of public institutionality and ageing, CELADE has been receiving with greater frequency requests for technical assistance during the past two years. In some countries assistance is asked to reinforce the agency s leadership function that deals with the issue, so that it may act effectively as a space for interinstitutional coordination that incorporates ageing in all the state s work. 11 to efficiently exercise the duties for which it was created. And finally, there are also countries in which a new institutional framework is being created and require technical support in its design and implementation of these new organizations. Without a doubt, the issue of public institutionality and ageing is acquiring centrality in the coming years. In this area it is fundamental to exchange best practices, learn experiences from outside the region, design institutional models according to the needs of each country and take strengthening actions for technical abilities. D. Regional Contribution for the Second Review and Evaluation Cycle of the Madrid International Plan of Action on Ageing Between 2008 and 2009, the review of the Brasilia Declaration was directly promoted by the member States of ECLAC by conducting follow-up meetings. During the first months of 2010, the discussion of the issue was directly concentrated on the ordinary session of the Ad Hoc Committee of ECLAC on Population and Development, which was held from 12 to 14 May 2010 at ECLAC headquarters in Santiago. It should be noted that the Committee is the intergovernmental organ of the ECLAC that has the responsibility of undertaking the regional follow-up of the Madrid International Plan of Action on Ageing (2002) and the Brasilia Declaration (2007). As a result of this meeting, the Committee approved the Agreements on Population and Development: Priority Areas for , in which a series of actions for member States as well as the Secretariat were recommended for them to undertake. Among the main actions, the following stand out: It is proposed that member States of ECLAC widely share the document titled Strategy Proposal, from the perspective of Latin America and the Caribbean, for advancing towards an International Convention on the Human Rights of Older Persons and encourage its consideration in the governmental, academic and civil society fields. It calls upon the countries of the region to promote the undertaking of national and regional dialogues with the aim of an international convention on the rights of older persons. It requests ECLAC to continue providing technical assistance to countries for the application of the Brasilia Declaration, with special reference to the issues of public policies and their financing, information, research and human rights. With the objective of reinforcing the application of the Brasilia Declaration, the agreements of the Committee will be the main guide to the activities that CELADE Population Division of ECLAC will undertake on the issue of ageing in the next two years. As part of this, in 2011, CELADE will develop new actions directed at strengthening their direct support work to countries in the implementation of the agreements of the Brasilia Declaration, in the framework of the joint program ECLAC-SIDA Protection and Social Inclusion in Latin America and the Caribbean, Component 3 Social Protection Strategies for an Ageing Population. On the other hand, it is expected that the countries of the region define their priorities for action to ensure the implementation of the Brasilia Declaration, whose results will be reported in 2012 in the framework of the second review and evaluation cycle of the Madrid International Plan of Action on Ageing (Madrid+10). 11
