1 CULTURAL EXECUTI VE PROGRAMME BETWEEN THE ITALIAN REPUBLIC AND THE REPUBLIC OF KOREA FOR THE YEARS The Government of the Italian Republic and the Government of the Republic of Korea, being guided by Article 19 of the Cultural Agreement between the Republic of Korea and the Italian Republic revised in Rome on October 21 st, 2005 and wishing to implement the aforesaid Agreement nad further strengthen the friendly relations and mutual undestanding between the two countries, has agreed upon the following Cultural Executive Programme for the years ART AND CULTURE Cultural Institutes and Institutions 1.1 The Italian Party will extend its efforts to strengthen cultural co-operation through the Italian Cultural Institute in Seoul, and the Korean Party will actively consider the possibility of establishing a Korean Culture Centre in Rome (see Annex I). Exhibitions and Cultural Events 1.2 The Parties will encourage the exhibition of their works of art in the other country (see Annex I; Annex II C). 1.3 The Parties will encourage the performances of their traditional and modern dance, music as well as the participation in other cultural events held in the other country (see Annex I). Cinema 1.4 Both Parties shall favour co-production initiatives between their public and private organizations through common projects of promotion and co-production; the exchange of artists; the participation in festivals, celebrations, workshops and international major cultural events, in order to increase the value of the cinema of both countries (see Annex II D). Cultural Heritage 1.5 Both Parties underline the importance of the co-operation between their respective administrations of archives for study-visits, research, as well as the exchange of scientific publications, microfilms and copies of documents, in compliance with their national laws in force and on the basis of reciprocity (see Annex II A). As to the above initiatives, the relevant administrations of archives shall agree on them through diplomatic channels or also through direct contacts, timely informing the two Ministries of Foreign Affairs. 1.6 Both Parties shall encourage co-operation between the Historic Archives of both Ministries of Foreign Affairs, on the basis of the principle of reciprocity, and in

2 accordance with their own legislation, in order to permit the access of qualified researchers and in order to exchange information and experiences. 1.7 Both Parties shall encourage, in accordance with their respective domestic laws, the co-operation between the libraries of both countries, including the exchange of librarians, books, data bases, and bibliographical exhibitions between them (see Annex II, A and C). 1.8 The Parties will encourage the exchange of data, information and experts on the preservation and restoration of cultural assets in their territories. The Parties will promote co-operation between the main museums of the two countries in the field of preservation and restoration of cultural assets. In order to achieve this, the Parties will extend their efforts to invite, within the limits of the budgets, experts in the field of preservation and restoration of cultural assets. Details, including the financial ones, will be agreed upon through diplomatic channels. (see Annex II A). The Italian Party hopes to hold the exhibition of a documentary film in Korea about history and development of restoration techniques realised by the Central Institute for Restoration of Rome. Financial details will be agreed upon through diplomatic channels. 1.9 The Parties agree to co-operate in order to contrast and prevent illicit traffic in works of art with preventive, repressive, and remedial measures, in accordance to the respective national legislations, and also in consideration of the principles borne by the 1970 UNESCO International Convention on the means of Prohibiting and Preventing Illicit Import, Export and Transfer in Ownership of Cultural Property, and borne by the 1995 UNIDROIT Convention on Stolen or Illegally Exported Cultural Objects. Both Parties shall also co-operate to facilitate the identification and the return to their lawful owners of works of art and cultural property that have illegally been taken to their territory. Copyright and related rights 1.10 The two Parties will endeavour to develop bilateral co-operation in the field of the protection of copyrights and related rights between the respective relevant Governmental bodies in this field. For Italy, the relevant administration body is the Ministry for Cultural Heritage and Activities. For the Republic of Korea, the relevant governmental body will be the Ministry of Culture and Tourism. Radio and TV 1.11 In the framework of specific agreements, the Parties will promote cooperation between radio and TV stations of the other country to enhance mutual understanding and knowledge, in the field indicated below: a) exchange training courses and temporary stays for journalists, technicians and 2

3 producers; b) exchange and co-produce broadcast programmes In the framework of specific agreements and in order to prepare effectively for the new broadcasting environment following developments in technology, the Parties will promote co-operation between their broadcasting authorities, in the field indicated below: a) try to find a joint scheme to deal with the trend of converging broadcasting and telecommunication; b) support academic exchanges including research and development of broadcasting. 2. LANGUAGE AND LITERATURE 2.1 The Parties will promote the teaching of the language and literature of the respective countries in the universities and other institutions of higher education - also through the development of the curriculum in the secondary schools - and the establishment of new chairs and lectureships at their respective universities. They will encourage, moreover, the teaching of the language of the other country through the Cultural Centres of the two Parties referred to in point 1.1 of the present Programme. 2.2 The Korean Party acknowledges with pleasure the lectureships in Korean language at the University Institute for Oriental Studies in Naples, the University of Ca Foscari in Venice and the University La Sapienza in Rome, and hopes that these lectureships will expand and strengthen and that lectureships in Korean language will be set up in other universities in Italy. 2.3 The Parties acknowledge that an Italian Government-funded lecturer has been teaching in Korea since September The Italian Party will examine the possibility, within the limits set by the annual budget, of further contributing to the teaching of the Italian language at university level in Korea. 2.4 The Italian Party will examine the possibility, within the limits set by the annual budget, of spreading Italian books and of promoting translations of its works of literature and the screening of full-length and short films through the Italian Cultural Institute in Seoul (see Annex I). 2.5 The Italian Party, through the General Directorate for Italians abroad and Migratory Policies, will provide funding for the settlement of Italian language and culture courses in Korea. 3. HIGHER EDUCATION 3.1 The Parties will promote direct contact and collaboration between their universities, other institutions of higher education and academic institutes, in particular for the organization of seminars, implementation of joint research, and exchange of information and lectures (see Annex I). To this end, contacts will be promoted between the conference of Italian University Rectors, and the equivalent Korean institution. 3

4 In order to ensure a more coordinated development of those contacts, the Parties will inform each other about the cooperation agreement concluded between universities and institutions of both countries. 3.2 During the validity of the present Programme the two Parties will encourage the exchange of professors and researchers, for lecturing and mutual exchange of experience. Priority will be given to those visits aimed at starting co-operation between universities, and at the implementation of common projects. Details will be agreed upon through diplomatic channels. 3.3 The Parties will provide scholarships of 48 months annually to students of the other country participating in graduate courses for the aim of promoting linguistics, cultural and natural sciences, and the language of the other country. Details of scholarships will be agreed upon through diplomatic channels (Annex II, B). 4. SPORTS AND YOUTH EXCHANGES 4.1 The Parties shall favour the development and co-operation in the various sports and disciplines through direct contacts between the sport organisations, in particular between their Olympic Committees. 4.2The Italian Party will provide all possible cooperation for the Korean Party to introduce and spread Taekwondo within Italy. 4.4 The two Parties shall encourage contacts between the organisations responsible for programmes of youth social-cultural exchange. 5. HUMAN RIGHTS 5.1 The two Parties will encourage activities in the field of education and culture which are aimed at ensuring the full protection of internationally recognised human rights. In particular, they shall intensify the struggle against racism, intolerance and xenophobia. 6. FINAL PROVISIONS 6.1 This Executive Programme does not exclude the possibility for the Parties to agree, through diplomatic channels, on exchanges that are not included in the present Programme, subject to previous authorisation from the bodies which are in charge of co-ordinating the Programme itself. 6.2 The Parties agree that the activities mentioned in this Programme will be implemented within the limits of the annual budget of each country. 6.3 This Program will remain valid until the signing of a new one and in any case no longer than two years following its expiry. 6.4 The Annex I and II are considered to be an integral part of this Programme. 6.5 The Parties agree that the next meeting of the Joint Committee will be held as soon as possible. Details about the date will be agreed upon through diplomatic channels. 4

6 ANNEX I CULTURAL COLLABORATION BETWEEN INSTITUTIONS, ADMINISTRATION BODIES AND ASSOCIATIONS This list is not a final version, as it is believed that a majority of other public and private bodies could participate in the cultural collaboration programme. The Parties will participate in the planned activities within the limits of available funds. Each Administration shall examine the possibility of realizing planned activities on the basis of their quality level and fitting costs. 1.1 The Parties will acknowledge the role of the cultural associations and institutions in Seoul in order to promote cultural exchanges. - The Accademia dei Lincei, Accademia Nazionale di San Luca, Consiglio Nazionale delle Ricerche, Fondazione Giorgio Cini in Venice and Fondazione Giovanni Agnelli in Turin as well as other academic Institutions in Italy are interested in starting or increasing co-operation with Korean Institutes. - The City of Kyeong-ju hopes to further strengthen cultural and economic cooperation with its sister city Pompei. 1.2 The Parties will continue to co-operate in accordance with their regulations in order to set up a Korea room in the National Museum of Oriental Arts ( Museo Nazionale d'arte Orientale ) in Rome. 1.3 The Korean Party expresses its intention to open exhibitions in the newly established Korea room and cultural events in Italy, as written below: a) hold an exhibition of pottery dating from the Koryo and Chosun dynasty from the Korean National Central Museum collection, and other cultural events (lectures on pottery will also be held). - The Italian Party expresses its intention to organize the exhibition of contemporary Italian art ( ) Forma 1 and his artists. 1.4 The Korean Party expresses its intention to hold demonstrations and performances, as follows: a) performance of 'Nanta'; b) performance by the National Center for Korean Traditional Performing Arts; c) demonstration by the Taekwondo demonstration team. 2.1 The Italian Party advises that the following financial contributions and/or awards for translators of Italian books into foreign languages are established: - National Awards for Translations, under the High Patronage of the President of the Republic, assigned by the Ministry for Cultural Heritage and Activities to Italian and/or foreign translators and publishers. Applications shall be forwarded directly to the 6

7 Ministry for Cultural Heritage and Activities, or through Italian diplomatic missions or Italian Cultural Institutes abroad - Awards and contributions from the Italian Ministry of Foreign Affairs, conferred annually to Italian and/or Korean publishers and translators formulating proposals aimed at the diffusion of Italian books and culture, through the translation and publishing of literary and scientific works, and the dubbing and subtitling of short and long motion pictures. Notice of the procedures will be given through a circular letter to Italian diplomatic missions or Italian Cultural Institutes abroad. Applications shall be forwarded to the Ministry of Foreign Affairs, Directorate General for Cultural Promotion and Cooperation, Office I, through Italian diplomatic missions or Italian Cultural Institutes abroad. - Awards to cultural associations are assigned by the Presidency of the Council of Ministers, Information and Publishing Department, Cultural Awards Office. Applications shall be forwarded to the Presidency of the Council of Ministers by September 30, throughdiplomatic channels or directly as indicated in the presidency website: http// In regard to point 3.1. of the Programme, the following are the inter-university cooperation in process: the University L Orientale in Naples and the Sogang University; the University La Sapienza in Rome and Hankuk University of Foreign Studie in Seoul; the University of Ca Foscari in Venice and Hanruk University of Foreign Studie in Seoul; the University of Siena and the University of Soong Sil. Moreover within the internationalisation programme cofinanced by the Ministry for University and Research, two joint projects are in progress: University of Milan-Korea University of Seoul, Respiratory effects of air pollution ; Univesity of Perugia for Foreign Students Pusan University for Foreign Studies, Catholic University of Taegu-Hyosung-Kyongbuk, Joint degrees for the dissemination and the promotion of the Italian language and culture abroad. 7

8 ANNEX II GENERAL AND FINANCIAL PROVISIONS A) Exchanges of visits (points 1.5, 1.7, 1.8, 3.2: archivists, librarians, museums experts, professors) Exchanges of visits under this Programme shall be regulated as follows: 1) The sending Party shall notify the receiving Party through diplomatic channels, at least three (3) months in advance, of the following: name and nationality, which must be Italian (or EU citizens who are legally resident in Italy) for those visiting Korea and Korean for those visiting Italy, of the proposed candidate; personal data of candidate, curriculum vitae and foreign language capability; proposed visit programme with list of conferences if any, name of hosting professor and his/her university department; duration and dates of the visit. 2) The sending Party will bear the cost of return international travel from capital city to capital city. 3) The receiving Party will confirm acceptance of the visit through diplomatic channels usually at least one month before the scheduled date of arrival. 4) The receiving Party will bear the cost of domestic travelling within its own territory from the capital city to the hosting university. 5) The Italian Party will offer an all-inclusive daily allowance of 93 Euro a day for a period not exceeding 10 days (up to four people). 6) The daily allowance which Korean Party offers will be defined through diplomatic channels. B) Exchange of scholarship-holders (point 3.3) The selection of candidates for scholarships shall be made yearly in each Country by a Joint Committee that includes at least one representative of the Embassy of the offering Country. The Parties will announce the definite acceptance of the scholarship holders no later than 30th June. Scholarship-holders must know either the language of the receiving country or English. Scholarship holders shall not leave for the host country until they have received from the Embassy of the offering Country a formal notification specifying the earliest date of departure. 8

9 The Italian Party will grant to Korean scholarship-holders: a) a monthly allowance of Euros; b) full or partial waiver of University fees where this is provided by the universities, within the exercise of their autonomy (excluding medical specialisation school); c) health and accident insurance except for pre-existing diseases and for dental care. The Korean Party will grant to Italian scholarship-holders: a) a monthly allowance; b) a yearly research fund and book budget; c) exemption from tuition fees; d) health and accident insurance except for pre-existing diseases and for dental care; e) round-trip air fare; f) a fee for Korean language programme (however, this will be granted to those who need a Korean language programme before the start of the university course, in an institute designated by the Korean Party for the duration of 6-12 months). C) Exhibitions (point 1.2) As for the costs of arranging for the exhibitions as indicated in Article 1.2 of this Programme, the sending Party will cover: a) insurance of the goods nail to nail ; b) packaging and transporting the goods to the first exhibition site, and from the final exhibition site to the original site in the other country; The receiving Party will cover: a) costs of transport to other places within its territory; b) local organisation and advertising expenses connected with the exhibition, except for the cost of the publication of catalogue, which will be agreed each time through diplomatic channels; c) expenses for the preparation of materials destined to the catalogue of the exhibition; d) travel expenses of the experts accompanying the exhibition (the number of experts and the duration of their stay shall be established through diplomatic channels) c) board and lodging for the experts accompanying the exhibition; their number and length of their stay shall be established through diplomatic channels. If any item is damaged, the receiving country shall supply all the relevant documents to the sending country. The damage survey fees shall be paid by the receiving country. In no case should any restoration work be carried out without the explicit authorisation of the sending country. Other procedures shall be agreed upon, on a case-by-case basis, through diplomatic channels. All the Italian initiatives, included the cultural exchanges with Pompei, shall be implemented in accordance with UE and Italian legislation on transfer of cultural objects. 9

10 D ) Cinema (point 1.4) As far as the organisation of initiatives related to cinematography and the implementation of whatever project in the field are concerned, the expenses shall be agreed upon between the Parties, on case-by-case basis, in accordance with existing legislation, financial availability and the economic modalities most advantageous to the Parties. All inititatives requesting economic support from the General Direction for Cinema Ministry of Cultural Heritage and Activities shall need to obtain a previous positive evaluation from the relevant Consultative Commission. 10
