I) Please concisely state (a) why you feel you should be endorsed over the other candidate(s) and (b) what goals for the office you seek are most important to you personally? (a) IVI-IPO should endorse my candidacy because our criminal justice system is broken--and incumbent State s Attorney Anita Alvarez is part of the problem. Alvarez has failed at her job time and time again. Her failure to press charges against Officer Van Dyke for 400 days in the Laquan McDonald case is only the latest failure to protect victims and execute justice in a timely and effective manner. I am a veteran prosecutor with a record of getting things done. I m the only candidate with the unique life experiences needed to make Cook County s broken criminal justice system fair for everyone while doing the hard work to make our communities safer. Further, IVI IPO should endorse my candidacy over Donna More as she does not share our values. A wealthy casino lobbyist, More actively supported Bruce Rauner s campaign. (b) 1. Ensuring that all criminals are treated by the same standard of justice; this includes reviewing the backlog of police misconduct cases. 2. Restoring the People s faith in the office; this includes reviewing the backlog of wrongful conviction cases. 3. Eliminating the school to prison pipeline. 4. Directing all ASAs to always do the right thing in every case. 5. Developing programs with Juvenile Court and the Cook County Jail to support children of incarcerated parents. For fam il ies of lim ited eco nom ic means, in par tic u lar Black and Latino families, op tions for sup port ing chil dren with im prisoned par ents can be scarce. Research estimates that Black chil dren, poor chil dren, and chil dren of par ents without as much access to education are dis pro por tion ately rep res en ted among the total pop u la tion of chil dren of in car cer ated par ents. When our jail is so overcrowded, with housing more than double the capacity it was built for, and when 86% of those imprisoned there are minorities, something must be done to address the vulnerability of their children and families which makes them more at-risk for ad verse child hood experiences, af fect ing chil dren with in car cer ated par ents. J) (a) What is your campaign budget and (b) how much have you raised to date? We hope to raise at least $1.2 million-$1.5 million. To date, we have raised about $530,000. A. General: Essay 9. In what circumstances would you contract for outside professional services and what criteria would you implement for letting contracts? Please comment on any existing abuses and how you would correct them. Would you support contracting for outside services with companies located outside Cook County? Why or why not? I would only contract for outside services if the internal organization lacked the skills, capacity, or expertise to complete the work. I would not support contracting outside of Cook County--we have an obligation to utilize the talent and support the businesses within the County. I would only go outside of the County after an exhaustive search for local work. Page 4 of 10

5 10. What is your position in regard to putting all Assistant State's Attorneys and other employees of your office under Civil Service or other merit systems? How would hiring minorities and women and retaining career personnel in your office be affected? Either Assistant State s Attorneys should be able to unionize, or the administrative and investigative staff should be converted into a merit compensation system so that all CCSAO personnel are treated the same. The current system creates a divide between the two when the CCSA should be doing everything to ensure that all parts of the office can work smoothly together to promote efficiency. Currently, 54% of ASAs are women. As State s Attorney, I ll prioritize hiring a representative minority demographic proportional to the county s population. This is not something that happens overnight, but it is a goal I will strive toward. I would institute a Chief Diversity Officer to ensure that the county s prosecutors are representative of the county s population. 11. What is your position on state s attorney promotions based on convictions? State's Attorney promotions should be based on merit, knowledge, training, experience, and qualifications to be a manager. This is irrespective of a person's conviction record. 12. Do you favor mandatory drug testing of your employees, prisoners, and/or probationers, and under what circumstances and standards? I do not favor mandatory drug testing of my employees or prisoners. In some circumstances, drug testing is appropriate for probationers. 13. Please address the issue of prosecuting police officers for police brutality or any other crime? Police officers should be investigated and prosecuted in the same way that all defendants are prosecuted. Due to the inherent conflict of interest in prosecuting police officers that the office works closely with, a special prosecutor should be the one to objectively prosecute police officers in police-involved shooting cases. 14. What is the appropriate role for the State s Attorney Police force? Should it cooperate with other law enforcement agencies and if so, what guidelines should be followed? There is no State s Attorney Police Force at present. 15. What means would you employ to encourage neighborhood outreach and citizen input into your office? There's a major disparity in accessibility to the office under the current administration. I would open more Community Justice Centers where they are needed most based on where we receive the most cases from. I would adequately staff them and direct the prosecutors to partner with local police districts, church groups, and community organizations. These offices would be driven by a mission to work with the community and local police to resolve why conflicts and violence threaten the area. I would overhaul the website of the office and keep it frequently updated to keep the people of Cook County aware of and connected to what is going on in the office and county. I would also add content to the website in Spanish and ensure that at least one Spanish-speaking ASA and Victim-Witness liaison are assigned to each unit Page 5 of 10

6 within the office. IVI-IPO 2016 STATE S ATTORNEY QUESTIONNAIRE In order to work on truancy and the school to prison pipeline, I would also send ASAs regularly to various public schools to educate students on the system and listen to their concerns about the system. Do you support: YES NO 16 X B. Civil Rights and Public Policy legislation to prohibit the use of eavesdropping and wire-tapping in criminal investigations? 17 X the mandatory videotaping of all interrogations? 18 X prosecuting cases based on citizen audio or video recording of a police officer? 19 X establishing an elected, all-civilian, police review board. 20 Should any changes be made state of the law on fitness to stand trial and the insanity defense? If yes, please elaborate below. I would have to do further review of the current case law and best practices. B. Civil Rights and Public Policy: Essay 21. What is your position on carrying concealed weapons? As State's Attorney, I will uphold the law of the land. 22. What is your position on capital punishment? I oppose capital punishment. 23. How quickly is the State s Attorney s office required to turn around a Freedom of Information Request (FOIA). What do you think the turnaround time should be? The turnaround time to respond to a FOIA request should be ten days, commensurate with the law and policies of local government agencies. 24. Under what circumstances should law enforcement agencies put citizens or organizations under surveillance? Only if and when they pose a viable threat to the community or there's a good faith basis to believe they are engaged in criminal activity. If that basis exists, the CCSA should follow the law in requesting various surveillance techniques. 25. Do present procedures adequately protect the rights of the accused? Page 6 of 10

7 I am running to ensure that everyone who comes before our criminal justice system has access to the ability to have a fair process, both accused and victims. Do you support: YES 26 X NO B. Prosecutorial Discretion Assistant State s Attorneys having the power to reduce the charge from a felony to a misdemeanor or dismiss the case outright if the circumstances warrant? a program to integrate aspects of the juvenile justice and child welfare systems to better serve children who cross between the dependency and delinquency systems and recommend to the court which system could serve the best interests of the child and the safety of society? Please elaborate below. 27 X I believe we need a better system for dually-involved minors. Implementing an integrated system would require research by qualified individuals in order to come to the best, holistic proposed solution. Currently, having two systems simultaneously address a juvenile's cases only adds more stress to that juvenile who starts out 'at-risk' simply by having a dependency case. Experts from both systems, as well as in child psychology, social work, and rehabilitation should be consulted. B. Prosecutorial Discretion: Essay 28. What criteria will you employ in reaching prosecution, sentencing recommendation, and immunity grant decisions? I will base my criteria on ensuring justice. I will only bring forth cases in which I can I have a good faith basis to bring charges and its in the best interest of justice. 29. Please comment on the felony screening process currently used by the State's Attorney's office. The felony review process needs reform. As currently configured, ASAs are required to work extreme schedules in a manner that does not necessarily improve results. 30. What do you think about the use of programs as alternatives to prosecution? I support the use of programs, particularly for juveniles and first offenders, that employ diversion and other techniques to keep people out of the system for minor offenses. 31. Should the present procedures for bail and personal recognizance bonds be changed and, if so, how? Yes. I have worked on bail reform in the past and continue to support it. Pre-trial detention should only be for those who are a flight risk or pose a threat to the community. Otherwise, all others should be afforded an opportunity to await trial at home. The County should never be spending the amount of money that we spend to house people in jail for minor violations simply because they can not afford bail. As Chief of Staff to the Cook County President, I was part of a group who studied the disparity in I bonds issued by certain judges in bond Page 7 of 10

8 court. I was then part of a team who addressed this issue with the Chief Judge to work on setting reasonable bonds appropriate to the crime committed and offender s background. 32. In what circumstances, if any, would your office seek to prosecute juveniles as adults? I worked with legislators to increase the age that juveniles could be charged in the adult system and Governor Rauner signed that law in July 2015, having just taken effect at the beginning of this year. I'm aware of the discretionary transfer laws under the Juvenile Court Act having been a Supervisor at Juvenile Court. I would use discretion to look at this tactic on a case-by-case basis in the most violent cases, where treatment and probation have already proven unsuccessful or after a pre-trial assessment conducted by a licensed clinical social worker or child psychologist recommends prosecuting a juvenile in the adult system. These cases would be the exception and not the norm. 33. What would you do to reduce the wrongful prosecutions and convictions? I would start by reviewing all of the pending petitions for review to see if release is warranted. I would ask the County Board to establish a Cook County Commission on Wrongful Convictions to make recommendations and findings to me of whether offenders should be released or re-tried. I would also work with local police agencies to train their officers on proper and legal investigation and arrest techniques. I would create an open discovery policy in the office to ensure that exculpatory and inculpatory evidence is not accidentally nor intentionally withheld from defense attorneys. 34. What would you do to avoid political influence on investigations and prosecutions? I would direct my ASAs to always do the right thing and report any outside pressure or influence to the Executive Staff to be handled accordingly and possibly investigated by the public corruption unit, if appropriate YES NO B. Sentencing Do you support determinate sentencing? I support determinate sentencing that is proportional to the crime committed. The current system of mandatory sentences is based on offense classifications in desperate need of reclassification and are applied very inconsistently. I would support a determinate sentencing reform and overhaul of the classification of criminal offenses. Do victim impact statements have a positive effect on the sentencing process? I believe victims' voices deserve to be heard in the sentencing process. B. Prosecutorial Priorities: Essay 37. What are your priorities in prosecuting various types of crime? What is your attitude toward prosecuting so called victimless crimes? The State's Attorney's Office should ensure that its main priority is getting violent criminals off of the streets and keeping the community safe. I will not spend resource prioritizing prosecutions that should better be served through drug or mental health treatments. 38. Comment on the adequacy of the State's Attorney's treatment of crimes of domestic violence. Page 8 of 10

9 The State s Attorney has failed to make improvements to the Domestic Violence Division. The DV Division is currently a statistics-driven unit that prosecutes cases so that the CCSA can say tout convictions. But once that sentence is served, victims are left struggling in single-income homes with kids to raise and no outside support system. Frequently, the victim allows the offender back into the home because she is so dependent on him to survive and raise a family. 39. How would you address the problem of hate crimes and violence against racial minorities, gays, and lesbians? How would you implement the Hate Crimes statute? Hate crimes against anyone should be taken seriously and prosecuted to the fullest extent like every other crime where there is a good faith basis to bring a criminal charge. I would implement a hate crimes element to the new ASA training for newly hired ASAs. I would also ask that cultural sensitivity training be an element of anyone s sentence found guilty under a hate crimes statute. I would also consider establishing a hate crimes diversion program for appropriate cases. 40. Under what circumstances would you prosecute political demonstrators? I would prosecute political demonstrators in any instance where they have committed a crime and engaged in activity not protected by their First Amendment right to freedom of speech. 41. Comment on the current procedures for handling rape cases. What changes would you make, if any? Sex crimes are of a sensitive nature because the victims undergo such trauma and the physical evidence is delicate and limited. Sex crimes can come in various forms. Because of this, sex crimes come into misdemeanor courtrooms, juvenile courtrooms, and felony courtrooms. I would enhance the Sex Crimes Unit in multiple ways; 1) Require all ASAs assigned to the unit to have specialized trainings in how to talk to victims, handle evidence, and handle these cases from charging to sentencing. 2) Require an ASA from this unit to take the lead on the various sex crimes in misdemeanor and juvenile courts. 3) Record all victims statements, regardless of their age, to minimize the effects of retraumatizing them. 4) Refer victims to counseling services. 5) Refer all sex crimes offenders to undergo a professional assessment to determine what type of sex offender they are as early into the process as the parties agree to. Another aspect of sex offenses that needs reform are the mandatory reporting timeframes that apply even to juvenile offenders. This label stigmatizes even rehabilitated individuals who have juvenile convictions and prevents them from being able to apply for college, live on campus, seek employment and reintegrate fully. 42. What would you change, and what would you keep, in the present system of handling criminal housing prosecutions? I would evaluate the current practices in order to make a determination. 43. What are your proposals, if any, for increasing investigations and prosecution of election fraud? The office could prosecute anyone under their jurisdiction, including under election fraud statutes. The current CCSA chooses not to. The public corruption unit could help restore some confidence into the CCSAO. If the office is willing to prosecute those officials and officers that break the law, it will be viewed as an independent organization the public can have confidence in. Currently, all eyes all over the nation Page 9 of 10

10 are on Cook County and State of Illinois elections. I would reach out to ask other law enforcement agencies to investigate whether there is election fraud in Cook County. While I would work tirelessly with them to investigate these matters, I would ask that any charges filed be subsequently prosecuted by a Special Prosecutor. As a Cook County elected official, there is an overwhelming conflict of interest in taking those cases to trial. B. Civil Duties: Essay 44. What types of cases involving law reform or civil activism (such as civil rights or environmental enforcement) would you anticipate bringing to the State's Attorney's office? Taking on issues such as predatory lending, environmental abuse, and civil rights violations. 45. What proposals do you have to increase public corruption prosecutions? First, I will review what the current CCSA has done to delegitimaze that unit. I would assign dedicated prosecutors who are genuinely interested in investigating and prosecuting local officials. I would also develop relationships with the AG s public corruption unit and the AUSA s public corruption unit. This would help reduce the resources that the office would have to use to investigate and prosecute local officials. Currently, the Office partners with the FBI and Secret Service for its Financial Crimes prosecutions. The same should be done to go after corrupt public officials because the People suffer when they commit crimes and abuse taxpayer resources. 46. What would you do to improve and manage potential conflict of interest recusal policies for yourself and your top assistants in order to avoid situations like the Jon Burge investigation? All prosecutions of police officers should be handled by a special prosecutor to be handled objectively. The Illinois Appellate Prosecutor s Office already has a unit for handling cases that the CCSAO cannot prosecute because of a conflict. 47. Comment on the propriety of prosecutorial public criticism of judges on criminal case outcomes. Prosecutors must help maintain faith in the system. As the lead prosecutor, I feel a responsibility to call out miscarriages of justice, but in the office we must be careful not to diminish the validity of results that we do not agree with.
