Ratifies existing law establishing the No Place Like Home Program. Fiscal Impact: Allows the state to use up to $140 million per year of county mental health funds to repay up to $2 billion in bonds. These bonds would fund housing for those with mental illness who are homeless. 3 AUTHORIZES BONDS TO FUND PROJECTS FOR WATER SUPPLY AND QUALITY, WATERSHED, FISH, WILDLIFE, WATER CONVEYANCE, AND GROUNDWATER SUSTAINABILITY AND STORAGE. INITIATIVE STATUTE. Authorizes $8.877 billion in state general obligation bonds for various infrastructure projects. Fiscal Impact: Increased state costs to repay bonds averaging $430 million per year over 40 years. Local government savings for water-related projects, likely averaging a couple hundred million dollars annually over the next few decades. 4 AUTHORIZES BONDS FUNDING CONSTRUCTION AT HOSPITALS PROVIDING CHILDREN S HEALTH CARE. INITIATIVE STATUTE. Authorizes $1.5 billion in bonds, to be repaid from state s General Fund, to fund grants for construction, expansion, renovation, and equipping of qualifying children s hospitals. Fiscal Impact: Increased state costs to repay bonds averaging about $80 million annually over the next 35 years. 5 CHANGES REQUIREMENTS FOR CERTAIN PROPERTY OWNERS TO TRANSFER THEIR PROPERTY TAX BASE TO REPLACEMENT PROPERTY. INITIATIVE CONSTITUTIONAL AMENDMENT AND STATUTE. Removes certain transfer requirements for homeowners over 55, severely disabled homeowners, and contaminated or disasterdestroyed property. Fiscal Impact: Schools and local governments each would lose over $100 million in annual property taxes early on, growing to about $1 billion per year. Similar increase in state costs to backfill school property tax losses. 6 ELIMINATES CERTAIN ROAD REPAIR AND TRANSPORTATION FUNDING. REQUIRES CERTAIN FUEL TAXES AND VEHICLE FEES BE APPROVED BY THE ELECTORATE. INITIATIVE CONSTITUTIONAL AMENDMENT. Repeals a 2017 transportation law s taxes and fees designated for road repairs and public transportation. Fiscal Impact: Reduced ongoing revenues of $5.1 billion from state fuel and vehicle taxes that mainly would have paid for highway and road maintenance and repairs, as well as transit programs. 7 CONFORMS CALIFORNIA DAYLIGHT SAVING TIME TO FEDERAL LAW. ALLOWS LEGISLATURE TO CHANGE DAYLIGHT SAVING TIME PERIOD. LEGISLATIVE STATUTE. Gives Legislature ability to change daylight saving time period by two-thirds vote, if changes are consistent with federal law. Fiscal Impact: This measure has no direct fiscal effect because changes to daylight saving time would depend on future actions by the Legislature and potentially the federal government. 8 REGULATES AMOUNTS OUTPATIENT KIDNEY DIALYSIS CLINICS CHARGE FOR DIALYSIS TREATMENT. INITIATIVE STATUTE. Requires rebates and penalties if charges exceed limit. Requires annual reporting to the state. Prohibits clinics from refusing to treat patients based on payment source. Fiscal Impact: Overall annual effect on state and local governments ranging from net positive impact in the low tens of millions of dollars to net negative impact in the tens of millions of dollars. Proposition 9 was removed from the ballot by the CA Supreme Court. 10 EXPANDS LOCAL GOVERNMENTS AUTHORITY TO ENACT RENT CONTROL ON RESIDENTIAL PROPERTY. INITIATIVE STATUTE. Repeals state law that currently restricts the scope of rentcontrol policies that cities and other local jurisdictions may impose on residential property. Fiscal Impact: Potential net reduction in state and local revenues of tens of millions of dollars per year in the long term. Depending on actions by local communities, revenue losses could be less or considerably more. 11 REQUIRES PRIVATE-SECTOR EMERGENCY AMBULANCE EMPLOYEES TO REMAIN ON-CALL DURING WORK BREAKS. ELIMINATES CERTAIN EMPLOYER LIABILITY. INITIATIVE STATUTE. Law entitling hourly employees to breaks without being on-call would not apply to private-sector ambulance employees. Fiscal Impact: Likely fiscal benefit to local governments (in the form of lower costs and higher revenues), potentially in the tens of millions of dollars each year. 12 ESTABLISHES NEW STANDARDS FOR CONFINEMENT OF SPECIFIED FARM ANIMALS; BANS SALE OF NCOMPLYING PRODUCTS. INITIATIVE STATUTE. Establishes minimum requirements for confining certain farm animals. Prohibits sales of meat and egg products from animals confined in noncomplying manner. Fiscal Impact: Potential decrease in state income tax revenues from farm businesses, likely not more than several million dollars annually. State costs up to $10 million annually to enforce the measure. 7 COMMERCIAL CANNABIS BUSINESS TAX MEASURE M SUMMARY OF ORDINANCE PROPOSED FOR ADOPTION BY THE LASSEN COUNTY BOARD OF SUPERVISORS ON JULY 24, 2018 An Ordinance proposing the addition of a Chapter 3.30 to Title 3 of the Lassen County Code is being proposed for adoption at the regular meeting of the Lassen County Board of Supervisors located at 707 Nevada St. in Susanville on July 24, 2018 at the hour of 9:00 a.m. or as soon thereafter as the matter is called. The new chapter 3.30, if adopted, would establish a structure for taxing commercial cannabis activities, recreational or medical, in the County of Lassen if those activities are ever authorized to occur. If the Board adopts this ordinance it must still be approved by the voters by a majority vote at the upcoming November 6, 2018 Statewide General Election. A complete copy of the proposed new chapter is available for review in the office of the Clerk of the Board of Supervisors office, in the Historic Courthouse located at 220 South Lassen St., Suite 5, Susanville, CA, COUNTY COUNSEL S IMPARTIAL ANAYLSIS Cannabis Business Tax - Measure M California state law now allows the commercial cultivation, manufacturing, testing, distribution, dispensing and sale of cannabis (marijuana) and related products for profit. The decision on whether to allow these kinds of businesses into communities has been left to local jurisdictions. In Lassen County, the decision on whether to allow these kinds of businesses to operate in the unincorporated portion of the County is up to the Lassen County Board of Supervisors. In the City of Susanville, that decision is up to the Susanville City Council. The Lassen County Board of Supervisors has concluded that operation of these kinds of businesses creates, or has the potential to create, significant impacts on code enforcement, law enforcement, planning services, public and environmental health, at least. The Board of Supervisors also believes that it has a responsibility to zealously safeguard the precious few general fund dollars it already possesses and if such commercial cannabis activities are to potentially be approved in the future, there must be a separate funding mechanism to support the additional work that comes with allowing it. Said a different way, the Board of Supervisors believes that the industry ought to be responsible for paying the increased costs associated with regulating it. Consequently, the Board of Supervisors has enacted a cannabis business tax ordinance which imposes a tax on commercial cannabis activities. In order to take effect however, it must be approved by a majority of electors of the County voting on the measure. If the tax is approved, any revenue collected will be deposited into the County general fund and may be used for any legitimate County activity. The tax is structured in two ways. First, for persons who want to cultivate cannabis, their tax is calculated based on the amount of square footage of canopy space they are using to cultivate. The tax rate per square foot of canopy space depends on the light source being used for cultivation and can range from.50 cents per square foot annually for outdoor cultivation all the way up to $3.00 per square foot annually for space that relies on indoor artificial lighting. Secondly, all other commercial cannabis activities tax rate is established as a percentage of gross receipts of the particular business. Depending on what kind of cannabis business is being taxed, the rate may go from 2.5% of gross receipts all the way up to 8% of gross receipts. A Yes vote is a vote to impose the tax. 8 ARGUMENT IN FAVOR OF MEASURE M With the passage of Proposition 64, which legalized recreational cannabis, local governments were given the responsibility to provide oversight and regulate the legalization within their communities. Whether you agree with the legalization of cannabis or not, it is imperative that we tax the industry to ensure compliance with existing laws and deal with the black market. Over 40 Cities and Counties in California have enacted similar taxes for cannabis businesses to address strains on the local resources resulting from cannabis legalization. Measure M is fiscally responsible, timely, and prudent. Legalization leads to needed enforcement, education, and other related services. Lassen County needs to tax the cannabis industry in order to effectively enforce any future ordinances and fund critical services such as the Sheriff s Department, District Attorney, public health and other important services that serve this industry. Why pay for the legal or illegal cannabis industry out of the 1% sales tax the County receives now? Measure M does not create a new sales or property tax on ordinary citizens. The tax will solely be paid by marijuana businesses and no one else. Measure M guarantees that these legal and illegal cannabis businesses will pay their fair share. It s important to vote on Measure M now - before special interests redirect local taxes to the state government in Sacramento. Taxes authorized by a vote will stay here and can t be stolen by Sacramento. Opponents may claim that the money will simply go into the general fund. What they usually leave out is that the general fund is used to pay for important services like public safety (67%), parks, and road maintenance. ARGUMENT AGAINST MEASURE M A Yes Vote on Measure M to allow taxes to be assessed on Commercial Cannabis is a vote telling your county leaders that you support the production of Commercial Cannabis in Lassen County. An already stretched budget will become tighter as our shrinking Sherriff s Department will have to deal with the offenders that are not following the new County ordinances through the abatement process. There will also be an impact on probation and the schools who will have to deal with juvenile offenders. The County will also have to hire additional non-law enforcement employees to make sure the cannabis industry is taxed properly. Currently the Federal Banking system does not allow transactions derived from Cannabis activities. The County Treasurer will effectively become a money launderer. This will also put at risk the other non-cannabis County and School funds that are held by the Treasurer should the Federal Government decide to freeze the County Treasurer s bank account, or should our current bank drop services to the County and the Schools for depositing money that the Federal Government deems to be illegal funds. Assemblyman Brian Dahle told the Board of Supervisors at the July 17, 2018 meeting to go slow, there is not a solution to the Federal Banking problem in the foreseeable future, and that cannabis is not the cash cow that people think it is. The voters of Lassen County should listen to Assemblyman Dahle who is deeply involved at the state level, understands the complexities, and whom resides in and loves Lassen County. Lassen County does not have the expertise, law enforcement staffing, or additional finances to hire new employees to enforce this tax. For these reasons Lassen County SHOULD T pass a local tax on Cannabis. Vote no on Measure M. 9 STATEMENT OF CANDIDATE FOR: US HOUSE OF REPRESENTATIVES, CONGRESSIONAL DISTRICT 1 AUDREY DENNEY Occupation: Educator/Farmer Education and Qualifications: It s time to elect a representative who will faithfully represent the needs and interests of our entire district beyond those of select corporate contributors. We deserve honest and strong leadership to reach those of us who have been neglected, forgotten and ravaged by years of ineffective representation. Our district currently has no voice in the House of Representatives. I have the background, skills, and determination to change that to listen, understand, and negotiate for our interests. I am an educator and farm-business owner from Chico. My strength is rooted in my rural upbringing, while my approach is guided by evidence, practicality, and a desire to enrich life in our communities. As your representative, I will fight to get money out of politics. I will be a champion for healthcare, education, water management, national security, and our veterans. I will advocate for investments in infrastructure and forest management to keep us safe and boost our economy. I live and work the same way the vast majority of our district does. I understand the challenges faced by ranchers, teachers, bartenders and everyday Americans because that is who I am. I m not running with the backing of a wealthy or powerful family. My father is a farmer and Vietnam veteran, and my mother is an Episcopalian priest. STATEMENT OF CANDIDATE FOR: US HOUSE OF REPRESENTATIVES, CONGRESSIONAL DISTRICT 1 DOUG LAMALFA Occupation: Family Farmer/Member, United State House of Representatives Education and Qualifications: America s middle income families, workers, and small businesses have, until recently, been struggling in a tough economy. The values I learned growing up on the family farm are needed in Washington. That s why my focus has been to cut your taxes and repeal the unreasonable regulations that hurt jobs and increase costs for families. As your United States Representative, I helped craft and pass major tax cuts for families and businesses across the country. Businesses large and small in the North State are hiring more employees, increasing wages, and investing locally due to these tax cuts. The typical North State family will save over $2000 in taxes next year and you will find filing your taxes much simpler. I helped write and pass legislation to protect North State water rights and build new water storage, including Sites Reservoir. This project means jobs and water for Northern California. I ve worked with our federal agencies to ensure the Oroville Dam spillway is repaired and upgraded to ensure public safety. We must properly manage our forests to reduce fire risk, harvest the timber that we need, and that benefits our local economy. 10 STATEMENT OF CANDIDATE FOR: STATE ASSEMBLY - DISTRICT 1 BRIAN DAHLE Occupation: Farmer/Assemblyman Age: 53 Education and Qualifications: It is an honor to represent you in the State Assembly. Since going to the Legislature I kept my promises to the people of Northern California, focusing my time and energy creating jobs while voting against regulations and taxes. I am proud of what I have been able to accomplish. Through bipartisan efforts, I worked across party lines to save our rural hospitals, skilled nursing facilities and biomass plants from closing. I was able to get needed support for community college programs that actually get young people jobs, so they do not have to leave our communities to find work. 11 STATEMENT OF CANDIDATE FOR: LASSEN COUNTY ASSESSOR NICK CEAGLIO Age: 55 Occupation: Appraiser Education and Qualifications: I am a certified State property tax appraiser working in the Lassen County Assessor s office. I am thankful for the support I received in the June election, and I will continue to reach out to the taxpayers to demonstrate that I am the most qualified candidate for the office of Assessor. One of the primary duties of the Assessor is to value all taxable real and personal property within the county. As a third generation Lassen County resident, I am familiar with our county and have a working experience appraising residential, agricultural, and commercial properties. The role of the Assessor requires a commitment of service to the taxpayers and staff to ensure successful operation of the Department. RIOS Age: 38 Occupation: Deputy County Counsel Education and Qualifications: Born and raised in Siskiyou County, I attended college at CSU, Sacramento and Lincoln Law School. I moved to Lassen County in I began working for Lassen County in early 2012 as a Deputy District Attorney, and from mid-2016 to present as a Deputy County Counsel. The role of District Attorney is much more than prosecuting criminal cases. There are administrative and fiscal components as well. Aside from prosecutorial experience, my undergraduate degree is in Human Resource Management and I worked for six-plus years directly in personnel prior to becoming an attorney. 13 ELECTIONS IN CALIFORNIA The Top Two Candidates Open Primary Act requires that all candidates for a voter-nominated office be listed on the same ballot. Previously known as partisan offices, voter-nominated offices are state legislative offices, U.S. congressional offices, and state constitutional offices. In both the open primary and general elections, you can vote for any candidate regardless of what party preference you indicated on your voter registration form. In the primary election, the two candidates receiving the most votes regardless of party preference move on to the general election. If a candidate receives a majority of the vote (at least 50 percent + 1), a general election still must be held. California's open primary system does not apply to candidates running for U.S. President, county central committee, or local offices. candidates for voter-nominated offices can still run in the primary election. However, a write-in candidate can only move on to the general election if the candidate is one of the top two vote-getters in the primary election. Additionally, there is no independent nomination process for a general election. Superintendent of Public Instruction is a nonpartisan office. If a candidate for Superintendent of Public Instruction were to receive a majority of the vote (at least 50 percent +1) at the primary election, then that candidate would be elected, and no general election would be held. Additional information on nonpartisan offices can be found below. California law requires the following information to be printed in this guide. Voter-Nominated Offices Political parties are not entitled to formally nominate candidates for voter-nominated offices at the primary election. A candidate nominated for a voter-nominated office at the primary election is the nominee of the people and not the official nominee of any party at the general election. A candidate for nomination to a voter-nominated office shall have his or her qualified party preference, or lack of qualified party preference, stated on the ballot, but the party preference designation is selected solely by the candidate and is shown for the information of the voters only. It does not mean the candidate is nominated or endorsed by the party designated, or that there is an affiliation between the party and candidate, and no candidate nominated by the voters shall be deemed to be the officially nominated candidate of any political party. In the county voter information guide, parties may list the candidates for voter-nominated offices who have received the party s official endorsement. Any voter may vote for any candidate for a voter-nominated office, if they meet the other qualifications required to vote for that office. The top two vote-getters at the primary election move on to the general election for the voter-nominated office even if both candidates have specified the same party preference designation. No party is entitled to have a candidate with its party preference designation move on to the general election, unless the candidate is one of the two highest vote-getters at the primary election. Nonpartisan Offices Political parties are not entitled to nominate candidates for nonpartisan offices at the primary election, and a candidate at the primary election is not the official nominee of any party for the specific office at the general election. A candidate for nomination to a nonpartisan office may not designate his or her party preference, or lack of party preference, on the ballot. The top two vote-getters at the primary election move on to the general election for the nonpartisan office.
