2 CITY OF LAKE MARY HOME OCCUPATION (EXCERPT FROM CODE OF ORDINANCES) DEFINITION. For the purpose of this subchapter the following definition shall apply unless the context clearly indicates or requires a different meaning. HOME OCCUPATION. A home occupation is an activity for gain carried on in the main structure (residence) or in accessory or other permitted outbuildings (detached garages); requiring only customary home equipment; involving the employment of no nonresident help; and not involving the trading of merchandise or the rendition of personal physical service on the premises of the residence CONDITIONS, LIMITATIONS, AND RESTRICTIONS. The conduct of a permitted home occupation shall be subject to the following conditions, limitations, and restrictions. (A) No nonresidents shall be employed in such activity, whether for compensation or otherwise. (B) The use of a dwelling unit or permitted accessory buildings for a home occupation shall be clearly incidental and subordinate to the use of the premises as a residence, and shall under no circumstances change the residential character thereof. (C) There shall be no change in the outside appearance of any building on the premises, or other visible evidence of the conduct of a permitted home occupation, except, however, that the home occupation may be identified by one sign, not exceeding one square foot in area. Any such sign may not be illuminated. (D) A permitted home occupation shall not occupy more than 25% of the building floor area, excluding carports, garages, porte-cocheres, breezeways and screened or open porches. (E) Any parking required for the conduct of any permitted home occupation shall be off the street and other than in a required front yard. (F) No equipment or process shall be used in such home occupation which creates noise, vibration, glare, fumes, odors, or electrical interference. (G) No home occupation shall be conducted in an accessory building which does not meet the setback requirements of the principal building. (H) The following shall not be considered home occupations: (1) Adult entertainment (2) Antique shops (3) Art studio for group instruction (4) Mechanical service and repair (5) Barber and cosmetology services (6) Band instruction for groups
3 (7) Bed and breakfast facilities (8) Child care centers (9) Churches (10) Private clubs (11) Drive-in facilities (12) Eating and drinking establishments (13) Food processing (14) Fortune tellers (15) Funeral homes (16) Group instruction for more than two people (17) Health spas (18) Hospitals and clinics (19) Hotels/motels (20) Kennels (21) Massage establishments (22) Photographic studios (23) Plasmapheresis facilities (24) Vehicle sales or rental (25) Whole blood facilities (26) Secondary home offices: no retail or wholesale sales of goods involving home storage or delivery of merchandise shall be made on the premises (27) Tattoo parlors (28) Health care providers (29) Any other use or activity similar in nature or purpose to those listed hereon and any other use or activity inconsistent with the purpose of this subchapter as expressed in the definition of HOME OCCUPATION in OCCUPATIONAL LICENSE REQUIRED. All home occupations shall be required to obtain an occupational license prior to the start of such use. In addition to any other submittals required for an occupational lease, the applicant shall submit the following. (A) Location of dwelling where the home occupation will be conducted; (B) Total floor area of the dwelling unit; (C) Area of room or rooms to be utilized in conduct of the home occupation;
4 (D) A sketch of the floor plan showing the dimensions of the area to be utilized for the conduct of the home occupation; (E) The exact nature of the home occupation; and (F) Notarized letter of approval from the property owner or property manager NOTICE TO ABUTTING PROPERTY OWNERS. (A) Within 15 days after the initial issuance of the occupational license for the home occupation, the Planning Department shall mail, to each owner within 300 feet of the premises for which a home occupation license is issued, a notice in substantially the following form: Dear : On 19, zoning approval was given in accordance with the City of Lake Mary's Land Development Code, to to conduct a home occupation of in a dwelling unit located at. The restrictions provided by the City Code for home occupations are too numerous to list here. In general, however, it may be said that the code prohibits any activity in conjunction with a home occupation which in any way changes or adversely affects the peace and quiet of the residential character of the neighborhood in which it is conducted. If you see or hear any evidence of any commercial activity related to this home occupation, please call the Planning Department at If the home occupation is not conducted in accordance with the requirements of the City Code, appropriate action will be taken. Repeated failure of the licensee to comply with regulations will result in revocation of the permit. Unless revoked or abandoned, the occupational license issued to will be good until September 30. Sincerely, Zoning & Planning Official (B) In addition, a notice as prescribed by the Planning Department shall be posted in the front yard of the licensed premises on or before 15 days from the date of issuance of the home occupation license and shall remain posted for a period of 15 days, for the purpose of giving public notice of the issuance of a home occupation license. The notice to be posted shall be in the form of posted notices used for notice of rezoning applications and the like EXPIRATION; NONTRANSFERABILITY. (A) Expiration of occupational license. Each occupational license issued for a home occupation shall expire on September 30 of each year. Each license must be renewed by October 1 of each year by application to the City Clerk. (B) Nontransferability. The authority to conduct a home occupation shall be personal to the license holder and shall not be transferred to any other person through the sale, lease, rental, or other conveyance of the property for which the home occupation is licensed. A licensed home occupation can only be conducted at the premises for which the license is issued APPEALS FROM PLANNING DEPARTMENT DECISIONS.
5 (A) Any person jointly or severally aggrieved by the issuance of any home occupation license may, within 15 days after the posting of any notice of a license, appeal the issuance to the City Commission. Any person aggrieved by any other decision concerning the revocation or nonissuance of a license may, within 15 days after the issuance of the decision, appeal the decision to the City Commission. (B) An appeal to the City Commission shall stop all activity in furtherance of the decision appealed. The City Clerk shall give public notice thereof, in the same manner as appeals from decisions of the Planning and Zoning Board. The City Commission shall decide the same within a reasonable time. Any person may seek revocation of approval for a home occupation permit in accordance with Code Enforcement Board procedures as set out in through In the event that the occupational license holder is found in violation of this subchapter, the license may be revoked by the City Clerk and shall not be reissued.
