AND UPON the Respondent admitting to breaching clause 1(b) of the injunction order of Deputy District Judge Lawrence dated 18 April 2017 by i) on 14 June 2017 at approximately 23:00 threatening violence by shouting come on you cunts to police officers and adopting an aggressive stance, and ii) on 14 June 2017 at approximately 23:00 threatening violence against the children of PC Mark Bannon; AND UPON the Applicant not pursuing the allegation that on 14 June 2017 the Respondent threatened violence by threatening to shoot police officers and saying If I knew you personally I d get a gun and come and whack you in the head you cunt ; AND UPON the Court hearing mitigation from Mr. Ralph Hood. IS ORDERED THAT: 1. Mr Garret Murphy is sentenced to a 28day custodial sentence, suspended for 18 months until 29 December 2018 in respect of the first admitted breach. 2. Mr Garret Murphy is sentenced to a 28day custodial sentence, suspended for 18 months until 29 December 2018 in respect of the second admitted breach, such sentence to run concurrently with the sentence in paragraph 1 of this order. The injunction order of Deputy District Judge Lawrence dated 18 April 2017 and power of arrest attached thereto are extended to 4pm on 29 December The period specified in paragraph 5 of the injunction order of Deputy District Judge Lawrence dated 18 April 2017 is extended to 31 December No order as to costs. 6. Her Honour Judge Baucher addressed Mr. Murphy directly and ensured that he was fully aware that the injunction had been extended, including the requirement that he must attend onetoone sessions with Mr. Ralph Hood, and ensured that Mr. Murphy appreciated that he had to comply with the terms of the injunction and was aware of the consequences if he did not comply. 7. The committal order was served personally upon Mr. Murphy in court by hand. 8. Any further breach of the injunction order of Deputy District Judge Lawrence dated 18 April 2017 to be reserved to Her Honour Judge Baucher if available. Dated 29 June 2017
