Approve the changes to the Water Shortage Response Plan Amendment Bylaw No. 4378, 2013, as outlined in the report of the General Manager of Engineering and Public Works entitled "Fourth and Final Reading of Water Shortage Response Plan Amendment Bylaw No. 4378, 2013" including updates to the definition of "water" and to Schedules 4, 5 and Give fourth and final reading to the Water Shortage Response Plan Amendment Bylaw No. 4378,2013 as amended. 3. Direct staff to forward the report of the General Manager of Engineering and Public Works entitled "Fourth and Final Reading of Water Shortage Response Plan Amendment Bylaw No. 4378, 2013" and the Water Shortage Response Plan Amendment Bylaw No. 4378, 2013 to Metro Vancouver. Report Purpose: The purpose of this report is to present the Water Shortage Response Plan Amendment Bylaw No. 4378, 2013, for fourth and final reading, as amended. Strategic Goal: This report supports the corporate strategic goals of enhancing sustainability of City services and infrastructure, and achieving excellence in City governance.

2 Page 2 June 3, 2013 Executive Summary: At the May 13, 2013, Regular Council Meeting, Council considered a staff report related to water conservation program updates and gave the first three readings to the Water Shortage Response Plan Amendment Bylaw No. 4378, 2013 (Attachment l). Council also requested clarification related to the different stages of watering restrictions in the Bylaw as well as current statistics on water usage within Coquitlam. This report provides these details and recommends that Council give fourth and final reading, as amended, to Bylaw No. 4378, Background: The above-noted bylaw was given first, second and third readings at the May 13, 2013 Regular Council Meeting. Bylaw No. 4378, 2013 amends the Water Shortage Response Plan Bylaw No. 3701, 2005 (Attachment 2) by simplifying the enforcement procedures in the bylaw to ensure consistency with the City's regulatory bylaws. At this same Council Meeting, Council also requested clarification of Schedules 4 and 5 of Bylaw No. 3701, 2005 as related to Stage 3 and 4 water restrictions. Council also inquired whether non-potable water would be permitted to be used during Stage 3 and 4 restrictions and if there was a provision in the Bylaw to allow residents to water their lawns and gardens with water collected by rain barrels or other methods during these restrictions. In addition, Council requested current statistics related to per capita water usage. Discussion/Analysis: The City of Coquitlam works cooperatively with Metro Vancouver on water conservation initiatives and has a comprehensive water conservation outreach and enforcement program. The success of these regional and local programs has contributed to declining water consumption (along with changes to the Provincial plumbing code), which is monitored and documented annually by Metro Vancouver. Coquitlam's total (residential and industrial/commercial/institutional (ICI)) per capita consumption has been declining since its peak in the mid 1980s of 673 liters per capita per day (LPCD) to 377 LPCD in 2011, which is about 80% of the regional average of 471 liters LPCD. The 2012 data for daily consumption has been provided in draft form by Metro Vancouver and is estimated to be about 370 LPCD in Coquitlam.

3 Page 3 June 3, 2013 Successful initiatives that have contributed to declining water consumption include the regional Water Shortage Response Plan (WSRP) and Coquitlam's Water Shortage Response Plan Bylaw No. 3701, 2005, which was developed in accordance with the WSRP. The goals of these initiatives include reducing peak demands on drinking water during the summer months, conserving water in preparation for unforeseen emergency situations, reducing water system operating costs and deferring costs of new water supply infrastructure. The WSRP uses a staged approach, ranging from an initial standard level of water restrictions (Stage l) that is automatically implemented each summer season (June l - Sept. 30^^) through to the highest level of restrictions (Stage 4) intended for emergencies affecting the delivery of water. The Greater Vancouver Water District (GVWD) Commissioner is responsible for activating different stages of the WSRP and notifies member municipalities of the need for implementing or discontinuing each of the successive phases of the plan. Since the WSRP was originally adopted in 1993, it has been rare to activate water use restrictions beyond Stage 1. Stage 2 and 3 restrictions have only been implemented regionwide on one occasion in response to a 2003 drought and the region has never initiated the emergency level (Stage 4) of the restrictions. Overthe 20 summers from 1993 to 2012, Coquitlam has been at: Stage 1 for 2383 days (approx 97.7% of the time); Stage 2 for 17 days in 2003 (approxo.7% of thetime); and, Stage 3 for 40 days (approx. 1.6% of the time). In response to Council's comments at the May 13^'' Regular Council Meeting, the details in Schedule 4 and 5 of the Water Shortage Response Plan Bylaw No. 3701, 2005 have been amended to provide clarity and consistency of the Stage 3 and 4 water restrictions (see Attachment 1). The changes help clarify that the restrictions apply to watering with treated drinking water only and that washing of boats and motor vehicles is restricted to those features required for the purpose of safely operating the vehicle (e.g. lights, license plates and windows). In addition, the definition of "water" has also been amended in Section 3.I to clarify that for the purpose of Bylaw No. 3701, 2005, water refers to treated drinking water and excludes rain water, gray water and recycled water. This definition is consistent with the regional WSRP and clarifies at Council's request that the public is able to use collected water, such as from File#: /000/ Doc#: V4

4 Page 4 June 3, 2013 a rain barrel, even in the case of escalating restrictions. Finally, Section 7 has been amended and the reference to the $ fee for an Additional Water Use Charge has been removed in correlation to the deletion of Schedule 10 as outlined in the amended Bylaw No. 4378, Financial Implications: The Water Conservation Program is an annual program funded through the Water Utility. There are no additional financial implications associated with this report. Conclusion: Following Council's initial endorsement of the Water Shortage Response Plan Amendment Bylaw No. 4378, 2013 at the May 13, 2013 Regular Council Meeting, there were several details that required further clarification from staff. Those details are discussed in this report and further changes have been made to Bylaw No. 4378, 2013 to help clarify the points raised by Council. 5 Attachment 1 Page 1 BYLAW NO. 4378, 2013 A Bylaw to Amend the Water Shortage Response Plan Bylaw No. 3701, 2005 WHEREAS: A. Council forthe City of Coquitlam has adopted the Water Shortage Response Plan Bylaw No. 3701, 2005 (the "Water Shortage Response Plan Bylaw"); and B. Council forthe City of Coquitlam wishes to amend the Water Shortage Response Plan Bylaw to remove certain prerequisites for enforcing that Bylaw, NOW THEREFORE, the Council of the City of Coquitlam, in open meeting lawfully assembled, ENACTS AS FOLLOWS: 1. Name of Bylaw This Bylaw may be cited for all purposes as the "Water Shortage Response Plan Amendment Bylaw No. 4378, 2013." 2. Amendments 2.1 The Water Shortage Response Plan Bylaw is amended as follows: by deleting the definition of "water" in section 3.1 (o) and replacing it with the following: (o) "Water" used as a noun means treated drinking water supplied directly or indirectly by Greater Vancouver Water District or the City, but does not include rain water, gray water, any forms of recycled water, or other sources of water outside the GVWD/City water supply system by deleting section 7.2 and replacing it with the following: The following individuals have authority to enforce the provisions of this Bylaw: a) Bylaw Inspectors; b) any member of the Engineering & Public Works Department of the City designated by the General Manager of Engineering & Public Works, as Water Conservation Officers forthe purpose of enforcing the provisions of this Bylaw; c) special constables, officers or members of the Royal Canadian Mounted Police hereafter referred to as Water Conservation Officers.

6 2.1.3 by deleting sections 7.3 to 7.6 inclusive of the Water Shortage Response Plan Bylaw; by renumbering section 7.7 and 7.8 as sections 7.3 and 7.4 respectively; and Page by deleting Schedule 4 and replacing it with the schedule titled "Schedule 4", and attached to this Bylaw by deleting Schedule 5 and replacing it with the schedule titled "Schedule 5", and attached to this Bylaw By deleting the following from Schedule 7: 2. 7 Page 3 (Amendments to) SCHEDULE 4 INFORMATION FOR PUBUC ANNOUNCEMENT OF STAGE 3 RESTRICTIONS A Public Announcement of Stage 3 Restrictions is sufficient for the purposes of section 4.5 of this Bylaw if it includes substantially the following information: That lawn sprinkling using treated drinking water is not allowed by homes or businesses That residential and most commercial gardens, shrubs, trees and flower beds may only be watered by hand, by containers or drip irrigation That private (residential) pressure washing is prohibited, and that commercial hosing or pressure washing is only allowed for health, safety or preparing a surface for painting That decorative fountains must be shut down That refilling of private, commercial and public swimming pools is prohibited That no person shall use a hose providing water to outdoor wash boats or motor vehicles, unless the hose is equipped with an Automatic Shut-off Device, and the purpose of washing is to maintain visibility of lights or licence plates, or through windows, or is otherwise for the safe operation of the boat or motor vehicle. Car washing at indoor commercial carwashes has no restrictions.

9 Attachment 2 Page 1 BYLAW NO. 3701, 2005 Consolidated with amendments in Bylaw No. 4221, 2012 NOTE: This is a consolidation for convenience purposes only and does not have the force of law. WHEREAS: A Bylaw to Provide for a Water Shortage Response Plan A. Pursuant to section 8(2) of the Community Charter, S.B.C., 2003, c 26, as a mended. Council for the City of Coquitlam may, by bylaw, establish and regulate a service to all or part of the City; B. fhe City, under Water Distribution System Bylaw NO. 2973,1995, has established and maintains a water distribution system and, in recognition of the need to provide an effective method of water conservation within the City, has agreed to cooperate with the Greater Vancouver Water District to regulate the use of water supplied by the water distribution system for purposes of landscape irrigation and other outdoor uses; NOW THEREFORE, the Council of the City of Coquitlam, in open meeting lawfully assembled, ENACTS AS FOLLOWS: 3. Name of Bylaw This Bylaw may be cited for all purposes as the "Water Shortage Response Plan Bylaw No. 3701, 2005". 4. Repeal of Existing Bylaws Bylaw No. 3522, 2002 and all amendments thereto are hereby repealed in their entirety. 5. Definitions and Interpretation 3.1 In this Bylaw: a) "Automatic Shut-off Device" means a device attached to a water hose that is spring loaded and shuts off the supply of water automatically unless hand pressure is applied to allow the supply of water. b) "City" means the City of Coquitlam. c) "Commissioner" means the Commissioner of the Greater Vancouver Water District.

10 Page 2 d) "Drip Irrigation" means a system using irrigation components which consume less than 20 gallons (91 litres) per hour and operate at less than 25 PSI (172 kpa) to deliver Water to the root zone of the plant material being irrigated. e) "Engineer" means the City's General Manager of Engineering and Public Works (City Engineer) or authorized City representatives. f) "Lawns" includes grass growing at cemeteries. g) "Permit" means a permit issued under Part 6. h) "Person" does not include a municipality, a regional district, the provincial government, or any body appointed or created under an enactment of Canada or British Columbia. i) "Public Announcement" means one or more advertisements or public service announcements in any one of: (i) (ii) a television or radio broadcast from a station that broadcasts to the City; a newspaper or other publication intended for general circulation, including one that is distributed without charge to the reader, that contains news and advertising, and is distributed within the City at least once per week. j) "Restriction Stage" means Stage l Restrictions, Stage 2 Restrictions, Stage 3 Restrictions, or Stage 4 Restrictions. k) "Stage 1 Restrictions" means the restrictions on Water use described in sections 1.1 and 1.2 of Schedule 1. I) "Stage 2 Restrictions" means the restrictions on Water use described in sections 2.1 and 2.2 of Schedule 1. m) "Stage 3 Restrictions" means the restrictions on Water use described in sections 3.1 and 3.2 of Schedule 1. n) "Stage 4 Restrictions" means the restrictions on Water use described in sections 4.1 and 4.2 of Schedule 1. n.l) "Non-Residential Use" means all land use other than Residential use as defined in City of Coquitlam Zoning Bylaw No. 3000,1996, as amended or any subsequent Zoning Bylaw adopted by the Council for the City of Coquitlam. o) "Water" used as a noun means water supplied directly or indirectly by Greater Vancouver Water District orthe City, whether or not mixed with rain water, gray water or recycled water.

11 p) "Water" used as a verb, and "Watering", mean the application or distribution of Water (used as a noun) to lands or plants but does not include Drip Irrigation; Page 3 q) "Water Conservation Officers" means any person authorized to enforce this Bylaw pursuant to the provisions of Section 7 of this Bylaw. r) "Water Play Park" means a recreational facility that is primarily out of doors, that includes water slides longer than 10 meters; s) "Water Restriction Announcement" means a Stage 1 Announcement, Stage 2 Announcement, a Stage 3 Announcement or a Stage 4 Announcement. t) "Water Use Plan" means a Water Use Plan approved by the City Engineer for a golf course operation under Part 5. a. The schedules to this bylaw are integral parts of this bylaw. 3.3 The City Engineer may delegate some or all of his or her powers and duties under this Bylaw. 6. Declaration and Announcement of Restriction Stages 4.1 The Commissioner may, by letterto the City, declare thatthe Greater Vancouver Water District has activated a Restriction Stage. 4.2 If the Commissioner makes a declaration under section 4.1, the Restriction Stage described in the declaration comes into force in City of Coquitlam seventy-two hours after the Commissioner orthe City makes a Public Announcement of the declaration. 4.3 When a Restriction Stage comes into force under this part,.a Restriction Stage that had been in force, if any, ceases to be in force. 4.4 If no Restriction Stage is in force on June 1^^ of any year. Stage 1 Restrictions come into force on that date without prior declaration of the Commissioner or announcement under section a) If the Commissioner declares that the Greater Vancouver Water District has activated Stage 1 Restrictions, a Public Announcement by City or the Commissioner is sufficient for the purposes of paragraph 4.2 if it contains substantially the information set out in Schedule "2". b) If the Commissioner declares that the Greater Vancouver Water District has activated Stage 2 Restrictions, a Public Announcement by City or the Commissioner is sufficient forthe purposes of paragraph 4.2 if it contains substantially the information set out in Schedule "3". 12 Page 4 c) If the Commissioner of the Greater Vancouver Water District has activated Stage 3 Restrictions, a Public Announcement City or the Commissioner is sufficient for the purposes of paragraph 4.2 if it contains substantially the information set out in Schedule "4". d) If the Commissioner of the Greater Vancouver Water District has activated Stage 4 Restrictions, a Public Announcement City or the Commissioner is sufficient for the purposes of paragraph 4.2 if it contains substantially the information set out in Schedule "5". 4.6 No Restriction Stage remains in force after September 30*^ of any year, unless the Commissioner makes a declaration under this section. 4.7 At any time before or after September 30*^ of any year the Commissioner may, by letter to the City declare that notwithstanding section 4.6, a Restriction Stage will remain in force or come into force after September 30*^. 4.8 Sections4.2,4.3 and section 4 5 apply to a declaration made under this section, with such changes as are necessary, except that a Public Announcement of a declaration under this section shall state that the Restriction Stage that is continued in force or that comes into force after September 30*^ will remain in force until further declaration of the Commissioner. 4.9 The Commissioner may make one or more declarations under this section. 5. GOLF COURSE WATER USE PLANS 5.1 a) Agolf course operator may apply in writing to the City Engineer for approval of a Water Use Plan stipulating: a. The volume of Water historically consumed by the golf course operation from the first day of June to the last day of September of each year; b. The volume of Water to be consumed by the golf course operation from June 1st to September 30th of each year under the proposed Water Use Plan; c. the measures to be followed by the golf course operation to conserve Water and to reduce the use of Water; d. the schedule for Watering specified areas within the golf course operation for each of Restrictions Stages 1-3; e. thatthe golf course will report its actual water use to the City Engineer not less than once per month when Stage l Restrictions or Stage 2 Restrictions are in force, and not less than once every two weeks when Stage 3 Restrictions are in force; f. such other information or commitments, conditions or restrictions as the City Engineer may require.

13 5.2 The City Engineer may approve a proposed Water Use Plan in whole or in part, and may amend the proposed Water Use Plan, or add such other or further commitments, conditions and restrictions as the City Engineer considers advisable. 5.3 Ifthegolf course operator consents to adopt a Water Use Plan approved by the City Engineer it shall signify such consent in writing, specifying the date on which the golf course operator will adopt the Water Use Plan, in which case the Water Use Plan shall come into force for that golf course on the later of the date specified in the notice of consent, orthe date on which the City Engineer receives the written notice of consent. Pages 5.4 If the golf course operator does not consent to adopt the Water Use Plan approved by the City Engineer, the Water Use Plan shall be of no force or effect. 5.5 If a Water Use Plan is in force for a golf course operation, the golf course operator shall comply with all conditions and restrictions set out in the Water Use Plan. 5.6 The City Engineer may terminate or suspend a Water Use Plan by notifying the golf course operator in writing at least seven days before the termination date. 5.7 A golf course operator may terminate a Water Use Plan by notifying the City Engineer in writing, in which case the Water Use Plan is terminated on the later of the date specified in the notice, or the date on which the City Engineer receives the notice. 6. Permits 6.1 A Person who has installed a new Lawn, either by placing sod or turf or by seeding, or who has installed new landscaping on a substantial part of the outdoor portion of a premises may apply to the City Engineer for a Permit authorizing the Person to Water the new Lawn and new landscaping when Stage l Restrictions or Stage 2 Restrictions are in force, at times specified in the Permit, at the premises described in the Permit, during the currency of the Permit. A Permit does not exempt the holder from Stage 3 Restrictions or Stage 4 Restrictions. 6.2 The City Engineer, upon being satisfied that an applicant qualifies undersection 6.1, shall issue a Permit in the form set out in Schedule "6" to the applicant upon payment of a fee prescribed in Schedule "7". 6.3 A Permit issued under section 6.2 shall be displayed facing the street serving the premises, beside the principal driveway from the street to the premises. 6.4 A Permit issued under section 6.2 shall expire and be of no force or effect 21 days after the date of its issue, unless the Person has been issued an extension under section Before or after the expiration of a Permit issued under section 6.2 a Person may apply for one extension of the Permit on the same terms and conditions as may be imposed under section 6.2. Such an extension shall end on or before 42 days from the date of the issue of the initial Permit under section 6.2.

Offences and Penalties 7.1 Any person who: a) violates any provision of this Bylaw or neglects or fails to do anything required to be done by this Bylaw; or b) causes or permits any other person to violate any provision of this bylaw or to neglect or fail to do anything to be done by this Bylaw with respect to real property of which he or she is the registered owner, occupant, lessee or licencee; commits an offence under this Bylaw and is subjecttothe imposition of any and all penalties or remedies available to the City pursuant to this Bylaw or to other applicable bylaws or legislation. Any adult person who acknowledges that he or she is the registered owner, occupant, tenant, or licencee of or who is apparently the registered owner, occupant tenant or licencee, and is in occupation at the time of the offence of the real property in respect of which the violation, neglect or failure has occurred is deemed to be a person who falls within the definitions provided in paragraphs (a) and (b) of this section. 7.2 The following individuals have authority to enforcethe provisions of this Bylaw and, in particular, but without limiting their authority, to issue Water Conservation Offence Notices as provided for in sections in respect of real property in respect of which an offence under this has occurred: a) Bylaw Inspectors; b) any member of the Engineering & Public Works Department of the City designated by the General Manager of Engineering & Public Works, as Water Conservation Officers for the purpose of enforcing the provisions of this Bylaw; c) special constables, officers or members bf the Royal Canadian Mounted Police hereafter referred to as Water Conservation Officers. 7.3 Where any Water Conservation Officer identifies a violation of this Bylaw, the officer may issue to any person identified in section 7.1, a Water Conservation Offence Warning substantially in the form attached as Schedule "8" to this Bylaw. 7.4 Where a Water Conservation Officer identifies a second violation within one calendar year for any particular real property the officer may issue to any person identified in section 7.1, a Water Conservation Offence Notice substantially in the form attached as Schedule "9" to this Bylaw. 7.5 Where any Water Conservation Officer identifies a third violation for any particular real property in a given calendar year the officer may issue to any person identified in section 7.1, a notice of additional water use charge substantially in the form attached as Schedule "10" to this Bylaw. 15 Page7 7.6 The Water Conservation Officer may effectively serve a Notice issued pursuant to Sections 7.3, 7.4 or 7-5 either by leaving the same with any adult person found on the real property to which the Notice relates or by leaving a copy of the Notice on the front or principal entry door of any premises located on the real property where the violation has occurred. A copy of any Notice issued pursuant to section 7.5 will also be filed by the Water Conservation Officer with the City Treasurer and will result in an additional water use charge in the amount shown in Schedule "7" to this Bylaw being levied in respect of the real property to which the Notice relates. Such additional water use charges will be included with the water rates assessed against the real property at the time of issuance by the City of the next annual water rates notice. 7.7 Any person who commits an offence under this Bylaw, in addition to being subject to any remedies or penalties specifically provided for in this Bylaw, is also subject to prosecution and, upon conviction for such offence in a court of competent jurisdiction, is subjecttothe maximum fines provided for in the Offence Act, R.S.B.C., 1996, c 338, as amended, for each and every offence. 7.8 Notwithstanding the provisions of this Bylaw, the City may elect to pursue any and all other rights and remedies that it may have pursuant to the Local Government Act with respect to securing compliance with this Bylaw, including, without limitation, the right to commence an action under section 260 of the Community Charter, S.B.C. 2003, c. 26 against any person who commits an offence under this Bylaw. 8. Fire Chief Authority ' 8.1 In any area within the City where the fire hazard rating has been set at "extreme" for a minimum of three consecutive days, the Fire Chief for the City may issue a notice to the public identifying some or all of those areas within the City as areas where the lawn sprinkling and garden watering regulations otherwise imposed under this Bylaw will be suspended for the period specified in the notice thereby allowing property owners and occupants to take measures to reduce the fire hazard to their property by watering their lawns and gardens. Notice under this section may be given by means of one or more of the following methods: a) Notice published in one or more local newspapers; b) An announcement on radio ortelevision; c) Notice on the City's webpage and posted at City Hall and other municipal locations; d) Notice delivered to properties within the area or areas affected. 16 Page 8 9. Date of Coming Into Force This Bylaw comes into force and takes effect On the date of its passing. 17 Page 9 SCHEDULES TO BYLAW NO. 3701, 2005 SCHEDULE 1 RESTRICTION STAGES Part 1: Stage 1 Restrictions 1.1 Subject to section 1.2 of this Schedule, when Stage l Restrictions are in force, no Person shall: a) Water Lawns, except: (i) for properties zoned for residential use: (A) at premises with a civic address ending in an even digit on Mondays, Wednesdays and Saturdays between the hours of 4:00 a.m. and 9:00 a.m.; (B) at premises with a civic address ending in an odd digit on Tuesdays, Thursdays and Sundays between the hours of 4:00 a.m. and 9:00 a.m.; (ii) for properties zoned for Non-Residential Use or for combined Non- Residential and residential use: (A) at premises with a civic address ending in an even digit on Mondays and Wednesdays between the hours of 1:00 a.m. and 6:00 a.m. (B) at premises with a civic address ending in an odd digit on Tuesdays and Thursdays between the hours of 1:00 a.m. and 6:00 a.m. (C) all premises on Friday between the hours of 4:00 a.m. and 9:00 a.m. b) use a hose providing Water to wash boats or motor vehicles, unless the hose is equipped with an Automatic Shut-off Device. 1.2 Section 1.1 of this Schedule does not apply to: a) a Person who Waters a Lawn or landscaping at premises described in a valid and subsisting Permit, provided the Person is and has been at all times in compliance with the Permit; b) Watering:

Part 2: Stage 2 Restrictions 2.1 Subject to section 2.2 of this Schedule, when Stage 2 Restrictions are in force, No Person shall: a) Welter Lawns, except: (i) for properties zoned for residential use: (A) at premises with even numbered civic addresses, on Mondays between the hours of 4:00 a.m. and 9:00 a.m.; and (B) at premises with odd numbered civic addresses, on Thursdays between the hours of 4:00 a.m. and 9:00 a.m. (ii) for properties zoned for Non-Residential Use: (A) at premises with even numbered civic addresses, on Wednesdays between the hours of 1:00 a.m. and 6:00 a.m.; and (B) at premises with odd numbered civic addresses, on Tuesdays between the hours of 1:00 a.m. and 6:00 a.m. b) use a hose providing Water to wash boats or motor vehicles, unless the hose is equipped with an Automatic Shut-off Device; c) use a hose providing Water to wash sidewalks, driveways> walls, roofs or other outdoor surfaces, unless the hose is equipped with an Automatic Shut-off Device, and the purpose of washing the surface is: File #: /000/ Doc #: V4

19 Page 11 (i) to prepare a surface for painting, sealing, or similar treatment; or (ii) for the health or safety of any Person, or to prevent or control fires; or d) operate ornamental fountains. 2.2 Section 2.1 of this Schedule does not apply to: a) a Person who Waters Lawns or landscaping at premises described in a valid and subsisting Permit, provided the Person is and has been at all times in compliance with the Permit. b) Watering: (i) public sports playing fields; (ii) schoolyards; (iii) the tee-off areas and putting greens of golf courses; (iv) turf at turf farms; (v) flowers or vegetables at commercial vegetable or flower gardens; (vi) artificial turf or outdoor race tracks where watering is required for dust control or safety; (vii) flower gardens, vegetable gardens, decorative planters, shrubs or trees. c) commercial car washes. Part 3: Stage 3 Restrictions 3.1 Subject to Section 3.2 of this Schedule when Stage 3 Restrictions are in force^ no Person shal a) Water: (i) Lawns; or (ii) flower gardens, vegetable gardens, decorative planters, shrubs ortrees, unless such Watering is carried by hand with hoses equipped with Automatic Shut-off Devices, and is not carried out using sprinklers or soaker hoses. b) use a hose providing Water to wash boats or motor vehicles, unless the hose is equipped with an Automatic Shut-off Device, andthe purpose of washing is to

20 Page 12 maintain visibility of lights or licence plates, or through windows, or is otherwise for the safe operation of the boat or motor vehicle; c) use a hose providing Water to wash sidewalks, driveways, walls, roofs or other outdoor surfaces, unless the hose is equipped with an Automatic Shut-off Device, and the purpose of washing the surface is: (i) to prepare a surface for painting, sealing, or similar treatment; or (ii) for the health or safety of any Person, or to prevent or control fires; d) operate ornamental fountains; e) use Water to fill or re-fill garden ponds, ornamentai fountains, hot-tubs, or swimming pools; or f) use a hose providing Water unless the hose is equipped with an Automatic Shut-off Device. 3.2 Section 3.1 of this Schedule does not apply to: a) Watering: (i) turf on turf farms; (ii) public sports playing fields; (iii) school yards; (iv) the tee-off areas and putting greens of golf courses, provided that water is used only to the extent necessary to maintain the viability of the grass in those areas; (v) flowers or vegetables at commercial vegetable or flower gardens; or (vi) artificial turf or outdoor race tracks if such Watering is required for dust control or safety; or. b) commercial car washes. Part 4: Stage 4 Restrictions 4.1 Subject to section 4.2 of this Schedule, when Stage 4 Restrictions are in force, no Person shal a) Water, or engage in drip irrigation using Water for:

21 Page 13 (i) Lawns or landscaping, whether newly planted or otherwise; (ii) flower or vegetable gardens; (iii) decorative planters; (iv) shrubs ortrees; (v) artificial turf; (vi) outdoor tracks. b) use a hose providing Water to wash boats or motor vehicles, unless the hose is equipped with an Automatic Shut-off Device, and the purpose of washing is to maintain visibility of lights or licence plates, or the ability to see through windows, or is otherwise forthe safe operation of the boat or motor vehicle; c) operate a lawn sprinkler using Water for play; d) use a hose providing Water to wash sidewalks, driveways, walls, roofs or other outdoor surfaces, unless the hose is equipped with an Automatic Shut-off Device, and the washing has been ordered by a regulatory authority; e) operate ornamental fountains; f) operate a Water Play Park or water slide; g) use Water to fill or re-fill garden ponds, ornamental fountains, hot-tubs, or swimming pools; h) use Water from a hose providing Water unless the hose is equipped with an Automatic Shut-off Device; or i) operate a car wash. 4.2 For greater certainty, section 4.1 of this Schedule applies to all areas of: a) golf courses; b) turffarms; c) sports playing fields; and d) school yards.
