FOR THE COUNTY OF WHATCOM No NOOKSACK POLICE CHIEF RORY GILLILAND'S MOTION TO VACATE ORDER DOMESTICATING FOREIGN AND ENFORCEMENT EFFORTS I. INTRODUCTION AND REQUEST FOR RELIEF Rory Gilliland submits this Motion to Vacate the Court's Order domesticating the September, Order and Judgment of the Nooksack Tribal Court of Appeals, and to quash all ongoing and contemplated execution and enforcement efforts by petitioners, on the ground that the underlying judgment was void ab initio^ has been vacated by the Nooksack Supreme Court, and been found unenforceable by the Nooksack Tribal Court in a separate proceeding. II. FACTS Rory Lee Gilliland is the Chief of the Nooksack Tribal Police. The Nooksack Indian Tribe (the "Tribe") is a federally recognized Indian tribe and a signatory to the Point Elliott treaty of, with all rights and privileges inherent in its sovereign status. The Nooksack Tribal Court, the Nooksack Tribal Court of Appeals, and the Nooksack Supreme Court are divisions of the Tribal government, created by the Tribal Council pursuant to the Constitution PAGE 1 OF P.O. 2 and By-Laws of the Nooksack Indian Tribe. On September,, the Northwest Intertribal Court System, a Washington non profit corporation, acting under its assumed authority granted by agreement as the Nooksack Tribal Court of Appeals, entered an Order and Judgment Awarding Costs against an individual identified only as "the Nooksack Tribe's Chief of Police." The Nooksack Tribal Court of Appeals, an appellate body created by ordinance under Nooksack law, lacks original jurisdiction and is not a court of general jurisdiction. In addition, the judges who signed the decision lacked a current appointment to serve as judges for the Nooksack Tribal Court of Appeals, and therefore had no authority to act. On October,, the Supreme Court of the Nooksack Indian Tribe vacated all of the orders entered by those same judges, based on their lapsed appointments and absence of authority to act as the Nooksack Tribal Court of Appeals. Included among those orders that were vacated on October, was the September, Order and Judgment Awarding Costs ("Judgment") that petitioners have domesticated with this Court. On November,, the Nooksack Tribal Court entered an order in Nooksack Indian Tribe v. Northwest Intertribal Court System, which affirmed the voidness of the Judgment. In that separate proceeding, the Court held: Nothing in the [appellate services] contract documents provide [Northwest Intertribal Court System ("NICS")] or an NICS-engaged appellate panel authorization (a) to NICS to accept filings directly from third parties, as opposed to filings through the [Nooksack Indian Tribe ("NIT")] Clerk; (b) to assert original jurisdiction in matters involving the NIT; (c) to issue orders as a court of original jurisdiction or (d) to issue contempt-related monetary sanctions against an NIT officer acting in his or her official capacity. Nothing in the Code or Constitution appears to grant these powers. It is therefore declared that court of appeals orders issued throughout much of requiring the Clerk to accent filings, and the sheriff to arrest her and pav dailv penalties for each dav he does not, cannot be enforced. This court declares such orders to be invalid, unenforceable, and, to the extent that a lower court can direct vacation of an order of a higher court, vacated. While there is no reason to anticipate NICS will ignore this Order, any collection effort under PAGE OF P.O. BOX DEMING,WA PH: (0) -, FAX: (0) -

3 way against the Tribe or any of its officials must cease and desist forthwith. No person may collect on any order related to the subiect matter of this Order against NIT or any of its officers, agents or employees. There was no waiver of sovereign immunity, and the issuing court lacked jurisdiction to make such orders. The orders holding the Nooksack Sheriff liable for dailv penalties or holding the Nooksack Indian Tribe liable for monetarv penalties or costs, if anv. are unenforceable. The Judgment must be Vacated Because the Underlying Court Lacked Jurisdiction and the Order was Vacated Washington law provides for the entry of a foreign judgment as follows: A copy of any foreign judgment authenticated in accordance with the act of congress or the statutes of this state may be filed in the office of the clerk of any superior court of any county of this state. The clerk shall treat the foreign judgment in the same manner as a judgment of the superior court of this state. A judgment so filed has the same effect and is subject to the same procedures, defenses, set-offs, counterclaims, cross-complaints, and proceedings for reopening, vacating, staying, or extending as a judgment of a superior court of this state and may be enforced, extended, or satisfied in like manner. ROW..0(l)(emphasis added). 1. The Underlying Court Lacked Jurisdiction to Issue the Judgment. A "foreign judgment" is "any judgment, decree or order of a court of the United States or of any state or territory which is entitled to full faith and credit in this state." RCW..0. Tribal court decrees are entitled to full faith and credit to the same extent as decrees of sister states. In re Adoption ofbuehl, Wn.d,, P.d (). However, full faith and credit need not be extended to a foreign judgment - or a tribal judgment - if the court lacked jurisdiction to hear a case in the first place. City ofyakima v. Aubrey, Wn. App., 1 P.d (), citing In re Estate of Stein, Wn. App. 1, 1, P.d 0 () ("a PAGE OF P.O. BOX DEMING,WA PH: (0) -, FAX: (0) -

4 decree of a sister state may be subject to collateral attack for want of jurisdiction over the subject matter of the action); State ex rel Eaglin v. Vestal, Wn. App,,, P.d (). A judgment entered by a Tribal court is enforceable "unless the superior court finds the tribal court that rendered the order, judgment or decree (1) lacked jurisdiction over a party or the subject matter, () denied due process as provided by the Indian Civil Rights Act of, or () does not reciprocally provide for recognition and implementation of orders, judgments and decrees of the superior courts of the State of Washington." CR.(c)(emphasis added). Here, treating the Nooksack Tribal Court of Appeals' September, Order and Judgment Awarding Costs "as a judgment of the superior court of this state" requires the vacation of the judgment, and the barring of any efforts to execute on such judgment, because the Nooksack Court of Appeals lacked personal and subject matter jurisdiction. N.T.C ("The Court of Appeals is an appellate body only and does not have original jurisdiction to hear and decide non-appellate matters..."); N.T.C ("The court shall have no jurisdiction over any suit brought against the Nooksack Indian Tribe, its officials, its entities, or employees without the consent of the Tribe."). Even if the Nooksack Tribal Court of Appeals did have personal and subject matter jurisdiction at the time it entered the Order and Judgment - which it did not - the underlying judgment has been vacated, and thus is void. Civil Rule 0(b) provides, among other bases, that I a party shall be granted relief from a judgment or order because the judgment is void, or the prior judgment upon which it is based has been reversed or otherwise vacated. CR 0(b)(), () Vacation of this Court's Order domesticating petitioners' judgment is warranted based on both grounds. The timing of the Tribe vacating the underlying judgment is irrelevant; the underlying court's judgment has been vacated and is unenforceable. When a trial court is faced with a void judgment, it has no discretion and the judgment must be vacated. Mitchell v. Kitsap County, PAGE OF P.O. BOX DEMING,WA PH: (0) -, FAX: (0) -

5 Wn. App., P.d (0). A void judgment may be vacated at any time. Allstate Ins. Co. V. Khani, Wn. App., P.d (). A judgment is void if entered without subject matter jurisdiction. In re Marriage of Ortiz, Wn.d,, 0 P.d () {citing Dike v. Dike, Wn.d 1,, P.d 0 ()). "Jurisdiction over the subject matter 'of an action is an elementary prerequisite to the exercise of judicial power." In re Buehl, Wn.d,, P.d (). A party may raise the lack of subject matter jurisdiction at any time: before there is a final judgment, pursuant to CR (h)() and RAP.(a)(1); and after a final judgment has been entered, pursuant to CR0(b)(). A judgment may be vacated if there was no subject matter jurisdiction, even though a mandate has been issued. Bour v. Johnson, 0 Wn. App., - (). Proceedings to vacate judgments are equitable in nature and the court should exercise its authority liberally to preserve substantial rights and do justice between the parties. Griggs V. AverbeckRealty, Inc., Wn.d, P.d (); In re Hardt, Wn. App., P.d (). A party to the record, adversely affected by a void judgment, may have the judgment vacated as a matter of right. Ballard Sav. c& Loan Ass'n v. Linden, Wash. 0,, P.d (), citing Batchelor v. Palmer, Wash. 0, P. (), Hole v. Page, Wash., P. (). Here, the Tribe had the "foreign judgement" underlying this case vacated by the Nooksack Supreme Court. As such, this Court must vacate its order granting the Petition for entry of foreign judgment of October,.. The underlying Tribal judgment has been vacated. It is black letter law that a judgment entered by a court lacking the proper jurisdiction is void. In re Powell, Wn. App., P.d 1 (). Courts have a nondiscretionary duty to vacate void judgments. Leen v. Demopolis, Wn. App., P.d (1), review denied, 1 Wn.d, P.d (). A vacated judgment has no effect. In PAGE OF P.O. BOX DEMING,WA PH: (0) -, FAX: (0) -

6 -^ re Marriage ofleslie, 1 Wn.d,, P.d (). The rights of the parties are left as though the judgment had never been entered. Anacortes v. Demopoulos, 1 Wn.d, 00 P.d (); Weber v. Biddle, Wn.d,, 1 P.d 0 (); In re Estate of Couch, Wn. App. 1,, P.d 0 (). Here, the Nooksack Supreme Court vacated the underlying Order and Judgment. See October, Order Vacating Tribal Court of Appeals Orders as Void, In re: Orders Entered by Nooksack Tribal Court of Appeals After May 0,, Nooksack Supreme Court Case No. -CI-SC-00. That vacation included the September, Order and Judgment Awarding Costs that petitioners have taken steps to domesticate. Because the Order and Judgment has been vacated, it has no effect and cannot form the basis of a domesticated judgment that may be executed upon.. The Underlying Order and Judgment is Void. The reason for which the Nooksack Supreme Coxirt vacated the Order and Judgment provides an additional basis for vacating this Court's order domesticating the judgment: the terms of the judges who entered the September, Order and Judgment expired on May 0,, and therefore the judges lacked a current appointment by the Tribal Council and were not authorized to act as the Nooksack Tribal Court of Appeals. See Burton v. Ascol, Wn.d, 1-, P.d 0 ()(all actions taken by a judge without authority to act are null and void), citing National Bank of Washington v. McCrillis, Wn.d,, 0 P.d 01 (), superseded by statute as stated in Zachman v. Whirlpool Fin. Corp., Wn.d, P.d (); Mitchell v. Kitsap County, Wn. App., 1, (0)(if a party has not consented to the appointment of a judge pro tempore, the appointed pro tempore judge lacks jurisdiction, and without jurisdiction, the entire proceedings before the judge pro tempore are yoi^, citing McCrillis, Wn.d at ; CR 0(b)() ("the court may relieve a party or the party's legal representative from a final judgment, order or proceeding [where]... the judgment PAGE OF P.O. In a separate proceeding, in a decision entered November, by a pro tempore Judge, the Nooksack Tribal Court independently concluded that the Nooksack Tribal Court of Appeals lacked the contempt powers it seized by judicial fiat, that the Court of Appeals lacked jurisdiction to entertain any suit against the Tribe, its Court staff, or its Chief of Police in the absence of a waiver of sovereign immunity, and that the Judgment was void and unenforceable. See November, Order Granting in part, Denying in Part, Plaintiff Nooksack Indian Tribe's Motion for Equitable Relief at. a. The Appellate Judges Lacked Authority to Act. A judgment is void for purposes of CR 0(b)() if the court lacked jurisdiction over the parties or the subject matter of the suit or if it lacked the inherent power to make or enter the particular order involved. State ex rel Turner v. Briggs, Wn. App., 0-0, 1 P.d 1 ()("A void judgment is a 'judgment, decree or order entered by a court which lacks jurisdiction of the parties or of the subject matter, or which lacks the inherent power to make or enter the particular order involved.") {quoting Dike v. Dike, Wn.d 1,, P.d 0 ()); see, also, Bergren v. Adams County, Wn. App., 0 P.d 1, review denied, Wn.d 0 (). Here, even if the Nooksack Supreme Court had not acted to vacate the Court of Appeals Order and Judgment, this Court would be obligated to vacate the order domesticating the judgment because the Tribal Court of Appeals lacked personal and subject matter jurisdiction over the Tribe and its Chief of Police, Rory Gilliland. The three appellate judges who signed the Order and Judgment lacked authorization to act because their terms had expired, and without authority to act, they did not constitute the Court of Appeals. 8 Nooksack Supreme Court Case No. -CI-SC-00, at -. b. The Court of Appeals Lacked Jurisdiction Because the Tribe Had Not Waived its Sovereign Immunity. In addition, under Noosack law the Court of Appeals lacked jurisdiction to enter the Order and Judgment because the Tribe had not waived its sovereign immunity or the sovereign immunity of its agents and officers acting within the scope of their authority. Order Granting in part, Denying in Part, Plaintiff Nooksack Indian Tribe's Motion for Equitable Relief, at. A court must have both personal and subject matter jurisdiction in order to have authority to act. Marley v. Dep't of Labor & Indus., Wn.d, () (a void judgment exists whenever the issuing court lacks personal jurisdiction over the party or subject matter jurisdiction over the claim). Where jurisdiction is lacking, any judgment entered is void. In re Marriage of Ortiz, Wn.d, () ("A judgment, decree or order entered by a court which lacks jurisdiction of the parties or of the subject matter, or which lacks the inherent power to make or enter the particular order involved, is void."). Subject matter jurisdiction is more than a determination as to whether sovereign immunity prevents any lawsuit, but whether the court hearing the lawsuit has authority to hear the type of lawsuit brought before it. See Wright v. Colville Tribal Enter. Corp., Wn.d,1, P.d (0), (Madson, J., concurring). It is well-established that "Indian tribes possess the common-law immunity from suit traditionally enjoyed by sovereign powers." Kiowa Tribe of Okla. v. Mfg. Techs., Inc., U.S. 1, -0 (); Val-U Constr. Co. v. Rosebud Siom Tribe, F.d, (th Cir. ); United States v. James, 0 F.d (th Cir. ). The doctrine applies broadly to a tribe's commercial activities and to activities outside its reservation. See Okla. Tax Comm'n v. Citizen Band Potawatomi Indian Tribe of Okla., U.S. 0, - (1); Santa Clara Pueblo V. Martinez, U.S., (). Sovereign immunity extends not only to the tribe itself, but also to tribal officers and PAGE OF P.O. BOX DEMING,WA PH: (0) -, FAX: (0) -

9 tribal employees, as long as their alleged misconduct arises while they are acting in their official capacity and within the scope of their authority. Wright, Wn.d at 1; Cook v. AVI Casino Enters., Inc., F.d, - (^*^ Cir. 0), cert, denied, U.S., S. Ct., L. Ed. d 1 (0). "The principles that motivate the immunizing of tribal officials from suit ^protecting an Indian tribe's treasury and preventing a plaintiff from bypassing tribal I immunity merely by naming a tribal official apply just as much to tribal employees when they are sued in their official capacity." Cook, F.d at {quoting Will v. Mich. Dep't of State Police, 1 U.S., 0-1, S. Ct. 0, L. Ed. d ()). An Indian tribe has the undisputed authority to "'employ police officers to aid in the enforcement of tribal law and in the exercise of tribal power.'" State v. Schmuck, 1 Wn.d,, 0 P.d () {quoting Ortiz-Barraza v. United States, F.d, (^ Cir. )). The Tribe employs Chief Gilliland to aid in the enforcement of Nooksack law and in the exercise of Nooksack power. Chief Gilliland is protected by the Tribe's sovereign immunity from claims arising from acts and omissions undertaken in the scope of his official duties as Chief of Police. Young v. Duena, Wn. App., P.d (). Chief Gilliland is also protected from the domestication of the underlying vacated judgment.. A Void Judgment May Not be Executed Upon. The Washington Supreme Court has long held that "[a] void judgment is, in legal effect, no judgment. By it no rights are divested. From it no rights can be obtained. Being worthless in itself, all proceedings founded upon it are equally worthless. It neither binds nor bars any one. All acts performed under it and all claims flowing out of it are void. The parties attempting to enforce it may be responsible as trespassers." State ex rel. Reed v. Gormley, 0 Wash. 01, 0, P. (0). Where a judgment is void, actions authorized in aid of execution are similarly void. See, e.g., TCAP Corp. v. Gervin, Wn.d,, P.d (0) (because the underlying EFFORTS- PAGE OF P.O. 10 foreign judgments had become unenforceable, writs of execution were improperly issued and had to be quashed); Hardin v. Day^ Wash.,, 0 P. 1 (0)(sale that occurs after the lien has expired is void because "[tjhere being no lien in existence, there could have been no authority for the sale in any execution that might have been issued.") {quoting Packwood v. Briggs, Wash. 0,, P. (01)(competing mortgage and judgment liens, held execution void because lien ceased to exits prior to sale); Mueller v. Miller, Wn. App.,, P.d 0 ()(execution through sheriffs sale was void at the outset because lien had expired). Because the underlying Tribal Court of Appeals Order and Judgment has been vacated, this Court's Order domesticating the judgment is void, and no writs or remedies in aid of execution may be issued.
