Section ; and Florida Statutes (2)(a)&(b). WH EREAS, the Third Judicial Circuit seeks to assist the seven (7) counties in this Circuit in implementing a comprehensive substance abuse program where by defendants and litigants receive substance abuse treatment whi ch adheres to the len ( 10) key componen ts recognized by the Florida Legislature and the Office of Justice Programs of the United States Departme nt of Justice, and WHEREAS, the Co urt Administrator's Office of the Th ird Judi cial Circui t, in partnerships with the Third Circuit State Attorney's Office, The Third Circuit Public Defenders Offi ce, the Department of Children and Fam ilies, the Guardian at Litem Program, Meridian Behavioral Health Care, Inc., Departme nt of Juveni le Justice, Departme nt of Corrections, Columbia County and Suwannee County Schoo l Boards, Columbia County and Suwannee County Sheriffs' Offices, Lake City and Live Oak Police Departm ents. and othe r agencies rendering any servic e related to substance abuse has determined that the implementation of a circuit wide drug court program will assist Ins' : 200S Datt:04/ 15J20 05 Time: 10:02 _ ZZC<:'-:oc,F,Deu.:tt t Ca son, Colurnhid Coun ty 8: 1043 P:1ZS:

DelJJ1t.ason, Columbi a County B:1043 P:125J litigants who have come into the court as a litigant or defendant as a direct or indirect result of a substance abuse, and WH EREAS, a drug court program can provide intensive drug treatment and education for parents, litigants, defendants, and family mem bers who have a substance abuse problem and provide those persons an opportunity to overcome their addiction so that they will be able to exit the j ustice system and maintain a crime free and/or addiction free life style, and WHEREAS, the litigants require the assistance of the Court to provide these services to the public and to work toward the goal of preventing substance abuse and resulting criminal offenses, and WHEREAS, a circuit drug treatment court program is necessary for the efficient administration ofjustice. NO\V, THEREFORE, it is, after due considerat ion ORDERED AND ADJUDGED as follows: I. There is hereby created the Drug Treatment Courts Program of the Third Judicial Circuit of Florida. 2. Judge William R. Slaughter, II, is hereby assigned as Administrative Judge for the Drug Treatment Courts Division and he shall also be the Lead Judge for the Family Drug Treatment Court Section. 3. Judge Paul S. Bryan is hereby assigned as Lead Judge for the Adult Criminal Drug Treatment Court Section. 4. Judge Julian E. Collins is hereby assigned as Lead Judge for the Juvenile Delinquency Drug Treatment Court Section. 2
3 5. Other Judges may be added or substituted, and the above judges may rotate out of this division shou ld the need arise or at the request ofa Judge. 6. The Adult Criminal Drug Treatment Court and the Juvenile Delinquency Drug Treatment Cou rt shall initially be located in Columbia County, Florida. The Family Drug Treatment Court shall be located initially in Suwannee County, Florida. The Drug Courts program may be expanded to any county in the Circuit. 7. The Adult Cri minal Drug Treatment Court may accept eligib le cases from the other crim inal divisions for possible referral into substance abuse treatment and support. 8. The Ju veni le Delinq uency Drug Treatmen t Co urt and the Family Drug Treatment Court may accept eligible cases from the other circuit divisi ons for possible referral into substance abuse treatment and support. 9. Until such time as the Drug Treatment Court Program is established in all count ies throughout this circuit, any adult defendant, j uvenile defendant, or parent in a depe ndency case, who (a) meets the eligibility criteria as set forth in the Policy and Procedures Manual for the respective court, and (b) hasjn ade satisfacto ry arrangements for transportation for himself or herself for all required court appearances and services, may be transferred to the appropriate Drug Treatment Court within this Circuit. Such transfer shall require the approval of the presiding ju dge in the case being trans ferred and the presiding judge of the drug treatment court receiving the case. Participants whose case or cases have been transferred pursuant to this paragraph may be required to pay an administrative fee to the Board of County Commissioners of the county to which the case or cases is transferred. Hov..'ever, once a participant is accep ted into a drug treatment co urt program. only the presiding j udge of the dru g treatment court may release a participant from further part icipation in the program. In the event that a participant should fail to comply with treatment directive s, the policies and procedures of the drug treatment co urt, or the orders of the drug treatment cou rt, the drug treatment court j udge may impo se any sancti on dee med appropriate including but not limited to: incarceration ordered as a result of cont em pt of court, admitta nce into a residential treatment program for a period not to exceed one year, and removal from the drug treatment court program, 11. If any participant in the program is terminated for cause, the case shall be remanded to the division from which the case originated prior (0 its referral to Drug Treatment Cou rt. 12. All hearin gs conducted pursuant to this adm inistrative order shall be reco rded. 13, Each Drug Treatment Court shall establish. policies and procedures. The policy and procedures manual, and any part thereof, may he revised from time to time at the discret ion of the Administrative Judge for the Drug Treatment Courts Division. A copy of all manua ls and all subsequent revisions thereto shall be filed in the office of the Court Adm inistrator of the Third Judicial Circui t of Florida and available for public distributi on. 14. Pursuant to F,S the courts in this Circuit may impose additional monetary assessments or court costs for any criminal offen se under Chapter 893, or for any criminal violation of ,s., I I,s or Chapter 562, 567, or Chapter 4

Said fund s shall be collected by the Cle rk of Court for the county where the drug court is situated and dep osited into the County Alcohol and other Drug Abuse Trust Fund; or, if said county has not established said trust fund, the monies sha ll be remitted to the Department of Reven ue for the Community Alcohol and othe r Drug Abuse Services Gran t and Donations Trust Fund. 15. The Drug Treatment Courts Program of the Third Judicial Circuit are hereby identified as a local requi rement and may be designated as the recipient of the County Alcohol and Other Drug Abuse Trust Fund in all seven (7) counties within the Th ird Judicial Circui t pursuant to Section , Florida Statutes. 16. This orde r amends and supercedes all previous adm inist rative orders dealing with the creation and initial governance ofdrug treatment courts within thethird Judicial Circ uit of Florida.
