("Plaintiff) is at all times mentioned herein a California business organized and has always enjoyed a very good business reputation and respect in the community. 2. Defendant Gail Munro ("Defendant") is an individual that, upon information and belief resides in County of Contra Costa, California. PARTIES 3. This Court has jurisdiction over the subject matter of this action. Plaintiff seeks a permanent injunction and/or damages in excess of the jurisdiction minimum of the unlimited jurisdiction of the Superior Court. 4. Venue is proper in the Court because the tortious acts complained of occurred in Contra Costa County and it is believed that the Defendants reside in Contra Costa County, California. FACTS COMMON TO ALL ALLEGATIONS 1

(S O 03. il b> o* sz «w «.^ td > U *r o "tt - H r- c I Upon information and belief, Defendant published false statements on the Internet concerning Plaintiff on the website PlainsElmsford-New-York-10523/Central-Turf-and-Irrigation-Supply-Bernardo-Luciano-Anthony- Luciano-and-Filomina-Luciano , httpr/mww.ripoffreport.com/r/bernardo-luciano/atlanta- Georgia/Bernardo-Luciano-Anthonv-Luciano-and-Filomina-Luciano-Multi-millionaire-refiises-topay , among others. 5. The statements published by Defendant are false, disparaging, impugn Plaintiffs business reputation, and injuriously affect Plaintiff in its trade and profession. 6. These statements include, among others, that Plaintiff: a. "refuses to pay" for rehab bill b. "stopped payment on check" for partial payment of fees c. "threatened by him" d. and that "bad things are going to happen to me" e. "controlling" (a-i collectively hereafter referred to as the "Statements") The false and libelous Statements are attached hereto as Exhibit A. FTRST CAUSE OF ACTION (Defamation - Libel and Libel Per Se Against All Defendants) 7. Plaintiff incorporates by reference paragraphs 1 through 6, inclusive, as though fully set forth herein, in support of this cause of action. 8. Defendant published false Statements on the Internet websites Ripoffreport.com, among others stating, among other things, that Plaintiff is a scam. 9. Defendant authored and published the Statements without privilege or authorization. 10. The Statements constitute libel per se as they are false, defamatory, impugn Plaintiffs business reputation, and injuriously affects Plaintiff in its trade and profession. 11. Plaintiff is informed and believes and, upon that basis, alleges that the Statements were written and published with malice in that those publications were made with knowledge of their falsity, or with reckless disregard as to the truth or falsity of the statements. Plaintiff is further informed and believes and, upon that basis, alleges that such publications were specifically directed and communicated to Plaintiffs customers, or individuals considering Plaintiffs services, for the purpose of damaging Plaintiffs reputation. O EQ 03 5> O W5 fl I- W > U. i As a direct and proximate result of the Statements, Plaintiff has suffered significant reputational harm and sustained actual damages including, but not limited to, loss of capital and revenue, lost productivity, expenses incurred, and loss of intangible assets. SECOND CAUSE OF ACTION (Defamation - Libel and Libel Per Se - Application for Permanent Injunction) 13. Plaintiff repeats and re-alleges each and every allegation contained in paragraphs 1-12 as though set forth fully herein. 14. Defendant published false statements on the Internet websites Ripoffreport.com, among others things, that Plaintiff is a scam. 15. Defendant authored and published the Statements without privilege or authorization. 16. The Statements constitute libel per se as they are false, defamatory, impugn Plaintiffs business reputation, and injuriously affects Plaintiff in its trade and profession. 17. Plaintiff is informed and believes and, upon that basis, alleges that the Statements were written and published with malice in that those publications were made with knowledge of their falsity, or with reckless disregard as to the truth or falsity of the statements. Plaintiff is further informed and believes and, upon that basis, alleges that such publications were specifically directed and communicated to Plaintiffs customers, or individuals considering Plaintiffs services, for the purpose of damaging Plaintiffs reputation. 18. As a direct and proximate result of the false Statements, Plaintiff has suffered significant reputational harm and sustained actual damages including, but not limited to, loss of capital and revenue, lost productivity, expenses incurred, and loss of intangible assets. 19. Plaintiff requests a permanent injunction halting Defendants continued dissemination of the false statements described herein, and further ordering Defendant to request Google, Bing, Yahoo! and other search engine providers to remove the websites listed from their respective search results. Without a permanent injunction judgment of this Court, Defendants' false statements will continue to cause great and irreparable injury to Plaintiff. Plaintiff has no adequate remedy at law for injuries that they are currently suffering and is threatened to be suffered from these false statements. Who do they call? You guessed it, me, their saving grace. I fly to Atlanta and intervene, get him on a plane, and take him back to rehab. On his 2nd day he is busted with an assortment of illegal drugs in his posession, after he tried to get another patient high. I get him reinstated and after only 2 more days he is booted once again for making physical threats against staff and clients. Dad owes me $10,000 for my services and refuses to pay me. I am now suing him and his wife after they stopped payment on a check for part of the fee. He blames the fact that his son is unsuccessful on me. Go figure? Not only that, but now I have been threatened by him and his wife, as well as Anthony. They tell me bad things are going to happen to me if I dont leave them alone. This guy's company is valued at $78 million dollars and he cant pay the one person who helped them. If only parents would realize that money is not what their kids need. What they need is love and attention. In this case Dad went so far as to hire a private investigator to follow Anthony around when he was a teenager and now wonders why his son doesnt trust him. It is a very sad commentary on our priorities, or lack of them in this case. Pathetic is the only word that seems to fit... The drug dealer tried to sell it to someone I know and she called to report that Anthony's crackhead male lover had posession of the stolen vehicle. The police are investigating as we speak. I had placed him in rehab and had problems from day one. In the beginning everything was great and I was a Godsend. At the end the food was bad, the mattress was lumpy and nobody liked him...gee, I wonder why. When you're calling the therapist and other female patients c t's and bitches, people tend to stay away from you. He was terminated and relapsed before reaching home in Atlanta. His Dad called me and hired me to fly to Atlanta and perform an intervention and get Anthony back into treatment. After sucessfully intervening and returning him to treatment as I was hired to do, he was found to be in posession of marijuana, Klonapin, Roxy's and crystal meth after attempting to get another patient high. Even after this, I was able to convince the treatment team to not put him out,. If anyone ever needed help, it was this guy. Unfortunately, 2 days later, he is thrown out permenently for once again becoming abusive and physically threatening. Now Dad is refusing to pay me the $10, owed to me for attempting to save his son's life. It's everyone elses fault that Anthony cannot stay sober. (Even though he has not drawn a sober breath since he was 14). His father went so far as to hire a private investigator to follow him around when he was a teenager. No wonder Anthony hates his dad.(his words, not mine)! I just want to be paid as anyone else would who spent 3 months trying to help someone. In the end, I blame Bernardo, his Dad. His attempts at controlling Anthony are pathetic. Money has surely only brought sadness and misery to this poor family. We all know who will pay the price here.
