The property is zoned FC Freeway Commercial and is located at 4938 New Jesup Highway. APPLICANT: Michael L. Cudd with The WIT Group, Inc., agent and applicant for Andy Hill, owner. CURRENT ZONING: FC Freeway Commercial EXISTING LAND USE: Restaurant. Wendy s Old Fashioned Hamburgers Fast Food SUMMARY: The property in question is located in an FC Freeway Commercial Zoning District. Section of the Glynn County Zoning Ordinance details the types of signs that are allowed in the FC Freeway Commercial District. The sign Ordinance states that three (3) signs (needing a permit) are allowed per building. The applicant maintains that he did not know that the signs were not approved as part of the building permit process and did not know a separate sign permit was needed. Staff performed a survey of the restaurants along New Jesup Road to see how many had only the three signs, including the monument sign. Out of the nine (9) examined (Burger King, IHOP, KFC, Krystal, McDonalds, Pizza Hut, Starbucks, Taco Bell, and Waffle House), two (2) had more than three (3) building signs; McDonalds and Pizza Hut. The permit dates for these restaurants are 2014 and 2009 respectively. There may be additional signs at these fast food restaurants, such as directional signs and menu boards, but these types of signs no not count toward site signage. The applicant submits that the signage that is in place at the moment is in keeping with their corporate standard requirements and the cost to remove

2 two of the building signs would be approximately $11,000. The applicant has spoken with several of the adjacent restaurants and they have expressed their approval of the variance. ORDINANCE PROVISIONS The Glynn County Zoning Ordinance exclusively authorizes the Board of Commissioners to grant variance requests to Article VIII - Signs. Following is the ordinance section establishing the parameters for considering variances: To authorize upon appeal in specific cases, so that the spirit of this Ordinance shall be observed, public welfare and safety secured, and substantial justice done, such variances from the terms of this Ordinance as will not be contrary to the public interest where, owing to special conditions, a literal enforcement of the provisions of this Ordinance will, in an individual case, result in unnecessary hardship. No variance application will be accepted or processed unless the Community Development Director, or designee, determines that it is reasonable possible for the Board of Appeals to find that the application meets the terms of subsections (a), (b), (c), and (d) of the standards set forth below. Such variance may be granted in each individual case of unnecessary hardship upon a finding by the Board of Appeals that: a) There are extraordinary and exceptional conditions pertaining to the particular piece of property in question because of its size, shape or topography: Staff comment: There are no extraordinary and exceptional conditions pertaining to the particular piece of property in question because of its size, shape or topography. b) Such conditions are peculiar to the particular piece of property involved; Staff comment: There are no conditions peculiar to this piece of property; c) No variance may be permitted for a land use that is prohibited by this Ordinance within the District in which the property is located; Staff comment: The use of this property is permitted in the zoning district (church). d) The special conditions or circumstances do not result from the action or actions of the applicant, i.e., a self-imposed hardship; and Staff comment: Certain elements of this request constitute a self-imposed hardship. The applicant did not apply for a sign permit before installing the signs on the building. It will cost the applicant approximately $11,000 plus the cost of the removed signs which cannot be used on the building. e) Relief, if granted, would not cause substantial detriment to the public good or impair the purpose and intent of this Ordinance. Staff comment: The proposed request will not create a detriment to the public good, or create any undue hardship.
