The Bidder shall quote its rates for a period of one year. The term of annual rate contract may be extended for further one year at same terms and conditions with the consent of both parties. 2. The Bidder shall commence the work/supply immediately after awardg the annual rate contract till the specialized date mentioned supply/work order. 3. Bidder must submit Earnest Money as mentioned detailed list of items, the shape of a Demand-draft issued by a Nationalized/Schedule Bank favour of the Registrar, National Law University, Jodhpur payable at Jodhpur at the time of submission of tender documents. Earnest Money shall be refunded/adjusted agast security deposit, if any, after award of annual rate contract, as the case may be. 4. In absence of earnest money, quotation of the firm shall stand rejected. 5. Successful bidder shall be required to deposit security money equal to 10% of total amount of supply/work order given, for a period of one year or guarantee period of underlyg procurement, as the case may be. 6. In case of non-submission of security deposit by successful bidder, supply order shall be stand cancelled and earnest money shall be forfeited by the University. Further, University shall have right to give supply order to the next bidder, accordance with the bid. 7. In case of non-fulfillment of any condition of workorder, University shall have a right to forfeit the security deposit or penalty may be imposed as may be decided by the University. 8. The bidder shall be bound to fulfill all the conditions of the tender. 9. Tenders are non-transferable. 10. The bidder shall quote its rates which shall be clusive of all taxes, etc. whatsoever. Tax if applicable should be mentioned quotation clearly.in absence of that price will be treated as clusive of taxes and any change/rise price shall not be accepted. 2 of 6 Page

3 The rates should not be higher than those quoted any other organisation/stitution. Any hike price durg annual rate contract period shall not be entertaed for any reason. 11. s should be quoted schedule of quantity mentioned by university, and it should be signed by authorized signatory. 12. s should be quoted figures as well as words, case of difference both the rates for whatsoever reason,rates mentioned words shall be treated as fal. 13. Successful Bidder shall not show their ability to execute work/ supply the items given the tender. In such case, the University may black list the Agency. Agency may not be allowed to participate any tender future. The Security Deposit of such Agency shall be forfeited without any prejudice. 14. Incomplete tender shall be rejected. 15. Conditional tender shall be rejected. 16. The Supplier must submit the PAN, GST No. along with tender form for supplyg the items/services, failg which tender shall be stand rejected. 17. Any clarification required by the bidder shall be asked writg only through /fax/post and reply of the same will also be communicated writg only. 18. All disputes pertag to the contract is limited to the jurisdiction of Vice-Chancellor, NLU, Jodhpur, District Court of Jodhpur and exceptional cases to the Hon ble High Court of Rajasthan, Jodhpur. 19. Without prejudice to above, the parties reserve the right to enter to an Arbitration process accordance with the relevant clause of Arbitration and Conciliation Act, The NLU, Jodhpur reserves its right to reject/accept any all tenders at any time without assigng any reason thereof. It shall be without any liability towards the bidder. 21. If annual rate contract awarded, Supplier shall ensure timely execution of work as and when required University. 22. Payment shall be made only after satisfactory execution of work/supply. 23. It shall be responsibility of the firm/agency to ensure the safe, timely reachg sealed envelop to the office of the Registrar, National Law University, Jodhpur, N.H.-65, Nagour Road, Mandore, Jodhpur (Raj.).by 30/07/2018 at 2.00 P.M. 4 24. The firm must not have been debarred / blacklisted by any Govt. Deptt, agency, PSUs / stitution / agencies / autonomous organisations. The bidder shall submit a self certification by an authorized person duly notarized to this effect.(attach self declaration certificate duly notary attested) the prescribed format attached as Annexure A 25. The bidders must sign at the bottom of each page of the bid documents at the time of submission token of unconditional acceptance of the terms and conditions 26. University reserves its right to modify the bid document/details by way of amendment. 27. Successful bidder shall be calculated on the basis of on overall basis for servicers of Car on hire. 28. Any losses sustaed by Institute due to negligence of contractor s service the form of loss/damage of property, will be recoverable from the contractor, as the money value shall be estimated by the Institute. The decision of the stitute this regard will be fal and bdg on the contractor/firm. 29. The Contractor/firm will adopt all safety measures /precautions while executg the work/supply. In case of any accident /causality of any personnel, volved work/supply the complete responsibility will be borne by the contractor/firm himself and University will not be held responsible for any claim/compensation. 30. In case of claim for exemption from deposit of Earnest money sufficient proof support of claim for exemption of EMD as prescribed Govt. of India Notification is to be attached with the bid. 31. In case supply /work is not found as per specifications of the University, whole supply/work shall be rejected and there shall not be any liability towards University for any reason.
