All requests for interpretation, clarification & queries in connection with Tender shall be addressed in writing to Dy.General Manager (HR), NFL, Panipat,at least 7 (Seven) days prior to the closing date of the tender. 11. The Tender shall be submitted duly super scribed Contract for Mosquito/Pest/Rodent Control services in & around NFL premises for the year The price quoted shall be exclusive of all taxes and duties as may be applicable presently or imposed by Government of India from time to time. 13. The bidder shall indicate the rates of GST applicable in their bid, for the quoted items indicating clearly the HSN code of item/sac Code in case of service and applicable category of GST(i.e. whether IGST,CGST,SGST,UGST). 14. Bidders shall have valid GSTIN/GST, provisional ID and provide Invoice and all other documentation in such from and manner as may be prescribed under GST Act and Rules which are inter-alia necessary to enable NFL to claim input tax credit set off, rebate or refund in relations to payment of GST. 15. The rate should be quoted in the Units given in the Schedule of Rates. The rates should be quoted in words and figures. The rates quoted shall remain valid for 120 days from date of opening of tenders for the acceptance. 16. National Fertilizers Limited reserves the right to reject any or all tenders and also does not bind to accept the lowest tender. The tender can be split between two or more contractors without assigning any reason thereof as per the requirement on case to case basis. 17. Bidders shall ensure the submission and receipt of the bids in NFL before the scheduled date and time of submission of bids as given in the NIT. Bids received after scheduled date and time of submission would be outrightly rejected without any cognizance of date / time of dispatch of the bid. 18. Tender shall be submitted in THREE SEPARATE SEALED ENVELOPS as under: Envelop No. 1: Will be super scribed EM (Earnest Money) and shall contain earnest money deposit of Rs.10,000/- (Rupees Ten Thousands only) and Rs.250/-(Rupees Two Hundred and Fifty only) as Tender Fees in the form of a crossed demand draft (separate for both amount) issued by any scheduled bank except rural and cooperative bank in favour of National Fertilizers Limited, Panipat payable at Panipat. Envelop No. 2: Will be super scribed TC (Terms and Conditions) and shall contain terms and conditions set for the tender by tenderer for his offer (in duplicate) and which are at variance from the terms and conditions of the NIT/ tender documents issued by NFL. Envelop No. 3: Will be super scribed PB (Price Bid) and shall contain the rates and amount quoted in the prescribed schedule of rates. All the three sealed envelopes shall be submitted in a separate sealed envelope super scribed Bid for the job Contract for Mosquito/Pest/Rodent Control services in & around NFL premises for the year OPENING OF TENDERS: Envelop No. 1: Marked EM containing earnest money will be opened first, on the scheduled date of opening of tender in presence of those tenders who wish to be present at the time of Tender Opening. Envelop No. 2: Marked TC will then be opened and discussion will be carried on with the respective tenderer for clarification, if any. Page 2 of 16

3 Envelop No. 3: Marked PB will be opened subsequently on the same day or at a later date, which will be intimated to tenderer. 20.(I) (II) Tender shall submit along with the tenders full particulars of their capacity, experience giving the list of similar jobs carried out by them during the last seven years, the complete address or organization for which such works have been executed and also substantiate their furnishing the copy of their credentials as per NIT. In the absence of these documents tender will not be considered. The following documents are to be submitted with the quotation in the envelope No. 2, failing which the tender will be liable for rejection: a) Certified copy of Permanent Account Number (PAN) from Income Tax Authorities. b) Certified copy of Proof of PF Registration No. c) Certified copy of GST Registration No. along with documentary proof thereof. d) Certified copy of ESI Registration No. along with documentary Proof. e) Declaration Forms I & II. f) An Affidavit on Non-judicial Stamp Paper of Rs.10/- duly attested by Notary stating : With reference to NIT No. dt. of National Fertilizers Ltd., Panipat for the work I, S/o Sh. R/o Proprietor / Partner / Authorized Representative of the firm M/s do solemnly affirm and declare as under:- i) That my/our firm/sister concern etc. has not been black listed or put on holiday by any Institutional Agency / Government Department / Public Sector Undertaking for participating in the Tender, in last 2 years. ii) No other Firm / Sister Concerns / Associates belonging to the same group are participating / submitting the Tender for the job. iii) That the information furnished by me/us in respect of above Tender is true and correct and nothing has been concealed. In case any of information is found to be false and incorrect at any stage, NFL shall be fully competent to take the necessary action as deemed fit. g) Eligibility Criteria in prescribed Proforma enclosing all the supporting documents. h) Information regarding Tenderer in the Performa (1) to (4) attached. i) Power of Attorney in the name of person, who has signed the Tender Documents (in case of Partnership Firm or otherwise as the case may be). j) Declaration for downloading the tender document in the prescribed Performa in case the tender has been downloaded from NFL website. k) All the tenderers will have to sign the agreement in the format attached with the NIT for all tenders having value of Rs. 1 Crore and above in compliance of Integrity Pact. Agreement proforma is also being displayed at NFL Web Site. Agreement duly filled, signed and stamped shall be submitted along with the technical bid failing which bid will not be accepted techno-commercially for opening of price bid and will be rejected. 21.(a) The Tenderer is required to furnish the details regarding its status of Micro, Small and Medium Enterprise under the MSMED Act, 2006 under Sr. No. 6 of declaration form-ii at the time of submission of their quotation. The benefits of the Public Procurement Policy for MSEs Order, 2012 shall be considered only if self- certified copy of valid registration certificate of MSME as per the MSMED Act, 2006 along with the status of MSEs owned by SC/ST Entrepreneurs, if applicable, is provided. In case no information is given by tenderer, it will be presumed that he is not covered by the Act and consequently not eligible for any benefits under the Act. (b) The Benefits of the Public Procurement Policy for MSEs Order, 2012 on MSMED Act 2006 shall not be applicable on Works Contracts means wherein transfer of property in Goods involved in execution of such contracts i.e. wherein both material and services are involved. 4 22. The contractor shall quote single rate against each item and not the multiple rates in the Schedule of Rates. Any tender with the multiple rates quoted will be summarily rejected. Price should be quoted strictly as per the Performa enclosed for Schedule of Price. 23. All pages shall be initialed at the lower right hand corner and signed wherever required in the tender papers by the tenderers or by a person holding power of attorney authorizing him to sign on behalf of the tenderer before submission of tender. All corrections and alterations in the entries of tender paper will be signed in full by the tenderer with date. No eraser or overwriting is permissible. 24. No condition or deviation should be mentioned by tenderer in Price Bid. Offers where the party has mentioned any condition or deviation in Price Bid shall be out rightly rejected. 25. The prospective tenderer having any common Partner / Director / Managing Director etc. or having any other common criteria shall be considered as Sister / Group / Associates Company. In such cases only one of them will be eligible for participating in the tender. 26. While submitting the offer, Bidders may ensure that tender documents / offer have been signed by authorized signatory or the Company. Subsequent withdrawal of offer / non-acceptance of orders placed based on offers submitted by them will not be entertained on the ground that the offer was not signed by the authorized person. 27. In case the tender is received in open condition, then the entire risk for loss of confidentiality shall be with the party. NFL shall not own any responsibility on this account whatsoever. 28. One person will be allowed to represent only one Company during discussion, negotiation with NFL.If same person is representing different companies with authorization letter from more than one Company, such person will be allowed to represent only the first Company called for negotiation. 29. NFL reserves the right to postpone the tender opening date and / or time and will intimate all the tenderers well in time, of such postponement along with notice of revised opening date and time. 30. In case, due to some unforeseen circumstances, the date of receiving / opening of the tender happen to be a holiday / closed day, the tender will be received and opened on the next working day. 31. If a tenderer resorts to any frivolous, malicious or baseless complaints / allegations with an intent to hamper or delay the tendering process or resorts to canvassing/ rigging/ influencing the tendering process, NFL reserves the right to debar such tenderer from participation in the present/future tenders up to a period of 2 years. 32. All bidders/service providers/ vendors/ consultants etc. shall be required to certify that they would adhere to Anti-Fraud Policy of the Company and not indulge or allow anybody else working in the Company to indulge in fraudulent activities and would immediately apprise the Company of the fraud/suspected fraud as soon as it comes to their notice. In case of failure to do so, the Company may debar them for future transactions. The Policy is being displayed at Company s Web Site. This condition shall form part of documents both at the time of submission and execution of agreements and contracts with suppliers and service providers, etc. 33. This letter shall form part of the contract document and shall be signed and returned along with all other tender documents like STC/GTC/Technical Terms & Conditions/ Scope of Work/SOR etc. 34. 5 Scope of Work for the Contract of Mosquito/Pest/Rodent Control Services inand around NFL premises for the year Area of operations- NFL complex is situated on main G.T.Road at a distance of 4 Kms from Panipat towards Delhi. The contractor shall provide services for control of pest/mosquito/honey comb removal/rodent control,etc in and around NFL Township, CISF colony and NFL Factory premises etc. In addition to above, fogging operations shall also be carried out in adjoining village namely NangalKheri&Vikas Nagar as per requirementbeing peripheral areas of congested density. The entire site must be inspected by the contractor before quoting their offers. 1.2 RESIDUAL SPOT SPRAYING (ANTI-ADULT MOSQUITOS MEASURE): Fortnightly operations will be carried out inside all the residential/public Building of NFL Township, CISF Colony area etc. including factory buildings in entire factory area. The frequency may be increased at the discretion of the NFL if the desired results are not achieved (without any extra payment). Chemicals used in the operations shall leave no strains on the walls. 1.3 ANTI LARVA TREATMENT: Anti Larva treatment will be done by the contractor in all ponds, pools drains, stagnated water and all other breading places in and around NFL premises i.e. adjoining area within the radius of 2 Kms and in village NangalKheri and VikasNagar in a systematically manner fortnightly and on call to control the density of mosquitoes in the areas mentioned above. 1.4 DISINFESTATION SERVICES: Contractor will have to provide services for control of cockroaches and silver fishes in all the residential and ancillary/factory buildings in all at least one operation will be carried out in all the houses once in a month. In addition to above the disinfections services will also be provided in drains and sewerage channels twice a month. 1.5 REMOVAL OF HONEY/WASP COMBS: Contractor will have to remove honey combs and wasp combs at all heights outside factory, in offices & buildings in factory area, houses & public buildings in NFL Township, other structures, etc. as per the instructions given by Dealing Official from time to time. Spray gun/pump and pesticide will be arranged by the contractor. The job has to be carried out safely at contractor s responsibility with adequate manpower. The contractor shall quote the rate for removal of honey comb and wasp comb differently on operation basis. 1.6 RODENT CONTROL: Your representative shall visit AFCP control room, Bentonite Sulphur Plant Control Room, Urea plant control room, CPP control room, SGP control room, DM Plant control room & Bagging control room at least fortnightly during the first quarter and on monthly basis or as earlier when required, during the subsequent quarters and apply rodent control chemicals or any other measurers considered necessary. The rodenticide baits used shall be anticoagulant type which is a slow acting poison thus reducing the chances of rats dying inside the hidden places The rodent control chemical shall be applied in a rectangle card board plates printed on all the sides with a warning in bold red letters Poison and dangerous for human use, with the name of chemical You shall supply all the chemicals (Rodenticides) and provide labour, supervision and other services for rodent control in presence of authorized representative of Instrument department. The contractor will replenish the chemicals as and when required. Page 5 of 16

6 1.6.4 You shall have valid License required under the Insecticides Act, 1968 (46 of 1968) as amended by The Delegated Legislation Provisions (Amendment) Act, 2004 (4 of 2005) along with The Insecticides Rules, Valid License to stock & use restricted Insecticides for Commercial Pest Control operations Under FORM VI-C [Rule 10(3A)] The work shall be carried out on normal working days and during general shift hours (8 AM to 5 PM) only You shall furnish compliance report after every visit. (Report shall be signed by Incharge of Plants mentioned at Sr. No ) Report shall reach the office of the Engineer-in-charge (HOD of Instt. Deptt.)within a week of the application of rodent control measure All the rodent control measure/application of chemical must meet the approval/guidelines issued by Government agencies/law of land. No banned item shall be used. Necessary services for control of snakes etc. will also be provided through fumigation using appropriate chemicals and other measures periodically. 1.7 FOGGING OPERATION: Fortnightly fogging operation shall be carried out in the eveninginternally& externally in the residential/public buildings and surroundings areas in entire NFL complex with fogging machine having engine performance 17.5 KW or aboveby using chemicals giving better results. Fogging operation in all the areas may be done on the same day. Sufficient fogging teams with fogging machines shall be deployed by the contractor. In peripheral village namely Nangal-Kheri&Vikas Nagar, fogging operation may also be got done. Note: The time schedule for execution of job is given in Annexure- I hereinafter attached. The approximate quantity of job shall be as per scope of work. However, NFL does not guarantee the above work load and there can be variation to any extent for which no claim from the contractor shall be entertained by NFL. The contractor should have capacity to carry out the job within specified time schedule. Page 6 of 16

7 Special Terms & Conditions of the Contract for Mosquito/Pest/Rodent Control Services in& around NFL premises for the year EMD & Tender Fees : Tenderers shall make a deposit ofrs.10,000/- as EMD and Rs.250/-as Tender Fees in the manner as specified in clause No of GTC. 2. Validity of Contract : The contract shall remain valid for a period of two years. The contract may be extended on the same rates, terms & conditions for a period three months at the sole discretion of NFL, as per Clause No of GTC. 3 Defect Liability Period: The contractor shall give the guarantee for the work done for a period of one month and clause No of GTC shall be applicable. 4 SECURITY DEPOSIT: Security 10% of the annualized gross value of the Contract would be deposited by the Contractor. The Successful Tenderer will deposit Initial Security 2.5% of annualized value of the contract within 10 days from date of issue of LOI including the amount of EMD already deposited. The balance Security Deposit will be deducted from each running bill of the 7½% of the running bill so as to make it total of 10 % of the annualized value of the contract. In case work is split between two or more parties, SD shall be deposited based on the value of split order. Security deposit deducted during first year of the contract period shall be retained for faithful execution of the contract for remaining period. Further security deposit will not be deducted during the remaining period of contract unless the yearly executed value exceeds the executed value of the contract during first year. No interest will be payable on Earnest Money Deposit (EMD) and Security Deposit (SD). Any amount recoverable from the contractor shall be deducted from security deposit. The SD will be refunded after the defect liability period as specified in Para This supersedes clause No of GTC. 5 MANPOWER The contractor shall deploy sufficient manpower to carry out the job smoothly as per standard and the job should not suffer in any way on this account. The contractor s supervisors shall maintain the day-to-day register of various activities performed/carried out and furnish the same for inspection of the Officer-in-Charge of NFL. The operation will be carried out under the supervision of officer authorized by NFL from time to time and payment will be released only after obtaining necessary certificate from the concerned officer that the operation/job has been carried out satisfactorily. In case services are not satisfactory and the operation is not carried out as per entire satisfaction, no payment will be made for the same. The contractor shall arrange all the chemicals, provide labour, supervision and other services for mosquito/pest/rodent control, etc. The contractor will replenish the chemicals as and when required. 6 PENALTY. (i)if any of the items/areas as given in the Time Schedule for Execution of Work (Annexure-I), is not executed or attended, a penalty of Rs. 500/- per day for delay of every day or part thereof subject to maximum of 10% of the total value of the work, shall be levied and recovered from the bills or any other amount due to the contractor. (ii) In case work of pest/rodent control is not executed / attended due to stoppage of work or strike by the employees of the contractor or due to any reason whatsoever, proportionate amount by taking the number of days in that month will be deducted from the bill. If during this period, the job is got executed from any other alternate source, the same will be done at the risk and cost of the contractor plus 25% departmental charges. (iii) If any of the job executed by the contractor is found to be unsatisfactory, a penalty of Rs.500/- shall be levied. Note : This penalty Clause supersedes Clause No of GTC. Page 7 of 16

8 7 APPLICABILITY OF TAXES: NFL shall pay GST as per provisions of GST Act, Clause with regard to GST given in NIT/GTC shall be applicable. 8 The Officer-in-charge for the purpose of this contract is Chief Manager (HR)/HR Head, NFL, Panipat, who shall be empowered to deduct any amount of penalty levied in terms of the penalty clause No.5 mentioned above from the bills of the contractor or any other amount due to the contractor. The decision of the CM (HR) in this regard shall be final and binding on the contractor. 9 CONTRACTOR TO REMOVE UNSUITABLE EMPLOYEES: The contractor shall on instruction of the Officer-in-charge immediately remove from the work any person employed thereon who may misbehave or cause any nuisance or otherwise, in the opinion of the Officer-incharge and is not a fit person to be retained on the work and such person shall not be again employed or allowed on the works without the prior written permission of the Officer-in-charge. 10 All the insecticides will be provided by the contractor. Insecticides used by the contractor should be of high quality supplied by the reputed manufacture or ISI specifications with proper seal will be stored under supervision of officer in Charge of NFL. The Chemical used by the contractor shall be in sealed container & Bags. Insecticides may be got tested in NFL Lab or any other recognized test house at the risk & cost of contractor. Contractor will produce a list of insecticides used for this purpose. 11 While handling the material all the safety precautions of the personnel working will be followed up strictly by the contractor. NFL will not be responsible for any accident arising out of on the part of contractor on their labour. Adequate safety protection shall be provided by the contractor to their labour. 12 While performing the job/spraying in the plant area, the safety and security measures are to be followed by the contractor s labourers as per plant requirement. 13 It is the responsibility of the contractor to maintain regular record/register for the persons working under them viz. name, age, address, identification, attendance payments etc. as required under the wages act for submission to Govt. on demand. Contractor would comply with labour laws, statutory regulations and rules framed thereunder. NFL shall be under no obligation to accept/admit any claim in this behalf. 14 It is the responsibility of the contractor to keep their labour in specified area only. Strict action would be taken against the labour and contractor, if found at other places and or indulge in unlawful activities. No labour below the prescribed limit of age shall be employed on the work. 15 Contractor will strictly adhere to the rules and regulations as laid down by NFL. 16 Contractor would be responsible for getting the gate passes issued, duly signed by authorities for the persons working under them. 17 The contractor shall indicate the list of chemicals to be used for control of mosquitoes, pest, cockroaches, honey comb, rodent, anti-larva and for fogging. 18 The chemical to be used by the contractor preferably should not fall under the restricted category of chemicals/insecticides. If used from restricted category, it should be declared in the offer. 19 The application of chemicals/control measures must meet the approval/guidelines issued by Government Agencies/Law of land. No banned item shall be used. 20 The contractor will have to carry out work on Sunday, Holidays and round the clock, if required, for which nothing extra shall be paid. Page 8 of 16
