5 No Government Gazette 1 April MINISTRY OF LABOUR AND SOCIAL WELFARE No AMENDMENT TO REGULATIONS MADE UNDER THE SOCIAL SECURITY ACT, 1994 The Minister of Labour and Social Welfare makes, under section 47 of the Social Security Act, 1994 (Act No. 34 of 1994) and on the recommendation of the Social Security Commission, the regulations set out in the Schedule. SCHEDULE 1. In these regulations, the Regulations means the regulations under the Social Security Act, 1994 (Act No. 34 of 1994) promulgated under Government Notice No. 198 of 1 November 1995, as amended by Government Notices No. 31 of 31 January 1996, No. 80 of 15 April 1996, No. 224 of 1 December 1997, No. 235 of 16 September 1998, No. 101 of 1 June 2001, No. 227 of 15 November 2003 and No. 53 of 29 February Amendment of regulation 1 of the Regulations 2. Regulation 1 of the Regulations is amended by - the deletion of the definition remuneration ; and the insertion immediately before the definition of the Act of the following definition: basic wage means that part of an employee s remuneration in money including the cash equivalent of payment in kind, if any, paid in respect of work done during the hours ordinarily worked, but does not include - (c) (d) (e) allowances, including travel and subsistence, housing, motor vehicle, transport, and professional allowances, whether or not based on the employee s basic wage; pay for overtime, as defined in section 8(g) of the Labour Act, 2007 (Act No. 11 of 2007); additional pay for work on Sunday or a public holiday; additional pay for night work, as required in terms of section 19(1) of the Labour Act, 2007 (Act No. 11 of 2007); payment in respect of pension, annuity or medical benefits or insurance, but for the purpose of these regulations an employee is deemed to have been paid a basic wage of not less than N$300 and not more than N$6000 in any given month, as the case may be; and Amendment of regulation 9 of the Regulations 3. Regulation 9 of the Regulations is amended by the substitution of subregulation (1) of that regulation for the following subregulation (1):

6 6 Government Gazette 1 April 2009 No (1) Maternity leave benefits shall be equal to 100 percent of the basic wage of the female employee concerned, up to an amount of N$7000 per month of such maternity leave.. Amendment of regulation 10 of the regulations 4. Regulation 10 of the Regulations is amended by the substitution for subregulation (1) of that regulation for the following subregulation (1): (1) Sick leave benefits shall be equal to 75 percent of the basic wage of the employee concerned up to an amount of N$7000 per month for the first 6 months of such sick leave and thereafter such employee shall be entitled to an amount equal to 65 percent of his or her basic wage up to an amount of N$7000 per month of such sick leave.. Amendment of regulation 11 of the regulations 5. Regulation 11 of the Regulations is amended by the substitution for subregulation (1) of that regulation of the following subregulation (1): General amendment of the Regulations (1) The death benefit shall amount to a single payment of N$ The Regulations are amended by the substitution of the word remuneration wherever it occurs for the word basic wage. No RECLASSIFICATION OF A PORTION OF DISTRICT ROAD 1992 TO A PORTION OF FARM ROAD 1964: DISTRICT OF KARIBIB In terms of section 23(3) of the Roads Ordinance, 1972 (Ordinance 17 of 1972), it is hereby made known that the Minister has, under section 23(1)(e) of the said Ordinance, in the district of Karibib, amended the classification of a portion of district road 1992 described in the Schedule and shown on sketch-map P2214 by the symbols A-B, to a portion of farm road The said sketch-map shall at all times lie open to inspection at the office of the Roads Authority, Windhoek, during normal office hours. SCHEDULE From a point (A on sketch-map P2214) on the farm Portion A of Okongava Ost 72 generally southeastwards and more and more southwards across the said farm to a point (B on sketch-map P2214) at the junction with farm road 1964 on the common boundary of the said farm and the farm Otjibingwe 104.

7 No Government Gazette 1 April No PROCLAMATION OF A DISTRICT ROAD (NUMBER 3663): DISTRICT OF OUTAPI It is hereby made known - in terms of section 22(2) of the Roads Ordinance, 1972 (Ordinance 17 of 1972), that the Minister has, in the district of Outapi under section 22(1) of the said Ordinance declared the road described in the Schedule and shown on sketch-map P2212 by the symbols A-B to be a proclaimed road. in terms of section 23(3) of the said Ordinance that the Minister has under section 23(1)(c) of the said Ordinance declared the road referred to in paragraph to be district road (number 3663). The said sketch-map shall at all times lie open to inspection at the office of the Roads Authority, Windhoek, during normal office hours. SCHEDULE From a point (A on sketch-map P2212) at the junction with main road 67 generally eastwards and more and more north-eastwards via the places known as Ehongo, Oshivanda, Okatjekja and Otshaambelo to a point (B on sketch-map P2212) at the junction with main road 123. A copy of this notice and the said sketch-map on which the roads to which the proposal refers and other proclaimed, minor and private roads in the area are shown, shall for the full period of 30 days, mentioned below, lie open to inspection at the offices of the Roads Authority, Windhoek, and the District Manager of the Roads Authority, Windhoek, during normal office hours. In these regulations, the Regulations means the Regulations Relating to Nature Conservation, published under Government Notice No. 240 of 1976, as amended by Government Notices Nos. 256 of 1976; 112, 248, 302, 314 and 364 of 1977; 114, 190 and 247 of 1978; 10, 50 and 56 of 1979; AG.8 of 1981; AG.41 of 1982; 23,49 and 61 of 1983; 72 of 1984; 3, 36, 101 and 121 of 1985; 122 and 242 of 1986; 81 of 1987; 89 of 1988; AG.37 and AG.44 of 1989; 152 of 1993; 304 of 1996 and 83 of Substitution of regulation 101 of Regulations 2. The Regulations are amended by the substitution for regulation 101 of the following regulation: Registration fees 101. Amendment of regulation 118C of Regulations 5. Regulation 122 of the Regulations is amended - by the substitution for subparagraph (i) of paragraph of subregulation (4) of the following subparagraph: (i) against payment of a registration fee in Schedule D, issue to the game cropping team a registration certificate in which the details referred to in paragraph are stated; ; by the substitution for subregulation (6) of the following subregulation: (6) A registration certificate issued to a game cropping team by virtue of subregulation (4)(i), expires on 30 March following the date of issue thereof, but may, against payment of the registration fee in Schedule D, be renewed annually on or before 30 April.. Amendment of regulation 128B of Regulations 7. Regulation 128B of the Regulations is amended by the substitution for subregulation (3) of the following regulation: Amendment of Regulations (3) The permit fees for the exportation of the carcass or the raw meat of game or wild animals are in Schedule D.. 8.
