1 E SENATE BILL lr By: Senator Zirkin Introduced and read first time: January, 0 Assigned to: Judicial Proceedings Committee Report: Favorable with amendments Senate action: Adopted with floor amendments Read second time: March, 0 CHAPTER 0 AN ACT concerning Criminal Law Obstructing Justice Penalties Comprehensive Crime Bill of 0 FOR the purpose of adding certain crimes relating to firearms to a certain list of crimes for which certain evidence may be gathered by, and a judge may grant an order authorizing, interception of oral, wire, or electronic communications; making conforming changes; authorizing the State, in a criminal case involving the unlawful possession of certain firearms, to appeal from a decision of a trial court that excludes evidence offered by the State or requires the return of property alleged to have been seized in violation of certain constitutional provisions; altering penalties for certain crimes relating to firearms; altering the list of controlled dangerous substances applicable to a certain prohibition against volume dealing in controlled dangerous substances; altering maximum penalties for crimes relating to inducing false testimony or avoidance of a subpoena, retaliation for testimony, and intimidating or corrupting a juror; providing that the use of a firearm in the commission of a felony or other crime of violence constitutes a crime of violence; eliminating parole eligibility for certain violent offenders under certain circumstances; authorizing, for purposes of filing a certain petition for certain immigration status, a certain victim or victim s family member to request a certain certifying official to certify victim helpfulness on a Form I, Supplement B certification under certain circumstances; providing that, for the purpose of this Act, a victim shall be considered to be helpful, to have been helpful, or likely to be helpful under certain circumstances; requiring the certifying official to sign and complete the certification in a certain manner and within a certain period of time under certain circumstances; providing that certain conditions are not required in order to request or obtain the EXPLANATION: CAPITALS INDICATE MATTER ADDED TO EXISTING LAW. 2 SENATE BILL certification; authorizing the certifying official to withdraw the certification only under certain circumstances; authorizing a certifying entity to disclose the immigration status of a victim or person requesting the certification only under certain circumstances; restricting a court from ordering a certain substance use evaluation and commitment for certain defendants charged with, convicted of, or serving a sentence for a crime of violence under certain circumstances; establishing the Tyrone Ray Violent Crime Violence Intervention and Prevention Fund as a special, nonlapsing fund; specifying the purpose of the Fund; requiring the Executive Director of the Governor s Office of Crime Control and Prevention to administer the Fund in consultation with the Maryland Violence Intervention and Prevention Advisory Council; providing for certain funds to be received by the Governor s Office of Crime Control and Prevention for the administration of the Fund; authorizing the Executive Director to require the recipients of certain funds to meet certain requirements as a condition of receiving funds requiring the State Treasurer to hold the Fund and the Comptroller, in conjunction with the Executive Director, to account for the Fund; specifying the contents of the Fund; requiring the Governor to annually appropriate a certain amount to the Fund in certain fiscal years; specifying the purpose for which the Fund may be used; providing for the investment of money in and expenditures from the Fund; providing that the accounts and transactions of the Fund shall be subject to a certain audit; establishing the Maryland Violence Intervention and Prevention Advisory Council in the Governor s Office of Crime Control and Prevention; specifying the membership of the Council; specifying the duties of the Council; requiring that certain information be provided in a certain evaluation; providing that members of the Council may not receive compensation but are entitled to reimbursement for certain expenses; requiring the Executive Director, in consultation with the Council, to establish procedures for local governments and nonprofit organizations to use in applying for money from the Fund; specifying the information that must be provided in an application for money from the Fund; requiring the Executive Director, in consultation with the Council, to establish procedures for the distribution of funds; specifying the duration of awards and a certain preference for the award of funds; requiring awards to be commensurate with the level of gun violence; specifying certain requirements for a local government or nonprofit organization that is awarded money from the Fund; exempting the Fund from a certain provision of law requiring interest on State money in special funds to accrue to the General Fund of the State; requiring that certain reports be posted to a certain website; requiring the Governor s Office of Crime Control and Prevention to make certain information available in a certain format on or before a certain date each year; requiring the Governor s Office of Crime Control and Prevention to provide certain notice to the Governor and the Legislative Policy Committee each year; requiring the State Treasurer to hold the Fund and the Comptroller, in conjunction with the Executive Director, to account for the Fund; specifying the contents of the Fund; specifying the purpose for which the Fund may be used; providing for the investment of money in and expenditures from the Fund; requiring the Governor, in certain fiscal years, to include certain appropriations of money in the annual budget bill for certain purposes; requiring the Executive Director to establish certain measures for tracking the performance of certain activities or programs; requiring a certain local government or nonprofit entity that receives

3 SENATE BILL certain funds to comply with certain requirements as a condition of receiving certain funds; establishing the Task Force to Study Maryland s Criminal Gang Statutes; providing for the composition, chair, and staffing of the Task Force; prohibiting a member of the Task Force from receiving certain compensation, but authorizing the reimbursement of certain expenses; requiring the Task Force to study and make recommendations regarding certain matters; requiring the Task Force to report its findings and recommendations to the Governor and the General Assembly on or before a certain date; providing for the termination of the Task Force; and generally relating to obstructing justice. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, That the Laws of Maryland read as follows: Article Courts and Judicial Proceedings 0. (c) () (i) This paragraph applies to an interception in which:. The investigative or law enforcement officer or other person is a party to the communication; or. One of the parties to the communication has given prior consent to the interception. (ii) It is lawful under this subtitle for an investigative or law enforcement officer acting in a criminal investigation or any other person acting at the prior direction and under the supervision of an investigative or law enforcement officer to intercept a wire, oral, or electronic communication in order to provide evidence:

A person has created a barricade situation; and B. Probable cause exists for the investigative or law enforcement officer to believe a hostage or hostages may be involved. 0. (a) The Attorney General, State Prosecutor, or any State s Attorney may apply to a judge of competent jurisdiction, and the judge, in accordance with the provisions of 0 of this subtitle, may grant an order authorizing the interception of wire, oral, or electronic communications by investigative or law enforcement officers when the interception may provide or has provided evidence of the commission of: () Murder; () Kidnapping; () Rape; () A sexual offense in the first or second degree; () Child abuse in the first or second degree; () Child pornography under 0, 0, or 0. of the Criminal Law Article; () Gambling;

(c) () In a criminal case, the State may appeal as provided in this subsection.

8 SENATE BILL () The State may appeal from a final judgment granting a motion to dismiss or quashing or dismissing any indictment, information, presentment, or inquisition. () The State may appeal from a final judgment if the State alleges that the trial judge: or (i) Failed to impose the sentence specifically mandated by the Code; Rules. (ii) Imposed or modified a sentence in violation of the Maryland 0 0 () (i) In a case involving a crime of violence as defined in of the Criminal Law Article, and in cases under 0 through 0 and through of the Criminal Law Article AND, 0, AND 0 OF THE PUBLIC SAFETY ARTICLE, the State may appeal from a decision of a trial court that excludes evidence offered by the State or requires the return of property alleged to have been seized in violation of the Constitution of the United States, the Maryland Constitution, or the Maryland Declaration of Rights. (ii) The appeal shall be made before jeopardy attaches to the defendant. However, in all cases the appeal shall be taken no more than days after the decision has been rendered and shall be diligently prosecuted. (iii) Before taking the appeal, the State shall certify to the court that the appeal is not taken for purposes of delay and that the evidence excluded or the property required to be returned is substantial proof of a material fact in the proceeding. The appeal shall be heard and the decision rendered within days of the time that the record on appeal is filed in the appellate court. Otherwise, the decision of the trial court shall be final. (iv) Except in a homicide case, if the State appeals on the basis of this paragraph, and if on final appeal the decision of the trial court is affirmed, the charges against the defendant shall be dismissed in the case from which the appeal was taken. In that case, the State may not prosecute the defendant on those specific charges or on any other related charges arising out of the same incident. (v). Except as provided in subsubparagraph of this subparagraph, pending the prosecution and determination of an appeal taken under this paragraph or paragraph () of this subsection, the defendant shall be released on personal recognizance bail. If the defendant fails to appear as required by the terms of the recognizance bail, the trial court shall subject the defendant to the penalties provided in of the Criminal Procedure Article.. A. Pending the prosecution and determination of an appeal taken under this paragraph or paragraph () of this subsection, in a case in which

9 SENATE BILL the defendant is charged with a crime of violence, as defined in of the Criminal Law Article, the court may release the defendant on any terms and conditions that the court considers appropriate or may order the defendant remanded to custody pending the outcome of the appeal. B. The determination and enforcement of any terms and conditions of release shall be in accordance with the provisions of Title of the Criminal Procedure Article. (vi) If the State loses the appeal, the jurisdiction shall pay all the costs related to the appeal, including reasonable attorney s fees incurred by the defendant as a result of the appeal. Article Criminal Law 0. (a) () Except as provided in subsection (b) of this section, a person may not: (i) on or about the person; wear, carry, or transport a handgun, whether concealed or open, (ii) wear, carry, or knowingly transport a handgun, whether concealed or open, in a vehicle traveling on a road or parking lot generally used by the public, highway, waterway, or airway of the State; 0 (iii) property in the State; or violate item (i) or (ii) of this paragraph while on public school (iv) violate item (i) or (ii) of this paragraph with the deliberate purpose of injuring or killing another person. () There is a rebuttable presumption that a person who transports a handgun under paragraph ()(ii) of this subsection transports the handgun knowingly. (b) This section does not prohibit: 0 () the wearing, carrying, or transporting of a handgun by a person who is authorized at the time and under the circumstances to wear, carry, or transport the handgun as part of the person s official equipment, and is: (i) a law enforcement official of the United States, the State, or a county or city of the State; (ii) a member of the armed forces of the United States or of the National Guard on duty or traveling to or from duty;

10 SENATE BILL (iii) a law enforcement official of another state or subdivision of another state temporarily in this State on official business; State; (iv) a correctional officer or warden of a correctional facility in the (v) a sheriff or full time assistant or deputy sheriff of the State; or (vi) a temporary or part time sheriff s deputy; 0 () the wearing, carrying, or transporting of a handgun, in compliance with any limitations imposed under 0 of the Public Safety Article, by a person to whom a permit to wear, carry, or transport the handgun has been issued under Title, Subtitle of the Public Safety Article; () the carrying of a handgun on the person or in a vehicle while the person is transporting the handgun to or from the place of legal purchase or sale, or to or from a bona fide repair shop, or between bona fide residences of the person, or between the bona fide residence and place of business of the person, if the business is operated and owned substantially by the person if each handgun is unloaded and carried in an enclosed case or an enclosed holster; () the wearing, carrying, or transporting by a person of a handgun used in connection with an organized military activity, a target shoot, formal or informal target practice, sport shooting event, hunting, a Department of Natural Resources sponsored firearms and hunter safety class, trapping, or a dog obedience training class or show, while the person is engaged in, on the way to, or returning from that activity if each handgun is unloaded and carried in an enclosed case or an enclosed holster; () the moving by a bona fide gun collector of part or all of the collector s gun collection from place to place for public or private exhibition if each handgun is unloaded and carried in an enclosed case or an enclosed holster; () the wearing, carrying, or transporting of a handgun by a person on real estate that the person owns or leases or where the person resides or within the confines of a business establishment that the person owns or leases; 0 employee: () the wearing, carrying, or transporting of a handgun by a supervisory (i) in the course of employment; (ii) within the confines of the business establishment in which the supervisory employee is employed; and establishment; (iii) when so authorized by the owner or manager of the business

11 SENATE BILL () the carrying or transporting of a signal pistol or other visual distress signal approved by the United States Coast Guard in a vessel on the waterways of the State or, if the signal pistol or other visual distress signal is unloaded and carried in an enclosed case, in a vehicle; or () the wearing, carrying, or transporting of a handgun by a person who is carrying a court order requiring the surrender of the handgun, if: (i) the handgun is unloaded; 0 0 (ii) the person has notified the law enforcement unit, barracks, or station that the handgun is being transported in accordance with the court order; and (iii) the person transports the handgun directly to the law enforcement unit, barracks, or station. (c) () A person who violates this section is guilty of a misdemeanor and on conviction is subject to the penalties provided in this subsection. () If the person has not previously been convicted under this section, 0 of this subtitle, or or of this title: (i) except as provided in item (ii) of this paragraph, the person is subject to imprisonment for not less than 0 days and not exceeding years or a fine of not less than $0 and not exceeding $,00 or both; or (ii) if the person violates subsection (a)()(iii) of this section, the person shall be sentenced to imprisonment for not less than 0 days. () (i) If the person has previously been convicted once under this section, 0 of this subtitle, or or of this title:. except as provided in item of this subparagraph, the person is subject to imprisonment for not less than year and not exceeding [] years; or. if the person violates subsection (a)()(iii) of this section, the person is subject to imprisonment for not less than [] years and not exceeding [] years. (ii) The court may not impose less than the applicable minimum sentence provided under subparagraph (i) of this paragraph. () (i) If the person has previously been convicted more than once under this section, 0 of this subtitle, or or of this title, or of any combination of these crimes:

12 SENATE BILL. except as provided in item of this subparagraph, the person is subject to imprisonment for not less than [] years and not exceeding [] years; or. A. if the person violates subsection (a)()(iii) of this section, the person is subject to imprisonment for not less than [] years and not exceeding [] years; or B. if the person violates subsection (a)()(iv) of this section, the person is subject to imprisonment for not less than [] years and not exceeding [] years. (ii) The court may not impose less than the applicable minimum sentence provided under subparagraph (i) of this paragraph. 0. (a) () In this section, firearm means: (i) a weapon that expels, is designed to expel, or may readily be converted to expel a projectile by the action of an explosive; or (ii) the frame or receiver of such a weapon. 0 0 () Firearm includes an antique firearm, handgun, rifle, shotgun, short barreled rifle, short barreled shotgun, starter gun, or any other firearm, whether loaded or unloaded. (b) A person may not use a firearm in the commission of a crime of violence, as defined in of the Public Safety Article, or any felony, whether the firearm is operable or inoperable at the time of the crime. (c) () (i) A person who violates this section is guilty of a [misdemeanor] FELONY and, in addition to any other penalty imposed for the crime of violence or felony, shall be sentenced:. FOR A FIRST OFFENSE, to imprisonment for not less than years and not exceeding 0 years; OR. FOR A SECOND OR SUBSEQUENT OFFENSE, TO IMPRISONMENT FOR NOT LESS THAN YEARS AND NOT EXCEEDING 0 YEARS. (ii). The court may not impose less than the minimum sentence of years [and, except] FOR A SENTENCE IMPOSED UNDER SUBPARAGRAPH (I) OF THIS PARAGRAPH.

13 SENATE BILL. THE COURT MAY NOT IMPOSE LESS THAN THE MINIMUM SENTENCE OF YEARS FOR A SENTENCE IMPOSED UNDER SUBPARAGRAPH (I) OF THIS PARAGRAPH. (III) THE COURT MAY NOT SUSPEND THE FIRST YEARS OF A MANDATORY MINIMUM SENTENCE IMPOSED UNDER SUBPARAGRAPH (I) OF THIS PARAGRAPH. (IV) EXCEPT as otherwise provided in 0 of the Correctional Services Article, the person is not eligible for parole in less than years. () For each subsequent violation, the sentence shall be consecutive to and not concurrent with any other sentence imposed for the crime of violence or felony.. (a) cocaine; A person may not manufacture, distribute, dispense, or possess: () 0 pounds or more of marijuana; () grams or more of cocaine; () grams or more of any mixture containing a detectable amount of () grams or more of cocaine base, commonly known as crack ; 0 0 () grams or more of morphine or opium or any derivative, salt, isomer, or salt of an isomer of morphine or opium; () any mixture containing grams or more of morphine or opium or any derivative, salt, isomer, or salt of an isomer of morphine or opium; () GRAMS OR MORE OF FENTANYL OR ANY STRUCTURAL VARIATION OF FENTANYL THAT IS SCHEDULED BY THE UNITED STATES DRUG ENFORCEMENT ADMINISTRATION; () GRAMS OR MORE OF ANY MIXTURE CONTAINING A DETECTABLE AMOUNT OF FENTANYL OR ANY STRUCTURAL VARIATION OF FENTANYL THAT IS SCHEDULED BY THE UNITED STATES DRUG ENFORCEMENT ADMINISTRATION; [()] (),000 dosage units or more of lysergic acid diethylamide; [()] () any mixture containing the equivalent of,000 dosage units of lysergic acid diethylamide;

14 SENATE BILL 0 [()] () ounces or more of phencyclidine in liquid form; [()] () grams or more of any mixture containing phencyclidine; [()] () grams or more of methamphetamine; or [()] () any mixture containing grams or more of methamphetamine. (b) For the purpose of determining the quantity of a controlled dangerous substance involved in individual acts of manufacturing, distributing, dispensing, or possessing under subsection (a) of this section, the acts may be aggregated if each of the acts occurred within a 0 day period. (c) () A person who is convicted of a violation of subsection (a) of this section shall be sentenced to imprisonment for not less than years and is subject to a fine not exceeding $0,000. () The court may not suspend any part of the mandatory minimum sentence of years. () Except as provided in 0 of the Correctional Services Article, the person is not eligible for parole during the mandatory minimum sentence.. (a) () In this section the following words have the meanings indicated. () Drug trafficking crime means a felony or a conspiracy to commit a felony involving the possession, distribution, manufacture, or importation of a controlled dangerous substance under 0 through 0 and of this subtitle. () Forfeiting authority means the office or person designated by agreement between the State s Attorney for a county and the chief executive officer of the governing body that has jurisdiction over the assets subject to forfeiture. (b) During and in relation to a drug trafficking crime, a person may not: 0 () possess a firearm under sufficient circumstances to constitute a nexus to the drug trafficking crime; or () use, wear, carry, or transport a firearm. (c) () In addition to the sentence provided for the drug trafficking crime, a person who violates subsection (b) of this section is guilty of a felony and on conviction is subject to:

15 SENATE BILL (i) for a first violation, imprisonment for not less than years and not exceeding 0 years; or (ii) for each subsequent violation, imprisonment for not less than years and not exceeding [0] 0 years. () (i) The court shall impose a minimum sentence of years under paragraph ()(i) of this subsection. (ii) The court shall impose a minimum sentence of years under paragraph ()(ii) of this subsection. sentence. () (i) A court may not suspend any part of a mandatory minimum 0 (ii) Except as provided in 0 of the Correctional Services Article, a person sentenced under this subsection is not eligible for parole. (iii) A sentence imposed under paragraph ()(ii) of this subsection shall be consecutive to and not concurrent with any other sentence imposed by virtue of the commission of the drug trafficking crime. (d) () (i) In this subsection, firearm silencer means a device that is designed for silencing, muffling, or diminishing the report of a firearm. (ii) Firearm silencer includes a combination of parts designed, redesigned, or intended for use in assembling or fabricating a firearm silencer or muffler. () A court shall double the minimum mandatory sentence provided in subsection (c)()(ii) of this section if the firearm used during and in relation to a drug trafficking crime is: Article; (i) listed in 0 of this article or of the Public Safety (ii) a machine gun; or (iii) equipped with a firearm silencer. 0 (e) () A firearm or ammunition seized under this section is contraband and shall be forfeited summarily to a forfeiting authority. () Unless otherwise prohibited by law or if forfeiture proceedings have begun, the forfeiting authority shall return the seized property to the owner or possessor within 0 days after the date of seizure if: (i) the owner or possessor of the property seized is acquitted; or

16 SENATE BILL (ii) the charges against the person are dismissed. () Unless otherwise prohibited by law, the forfeiting authority shall return the seized property to the owner or possessor promptly if the State: seized; and (i) enters a nolle prosequi against the owner or possessor of property is entered. (ii) does not charge the person within 0 days after the nolle prosequi. (b) A person may not possess, own, carry, or transport a firearm if that person has been convicted of: () a felony under this title; () a crime under the laws of another state or of the United States that would be a felony under this title if committed in this State; () conspiracy to commit a crime referred to in paragraphs () and () of this subsection; or () an attempt to commit a crime referred to in paragraphs () and () of this subsection. (c) A person who violates this section is guilty of a felony and on conviction is subject to imprisonment not exceeding years or a fine not exceeding $,000 or both. 0. (a) A person may not harm another, threaten to harm another, or damage or destroy property with the intent to: () influence a victim or witness to testify falsely or withhold testimony; or

17 SENATE BILL () induce a victim or witness: (i) to avoid the service of a subpoena or summons to testify; (ii) to be absent from an official proceeding to which the victim or witness has been subpoenaed or summoned; or delinquent act. (iii) not to report the existence of facts relating to a crime or (b) A person may not solicit another person to harm another, threaten to harm another, or damage or destroy property with the intent to: () influence a victim or witness to testify falsely or withhold testimony; or () induce a victim or witness: (i) to avoid the service of a subpoena or summons to testify; (ii) to be absent from an official proceeding to which the victim or witness has been subpoenaed or summoned; or delinquent act. (d) A sentence imposed under this section may be separate from and consecutive to or concurrent with a sentence for any crime based on the act establishing the violation of this section. 0. (a) A person may not intentionally harm another, threaten to harm another, or damage or destroy property with the intent of retaliating against: () a victim or witness for: (i) giving testimony in an official proceeding; or

18 SENATE BILL (ii) reporting a crime or delinquent act; () a juror for any reason relating to the performance of the juror s official duties in a pending or completed case in a court of the State or the United States; or () an officer of the court of the State or the United States for any reason relating to the performance of the officer s official duties in a pending or completed case. (b) A person may not solicit another person to intentionally harm another, threaten to harm another, or damage or destroy property with the intent of retaliating against: () a victim or witness for: (i) (ii) giving testimony in an official proceeding; or reporting a crime or delinquent act; 0 0 () a juror for any reason relating to the performance of the juror s official duties in a pending or completed case in a court of the State or the United States; or () an officer of the court of the State or the United States for any reason relating to the performance of the officer s official duties in a pending or completed case. (c) () Except as provided in paragraph () of this subsection, a person who violates this section is guilty of a misdemeanor and on conviction is subject to imprisonment not exceeding [] years or a fine not exceeding [$,000] $,000 or both. (a) A person may not, by threat, force, or corrupt means, try to influence, intimidate, or impede a juror, a witness, or an officer of a court of the State or of the United States in the performance of the person s official duties.

19 SENATE BILL (b) A person may not solicit another person to, by threat, force, or corrupt means, try to influence, intimidate, or impede a juror, a witness, or an officer of the court of the State or of the United States in the performance of the person s official duties. (c) () Except as provided in paragraph () of this subsection, a person who violates this section is guilty of a misdemeanor and on conviction is subject to imprisonment not exceeding [] years or a fine not exceeding [$,000] $,000 or both. () If an act described in subsection (a) of this section is taken in connection with a proceeding involving a felonious violation of Title of this article or the commission of a crime of violence as defined in of this article, or a conspiracy or solicitation to commit such a crime, a person who violates this section is guilty of a felony and on conviction is subject to imprisonment not exceeding [0] 0 years. (d) A sentence imposed under this section may be separate from and consecutive to or concurrent with a sentence for any crime based on the act establishing the violation of this section.. 0 (a) In this section, crime of violence means: () abduction; () arson in the first degree; () kidnapping; () manslaughter, except involuntary manslaughter; () mayhem; () maiming, as previously proscribed under former Article, and of the Code; () murder; () rape; () robbery under 0 or 0 of this article; () carjacking; () armed carjacking; () sexual offense in the first degree;

20 0 SENATE BILL () sexual offense in the second degree; () use of a [handgun] FIREARM in the commission of a felony or other crime of violence; () child abuse in the first degree under 0 of this article; () sexual abuse of a minor under 0 of this article if: (i) the victim is under the age of years and the offender is an adult at the time of the offense; and (ii) the offense involved:. vaginal intercourse, as defined in 0 of this article;. a sexual act, as defined in 0 of this article; 0. an act in which a part of the offender s body penetrates, however slightly, into the victim s genital opening or anus; or. the intentional touching, not through the clothing, of the victim s or the offender s genital, anal, or other intimate area for sexual arousal, gratification, or abuse; () home invasion under 0(b) of this article; () an attempt to commit any of the crimes described in items () through () of this subsection; () continuing course of conduct with a child under of this article; (0) assault in the first degree; () assault with intent to murder; () assault with intent to rape; () assault with intent to rob; () assault with intent to commit a sexual offense in the first degree; and () assault with intent to commit a sexual offense in the second degree.
