2 THE COUNTY COMJ.\IISSION OFIIANCOCK COUNTY ~.WEST VIRGINIA RE: ~L~\~ b ~~)~~ ~ \~~~1i~~\~ ~ ~-\: \J'l\1 PUBLIC HEARING ON ORDINANCE TO INCREASE 911 FEES I ORDER On the 3rd day of March, 2016 at 1:00 p.m. came the Hancock County Commission with all members present including Michael Swartzmiller, President, Jeff Davis and Joe Bamabei, Bob Vidas, Executive Director of Technology & Communications, and as well came Assistant Prosecuting Attorney, Michael W. Lucas III, Esq., for a public hearing on the Ordinance to increase 911 fees. After allowing additional time for members of the public to show, the Commission called the hearing to order at 1: 15 p.m. It was noted that the hearing had been duly noticed in accordance with West Virginia law. No public appeared in opposition to the proposed ordinance; there were no objections and no written objections to said increase received at this hearing. President Swartzmiller did note that Hancock County is the 19th most populous county in the State and is the 18th county in number of calls received. It was also said that other counties are having to raise fees to make up for budget shortfalls. Commissioner Swartzmiller also I pointed out that Hancock County's 911 budget began running short of funds in 2015; however, technically, a shortfall occurred in 2014 but the Commission was able to make up for that shortfall with other surplus funds. The Commission agrees that this pattern cannot continue. Page 1 of2 AN ORDINANCE AMENDING ORDINANCE, THE HANCOCK COUNTY ENHANCED EMERGENCY TELEPHONE SYSTEM RATE PER MONTH PER LOCAL EXCHANGE SERVICE LINE WHEREAS, there has been adopted an Ordinance regarding the establishment of an enhanced emergency telephone system and which imposed a fee for capital improvements or modifications, maintenance and personnel services costs of the said system in Hancock County, West Virginia; and WHEREAS, the Hancock County Commission has experienced increased costs for the provision of an enhanced emergency telephone system; and WHEREAS, the Hancock County Commission has not increased the fee for the monthly rate for each local exchange service line since 2006; and WHEREAS, in the judgment of the Hancock County Commission, it is fiscally necessary and appropriate to modify the rates or fees for consumers of the enhanced emergency telephone system. NOW THEREFORE, THE HANCOCK COUNTY COMMISSION HEREBY ORDAINS AND ORDERS: SECTION 1. This ordinance increased the fee to $4.05 per month per local exchange service line to finance the Enhanced Emergency Telephone System. The ordinance was adopted on March 3, 2016 and the effective date is ninety (90) days upon its passage. This ra~e increase will result in a $2.00 increase per line. I have attached hereto a copy of the Ordinance for your consideration. Please advise me of anything more that is required from Frontier to facilitate this increase. 9 HANCOCK COUNTY COMMISSION ORDINANCE By the County Commission of Hancock County an Ordinance amended under Chapters 7 and 24 of the West Virginia Code. An amended Ordinance of Hancock County providing for amendment of a and the continuation of a fee upon local exchange service consumers to finance a portion of the costs of the Enhanced Emergency Telephone System. WHEREAS, the Hancock County Commission has determined that the installation of a countywide, Enhanced Emergency Telephone System would allow any citizen in Hancock County and the Brooke County portion of the City of Weirton to request emergency fire, police, ambulance and rescue services by simply dialing from any telephone in the County; and WHEREAS, the Hancock County Commission seeks to promote the public health, safety and general welfare of all individuals within the County and the Brooke County portion of the City ofweirton by ensuring all requests for emergency assistance can be channeled through the Public Safety Answering Point to the appropriate emergency service response agency, regardless of whether the caller is located in an incorporated or unincorporated area of the county; and WHEREAS, the Hancock County Commission intends to install and maintain an Enhanced Telephone System that will, upon completion, automatically connect a person dialing within the County to the Public Safety Answering Point and provide prompt information on the location and telephone number from which the call is being made so... that the source of a call for help can be locked in even if a caller is disconnected or unable to communicate with emergency officials; WHEREAS, a copy of the proposal attached hereto was made available for examination by the public at the Hancock County Courthouse, 102 N. 10 COMPREHENSIVE PLAN FOR ENHANCED EMERGENCY TELEPHONE SYSTEM SECTION 1 -DEFINITIONS As used in this ordinance, unless the context otherwise clearly indicates, the following words and phrases shall have the meanings hereinafter set forth: a.) "Public Safety Answering Point (PSAP)" means a facility to which Enhanced Enhanced Emergency Telephone System calls for the county are initially routed for response, and where trained personnel respond to specific requests for Center. b.) "Emergency Services Organization" means the organization established under Article 5, Chapter 15 of the West Virginia Code. d.) "Enhanced Emergency Telephone System" means a telephone system which automatically connects the person dialing to the appropriate Public Safety Answering Point and in which the telephone network system automatically provides personnel receiving the calls, immediately on answering the cal~ information on the location and the telephone number from which the call is being made, and upon direction from the personnel receiving the call routes such call to emergency service providers that serve the location from which the call is made. ambulance, medical, rescue or other emergency services within the County. "Public Safety Unit" means a functional divisions of a public agency which provides firefighting, police, medical rescue or other emergency services. g.) "Public Utility" means any telephone company engaged in providing local exchange telephone service to consumers in Hancock County. h.) "Regulating Agency" means the West Virginia Public Service Commission which, by law, regulates services provided by a public utility and the West Virginia Department of Public Safety which also by law has regulatory authority involving Enhanced Emergency Systems. SECTION 2- TERRITORY INCLUDED IN SYSTEM a.) All territory in the County, including all municipal corporations in the County and the Brooke County portion of the City of Weirton, shall be included in the Enhanced Emergency Telephone System. b.) All emergency service providers serving any portion of Hancock County including all local political subdivisions that currently provide emergency services within the County will participate in the Enhanced Emergency Telephone System. 2 e.) "Public Agency" means the state, and any municipality, county, public district or public authority, which provides or has authority to provide firefighting, police, emergency service by directly dispatching the appropriate emergency provider of transferring the call to the appropriate provider. The Public Safety Answering Points for Hancock County Enhanced System shall be the Hancock County c.) "Emergency Service Provider" means any emergency services organization or public safety unit.
11 SECTION a- PUBLIC SAFETY ANSWERING POINT a.) The Public Safety Answering Point for the Enhanced Emergency Telephone System will be at the following location: 1.) The Hancock County Center located on the first floor of the Hancock County Courthouse, 102 North Court Street, New Cumberland, West Virginia. All Emergency calls originating in the Cities of Chester, New Cumberland and Weirton, including the portion of Weirton which is in Brooke County, and all unincorporated areas of Hancock County will be selectively routed to this PSAP. The PSAP will be in full service 24 hours a day for receiving and dispatching emergency call constantly. b.) The Hancock County Center PSAP will be connected to the Verizon network facilities via dedicated Automatic Number Identification (ANI) trunks and combination voice and data circuits and will serve as the only Public Safety Answering Point for the Hancock County Enhanced Telephone System. c.) Every Emergency Service provider that provides emergency services in the territory of Hancock County (including the emergency service providers providing services to the Brooke County portion of Weirton) is included in the Enhanced Emergency Telephone System. b.) If at any time a call is incorrectly dispatched to an emergency service provider, the provider receiving the call shall either radio the correct local jurisdiction to respond to the call or advise the PSAP personnel to correctly dispatch the appropriate provider. Under no circumstances will the caller be asked to make another call. SECTION 6- SPECIAL SERVICES a.) All telephone utilities providing local exchange service in Hancock County shall ensure, through installing a dial-tone-first option, that all coin-operated telephones in Hancock County are equipped by the public utility or other appropriate entity providing public telephone service to permit a caller to dial and initiate calls to the emergency telephone answering point without first having to insert a coin. SECTION 7- IMPOSmON OF FEES; ADOPTION OF BILLING CONTRACT; ESTABLISHMENT OF SEPARATE E-911 FUND; PAYMENT OF COSTS NOT RECOVERED THROUGH FEE a.) The imposition, pursuant to Section Three-cc, Article One, Chapter Seven (7-1-1-cc) of the West Virginia Code, of a fee of$2.05 per month per local exchange service line is proposed to finance the projected costs of capital installation and maintenance costs of the Enhanced Emergency Telephone system. Such fee is proposed to become effective beginning November 1, b.) The Brooke County Commission will receive the monies for the Brooke County portion of the City of Weirton and in tum will remit the monies to the Hancock County Commission. SECTION 8- TARIFFS, RULES REGULATIONS AND LAWS The final pian will be supplemented and superseded by the applicable tariffs on file with and approved by the Public Service Commission of West Virginia, the rules, regulations and orders of the Public Service Commission of West Virginia, and the laws of the State of West Virginia. Such tariffs, rules, regulations, orders and laws will be deemed incorporated in the final plan as if fully set out therein. SECTION 9-FILING OF REVISED PLAN WITH THE PUBLIC SERVICE COMMISSION AND DEPARTMENT OF PUBLIC SAFETY Upon completion and adoption of the revised plan, the County Commission will send a copy of such plan to the public Service Commission of West Virginia and to the West Virginia Department of Public Safety. 4

SERVICE AGREEMENT Hancock County Commission (Name of Customer) As provided by the Chesapeake and Potomac Telephone Company of West Virginia, this agreement is supplemental to the regular application for telephone service between the undersigned parties and installation of Common Equipment, Central Office Lines and Terminal Equipment to support Automatic Number Identification (ANI) and Selective Routing (SR) as part of E911; with two Public Safety Answering Points (PSAP) Han~.. County with a fully Enhanced 911 Service with CALLS for location identification. (Description and Location of Equipment, Facilities or Service) The period of this agreement shall be for 60 months, provided, however that this agreement may be terminated for non-appropriation of funds as set forth below. If at the customer's request, engineering, manufacturing or installation work once begun is stopped and the installation is not completed, then the customer agrees to reimburse the Telephone Company for all costs, incurred in connection with that part of the work which is done. The Telephone Company shall not bill customer for service until service is provided. The Telephone Company shall provide a CALLS data base prior to the system being put into service. ' l'.., ' BILLING CONTRACT This contract is made this 20th 1989, by and between the Hancock County Commission (the "Commission") and The Chesapeake and Potomac Telephone Company of West Virginia ("C&P"). The parties hereby agree as follows: 1. C&P shall act as the billing agent within its franchise service area in Hancock County for the Commission for the billing of the fee imposed by the Commission for the capital, installation and maint~nance costs, including recurring maintenance and dispatcher costs, of the enhanced emergency telephone system of Hancock County. 2. C&P's duties as billing agent shall be as follows: a. The enhanced emergency telephone system fee shall appear on the monthly bills C&P issues to its customers within its franchise service area in Hancock County, beginning with the ~):..lls dated October 1, The amount of such fee shall be fifty-five.cents (55 ) per local exchange For purposes of this a "local exchange service line"

In either such case, no interest shall be charged It is expressly understood that a "local exchange service line" shall include and be limited to the following: (1) each residence line; (2) each business line; (3) each semi-public telephone line; (4) each PBX trunk; or (5) each number of Centrex lines equivalent to a PBX trunk. For each fraction of a PBX trunk equivalent, a proportio~ate fraction of the fee shall be billed. b. C&P shall remit to the Commission by the last day of each month all fees collected by it during the preceding month, less the consideration set out in Paragraph 3. In the event the amount remitted is great~r or less than the amount due under this contract, any and all liability under this contract shall be discharged by payment of the remaining amount due or by return of the amount overpaid, whichever the case '

The Commission shall indemnify and hold C&P harmless from and against any claims or suits arising out of, in connection with, or related to the Commission's authority to impose an enhanced emergency telephone system c. In the event a customer of C&P contends either that such fee is not owed by such customer or that such customer is owed a refund of such fee, C&P shall refer the question to the Commission and C&P shall thereafter bill or refrain from billing such fee from such customer as instructed in writing.to do by such Commission. Such writing shall be mailed within five (5) days of the date the question is referred, unless otherwise agreed by the parties in writing_. 3. In consideration for C&P's billing agent services, it shall retain two percent (2%) of the fees collected before remitting the remainder to the Commission. For purposes of this contract, "fees collectad" shall mean the fees billed by C&P less the fees uncollectible, which shall be calculated at C&P's then current rate of uncollectible revenues for intrastate service.
17 a. All notices under this contract shall be fee or the erroneous collection or failure to bill such fee as a result of a good faith mistake on the part of C&P. It is expressly understood that the foregoing indemnification shall include the responsibility to investigate and defend against such claims, including payment of attorney's fees. 5. The Commission shall notify C&P in writing at least ninety (90) days prior to the effective date of any change in the amount of the enhanced emergency telephone system fee. 6. The term of this contract shall be one year. Such term may be extended by the Commission an additional year by giving C&P written notice of such extension within ninety (90) days of the date of expiration of such term. Such term may be extended in a like manner for three (3) more additional years, allowing for a total of four (4) extensions.of one year each. 7. Either party may, at any time, terminate this contract by giving the other party sixty (60) days written notice of such termination.

If any term or condition of this contract is held to be invalid or unenforceable, the emaining terms and conditions of this contlact shall continue in full force and effect. 11. This contract is executed in and shall be
