3 The District Attorney of the County of San Bernardino, by this Information alleges that: COUNT 1 On or about March 19, 2005, in the above named judicial district, the crime of MURDER, in violation of PENAL CODE SECTION 187(a, a felony, was committed by Eric John Estrada and, who did unlawfully, and with malice aforethought murder Raymond Holguin Jr, a human being. "NOTICE: The above offense is a serious felony within the meaning of Penal Code section (c and a violent felony within the meaning of Penal Code section 667.5(c." "NOTICE: Conviction of this offense will require you to provide specimens and samples pursuant to Penal Code section 296. Willful refusal to provide the specimens and samples is a crime." "NOTICE: Conviction of this offense will require you to register pursuant to Penal Code Section (a. Willful failure to register is a crime." It is further alleged as to count(s 1 that the murder of Raymond Holguin Jr was aided and abetted by defendant(s Eric John Estrada and and that Raymond Holguin Jr was a witness to a crime who was intentionally killed for the purpose of preventing his/her testimony in a criminal proceeding, but that said killing was not committed during the commission and attempted commission of the crime to which he/she was a witness, or the victim was a witness to a crime and was intentionally killed in retaliation for his or her testimony in any criminal or juvenile proceeding, within the meaning of Penal Code Section 190.2(a(10. ***** COUNT 2 On or about March 19, 2005, in the above named judicial district, the crime of MURDER, in violation of PENAL CODE SECTION 187(a, a felony, was committed by Eric John Estrada and, who did unlawfully, and with malice aforethought murder Fernando Anthony Gurule, a human being. It is further alleged as to count(s 1, 2 that a principal personally and intentionally discharged a firearm, a handgun, which proximately caused great bodily injury and death to Fernando Anthony Gurule and Raymond Holguin, within the meaning of Penal Code sections (d and (e(1. It is further alleged as to count(s 1, 2 that a principal personally and intentionally discharged a firearm, a handgun, within the meaning of Penal Code sections (c and (e(1. It is further alleged as to count(s 1, 2 that a principal personally used a firearm, a handgun, within the meaning of Penal Code sections (b and (e(1. It is further alleged as to count(s 1, 2 that the offenses charged in counts 1 and 2 are a special circumstance within the meaning of Penal Code Section 190.2(a(3. It is further alleged pursuant to Penal Code section 190.2(a(22, as to Count(s 1 and 2 that the defendant(s Eric Estrada and intentionally killed Fernando Anthony Gurule and Raymond Holguin while the defendant(s were active participants in a criminal street gang and the murder was carried out to further the activities of the criminal street gang. "NOTICE: The above offense is a serious felony within the meaning of Penal Code section (c and a violent felony within the meaning of Penal Code section 667.5(c."
