1 ' ~ ~ s ~, '''~ ~.._,,r......,.!"-~ ~ FIRST ADDENDUM TO AGREEMENT BY AND BETWEEN THE MARIN COUNTY FLOOD CONTROL AND WATER CONSERVATION DISTRICT AND AECOM/URS CORPORATION THIS ADDENDUM is made and entered into this day of 2015, by and between the MARIN COUNTY FLOOD CONTROL AND WATER CONSERVATION DISTRICT, a political subdivision of the State of California (hereinafter referred to as "District") and AECOM/URS Corporation (hereinafter referred to as "Contractor") RECITALS WHEREAS, the District and the Contractor entered into an agreement for feasibility study and preparing feasibility-level design services for the Phoenix Lake IRWM Retrofit Project dated March 11, 2014 ("Agreement"); and WHEREAS, Section 5 to the agreement obligated Contractor to complete the services by December 31, 2015; and WHEREAS, the parties desire to amend the Agreement to extend the time to complete the services to December 31, NOW, THEREFORE, the parties agree to modify Section 5 as set forth below. AGREEMENT 1. Except as otherwise provided herein all terms and conditions of the agreement shall remain in full force and effect. 2. ~ Updated Certificate of lnsurance(s) attached hereto. 3. Section 5, "TIME OF CONTRACT", the first sentence is hereby amended to read as follows: This Contract shall commence on date this contract is made and entered into, and shall terminate on December 31, IN WITNESS WHEREOF, the parties hereto have executed this Addendum on the day first written above. 2 EXHIBIT "D" DEBARMENT AND SUSPENSION CERTIFICATION TITLE 49, CODE OF FEDERAL REGULATIONS, PART 29 The Contractor, under penalty of perjury, certifies that, except as noted below, he/she or any other person including subcontractors associated therewith in the capacity of owner, partner, director, officer, manager: is not currently under suspension, debarment, voluntary exclusion, or determination of ineligibility by any Federal agency; has not been suspended, debarred, voluntarily excluded or determined ineligible by any Federal agency within the past 3 years; does not have a proposed debarment pending; and has not been indicted, convicted, or had a civil judgment rendered against it by a court of competent jurisdiction in any matter involving fraud or official misconduct within the past 3 years. If there are any exceptions to this certification, insert the exceptions in the following space. Exceptions will not necessarily result in denial of executing contract, but will be considered in determining Contractor's responsibility. For any exception noted above, indicate below to whom it applies, initiating agency, and dates of action. Notes: Providing false information may result in criminal prosecution or administrative sanctions. The above certification is part of the Contract.
