Petitioner believes that Robert Franco has failed to follow the terms of the trust and thus, failed to discharge his fiduciary duties. Objector claims the buyer made $8,000 of improvements to the property and four months later sold it for $97, Objector Lydia Villafana also claims the amount of attorney fees sought by Mr. Sessions is excessive. 5. Trial was initially set for December 16, Trial was continued several times, then a status conference hearing was set to determine it the matter would proceed as a contested matter (objections to final accounting and settlement of estate). The status conference hearing was continued numerous times, through 2009.

46 6. On July 23, 2009, the court ordered the attorney for the administrators to file a written status report, clearly indicating when the estate will come to a close.
