See note above re lack of certainty re will to be probated by this petition. b. Petitioner is a resident of Missouri. This court typically required bond of nonresident representatives even upon waivers. Petitioner alleges that probate estate is unknown. In the present petition, Petitioner states that it would be beneficial to be appointed as administrator pending resolution of the will issues. The right to reside agreement provides for the following: (a) Ms. Mercer would be responsible for all utilities, repairs, upkeep maintenance, insurance, association fees and property taxes. (b) The property owner shall be given the right to reasonable and regular inspections.

Petitioner, Hector Franco, is a child of the original trustors and beneficiary of the Joe R. Franco and Herminia S. Franco Revocable Trust dated 4/5/01. The original trustors died 12/10/07 and 3/8/10. Upon the death of the surviving trustor, Joe Franco, Robert Franco assumed the duties of successor trustee pursuant to the terms of the Trust. Petitioner believes that Robert Franco has failed to follow the terms of the trust and thus, failed to discharge his fiduciary duties. Petitioner requests the court to suspend Robert Franco and appoint petitioner as successor trustee, and to order that all records be turned over. Petitioner also requests the court to order Robert Franco to account for trust assets. 2. The status conference hearing was continued numerous times, through 2009.

46 6. On July 23, 2009, the court ordered the attorney for the administrators to file a written status report, clearly indicating when the estate will come to a close.
