6 MINUTES OF CITY COUNCIL MEETING FEBRUARY 7, Call to order. Meeting was called to order at 6:00 P.M. by Mayor Bert Echterling. 2. Invocation. Jimmy Rogers provided the Invocation. 3. Roll Call. Councilmembers present: Jimmy Rogers, Jeremy Stivener, Vernon Leuschner, Bert Echterling, Jim Mastergeorge, Steve Janics, and Steven Tindell. 4. Approve Minutes from: January 3, 2017: Jeremy Stivener motioned to approve the minutes from the January 3, 2017 meeting as written. Jimmy Rogers seconded this motion. Voting in favor; Rogers, Stivener, Leuschner, Mastergeorge, Janics, Tindell and Echterling. Motion carried unanimously. 5. Citizen Comments. None 6. Consider and possible action on approval for Girl Scout Juniors Troop 7064 to host a recycling event at Peplow Park from 10:00 am to 12:00 pm, and to waive fees for use of the park. Members of Girl Scout Junior Troop 7064 presented Council with a video outlining various tasks in order to achieve their Bronze award. The Troup chose the community problem of recycling, and asked to host an Earth Day event on Saturday, April 22, 2017 at Peplow Park. Councilmember Steve Janics motioned to approve the request as presented, to waive any associated fees, and asked the City to assist with promotional activities. Mayor Pro Tem Jim Mastergeorge seconded this motion. Voting in favor: Rogers, Stivener, Leuschner, Mastergeorge, Janics, Tindell and Echterling. Motion carried unanimously. 7. PUBLIC HEARING: Conduct a public hearing, consider, and possible action on a Preliminary and Final plat for the Crye Addition Block 1 Lot 1 and Block 2 Lots 1-14 in Robinson, Texas. Councilmember Vernon Leuschner recused himself from this item, and exited the Council Chambers. The Public Hearing was opened at 6:09 p.m. Interim Planning Director Barry Lightfoot provided an overview of the Preliminary and Final as presented. Mr. Lightfoot stated the Planning and Zoning Commission met on January 17, 2017, and recommended approval by a vote of 4-0. Julie Henson with 1519 Surveying, LLC, 5054 Franklin Avenue, Waco, Texas 76710, on behalf of the applicant, was available for questions, and respectfully requested approval. After no additional comments, the Public Hearing was closed at 6:11 p.m. Councilmember Jeremy Stivener motioned to approve the Preliminary and Final Plat as presented. Mayor Bert Echterling seconded this motion. Voting in favor: Rogers, Stivener, Mastergeorge, Janics, Tindell and Echterling. Motion carried by a vote of 6-0 with one abstention. 8. PUBLIC HEARING: Conduct a public hearing, consider, and possible action on Ordinance regarding a Comprehensive Plan Map Amendment for property located at 2226 S. Robinson Drive. The Public Hearing was opened at 6:13 p.m. City Manager Craig Lemin provided an overview of the Comprehensive Plan Map Amendment City Council Meeting Agenda February 7, 2017 Page 1 of 4

7 as presented. Mr. Lemin stated the Planning and Zoning Commission met on January 17, 2017, and recommended approval by a vote of 4-0. After no additional comments, the Public Hearing was closed at 6:15 p.m. Councilmember Jimmy Rogers motioned to approve Ordinance as presented. Councilmember Steve Janics seconded this motion. Voting in favor: Rogers, Stivener, Leuschner, Mastergeorge, Janics, Tindell and Echterling. Motion carried unanimously. 9. PUBLIC HEARING: Conduct a public hearing, consider, and possible action on Ordinance regarding a zoning change from R-1 to C-3 for property located at 2226 S. Robinson Drive. The Public Hearing was opened at 6:18 p.m. Interim Planning Director Barry Lightfoot provided an overview of the zoning change. Mr. Lightfoot stated the Planning and Zoning Commission met on January 17, 2017, and recommended approval by a vote of 4-0. After no additional comments, the Public Hearing was closed at 6:19 p.m. Councilmember Jeremy Stivener motioned to approve Ordinance as presented. Mayor Pro Tem Jim Mastergeorge seconded this motion. Voting in favor: Rogers, Stivener, Leuschner, Mastergeorge, Janics, Tindell and Echterling. Motion carried unanimously. 10. (REQUEST TO WITHDRAW BY APPLICANT) PUBLIC HEARING: Conduct a public hearing, consider, and possible action regarding a zoning change from C-3 & R-1 to PUD for property located at 100 S. Robinson Drive identified as the Bethke Addition, Lot 1, Block 1. Mayor Bert Echterling stated the applicant submitted a formal request to withdraw the zoning change. Councilmember Steve Janics made a motion to accept this request. Mayor Bert Echterling seconded this motion. Voting in favor: Rogers, Stivener, Leuschner, Mastergeorge, Janics, Tindell and Echterling. Motion carried unanimously. 11. Consider and possible action on awarding the proposal for Depository Banking Services for the City of Robinson. City Manager Craig Lemin presented this item. Mr. Lemin stated the existing Depository Contract is set to expire on February 28, Requests for Bank Depository Services were published in the Hometown News on December 16, 2016 and December 23, Mr. Lemin stated one proposal was received from Fidelity Bank of Texas, and recommends awarding the proposal to Fidelity Bank of Texas. Mayor Pro Tem Jim Mastergeorge asked how the proposals were distributed. Mr. Lemin stated aside from the two publications, proposals were available online, and sent to local banking establishments as well. Councilmember Vernon Leuschner asked would there ever be a time we would not meet the minimum financial requirement. Mr. Lemin said no. Councilmember Jeremy Stivener motioned to award the proposal for Depository Banking Services to Fidelity Bank of Texas effective March 1, 2017 ending Mar 1, 2020, with the option to extend for two additional one-year terms by mutual consent of both parties. Mayor Pro Tem Jim Mastergeorge seconded this motion. Voting in favor: Rogers, Stivener, Leuschner, Mastergeorge, Janics, Tindell and Echterling. Motion carried unanimously. 8 12. Consider and possible action on Resolution R designating the Waco Tribune- Herald as the official newspaper of publication for the City of Robinson. City Secretary Jana Lewellen presented this item. Mrs. Lewellen stated the City received notice on January 30, 2017 that Heart of Texas Media (formerly Hometown News) was no longer in business, and the City must designate a new official newspaper of publication for the City of Robinson. Mrs. Lewellen stated the Waco Tribune-Herald was currently designated as the City s secondary newspaper, is the only other source available to meet the general circulation requirements, and recommends designating the Waco Tribune- Herald as presented. Councilmember Jeremy Stivener motioned to approve Resolution R as presented. Councilmember Steve Janics seconded this motion. Voting in favor: Rogers, Stivener, Leuschner, Mastergeorge, Janics, Tindell and Echterling. Motion carried unanimously. 13. Consider and possible action granting a water and sewer easement to the City of Waco for sewer lines for the WMARSS system on city property located at 1091 Treatment Plant Road S. 3 rd Street and described as O Campo Tract Acres City Manager Craig Lemin presented this item. Mr. Lemin stated WMARSS is currently undertaking a project to replace an existing lift station on LaSalle and construct a new 54 force main to the WMARSS plant. Mr. Lemin said the plan is for the force main to be located along the western side of property belonging to the City of Robinson. Mr. Lemin said WMARSS is owned by 7 member cities which included Robinson, and the easement is to the City of Waco, as the member cities have selected Waco to operate the WMARSS system. Council expressed concerns regarding the benefit of granting this easement vs. the additional cost to the City of Robinson for its portion to construct the new force main. Council requested staff to go back for additional negotiations. No action taken. 14. Discussion regarding transfer of abandoned well site to Victorious Life Church. City Manager Craig Lemin presented this item. Mr. Lemin stated Mr. Everette Posey, the Business Administrator at Victorious Life Church approached the City regarding a one acre well site located within the church s property. Mr. Posey indicated the site was deeded to the city years ago, for a well to serve the city and subsequently, the church. Mr. Lemin said the Church would like the City to transfer ownership of the lot back to the Church as its location impacts their ability to expand their facilities as they grow. Mr. Lemin stated staff did communicate with TCEQ and we can transfer the ownership of the well and the property to the Church. It would fall to the church to plug the well if required in the future and they are agreeable to it. The consensus of Council was to move forward with compiling the agreement to transfer the abandoned well site as presented. No action taken. 15. Presentation of the Robinson Police Department Annual Racial Profiling Report. Chief of Police Rusty Smith presented the Robinson Police Department Annual Racial Profiling Report as required. 9 16. Councilmember requests for items to be placed on future agendas. Councilmember Jimmy Rogers requested a joint Work Session with the Planning & Zoning Commission to discuss the status of the Zoning Ordinance. Councilmember Jeremy Stivener requested a Work Session to discuss the status of the Street Reclamation Program. Councilmember Vernon Leuschner requested an update on the Waco Industrial Foundation Property. Mayor Pro Tem Jim Mastergeorge requested an update regarding the drought contingency plan as it relates to car washes inside the City limits. Councilmember Steve Janics requested discussion regarding Code Enforcement procedures. Mayor Bert Echterling requested discussion regarding the existing smoking ordinance, drug enforcement in the City of Robinson, and the emergency notification system to include sirens. 17. Adjourn. STAFF RECOMMENDATION: ITEM SUMMARY: This is an opportunity for citizens to address the City Council on matters which are not scheduled for consideration. In order to address the Council, please complete a Speaker s Request Form and submit to the City Secretary prior to the start of the Council meeting. All comments must be directed to the Presiding Officer, rather than an individual Council Member or city staff. Comments are limited to three minutes and must pertain to the subject matter listed on the Speaker s Request Form. Council may not comment publicly on issues raised, but may direct the City Manager to resolve or request the matter to be placed on a future agenda. 12 COUNCIL AGENDA ITEM MEMORANDUM DEPT./DIVISION SUBMISSION & REVIEW: Craig Lemin, City Manager Date Submitted:03/02/2017 Meeting Date: 03/07/2017 Agenda Item #7 ITEM DESCRIPTION: Consider all matters incident and related to the issuance and sale of City of Robinson, Texas, General Obligation Refunding Bonds, Series 2017, including the adoption of an ordinance authorizing the issuance of such bonds, establishing parameters for the sale and issuance of such bonds and delegating certain matters to authorized officials of the City. STAFF RECOMMENDATION: Staff recommends approval. ITEM SUMMARY: We have an opportunity to refund 2007 and 2010 Certificates of Obligation to take advantage of lower interest rates that would provide net savings of approximately $375,000 over the remaining life of the debt. Beginning in 2018, the annual savings would vary from approximately $25,000 to $34,000 each year. A preliminary copy of the statement outlining estimated costs and savings is attached. The actual savings will be based on the rates obtained at the time of issuance. FISCAL IMPACT: Approximately $375,000 in future savings. ATTACHMENTS: Preliminary statement Ordinance Timetable

68 Ordinances Sec Weeds, trash creating fire or health hazard. It shall be unlawful for any person in charge of any premises in the city to allow weeds, grass or brush to grow upon the premises, or trash or rubbish to accumulate upon such premises to such an extent as is reasonably calculated to create a fire hazard or to become injurious to the health of the citizens of the city, and either condition is hereby declared to constitute a public nuisance. With respect to lots, tracts or parcels of land two or more acres under single ownership, the provisions of this section shall not be applicable to the area in excess of 100 feet from any open public street or way, or to the area in excess of 100 feet from any adjacent property under different ownership on which habitable dwellings are located. (Ord. No. 247, III, ) State Law reference Weeds, V.T.C.A., Health and Safety Code Sec Failure to remove filth, unwholesome matter; work done by city. If the work is done or improvement made at the expense of the city, the expense shall be assessed on the real estate or lot upon which such expense was incurred. (Ord. If the owner refuses to comply with the regulations of sections , he shall have ten days after service of such notice to appeal to the municipal court by filing with the municipal court clerk notice of appeal and specifying the grounds therefor. An appeal shall stay all proceedings in furtherance of the action appealed from until a hearing on the appeal is had by the municipal court. (Ord. No. 247, VIII, ) Sec Creation of lien to recover city expenses. If an owner or person in charge of the premises fails or refuses to comply with the notice given by the director of community services pursuant to this article, and no appeal is made, or if the order of the municipal court is not complied with, such nuisance shall be abated by the city. The expenses incurred in abating the nuisance shall be charged against the property and a lien for the amount of the charges, including salary and wages of all employees and reasonable charges for machinery, tools and vehicles used in abating the nuisance, shall be created. Such lien shall be set forth in a statement of the expenses incurred, signed by the mayor, and filed in the deed records of the county, in accordance with V.T.C.A., Health and Safety Code Interest shall accrue on the lien at the rate of ten percent per annum, beginning on the date that work by the city is completed. Payment of all liens created in accordance with this article shall be made to the city secretary. For payments made subsequent to the filing of the lien, to the county clerk, an appropriate release will be prepared, and the mayor is hereby authorized to sign all such releases for the city. Suit may be filed by the city for the collection of any liens so created and a foreclosure had in the name of the city. The statement of the mayor shall be prima facie proof of the amount of money expended to abate any accumulation of stagnant water, or for the removal of any carrion, filth or other impure or unwholesome matter, or to abate any accumulation of grass, weeds, brush, trash or rubbish that constitutes a public nuisance. (Ord. No. 247, IX, ) Sec Penalty. Failure of the owner or occupant to cut weeds, grass or brush, or to remove trash, rubbish or filth, or to remedy any unsanitary condition when notified to do so by the city secretary under the provisions of this article shall be punished as provided in section 1-7, and each day that such nuisance shall continue after such time for abatement as set out in this article has been given shall constitute a separate offense. 70 Sec Definition of junked vehicle. In this article, the term junked vehicle shall mean a vehicle that is self-propelled and: (1) Does not have lawfully attached to it: an unexpired license plate, and is: (2) Wrecked, dismantled or partially dismantled, or discarded; or (3) Inoperable and has remained inoperable for more than: a. Seventy-two consecutive hours, if the vehicle is on public property; or b. Thirty consecutive days, if the vehicle is on private property (Ord. No , 1, ) Cross reference Definitions generally, 1-2. Sec Nuisance declared. (a) A junked vehicle, including a part of a junked vehicle, that is located in a place where it is visible from a public place or public right-of-way is detrimental to the safety and welfare of the general public, tends to reduce the value of private property, invites vandalism, creates fire hazards, constitutes an attractive nuisance creating a hazard to the health and safety of minors, and produces urban blight adverse to the maintenance and continuing development of the city, and is a public nuisance. (b) Section of the Transportation Code declares a junked vehicle or part thereof visible from a public place or public right-of-way a public nuisance, which declaration is adopted in this article. (Ord. No , 1, ) Sec Recognition of statutory offense. (a) A person commits an offense under the Transportation Code when he or she maintains a junked vehicle or vehicle part in a manner declared a public nuisance. [Source Law: , , Transportation Code]. Section of the Transportation Code makes such an offense (misdemeanor) punishable by a fine not to exceed $ (b) Section (c) of the Transportation Code requires the court in which the case is tried to order abatement and removal of the nuisance upon conviction. (Ord. No , 1, )

71 Sec City procedures for abating nuisance. (a) Procedures. The following procedures for the abatement, removal and disposal of a junked vehicle or a part of a junked vehicle maintained as a public nuisance are adopted by the city. These procedures conform to the requirements of Chapter 683, Subchapter E of the Texas Transportation Code. (1) Notice. Prior to the abatement and removal of the public nuisance, the chief of police or his designee shall provide not less than ten days' written notice of the nature of the nuisance, which notice must be personally delivered, mailed by certified mail with a five-day return requested, or by U.S. Mail with signature confirmation to: a. The last known registered owner of the nuisance; b. Each lienholder of record of the nuisance; c. The owner or occupant of: 1. the property on which the nuisance is located; or 2. if the nuisance is located on a public right-of-way, the property adjacent to the right-of-way. The notice must state that: the nuisance must be abated and removed not later than the tenth day after the date on which the notice was personally delivered or mailed; and any request for a hearing must be made before that ten-day period expires. If the post office address of the last known registered owner of the nuisance is unknown, notice may be placed on the nuisance or, if the owner is located, personally delivered. If the notice is returned undelivered, action to abate the nuisance shall be continued to a date not earlier than the 11th day after the date of the return. (2) Hearing. a. If a hearing is requested by a person to whom notice is required to be sent in accordance with (a)(1) above, the hearing shall be held not earlier than the 11th day after the date of service of the notice. A request for a hearing shall be made in writing to the municipal court. b. The judge shall set a date and time for the hearing, and shall notify the requestor, and all persons entitled to notice under (a)(1) above, of the date and time for such hearing, and the location of the hearing. If the address of persons entitled to notice under (a)(1) above is not available, such notice may be otherwise delivered or posted in accordance with (a)(1) above.

72 c. The judge shall hear the matter at the location, date and time noticed, unless changed by agreement or necessity with notice to the requestor, and shall, based on the information presented by the city representative(s) and the requestor (or any other person with a legal or equitable interest in the matter) at the hearing, make a determination of whether the vehicle or vehicle part is a public nuisance as set forth in this article. d. Pursuant to (c) of the Transportation Code, it is presumed that the vehicle or vehicle part is inoperable unless demonstrated otherwise by the owner. e. If the judge finds that the vehicle or vehicle part is a public nuisance as set forth in this article, he/she shall enter an order making such finding, ordering the owner of the vehicle or vehicle part, or owner or occupant of the private premises where the vehicle or vehicle part is located, as the case may be, to abate the public nuisance by removing or causing the removal of the same, and directing that if such public nuisance is not abated within ten days of the order that the chief of police, or someone acting under his direction, remove or cause to be removed the vehicle or vehicle part from the public or private property. f. The order shall be in writing, and must include, if available at the location of the nuisance, the following: 1. vehicle description; 2. vehicle identification number; and 3. License plate number. A copy of the order shall be mailed by certified mail to all known persons entitled to notice under (a)(1) above, or otherwise provided or posted in accordance with (a)(1) above if the address is unknown. (Ord. No , 1, ) Sec Entry onto premises. Pursuant to (e) of the Transportation Code, the chief of police or his/her authorized agent(s) may enter private property to examine a public nuisance, to obtain information to identify the nuisance, and to remove or direct the removal of the nuisance in accordance with this article. (Ord. No , 1, ) Sec Removal. (a) Removal of the nuisance shall be carried out, or caused to be carried out, by the chief of police or his/her authorized agent(s), in accordance with this article, and any judicial orders issued hereunder.

73 (b) The chief of police or other authorized city official shall give notice to the Texas Department of Transportation identifying the vehicle or vehicle part not later than the fifth day after the date of removal. (c) A junked vehicle or part may not be reconstructed or made operable by the city after it is removed. (d) Nothing herein shall be construed to affect laws or regulations permitting the immediate removal of a motor vehicle or part left on public property which constitutes an obstruction to traffic or a danger to the traveling public. (e) Junked motor vehicles or vehicle parts may be disposed of in accordance with this article. (Ord. No , 1, ) Sec Disposal. The chief of police, or his/her authorized agent(s), may dispose of or cause the disposal of the junked motor vehicle or vehicle part by removal to a scrapyard, a motor vehicle demolisher, or a suitable site operated by the city, or as otherwise provided by chapter 683, subchapter E of the Transportation Code, or amendments or recodifications thereof. (Ord. No , 1, ) Sec Removal to a non-complying location not abatement. In accordance with the authority provided by of the Transportation Code, the relocation of a junked vehicle or vehicle part that is a public nuisance to another location in the city after a proceeding for abatement and removal of the public nuisance has commenced by notice has no effect on the proceeding if the junked vehicle or vehicle part constitutes a public nuisance at the new location. (Ord. No , 1, ) DIVISION 6. - SUBSTANDARD BUILDINGS Sec Generally. (a) General. Any building, structure or portion thereof, including any dwelling unit, guest room or suite of rooms, or premises on which the same is located in which there exists any of the following listed conditions is a substandard building as defined in section of this article: (1) Lack of, or improper water closet, lavatory, bathtub or shower in a dwelling unit.

74 (2) Lack of, or improper window screens as necessary to prevent the entry of insects. (3) Lack of, or improper kitchen sink in a dwelling unit. (4) Lack of hot and cold running water to plumbing fixtures in a dwelling unit. (5) Lack of adequate heating facilities. (6) Lack of, or improper operation of required ventilating equipment. (7) Lack of minimum amounts of natural light required by the building codes. (8) Room and space dimensions less than required by the building codes. (9) Lack of required electrical lighting. (10) Dampness of habitable rooms. (11) Infestation of insects, vermin, reptiles, or rodents as determined by the health officer or his designee. (12) General dilapidation or improper maintenance. (13) Lack of connection to required sewage disposal system. (14) Deteriorated or inadequate foundations. (15) Defective or deteriorated flooring or floor supports. (16) Flooring or floor supports of insufficient size to carry imposed loads with safety. (17) Members of walls, partitions, or other vertical supports that split, lean, list, or buckle or which allow moisture penetration due to defective material or deterioration. (18) Members of walls, partitions, or other vertical supports that are of insufficient size to carry imposed loads with safety. (19) Members of ceilings, roofs, ceiling and roof supports or other horizontal members which sag, split, or buckle or which allow moisture penetration due to defective material or deterioration. (20) Members of ceilings, roofs, ceiling and roof supports, or other horizontal members that are of insufficient size to carry imposed loads with safety. (21) Fireplaces or chimneys that list, bulge, or settle, due to defective material or deterioration.

75 (22) Fireplaces or chimneys that are of insufficient size or strength to carry imposed loads with safety. (23) Electrical wiring. All wiring, except that which conformed with all applicable building codes and laws in effect at the time of installation and which has been maintained in good condition and is being used in a safe manner. (24) Hazardous plumbing. All plumbing, except that which conformed with all applicable building codes and laws in effect at the time of installation and which has been maintained in good condition and which is free of cross connections and siphonage between fixtures. (25) Hazardous mechanical equipment. All mechanical equipment, including vents, except that which conformed with all applicable building codes and laws in effect at the time of installation and which has been maintained in good and safe condition. (26) Faulty weather protection. Weather protection that shall include, but not be limited to the following: a. Deteriorated, crumbling or loose plaster. b. Deteriorated or ineffective waterproofing of exterior walls or roof. c. Defective or lack of weather protection for exterior wall coverings, including lack of paint or weathering due to lack of paint or other approved protective covering. d. Broken, rotted, split, or buckled exterior wall coverings or roof coverings. (27) Fire hazard. Any building or portion thereof, device, apparatus, equipment, combustible waste, or vegetation which, in the opinion of the fire marshal or his deputy, is in such a condition as to cause a fire or explosion or provide a ready fuel to augment the spread and intensity of fire or explosion arising from any cause. (28) Faulty materials of construction. All materials of construction, except those which are specifically allowed or approved by this article and the building codes and which have been adequately maintained in good and safe condition. (29) Hazardous or unsanitary premises. Those premises on which an accumulation of weeds, vegetation, junk, dead organic matter, debris, garbage, offal; insects, vermin, reptiles and/or rodent harborages; stagnant water, combustible materials, and similar materials or conditions which constitute fire, health, or safety hazards. (30) Inadequate maintenance. Any building or portion thereof that is determined to be an unsafe building as a result of improper or inadequate maintenance. (31) Inadequate exits. All buildings or portions thereof not provided with adequate exit facilities as required by the Building Codes, except those buildings or portions thereof whose exit facilities conformed with all applicable laws at the time of their construction and which have been adequately maintained and increased in relation to increase in occupant load, alteration or

76 addition, or any change in occupancy. When an unsafe condition exists through lack of or improper location of exits, additional exits may be required to be installed. (32) Inadequate fire protection or fire fighting equipment. All buildings or portions thereof which are not provided with the fire-resistive construction or fire-extinguishing systems or equipment required by this article, except those buildings or portions thereof which conformed with all applicable laws at the time of their construction and whose fire-resistive integrity and fire-extinguishing systems or equipment have been adequately maintained and improved in relation to any increase in occupant load, alteration or addition, or any change in occupancy. (33) Improper occupancy. All buildings or portions thereof occupied for living, sleeping, cooking or dining purposes that are not designed or intended to be used for such occupancies. (Ord. 77 Overview This is guide line for the steps used while enforcing codes. The first step is the property is inspected for violation, after receiving a complaint or witnessed while driving around the town looking for violations. Then depending on the severity of the violation a tag notifying the resident of the violation is put on the door, or they are sent a letter. Afterwards the owner s name and address are entered into MYGOV for documentation of the violation, prior to MYGOV it was entered into Incode. The letter notifies them of all code violations and gives the owner 10 days to correct the violations. After 10 days if the violations have not been fixed, Pictures are taken of the violations and the complaint is filed with the court. After the court process is over with the owner is given 1-2 weeks to correct the violations. If after 1-2 weeks the Owner has not corrected the violations then a new complaint is filed with the court. The letters sent out are good for a year so the court process could continue for up to a year, before a new letter must be sent out. If the owner is unreachable and the property has violations, the city then takes care of violations and places a lien on the property. Liens vary from a minimum of $200 to maximum of $2,000 dollars. The lien value is accessed by man hours and equipment used, along with any additional things that it may take to get the property in order, such as putting rat traps out or mosquito pellets are an example of additional things that do not have to happen often. If it is a building or home that is in violation of being considered a substandard building, the owner receives a Substandard building letter which gives them 30 days to fix the violations. After the 30 days it is then sent to the Substandard building committee. There is a very specific process that must be followed. In 2012 the Texas Supreme Court issued a decision that significantly impacted this process. A paper outlining the changes and process to be followed is attached. The list below is some of the most common code violations and their definition, along with how many letters that have been sent out so far in This list is not all of the potential violations, just the most common. So far 95 of these cases have been sent to court this year. The city has abated 32 properties since January 1st. Abatements It should be noted that property abatement is done as a last resort by the city. Every available action is taken to contact an owner or family member of the owner of the property. All abatements are done on abandoned properties, whose owner has either passed away or moved away and is unreachable. Anytime the owner is reachable the property is sent to court PROPERTIES ABATED STARTING JANUARY 2016= 30 1 Property Required extensive labor. 5 labor hands, 1 bobcat, and 1 dump truck. 78 The rest of the properties require a mower and a weed eater. And a few times a shredder. The range for the mowing lien is $200-$400 depending on lot size. The total estimated amount of liens = $10,200 In 2017 the mowing cost spread sheet will allow for 100% accuracy in total liens filed. 82 VOLUNTEER SERVICE TO THE ROBINSON COMMUNITY The City of Robinson today is a product of the efforts invested by many dedicated residents who have worked hard to enhance the quality of life for the city. The investment was made by caring, dedicated citizens who invested their time, energy, expertise, and vision. The city government of Robinson is overseen by the most basic grassroots level which allows citizens the opportunity to participate in shaping the future of the city. City Council members, all whom are volunteers, seek residents to apply for board/commission positions, who would like to serve the City of Robinson and play an important role in the future of the city. Any interested candidate seeking appointment to a board/commission is expected to become familiar with the duties and responsibilities for that board/commission. It is highly encouraged that the candidate also attend one of the meetings held by the board/commission they are seeking appointment to. There are currently 3 established boards and commission for the City of Robinson: The Building Standards Commission has the authority to hear and determine cases concerning alleged violations of City ordinances related to building codes, including the minimum housing code; conditions covered by accumulation of matter that creates unsanitary and unhealthy conditions; and serves as an advisory board to the city council to review and recommend ordinances and associated amendments. The Building & Standards Commission s final decisions may be appealed to the state district court by filing a petition with the district court within 30 calendar days after the date a copy of the final decision of the commission is mailed. The commission shall have at least one regular meeting each calendar year. Special meetings of the commission shall be called by the chairman of the commission or upon written request of three members of the commission. The city manager may also request a special meeting in coordination with the building official and/or code enforcement officer. Meetings are normally held on the second Tuesday of the month. The commission shall be composed of five regular members and four alternate members appointed by the city council. All members of the board shall reside within the corporate limits or within the extraterritorial jurisdiction of the city during the time in which they serve on the board. The Planning & Zoning Commission acts on a wide variety of issues including zoning, platting of subdivisions, special use permits, long range planning and development, etc. The Commission also conducts public hearings which might be required for citizen input, and develops and recommends planning and zoning amendments to the City Council when appropriate. The commission shall hold, at a minimum, quarterly meetings and report to the Council quarterly. Meetings are held on the third Tuesday of the month at 6:00 p.m. The commission shall be composed of five regular members appointed by the city council. All members of the board shall reside within the corporate limits or within the extraterritorial jurisdiction of the city during the time in which they serve on the board. The Zoning Board of Adjustment hears and makes a decision including appeals that allege error in a violation made by an administrative official, on special exceptions to the terms of a zoning ordinance, authorization of a variance from the terms of a zoning ordinance, and other matters authorized by an ordinance.
