He has a particular focus on regulatory, public and human rights, and competition law. He regularly appears in the Chancery Division, the Administrative Court, and in specialist tribunals including in particular the Competition Appeal Tribunal. In addition, Tristan is appointed to the Government Legal Panel C. EXPERIENCE EU & Competition Tristan is regularly engaged in EU and competition matters, both commercial and regulatory. 3 Public & Regulatory Tristan regularly acts and advises in public law and regulatory matters. He acts for a wide variety of clients, including individuals, corporate claimants, charities, and government bodies. Tristan has advised, among other matters, on the proper conduct of regulatory investigations, challenges to licensing decisions in the pharmaceutical and energy industries, complaints against broadcasters and advertisers, the drafting and implementation of new legislation and regulatory frameworks, freedom of information and data protection, conflicts of interest policies, the duties of regulators in the conduct of litigation, discrimination law, and the lawfulness of particular decisions. He is intelligent, hard-working and his advice is thorough, reflecting that he has diligently perused all of the papers down to the minute details. Professional Discipline Tristan advises and acts for parties in disciplinary proceedings in a variety of tribunals and in the High Court. He has advised and acted for individuals and regulatory bodies. He is well prepared, gives sound advice and deals with experts well. CHAMBERS UK, 2016 Confidential As Secretary to the Ethics Commission of the International Association of Athletics Federations, Tristan was involved in considering potential breaches of the IAAF Code of Conduct. Confidential Tristan has acted as counsel to the General Dental Council in proceedings against registered dentists. Confidential Tristan s recent professional disciplinary work has also included acting for Mr Holland, a student at the University of Cambridge, in his 2012 appeal against a sanction imposed for a student protest, which raised questions of the right to free speech in an educational context (led by Michael Beloff QC). Employment Tristan acts for claimants and respondents in employment disputes in Employment Tribunals, the Employment Appeal Tribunal and in the High Court. He has represented clients in employment cases including unfair and constructive dismissal, breach of contract, restrictive covenants, TUPE and protected disclosures. He has also represented clients in cases involving various types of discrimination, including disability, race, sex, pregnancy and age. Tristan is the co-author of the Restrictive Covenants chapter in Employee Competition: Covenants, Confidentiality and Garden Leave (Oxford, 2011), and the disability discrimination chapter in Tolley s Discrimination in Employment Handbook (second edition, 2011).

8 Tristan has been instructed as junior counsel on several large but confidential employment matters. These have included an alleged team move case between two inter-dealer brokers, and a breach of contract / restrictive covenant claim brought by a high profile trader against a hedge fund. Tristan has also acted in multi-jurisdictional employment disputes. BAE Systems (Operations) Ltd v Konczak [2017] EWCA Civ 1188 Represented the claimant in case involving apportionment of damages for psychiatric harm. Royal v Loughborough College (County Court, 2016) Represented the respondent in injunctive proceedings. Powell v OMV Exploration & Production Ltd (EAT, 2013) Represented the respondent before the EAT in a claim raising jurisdictional issues. Aiesha v London Borough of Camden (2012) Represented the claimant in a claim for unfair dismissal. Simons-Bourne v Polybags Ltd (2012) Represented the respondent in a claim for unfair dismissal. Inspector Claire Clark v Metropolitan Police Authority [2011] EqLR 1026 Junior counsel for the claimant (with Dinah Rose QC) in a test case on the lawfulness of the arrangements regarding part-time police inspectors pay. Commercial Tristan has advised and appeared in a range of commercial matters, in the county courts, the High Court and in arbitrations. Among other matters, he has appeared in trials, applications for interim relief, applications to strike out or for summary judgment and wasted costs applications. Tristan has advised on and drafted particulars for claims involving breach of contract claims, partnership disputes and claims involving allegations of breach of rules under the Financial Services and Markets Act Tristan has also advised on the application of A1P1 of the European Convention on Human Rights in a commercial law context.
