"Explicit sexual materials", as used in this subsection, means materials which are obscene or: any book, pamphlet, magazine, printed matter however reproduced, or sound recording which contains any matter enumerated in paragraph (1), or explicit and detailed verbal descriptions or narrative accounts of sexual excitement, sexual conduct, or sadomasochistic abuse and which, taken as a whole, is harmful to minors., that is to say the actor, gave the victim explicit, detailed verbal descriptions & narrative accounts of sexual excitement via text messages, in violation of Section 5903 (C)(2) of the Pennsylvania Crimes Code, as amended, 18 Pa.C.S (C)(2). Felony of the third degree D of the 18 1 F3 SEXUAL ABUSE OF CHILDREN SEXUAL ABUSE OF CHILDREN - The Actor, Timothy Rae George III, on or about, July 1 - September 21, 2016, in the County of York, knowingly possessed or controlled a book, magazine, pamphlet, slide, photograph, film, videotape or other material depicting a child under the age of 18 years engaging in a prohibited sexual act or in the simulation of such act, in violation of Section 6312(d) of the Pennsylvania Crimes Code, Act of December 6, 1972, as amended, 18 Pa. C.S. 6312(d) A1 of the 18 1 F3 CONTACT/COMM.W/MINOR-SEXUAL OFFENSES UNLAWFUL CONTACT WITH A MINOR-SEXUAL OFFENSES - The Actor, Timothy Rae George III, on or about, July 1 - September 21, 2016, in the County of York, commits an offense if he is intentionally in contact with a minor for the purpose of engaging in an activity prohibited under any of the following, and either the person initiating the contact or the person being contacted is within this commonwealth: Any of the offenses enumerated in Chapter 31 (relating to sexual offenses)., that is to say the actor, intentionally had contact with the minor in an attempt to have sexual contact with the minor, in violation of Section 6318 (A)(1) of the Pennsylvania Crimes Code, as amended, 18 Pa.C.S (A)(1). 3 A1I of the 18 1 M1 CORRUPTION OF MINORS CORRUPTION OF MINORS - Except as provided in subparagraph (ii), whoever, being of the age 18 years and upwards, by any act corrupts or tends to corrupt the morals of any minor less than 18 years of age, or who aids, abets, entices or encourages any such minor in the commission of any crime, or who knowingly assist or encourages such minor in violating his or her parole or any order of court, commits a misdemeanor of the first degree. The acts committed by the accused, as listed and hereafter, were against the peace and dignity of the Commonwealth of Pennsylvania and were contrary to the Act(s) of Assembly, or in violation of the statutes cited. 5 AFFIDAVIT of PROBABLE CAUSE On , the Northern York County Regional Police Department (NYCRPD) handled an incident involving a juvenile male, DL (Date of birth ). DL resides in Jackson Township, York County. DL was found, by his father, to be having a phone conversation with Tim George. T. George was older than DL and found to be 22 years old. A preliminary investigation found that George had been having phone and text message conversations with DL. George also responded, from Maryland, to spend time with DL at a Spring Grove High School football game. This was captured on the video surveillance at the football stadium. DL advised that he had sent George a video of himself masturbating. This was sent to George's personal cell phone which had # DL's cell phone was forensically examined by Det. Baker with the NYCRPD. DL's cell phone showed conversation between DL and George. There was conversation between the two about exchanging pictures and of DL sending George a video of himself masturbating. Other conversation was found between the two talking about marriage. An interview was done with DL at the York County Children's Advocacy Center (CAC) on Monday, DL disclosed information that would rise to the level of Corruption of Minors as perpetrated upon him by T. George. DL disclosed that he met George on Facebook sometime at the end of August. DL stated that they had a relationship and talked via phone conversation and through Facebook Messenger and phone text. DL advised George knew he was 15 years old. DL advised he sent George a video of himself masturbating and photos of himself, also. DL advised George drove to meet him at the high school football game, where they walked around and watched the football game. A search warrant was applied for and granted for Tim George's cell phone. The search warrant was executed on George's cell phone. Several pictures of DL were found on the phone, as well as a video of DL masturbating. The acts occurred in Jackson Township, York County. Due to the acts described, I request a warrant for the arrest of Timothy Rae George III. T. George HAS NOT BEEN PROCESSED for the charges.
