4 Burden of Proof for Furloughs OPM defines furlough as the placing of an employee in a temporary status without duties and pay because of lack of work or funds or other nondisciplinary reasons. 5 C.F.R ; see 5 U.S.C (a)(5). A furlough of 30 days or less is appealable to the Board as an adverse action. See 5 U.S.C (5). Agency must meet the burden of showing that its actions promoted the efficiency of the service. Agency can meet this burden by demonstrating that the adverse action was a reasonable management solution to financial restrictions and that management selected fairly the employees to furlough. Clark v. OPM, 24 M.S.P.R. 224 (1984). See 5 U.S.C (a); see also 5 C.F.R (b)(2)

8 Recent Significant Cases Kaplan v. Conyers, No (Fed. Cir. 2013) (en banc). The Board lacks jurisdiction to review the merits of an agency s decision to suspend or revoke an employee s eligibility to occupy a sensitive position. no authority to review adverse actions associated with loss of eligibility to hold a non-critical sensitive position. Gargiulo v. DHS, 727 F. 2d (Fed. Cir. 2013). Even though the Board cannot review the merits of a security clearance determination, the Board will still review whether the appellant received due process and whether the agency committed harmful procedural error when it assesses an adverse action. Ward v. USPS, 634 F.3 rd 1274 (Fed. Cir. 2011). When a deciding official receives new and material penalty related information through ex parte communications, the appellant is entitled to a brand new constitutionally correct hearing.
