The Mogale City Local Municipality consists of 39 wards with boundaries as set out in provincial General Notice No. 495 dated 20 November AMENDMENT OF PART 4 5. Part 4 is hereby amended by the substitution therefor of the following Part: PART 4 ESTABLISHMENT OF THE RAND WEST CITY LOCAL MUNICIPALITY 19. For that part of the district municipal area indicated by Map No. DEM4058_2, published under provisional General Notice No of 2013 in Gauteng Provincial Gazette Extraordinary No. 229 dated 8 August 2013, a new local municipality called the Rand West City Local Municipality is hereby established with effect from the effective date. CATEGORY 20. The Rand West City Local Municipality is a Category B municipality as determined by the Demarcation Board in terms of section 4 of the Municipal Structures Act. TYPE 21. The Rand West City Local Municipality is a municipality with a mayoral executive system combined with a ward participatory system as described in section 3(d) of the Gauteng Types of Municipality Act. BOUNDARIES AND AREA OF JURISDICTION 22. (1) The boundaries of the Rand West City Local Municipality are as indicated in Map No. DEM4058_2, published under provisional General Notice No of 2013 in Gauteng Provincial Gazette Extraordinary No. 229 dated 8 August 2013, and attached hereto as Annexure C. (2) The area of jurisdiction of the Rand West City Local Municipality shall be the area falling within the boundaries referred to in subclause (1).

The council of the Rand West City Local Municipality consists of 69 councillors as determined in provincial General Notice No dated 9 October 2015 of whom: (a) 34 must be proportionally elected councillors; and (b) 35 must be ward councillors. FULL-TIME COUNCILLORS 24. Any or all of the following office-bearers may be designated by the council of the Rand West City Local Municipality as full-time councillors: WARDS (a) The Speaker; (b) The Executive Mayor; (c) Members of the Mayoral Committee; (d) The Chairperson of a Committee in terms of section 79; and (e) A single whip. 25. The Rand West City Local Municipality consists of 35 wards with boundaries as set out in provincial General Notice No. 495 dated 20 November EXEMPTIONS 26. The Rand West City Local Municipality is not exempted from any provision of the Municipal Structures Act. SEAT 27. The seat of the Rand West City Local Municipality shall be the offices of the disestablished Randfontein Local Municipality at the corner of Pollock & Sutherland Streets, Randfontein, or the council of the municipality may by resolution decide that the seat of the Rand West City Local Municipality shall be at such other place as it may determine. AMENDMENT OF PART 5 6. Part 5 is hereby repealed.

Amendment of clause 41 Clause 41 is hereby amended: (1) by the substitution of paragraph (c) of sub-clause (2) of the following paragraph: (c) the disestablished Randfontein Local Municipality shall apply to the meeting of the municipality established by clause 19 hereof; and (2) by the deletion of paragraph (d) of sub-clause (2). AMENDMENT OF PART 9 8. Amendment of clause 47 Clause 47 is hereby amended: (1) by the substitution of paragraph (c) of sub-clause (1) of the following paragraph: (c) the municipal manager of the disestablished Westonaria Local Municipality shall be deemed to be the municipal manager of the newly established Rand West City Local Municipality; and (2) by the deletion of paragraph (d) of sub-clause (1). 9. Amendment of clause 48 Clause 48 is hereby amended by the substitution of paragraph (c) of sub-clause (8) of the following paragraph: (c) the disestablished Randfontein Local Municipality shall apply to the appointment and employment of staff to the newly established Rand West City Local Municipality who are appointed after the effective date. 10. Amendment of clause 49 Clause 49 is hereby amended by the substitution therefor of the 49. Notwithstanding the provisions of any applicable law to the contrary and notwithstanding the disestablishment of the

22 22 No. 252 PROVINCIAL GAZETTE, EXTRAORDINARY, 28 JULY 2016 municipalities concerned, but subject otherwise to any relevant provision of this Notice: (a) the 2016/2017 budget of a disestablished municipality shall remain in force until 30 June 2017; (b) the 2016/2017 budget of a disestablished municipality shall insofar as such budget pertains to an area of the new municipality, remain in force until 30 June 2017; and (c) the budgets referred to in sub-clauses (a) and (b) above shall together be deemed to constitute the budget of the new district and the new local municipality until 30 June 2017 and may be adjusted in terms of any applicable law. AMENDMENT OF PART Amendment of clause 58 Clause 58 is hereby amended by the substitution therefor of the 14. The council of the Merafong City Local Municipality consists of 55 councillors as determined in provincial General Notice No dated 9 October 2015 of whom: (a) 27 must be proportionally elected councillors; and (b) 28 must be ward councillors. 12.
