Schedule Acceptance the Trey. Trey to have the force law. Implemention amendments to the Trey. 1. This Act may be cited as the Security Assistance (CARICOM Member Stes) Act In this Act. "Contracting Parties" means the Contracting Parties to the Trey; "Minister" means the Minister responsible for Home Affairs; "Trey" means the Trey on Security Assistance among CARICOM Member Stes concluded among Member Stes the Caribbean Community on 6 July, 2006 St. Kitts and Nevis as set out in the Schedule together with the Protocol to the Trey. 3. The Government Guyana hereby enters into, adopts and adheres to the Trey. 4. The Trey shall have the force law in Guyana. 5.(1) Where an amendment or protocol to the Trey is accepted by the Contracting Parties, the Minister may by Order amend the Schedule for the purpose including the amendment. (2) Where the Schedule is amended in accordance with this section, any reference in this Act or in any other enactment or in any instrument having effect under any such enactment shall, unless the context otherwise requires be construed as a reference to the Trey as so amended. 3 )7 A.D. 2007] SECURITY ASSISTANCE (CARICOM MEMBERS STATES) [No SCHEDULE s.2 lee TREATY ON SECURITY ASSISTANCE AMONG CARl COM MEMBER STATES 3 to )me nee ded lean evis the into, Ity is )rder the ~ with tment tment as a :h '.his V, J THE CONTRACTING PARTIES Reaffirming the decision the Conference Heads Government the CaribbeanCommunityreached its 24th Meeting held in Montego Bay, Jamaica from 2-5 July, 2003, where the Conference was challenged to promote a system regional security to ensure the economic and social integrity Member Stes; Recalling further the First Meeting the Ministerial Sub-Committee on Developing a Regional Resource Mobilision Stregy for Crime Prevention and Security Issues which convened in Kingston, Jamaica, from 9-10 January, 2004; Convinced th the stability and well - being the Caribbean region can best be promoted by mutual cooperion; Wishing to maximize their strength in the interest the defence their Stes and to achieve sustainable social and economic development for their people; Striving to preserve the common heritage their people founded on the principles democracy, liberty the individual and the rule law: HAVE AGREED as follows: Article 1 USE OF TERMS In this Trey, unless the context otherwise requires: "Community" means the Caribbean Community established by the Revised Trey Chaguaramas Establishing the Caribbean Community including the CARICOM Single Market and Economy (CSME) signed Nassau, The Bahamas on 5 July, 2001; "Contracting Parties" means Antigua and Barbuda, The Bahamas, Barbados, Belize; Dominica, Grenada, Guyana; Jamaica; St. Kitts and

4 No. 14] LAWS OF GUYANA [A.D A.[ 4 Nevis, Saint Lucia; St. Vincent and the Grenadines; Suriname; Trinidad and Tobago; and the Regional Security System; "Contracting Stes" means Antigua and Barbuda, The Bahamas, Barbados, Belize; Dominica; Grenada; Guyana; Jamaica; St. Kitts and Nevis; Saint Lucia; St. Vincent and the Grenadines; Suriname; and Trinidad and Tobago; "Co-ordinor" means the Co-ordinor the RSS appointed in accordance with the Trey; "Forces Commanders" means the - (a) Commander the Antigua and Barbuda Defence Force; (b) Commissioner Police the Royal Police Force Antigua and Barbuda; (c) Chief Staff the Royal Bahamas Defence Force; (d) Commissioner the Royal Bahamas Police Force; (e) Chief Staff the Barbados Defence Force; (f) Commissioner Police the Royal Barbados Police Force; (g) Commissioner the Belize Nional Police; (h) Commandant the Belize Defence Force; (i) Chief Police the Commonwealth Dominica Police Force: U) Commissioner the Royal Grenada Police Force; (k) Chief Staff the Guyana Defence Force; (I) Commissioner Police the Guyana Police Force; (m) Chief Staff the Jamaica Defence Force; (n) Commissioner Police the Jamaica Constabulary Force; (0) Commissioner the Royal Saint Christopher and Nevis Police Force; (p) Commander the St Kitts and Nevis Defence Force; (q) Commissioner the Royal Saint Lucia Police Force; (r) Commissioner Police the Royal Saint Vincent and the Grenadines Police Force; (s) Chief Police the Suriname Police Force; (t) Commander in Charge the Suriname Army; (u) Chief Defence Staff the Trinidad and Tobago Defence Force; and (v) Commissioner Police the Trinidad and Tobago Police Service. Thl witl ace "Full command" means the military authority and responsibility a commander to issue orders to his subordines in every aspect military administrion and operions. "Regional Security System" or "RSS" means the Organision 5thday established March by the Trey signed St Georges, Grenada, on the 1996 between Barbados and the Member Stes the Organision Eastern Caribbean Stes;

5 ). ~'- 1 A.D.2007] SECURITY ASSISTANCE (CAR/COM MEMBERS STATES) [No "iname; Idmas, itts and Ie; and,rdance lua and "Security Assistance Mechanism" means the arrangements and the utilizion the support facilities required to expedite the mobilizion, coordinion and deployment resources to respond effectively and in a timely manner to control the thre serious crimes, man-made or nural disasters, and nional and regional crisis; "service personnel" means personnel belonging to or connected with anyone the Forces referred to in the definition "Forces Commanders"; and ''Trey'' means the Trey establishing the Regional Security System signed St. Georges, Grenada on the 5th day March, 1996 by Antigua and Barbuda, Bardados, The Commonwealth Dominica, Grenada, Saint Christopher and Nevis, Saint Lucia and Saint Vincent and the Grenadines. :;e; :orce: Article 2 ESTABLISHMENT There is hereby established a Security Assistance Mechanism th is charged with the execution the tasks and services required to be performed in accordance with this Trey. :e; Police Article 3 OBJECTIVES The objectives the Security Assistance Mechanism are the: lid the (a) efficient and timely response to and management nural and manmade disasters in order to reduce and elimine the harmful consequences there; lefence Police I a pect bli~hed March lision (b) expeditious, efficient mobilision and deployment regional resources in order to manage and defuse nional and regional crises and to comb serious crimes; (c) combing and eliminion thres to nional and regional security, however arising; and (d) preservion the territorial integrity the Contracting Stes.

6 No. 14] LAWS OF GUYANA [A.D A.I 6 ARTICLE 4 EFFECTIVE IMPLEMENTATION Each Contracting Ste shall take all necessary measures, including legislive and administrive measures, to ensure the effective implemention the objectives this Trey within its territory. 1. Se 2. Article 5 JOINT STRATEGIC COORDINATING AND PLANNING COMMITTEE 1. There shall be a Joint Stregic Coordining and Planning Committee (hereinafter called "the Committee") comprising the Co-ordinor the RSS and the Forces Commanders. 2. The Committee shall meet in session as ten as the exigencies the circumstances require. 3. The meetings the Committee shall be chaired by the Contracting Stes on a roting basis in the English alphabetical order. 4. The Committee shall perform the following functions: (a) monitor the availability and readiness the resources for deployment by the Security Assistance Mechanism as required; (b) monitor and advise on the preparedness the Contracting Parties to accommode merial, military and service personnel in times nional crisis; (c) make arrangements for the transportion merial, military and service personnel to receiving Contracting Stes short notice including where necessary arrangements for mandory requisition by the Contracting Parties air and sea transport vessels belonging to prive persons; and 3. see (d) any other function manded by the Contracting Stes which is within the objectives sted in Article the 5. Subject to Article 11, the Committee shall be responsible for mobilising, coordining and deploying the resources the Security Assistance Mechanism in response to a request for assistance by a Contracting Ste Combined operions shall be coordined any suitable place as may be agreed upon by the Committee.

8 No. 14] LAWS OF GUYANA [A.D A 8 (b) arranging and servicing meetings the Security Assistance Mechanism; (c) coordining the operions the Security Assistance Mechanism; (d) submitting annually and the request the Contracting Stes reports on the administrive and operional activities the Security Assistance Mechanism; and (e) taking approprie action in respect any decision taken or directive received from the Contracting Stes. 3. The Coordinor shall submit any informion and prepare any document sending by the Contracting Stes and submit any informion which in his opinion the Contracting Stes ought to be informed. Article 8 THE BUDGET 1. The Contracting Stes may, where the exigencies the Security Assistance Mechanism so require, agree to the preparion a budget in which the quantum or proportion each Contracting Ste contribution is determined. 2. Whenever a request is made for assistance or cooperion from the Security Assistance Mechanism, the receiving Contracting Ste shall meet the financial obligions arising from the rendering such assistance or cooperion. 3. Budget estimes shall on request be prepared by the Coordining Secretari with, where necessary, the assistance a technical committee, for submission to the Committee which shall consider and transmit it to the relevant Contracting Stes for their approval. 4. Supplementary estimes may be prepared and submitted to the Contracting Parties as the exigencies the Security Assistance Mechanism may require. 5. Article 9 AREAS OF COOPERATION 1. The Contracting Parties agree to coopere in the areas and in the manner set out hereunder -

The service personnel a sending Contracting Ste may, with the written consent the receiving Contracting Ste, use reasonable force as and when necessary during operions in the receiving Contracting Ste. the I may y the Article 10 COMMAND, CONTROL AND DISCIPLINE 1. Subject to the laws the requested Contracting Ste - (a) the requesting Contracting Ste shall have responsibility for the operional direction, administrion and logistics requirements all service personnel opering in th Contracting Ste for the purposes agreed by the Stes; and anner (b) the senior ficer a requested Ste shall exercise full command over his service personnel.

10 No. 14] LA WS OF GUYANA [A.D A The responsibilities referred to in paragraph 1 (a) may vest in the requested Contracting Ste based on a request in writing the requesting Contracting Ste for such period as is specifically sted by the requesting Contracting Ste. 3. Service personnel shall be subject to the applicable code discipline in accordance with the law his Ste and the regulions the Force to which he belongs. Article 11 COOPERATION BETWEEN TWO OR MORE CONTRACTING STATES 1. Notwithstanding the provisions any other article, within the spirit and in accordance with the objectives this Trey, any two or more Contracting Stes may- (a) active the Security Assistance Mechanism; and 2. Notwithstanding paragraph 1 the Coordining Secretari and the Coordinor may be required to give relevant support and coopere with the respective Contracting Stes to the extent and for the purposes required. EXCI OTHER Article 12 ARRANGEMENTS Contracting Stes may conclude bileral or multileral agreements with one another on the mters dealt with in this Trey for the purposes supplementing or strengthening its provisions or faciliting the applicion the principles embodied in it. Article 13 JURISDICTION 1. When service personnel a sending Contracting Ste are within the jurisdiction another Contracting Ste, they shall respect the laws, customs and traditions th other Contracting Ste. The courts a Contracting Ste shall have jurisdiction over service personnel another Contracting Ste with respect to fences th are committed by such personnel within the first-mentioned Contracting Ste which are punishable under the law the first-mentioned Contracting Ste. 3.nd in 3tes 4. Article 14 CLAIMS Except as otherwise agreed, the receiving Contracting Party shall: Id the 'ith the (a) not institute any legal proceedings against a sending Contracting Party or its service personnel or other legal entities acting on its behalf; ith one nenting inciples (b) deal with legal proceedings and claims brought by third Parties against a sending Contracting Party or against service personnel or other legal entities acting on its behalf; (c) preserve, save and keep free from harm service personnel the sending Contracting Party or persons or other legal entities acting on its behalf; and (d) compense a sending Contracting Ste or its service personnel or other legal entities acting on its behalf, thl11 the customs in respect deh or injury to such service personnel, damage to or loss equipment or property, or damage to the environment arising within the territory or other area under the jurisdiction or control the sending Contracting Ste in the course providing assistance.

The receiving Contracting Ste shall pay the expenses incurred in accommoding and victualling the service personnel the sending Contracting Party. 2. The medical expenses any service personnel the sending Contracting Ste who needs medical tention - (a) (b) in the receiving Contracting Ste as a result injuries received, or illness occurring during operions or training in th Contracting Ste shall be borne by the receiving Contracting Ste; after having been repried to the sending Contracting Ste as a result injuries or illness referred to in subparagraph (a) shall be borne by the receiving Contracting Ste; and (c) as a result injuries or illness referred to in paragraph (a) which cannot be obtained in either the receiving Contracting Ste or the sending Contracting Ste shall be borne by both Contracting Stes in such proportion as may be agreed upon. 3. The receiving Contracting Party shall pay the operional expenses incurred in respect the transportion and use the resources necessary to mobilize and execute any request made on its behalf. 1. Training may be conducted on a collective or individual basis. 3. The Committee shall be responsible for all training initiives undertaken by virtue this Trey. Article 17 SETTLEMENT OF DISPUTES In the case a dispute between two or more Contracting Parties reling to the interpretion or applicion this Trey, the Contracting Parties shall consult together with a view to the settlement the dispute by negotiion, enquiry, mediion, conciliion, arbitrion or other peaceful means their own choice prior to the initiion any judicial process. This Trey shall enter into force on the day th it is signed by two Member Stes the RSS, the RSS and two other Contracting Parties. 2. This Trey shall cease to be in force in respect a Contracting Party on the day specified by notice in writing to the other Contracting Parties; such notice to be given least six months before the de specified in the notice. 3. 16 No. 14] LAWS OF GUYANA 16 [A.D PROTOCOL TO THE TREATY ON SECURITY ASSISTANCE AMONG CARICOM MEMBER STATES RELATING TO THE ESTABLISHMENT OF THE CARICOM OPERATIONS, PLANNING AND COORDINATING STAFF (COPACS) Contracting Parties to the Trey on Security Assistance Among CARICOM Member Stes, Recalling Article 2 the Trey which established the Security Assistance Mechanism and Article 3 which set out the objectives the Mechanism including the "expeditious, efficient mobilision and deployment regional resources in order to manage and defuse nional and regional crises and to comb serious crimes"; Recalling further Articles 5 and 6; and Recognizing th the Community may have the need on occasion to mobilize forces under a single command in relion to the management a single incident or event; Agree as follows: Article 1 Interpretion In this Protocol, unless the context otherwise requires: "Conference" means the Conference Heads Government the Caribbean Community established by Article the Revised Trey Chaguaramas Establishing the Caribbean Community including the CARICOM Single Market and Economy; "Contracting Ste" shall have the meaning ascribed to it in the Trey; "COPACS" means the CARICOM Operions. Planning and Coordining established by Article 2; Staff "Regional Operions Commander" means the Regional Operions Commander appointed in accordance with Article 3; "Security Assistance Mechanism" shall have the meaning ascribed to it in the Trey;

Article 2 Establishment COPACS 1. Notwithstanding Articles 5 and 6 the Trey, the Contracting Stes hereby establish the CARICOM Operions, Planning and Coordining Staff, which shall have the functions specified in Article COPACS shall be temporary in nure and shall be convened by the Conference as and when required and for such period as determined by the Conference. 3. The Conference may assign any function or responsibility under the Trey to the Regional Operions Commander during the period th COPACS is convened. Article 3 Regional Operions Commander 1. 18 No. 14] LA WS OF GUYANA [A.D (b) seeking to ascertain the quantum and availability the resources in the territories the Contracting Stes which may be identified for use by the Security Assistance Mechanism; (c) preparing and implementing a Resource Mobilision Plan for the approval the Conference; (d) (e) (f) (g) preparing and implementing a Plan in relion to all security reled aspects the event or incident for which it was convened; as directed by the Conference, acting as the focal point for relions with governments third Stes and representives competent internional organisions on issues reling to its establishment; preparing a draft budget for its activities in relion to the incident or event for which it was convened; performing any other function manded by the Conference within the scope its establishment pursuant to paragraph 2 Article COPACS shall establish a Regional Operions Coordining Centre as required to be the Operional Headquarters under the command the Regional Operions Commander, in order to execute the Plan specified in subsection (c) paragraph 1 and reled mters. Article 5 Security Assistance Mechanism Nothing in this Protocol shall prevent any Contracting Party to the Trey from activing the Security Assistance Mechanism as provided in the Trey in relion to any incident or event for which COPACS does not have authority. Article 6 Entry into Force and Terminion 1. This Protocol shall be open for signure by any the Contracting Parties and shall enter into force upon signure by three such Contracting Parties. 2. This Protocol may be termined by the agreement all parties hereto and in any event shall be termined immediely upon the terminion the Trey, but terminion the Protocol alone shall not otherwise affect the operion the Trey. c
