Subordinate legislation (regulations and rules) A. Subordinate legislation notified on the Queensland Legislation website on 12 December SL No.295 of 2014: Environmental Offsets Legislation Amendment Regulation (No.1) 2014 As stated in its explanatory notes, this regulation progresses a second round of Greentape Reduction reforms to reduce costs to business and government while maintaining high environmental standards. In general terms, it supports the provisions of the Environmental Protection and Other Legislation Amendment Act Again in general terms as listed in its explanatory notes, it introduces further initiatives to reduce green tape for business by: prescribing matters of environmental significance that may be subject to an environmental offset decision made by local government establishing which duplicated offset condition imposed by state and local government may be removed establishing dispute resolution processes to support new administrative decisions made under the Environmental Offsets Act 2014 correcting minor errors and omissions and updating cross-referencing to other legislation.

4 6 12 December 2014 page 4 In particular, this regulation amends the Environmental Offsets Regulation 2014 by: amending s5 (Prescribed environmental matters Act, s10) amending s6 (Environmental offsets policy Act, s12) replacing s7 (Legally secured offset areas Act, s29) amending s8 [Requirements for offset delivery plans Act, s18(4)(c)] amending s9 (Matters administering agency to have regard to Act, s19) replacing s10 [Requirements for financial settlement offsets Act, s24(2)(b)] amending s13 (Meaning of decision-maker) amending s16 (Definitions for pt7) inserting a new provision, namely, s16a (Agreed delivery arrangement not entered into is taken to be reviewable decision) amending s18 (Requirements for making application) amending s20 (Stay of operation of particular reviewable decisions) inserting two new provisions, namely: s36 (Administering agency to apply to for removal of particular duplicate offset condition) s37 [Non-juvenile koala habitat tree prescribed as relevant for Act, s15(4)] amending Schedule 1 (Activities prescribed for section 9(c) of the Act) amending Schedule 2 (Prescribed environmental matters matters of State environmental significance) amending Schedule 3 (Dictionary). In addition, the regulation also amends s4 (Provision about South East Queensland Koala Conservation State Planning Regulatory Provisions) of the Environmental Offsets (Transitional) Regulation Further details on the policy objectives and how each amendment achieves those policy objectives are included in the section headed Notes on Provisions in the explanatory notes for this regulation. Pursuant to s2 (Commencement), this regulation commences on 19 December SL No.296 of 2014: Building Fire Safety Amendment Regulation (No.1) 2014 As described in its explanatory notes, this regulation: effects a reduction in regulatory burden by: removing the role of evacuation coordinator as it serves no tangible fire safety purpose removing the requirement for fire and evacuation plans to be stored in a way not likely to be damaged by fire as the additional current requirement for a copy of the plans to be stored on other premises is considered sufficient for this purpose exempting buildings smaller than 300m 2 from the requirement to display evacuation signage as the entry and exit points of such buildings are readily identifiable in the absence of such signage limiting the right of access to fire and evacuation plans to persons with a demonstrable interest enhances safety in the event of an evacuation by introducing a requirement that evacuation diagrams be oriented in the direction of egress from a building clarifies times for compliance by removing the words as soon as practicable but from a number of obligation provisions and stating only the time within which compliance must occur.

5 6 12 December 2014 page 5 In particular, this regulation amends the following provisions of the Building Fire Safety Regulation 2008: s17 (Meaning of evacuation coordination procedures s21 (General requirements) s23 (Requirements for secondary occupiers) s26 (Accessing a fire and evacuation plan) s27 (Changing a fire and evacuation plan) s30 (Evacuation signs and diagrams to be displayed) s32 (Fire and evacuation instructions) s35 (General evacuation instructions) s36 (General requirements) s38 (General requirements) s39 (Requirements for instructing new persons) s40 (Requirements for new occupiers) s48 (Signs to be displayed in accommodation units) s71 (Keeping plans and other particular documents) s72 (Retention and transfer of prescribed documents) Schedule 3 (Dictionary). It also omits s42 (Compliance by occupiers of particular low occupancy buildings) of the Building Fire Safety Regulation SL No.297 of 2014: Births, Deaths and Marriages Registration Amendment Regulation (No.1) 2014 The objective of this regulation is to amend the Births, Deaths and Marriages Registration Regulation 2003 so that it no longer prescribes the registration number, that is, as defined in Schedule 4 of that regulation, the number assigned to an event when the event is entered in the register, as a particular that must be contained in commemorative birth certificates, commemorative marriage certificates or commemorative registered relationship certificates (which documents are intended to be for the personal use of recipients and are not to be used for official purposes). The reason given for this measure in the explanatory notes is that the removal of the registration number will limit the risk that commemorative certificates will be accepted and relied on by service providers for proof of identity and other official purposes. For this purpose, this regulation amends the following provisions of the Births, Deaths and Marriages Registration Regulation 2003: s16 (Information for commemorative birth certificate) s17a (Information for commemorative marriage certificate) s17b (Information for commemorative registered relationship certificate).

SL No.298 of 2014: Proclamation commencing remaining provisions of the Appropriation Act (No.2) 2014 By a proclamation signed on 11 December 2014, his Excellency the Governor fixed 12 December 2014 for the commencement of the provisions of the Appropriation Act (No.2) 2014 (Act No.53 of 2014) that are not in force. In effect, this proclamation commenced Part 3 (Amendment of Wagering Act 1998) of the Appropriation Act (No.2) 2014 on 12 December 2014, which part was inserted in that Act during its passage through the Legislative Assembly and which was outside the scope of the original long title of the Bill for that Act. 5. SL No.299 of 2014: Proclamation commencing certain provisions of the Education and Other Legislation Amendment Act 2014 By a proclamation signed on 11 December 2014, his Excellency the Governor fixed the following dates for the commencement of the specified provisions of the Education and Other Legislation Amendment Act 2014 (Act No.62 of 2014): The following provisions commence on 27 January 2015: ss64 to 71 and 126 s127, to the extent it inserts new Divisions 4 and 6 in Part 8 of Chapter 20 s128(1), other than to the extent it omits the definitions original direction and review body s128(2), other than to the extent it inserts the definitions relevant decision-maker and review body The provisions that are not then in force and not otherwise commenced under this proclamation commence on 1 January SL No.300 of 2014: Education Legislation Amendment Regulation (No.2) 2014 Firstly, this regulation amends the Education (Accreditation of Non-State Schools) Regulation 2001 to prescribe the following matters: specific accreditation criteria relevant to special assistance schools temporary site criteria minimum enrolment numbers. This regulation also amends the Education (General Provisions) Regulation 2006 (the EGP Regulation) to: prescribe mature age state schools remove the fee prescribed for a mature age student notice prescribe the application fee for enrolment as a mature age student remove duplication between the EGP Regulation and the Public Service Act 2008 in relation to civil liability indemnity provisions replace a reference to the now repealed Financial Administration and Audit Regulation 1995 with a reference to the Auditor-General Regulation Pursuant to s2 (Commencement): ss11 and 12, which provisions, respectively, replace s72 [Fee Act, s28(2)(c)] and Schedule 6 (Fee for mature age student notice) of the EGP Regulation, commence on 27 January The remaining provisions of this regulation commence on 1 January 2015, immediately after s4 and Part 3 of the Education, Training and Other Legislation Amendment Regulation (No.1) 2013 commence.

SL No.301 of 2014: Economic Development Amendment Regulation (No.6) 2014 This regulation amends Schedule 1 (Priority development areas) and Schedule 2 (Interim land use plans) of the Economic Development Regulation 2013 to include the declaration of the Toowoomba Railway Parklands Priority Development Area and its associated Interim Land Use Plan respectively. 8. SL No.302 of 2014: Proclamation commencing certain provisions of the Environmental Protection and Other Legislation Amendment Act 2014 By a proclamation signed on 11 December 2014, his Excellency the Governor fixed 19 December 2014 for the commencement of the following provisions of the Environmental Protection and Other Legislation Amendment Act 2014 (Act No.59 of 2014): Part 4, other than s9a, s15a, s16(2), to the extent it inserts the definitions administering agency, impose and Planning Act, and s16(3) Parts 6 and 6A. 9. SL No.303 of 2014: Nature Conservation (Protected Areas) Amendment Regulation (No.4) 2014 This regulation amends Schedules 2AA, 3 and 5 of the Nature Conservation (Protected Areas) Regulation 1994 (the NCPA Regulation) to: dedicate a national park (Cape York Peninsula Aboriginal land) and two regional parks declare both regional parks as resource use areas declare a nature refuge. This regulation also corrects an error in s4aa of the NCPA Regulation in order to describe national parks (Cape York Peninsula Aboriginal land) correctly as Aboriginal land and not as State land. 10. SL No.304 of 2014: Nature Conservation (Forest Reserves) Amendment Regulation (No.1) 2014 The objective of this regulation, as described in its explanatory notes, is to amend the Schedule (Forest reserves) of the Nature Conservation (Forest Reserves) Regulation 2000 by revoking part of Baldy Mountain Forest Reserve and locate the gazetted alignment for part of Carrington Road, near Atherton, onto its actual physical location. 11. SL No.305 of 2014: Nature Conservation (Wildlife) Amendment Regulation (No.2) 2014 This regulation amends the species listing in the following schedules of the Nature Conservation (Wildlife) Regulation 2006 in order for current scientific knowledge to be represented in the conservation status of wildlife species : Schedule 2 (Endangered wildlife) Schedule 3 (Vulnerable wildlife) Schedule 5 (Near threatened wildlife).

8 6 12 December 2014 page SL No.306 of 2014: Proclamation commencing certain provisions of the Mineral and Energy Resources (Common Provisions) Act 2014 By a proclamation signed on 11 December 2014, his Excellency the Governor fixed 12 December 2014 for the commencement of the following provisions of the Mineral and Energy Resources (Common Provisions) Act 2014 (Act No.47 of 2014): Divisions 1 and 4 of Part 3 of Chapter 9 Divisions 1 and 6 of Part 4 of Chapter 9 Divisions 1 and 6 of Part 5 of Chapter 9 Division 7 of Part 7 of Chapter 9 s480 Division 6 of Part 9 of Chapter 9 Division 7 of Part 10 of Chapter 9. As summarised in its explanatory notes, these provisions commenced by this proclamation: authorise the remediation of legacy boreholes regardless of the location, type and history of the borehole correct an incorrect paragraph reference in s133 of the Mineral Resources Act SL No.307 of 2014: Land Amendment Regulation (No.2) 2014 In the wake of ex-tropical cyclone Oswald which caused severe beach erosion in 2013 resulting in the eastern boundary of three privately owned freehold parcels of land being located in the ocean, this regulation amends the Land Regulation 2009 by declaring these affected areas within the private boundary as public beach area, thus allowing for the state to assume the public liability risk over the beach area and providing suitable conditions of use to apply to this public access. In particular, this regulation amends the Land Regulation 2009 by inserting in Part 6 (General) the following new provisions: s49a [Declared beach area Act, s431q(1)] s49b (Camping on declared beach area) s49c (Lighting fires on declared beach area) s49d (Littering on declared beach area) s49e (Taking dogs into declared beach area) s49f [Temporary closure of declared beach area Act, s431w(2)]. No precise indication of the location of the subject land is given in either the explanatory notes or the amending regulation itself apart from the description in the latter of proposed easements A, B and C on SP situated in lots 69, 71 and 72 on plan FD395. In addition, the explanatory notes stated that the beach area seaward of these properties previously allowed for public access to this beach area and also direct beach access to the Broadwater Regional Park and that consultation had been undertaken with the Gladstone Regional Council, among others.

9 6 12 December 2014 page SL No.308 of 2014: Proclamation commencing certain provisions of the Queensland Building and Construction Commission and Other Legislation Amendment Act 2014 By a proclamation signed on 11 December 2014, his Excellency the Governor fixed the specified dates for the commencement of the following provisions of the Queensland Building and Construction Commission and Other Legislation Amendment Act 2014 (Act No.57 of 2014): The following provisions commenced on 15 December 2014: ss3, 5 to 10, 13, 14(1) and (3), 15, 17, 25, 26(2), 29, 37 to 41, 42(1) (2), 43 to 46, 47(1) (3) and (6), 48 to 53 and 55 to 58 s59 to the extent it inserts divisions 1, 2 (other than ss57 to 59), 3 and 6 of Part 11 s61(1) to the extent it omits the definition disciplinary proceeding s61(2) to the extent it inserts the definitions consequential damage and direction to rectify or remedy s61(3) amendments 1 and 2 of the Pest Management Act 2001 in Schedule 1 ss11 and 12 commence on 1 January SL No.309 of 2014: Queensland Building and Construction Commission and Another Regulation Amendment Regulation (No.1) 2014 This regulation amends the Queensland Building and Construction Commission Regulation 2003 in order to: prescribe fees for circumstances where contractors and nominee supervisors choose to renew their licences for three years introduce a new fee in Schedule 1 for the restoration of a licence provide that, until the commencement of the relevant provisions of the Queensland Building and Construction Commission and Other Legislation Amendment Act 2014, all building work on a residential park under the Manufactured Homes (Residential Parks) Act 2003 will not be classified as residential construction work and will therefore not be insurable under the statutory insurance scheme for residential construction work administered by the Queensland Building and Construction Commission. In addition, this regulation amends the Professional Engineers Regulation 2003 to include a new registration fee for non-practising professional engineers (for example, those on parenting leave). 16. SL No.310 of 2014: Proclamation commencing remaining provisions of the Building and Construction Industry Payments Amendment Act 2014 By a proclamation signed on 11 December 2014, his Excellency the Governor fixed 15 December 2014 for the commencement of the provisions of the Building and Construction Industry Payments Amendment Act 2014 (Act No.50 of 2014) that were not then in force.

10 6 12 December 2014 page SL No.311 of 2014: Building and Construction Industry Payments Amendment Regulation (No.1) 2014 As discussed in its explanatory notes, this regulation amends the Building and Construction Industry Payments Regulation 2004 to provide: for the introduction of new adjudication application and certificate fees and the removal of fees which are no longer required for the approval of the Adjudicator Grading and Selection Criteria for Nomination of Adjudicators Policy 2014 which was made by the Queensland Building and Construction Board on 17 October 2014 that the registrar will only accept adjudication applications during office hours on a business day, being 8am to 5pm. (An application received after 5pm will be taken to be lodged on the following business day.) for the removal of the bodies currently listed in Part 1 of Schedule 1 (all of which are currently appointed authorised nominating authorities) and the elements set out in Part 2 of Schedule 1. (It is proposed that new bodies will be selected in the coming months when they will be prescribed by a regulation along with new elements.) Pursuant to s2 (Commencement), this regulation commenced on 15 December SL No.312 of 2014: Legal Profession Amendment Regulation (No.1) 2014 The objectives of this regulation, as listed in its explanatory notes, are to amend the Legal Profession Regulation 2007 in order to: include the National Heavy Vehicle Regulator as a prescribed agency for the purposes of the definition of government legal officer in s12 of the Legal Profession Act 2007 provide that the general prohibition on engaging in legal practice when not entitled to do so does not apply to a government legal officer moving an application for admission to the legal profession if the Legal Practitioners Admissions Board has recommended the applicant s admission, without conditions under rule 15(1) of the Supreme Court (Admission) Rules 2004 align the cap on the rate of interest that may be charged by law practices on unpaid legal costs with the rate of interest applied to a money order debt under s59(3) of the Civil Proceedings Act SL No.313 of 2014: Nature Conservation (Macropod Harvest Period 2015) Notice 2014 As listed in its explanatory notes, this notice: declares a harvest period from 1 January 2015 to 31 December 2015 for harvest macropods allows the lawful harvesting of three species of macropod, namely: eastern grey kangaroo (Macropus giganteus) red kangaroo (Macropus rufus) common wallaroo (Macropus robustus) defines particular areas where harvesting of macropods can occur defines the maximum amount of macropods harvested from a particular area. Pursuant to s2 (Commencement), this instrument commences on 1 January 2015.

Sustainable Planning Act 2009 Notification, given by the Deputy Premier and Minister for State Development, Infrastructure and Planning under s60, that he has prepared a draft amendment to the standard planning scheme provisions under Sub-division 2 of Division 3 of Part 6 of Chapter 2 to be cited as the Draft Queensland Planning Provisions version 4.0, in respect of which submissions are invited with a deadline of 16 January 2015.

12 6 12 December 2014 page Water Supply (Safety and Reliability) Act 2008 Gazettal of the following notices in respect of the specified manuals of operational procedures for flood mitigation as flood mitigation manuals, both of which were approved by the Minister for Energy and Water Supply on 5 December 2014 under s371g for the indicated periods: Approval of Flood Mitigation Manual (Wivenhoe Dam and Somerset Dam) Notice (No.01) 2014, giving notice of the approval for a period of one year of the Manual of Operational Procedures for Flood Mitigation at Wivenhoe Dam and Somerset Dam (Revision 12) Approval of Flood Mitigation Manual (North Pine Dam) Notice (No.01) 2014, giving notice of the approval for a period of five years of the Manual of Operational Procedures for Flood Mitigation at North Pine Dam (Revision 9). Sustainable Planning Act 2009 Gazettal of the notice given by the Cairns Regional Council, that, at its meeting of 10 December 2014, it adopted an amendment to the FNQROC Development Manual Planning Scheme Policy Issue 6, the purpose and general effect of which planning scheme policy is to provide comprehensive and consistent development standards. 3.
