1 OFFICIAL RULES «100K - WE LOVE YOU» SECTION 1: OBJECT PRESTIGE ET COLLECTIONS INTERNATIONAL, a french Société en Nom Collectif, with a share capital of ,00 euros, registered before the Paris RCS [Trade and Companies Register] under the number , with its registered office located at 16 Place Vendôme, PARIS FRANCE, acting on behalf of its brand Biotherm (hereinafter the Organizer, Corporate Organizer or We or Us ) is organizing a lottery* entitled 100K - We love you (hereinafter the Lottery ) taking place on the Organizer s Instagram Account (hereinafter the Organizer s Instagram Account ), at the following address: * NO PURCHASE IS NECESSARY TO ENTER OR WIN THE LOTTERY. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING. Please read these rules carefully. They govern your participation in the Lottery. By participating in the Lottery, you unconditionally accept, agree with and bound by these rules and Instagram terms of use available here: In this regard, please note that the Lottery is neither associated with, governed by, nor sponsored by Instagram and that the persons involved who fulfilled the necessary conditions described in Section 3.1 (hereinafter Participant(s) ) will provide information only to the Organizer and not to Instagram. This present Official Rules may be consulted throughout the term of the Lottery at the following address: It may also be obtained free of charge by any person who requests access from the Organizer throughout the term of the contest to the following address: SECTION 2: TERM BIOTHERM INTERNATIONAL International Digital & Communication We love you Instagram Lottery 106, rue Danton Levallois Perret Cedex The Lottery shall be held from June, 9 th 2017, 12 pm, to June, 11 th 2017, pm. The draw of the Prizes (as defined in Section 4.1.) will take place on June, 13 th 2017 (hereinafter the Draw ). SECTION 3: PARTICIPATION 3.1 CONDITIONS OF PARTICIPATION The participation in this Lottery with no obligation to purchase is subject exclusively to the present Official Rules. This Lottery is open to any individual, who have reached the age of majority on the Lottery start date in their respective country, and have a valid and personal Instagram Account (hereinafter the Participant(s) ). The Organizer may also require that the Participant forward a copy of his/her personal identification as proof of age.

2 Any individuals wishing to enter the Lottery must already have a valid address. Entry into the Lottery may only take place via the Instagram Account. In view of this, any participation submitted by telephone, fax, post or shall be ignored. Entering the Lottery indicates full and absolute acceptance of all provisions of the present official rules, of the Instagram terms of use, of the rules of conduct generally applied on the Internet and of the laws and regulation applicable to lotteries. Several participations per home but only one participation per Participant are hereby authorized (e.g. one (1) participation per Instagram account). Members of personnel of the Organizer and persons having collaborated in the organization of the Lottery and their respective families (i.e. persons within the same home for tax purposes) are prohibited from participating in the Lottery. Participants shall refrain from implementing any participation mode which does not comply with these rules. In cases of suspected fraud and/or unfair participation, the Organizer reserves the right to conduct any verification it deems necessary. Any established corrupt or fraudulent practice will result in an immediate and definitive disqualification of the Participant, final without notice and the latter may not, even as a Winner, receive the Prize (as defined respectively in Section 4.1. and 4.2.). Your Participation may be deemed ineligible if you do not comply with the modalities of Participation set forth above. Any participation that is incomplete or inaccurate, or that do not follow the procedure set out above shall not be considered and so shall invalidate the entry. 3.2 PROCEDURE FOR PARTICIPATION In order to participate to the Lottery, it is necessary for the Participants to: Sign in to his/her Instagram Account Go to the Organizer s Instagram Account at and follow it. Like the post promoting the Lottery of 100K We Love You Comment with a blue heart emoticon and with the name the one you care about. SECTION 4: WINNER AND PRIZES 4.1. PRIZES The Winners shall each receive the following Prize: - One (1) Life Plankton Box, worth 257 (hereinafter the Prize ). This Prize is personal and may not be assigned to any person other than the Winners. The Prize offered to Winners may not give rise to any claim of any kind, nor the delivery of their exchange value in cash (total or partial), nor to the taking-back of the Prize, replacement or exchange with another Prize, of any value whatsoever, for any reason, including in case of loss or theft. The Participants agree that the Organizer reserves the right to substitute another Prize as a substitute for the proposed Prize at any time whatsoever.

3 The Organizer shall be under no obligation to grant the Prize if the Winner has not complied with the present Official Rules DESIGNATION OF THE WINNERS For this Lottery, ten (10) Winners will be drawn by the Organizer on June, 13 th 2017 (hereinafter the Winner(s) ). 4.3 NOTIFICATION TO THE WINNERS The Winners shall be identified with their Instagram Account, by a comment (posted by Biotherm) on the post promoting the Lottery. Then, the Winners shall be contacted by the Organizer, within 7 days after the Draw, by private message on their Instagram Account, requiring them to provide their full personal details (surname, forename, address, telephone number). Winners shall be required to respond to the aforementioned notification within seven (7) days in order to enable the Organizer to send them the Prize. Depending the Winners answer deadline to the private message on their Instagram Account, the Prize shall be sent from June, 16 th 2017, and at the latest, within two (2) months from the date on which the Winners have been designated. Unclaimed Prize characterized by the non-replying by the Winner to the private message notification within seven (7) days will be considered as remaining the property of the Organizer, or if the Winner renounces to the Prize, the said Prize would be considered as remaining the property of the Organizer which will be free to reassign or not. If the participation of the Winner does not comply with the present Official Rules (in particular concerning information that are inaccurate or plurality of participation), the Winner would then not be able to claim the grant of her/his Prize, which will remain the property of the Organizer which will be free to reassign or not. SECTION 5: PERSONAL INFORMATION As part of the Lottery, you expressly allow the Organizer to use the personal data transmitted during the Lottery only for Lottery management purposes. The Participants personal details shall be used in accordance with the provisions of the law on Information Technology and Civil Liberties passed on the 6th January 1978 or of any other law that replaces it. Therefore, the Participants are entitled to a right of access, opposition, rectification and deletion of data which concern them personally. The Participants may exercise this right by sending an to the Organizer attention accompanied by a photocopy of an identification document to the following address: 106 Rue Danton, Levallois-Perret Persons exercising the right to delete their data prior to the end of the Lottery shall be deemed to have waived their right to participation. SECTION 6: LIABILITY The Organizer shall not be held liable for the granting of a Participant s Prize, nor incur any liability whatsoever in the event of force majeure or other similar events which are beyond their control

4 (including, but not limited to technical problems, losses or delays in postal services,) interfering with the organization and management of the Lottery. The Organizer shall not be held liable in the event of the malfunctioning of the Internet, preventing access to, or satisfactory running of, the Lottery. In particular, the Organizer may not be held liable for any external malicious acts (e.g. virus, misused identity etc.). If exceptional circumstances require, the Organizer reserves the right to postpone, shorten, extend, modify, cancel or suspend the Lottery and the liability of the Organizer cannot be sought as a result. The Organizer shall not be held liable for any dissatisfaction of the Winner regarding his Prize. The Organizer shall not be held liable for any incidents and/or accidents that may occur to the Winner(s) during the enjoyment of the Prize. SECTION 7: DEPOSIT, CONSULTATION AND AMENDMENT OF THE RULES 7.1. AMENDMENT BIOTHERM INTERNATIONAL International Digital & Communication We love you Instagram Lottery 106, rue Danton Levallois Perret Cedex The Organizer may be required to amend these rules inter alia to comply with any new legislation and/or applicable regulations. Any amendment shall be integrated within these Official Rules and shall be announced in the Organizer s Instagram Account and filed with the Court bailiff identified in the article 7.1. In the event that any clause hereunder is declared null or void, it shall have no impact on the validity of the rules themselves. SECTION 8: APPLICABLE LAWS AND JURISDICTIONS The present regulations shall be governed by French law.

5 Any disputes relating to application or interpretation of the present regulations shall, unless settled on an amicable basis by the Parties, fall within the jurisdiction of the Paris Tribunal de Grande Instance (Regional Court).
