2 Why an EPPO? Prosecuting offences against the EU budget is currently within the exclusive competence of Member States and no Union authority exists in this area. National law enforcement and prosecution efforts remain often fragmented.

20 Prosecution before national Courts The European Delegated Prosecutor submits a draft decision suggesting to bring a case to judgment The Permanent Chamber to decide on this draft limited only to the question of a) the sanction requested by the European Delegated Prosecutor shall be raised and/or b) the case shall be referred to a competent court of a different Member State. 20
21 Relations with the PIF Directive A dynamic relationship (PIF) Directive 2017/xx/EU as implemented by national law VAT frauds to be included (new voting rules as from March 2017 ) 21
22 Competence EPPO to refrain from exercising competence and refer the case to the national level when: the maximum sanction provided for by national law for a PIF offence is less severe than the maximum sanction for an inextricably linked offence [the damage caused to the Union's financial interests by a PIF offence does not exceed the damage caused, to another victim] 22
23 Investigation measures (f) track and trace any object by technical means, including controlled deliveries of goods. Investigation measures set out under c) (computer data) and e) (interception of communications) may be subject to further conditions or limitations under applicable national law (in particular lett. e) for specific serious offences).
