2 APPROVAL OF PLANS OF SALE CREEK MULTIBOATING INC FOR CONSTRUCTION OPERATION AND MAINTENANCE OF ADDITIONAL BOAT DOCK FACILITIES AND HARBOR LIMIT.EXPANSION SALE CREEK MILE 1.OR OPPOSITE TENNESSEE RIVER MILE 495.OR CHICKAMAUGA RESERVOIR Pursuant to the authority vested in it by Section 26a of the Tennessee Valley Authority Act as amended the Tennessee Valley Authority hereby approves the plans submitted by Sale Cr.eek Multiboating Inc hereinafter called applicant covering the construction maintenance and operation of additional boat dock facilities and harbor limit expansion in the location and according to the plans which are attached hereto as Exhibits and and made part hereof The approval is granted upon the following terms and conditions Applicant shall obtain all such licenses and permits as may be required by Federal or State law No changes in the plans submitted by the applicant shall be made unless and until such changes have been submitted in writing to the Director of Land and Forest Resources and applicant has received either revised approval or notice in writing from the Director of Land and Forest Resources authorizing construction in accordance with the revised plans and advising the applicant that formal.approval of the revised plans is unnecessary If any future operations of the United States or TVA or agents of either require an alteration in the structure or work herein authorize4 or if TVA shall find at any time that it has an adverse effect upon navigation flood control or public lands or reservations applicant shall upon due notice in writing from TVA remove or alter the structure or work or obstructions caused thereby without expense to the United States or TVA and if upon the expiration or revocation of this Approval of Plans the structure fill excavation or other work hereby authorized shall not be completed applicant shall without expense to the United States or TVA and to such extent and in such time and manner as TVA may require remove all or any portion of the uncompleted structure or fill and restore to its former condition the navigable capacity of the water course No claim shall be made against the United States or TVA on account of any such removal or alteration This Approval of Plans does not constitute conveyance by TVA or by the Federal Government of..any property or interest in any property covered by or used in connectionwith this project nor does it constitute waiver on the part of the Federal Government of any of its rights in such property

This Approval of Plans does not give any property rights in real estate or material and does not authorize any injury to private property or invasion of private or public rights It merely constitutes finding that the facility if constructed at the location specified in the plans submitted and in accordance with said plans would not at this time constitute an obstruction unduly affecting navigation flood control or public lands or reservations In issuing this Approval of Plans TVA makes no representations that the structures or work herein authorized or property used or stored in connection therewith will not be subject to damage due to future operations undertaken by the United States and/or TVA for the conservation or improvement of navigation for the control of floods or for other purposes or due to fluctuations in elevations of the water surface of the river or reservoir and no claim or right to compensation shall accrue from any such damage By the acceptance of this approval applicant covenants and agrees to make no claim against TVA or the United States by reason of any such damage and to indemnify andsave harmless TVA and the United States from any and all claims by other persons arising out of any such damage applicant This approval shall not become effective until accepted by the All facilities for or incidental to the storage piping and dispensing of liquid fuel shall comply with the applicable requirements of the Flammable and Combustible Liquids section of the National Fire Codes and any additional requirements of State and local laws and regulations and shall be subject to TVA inspection for such compliance The applicant will not place any permanent mooring buoys boat slips or other harbor facilities outside the harbor limits as shown by the red line on the enclosed map Only those facilities which have been approved by TVA prior to construction may be placed within the harbor The Tennessee Valley Authority has accordingly caused this Approval of Plans to be executed on this 12th day of March 1981.Unless the constfuction of the project herein approved shall be initiated within one year from the date of this approval the approvalshall thereafter be subject to revocation by the Director of Land and Forest Resources if in his judgment changed conditions make such revocation desirable from TVAs standpoint TENNESSEE VALLEY AUTHORITY Accepted Date.J Resources /919/ cc Norman Ailgood Athens
