1 REPLY TO QUERIES OF WIDENING AND STRENGTHENING OF EXISTING HIGHWAY SECTION TO TWO-LANING WITH PAVED SHOULDER OF UNCHA-NAGLA-KHANUAWA-ROPPAS-DHOLPUR SECTION OF NH-123 IN THE STATE OF RAJASTHAN/ UTTAR PRADESH In the pre-bid meeting held on 29 Sept.2014, the queries have been raised on a number of issues in which many of them already stand clarified in the bidding documents. For the purpose of clarity, the following is further clarified in a general manner: 1. There shall be no change in the draft contract agreement (RFP Part-I and Part-II) except the corrigendum/ addendum / clarification issued herewith. 2. For the avoidance of doubt, the Concessionaire is, hereby, undertakes that the responsibility generated in order to fulfill the stipulation of Schedule D or any other schedules shall be deemed to be an integral part of Schedule B and shall not consider as Change of Scope under Article-13 of Contact Agreement. 3. In reply to all queries emanating from feasibility report (FR), Executive Summary, Geo-technical Report, GADs, it is stated that the information furnished in these documents is only for guidance purpose to the bidders. NHAI does not take any responsibility for the correctness or otherwise all the information given in these documents. Bidders may please note that these documents shall not become part of the concession agreement. 4. Infra Endevours P Limited Legal advisor M/s. M.V. Kini & Company. The specific issues referred to by the bidders in the pre-bid have been identified and replied to as under:

2 1 (Schedule-A] 1. The Site Clause The alignment plans of the Project Highway are specified in Annex-III. In the case of sections where no modification in the existing alignment of the Project Highway is contemplated, the alignment plan has not been provided. Alignment plans have only been given for sections where the existing alignment is proposed to be modified. Kindly elaborate the scope with respect to existing alignment. We presume that neither Geometric nor any Type Improvement of Curve is cover under the project scope in respect to Existing Alignment. Kindly confirm. The highway components shall be designed in accordance with Schedule D as per provision of Schedule B taking into account the Plan and Profile. The minimum FRL has been given as guidance and should be followed in general. The contractor may revise the profile only under unavoidable circumstances with prior approval of AE/NHAI as per site requirement. 2 Schedule -B Cl. 211 Note: 1.Typical cross section 9 will be applicable at the locations of air valves and manholes of water pipelines. (approx. 175 locations] The location of Air Valves / Manhole of PHED Water Pipe Line is exceed, then the extra quantity is payable in the shape of Retaining Structure? Please refer clause 13 of schedule B of RFP. 3 Schedule A Cl. 8 4 Anne - I (Schedule-B, Cl 5.2) 5 Article 4. (EPC Contract Agreement] Railway level crossings The Site includes the following railway level crossings: At Ch & Ch. 37/500 Type of pavement The existing road shall be strengthening as flexible pavement while the new pavement section shall be rigid pavement. The Authority shall be responsible for the correctness of the Scope of the Project, Project Facilities, Specifications and Standards and the criteria for testing of the completed Works. As per schedule B at Ch there is proposed ROB. But on Ch there is no proposed structure. Kindly Clarify. Contractor free to adopt any type Pavement design composition as per EPC Contract. Kindly clarify. i] As per Article "4" Authority is responsible for the Correctness of the Scope of the Project, Project facilities..., if due to achievement of specification and standard the quantities of particular item deviates from the quantities as defines in schedule-b, Whether the additional quantities will be given under clause 13 i.e. Change of scope. Please refer Clause7.4 of Schedule B, ROB location are already mentioned. LC at existing Ch. 2/300 is bypassed. Query is incorrect. Please refer clause 5.2 of schedule B in this regard. Further attention is invited to clause 5.3 of schedule B with respect to query raised.

Authority may please clarify. The Reconstruction/ repair/ rehabilitation of structures have to be made in accordance with provisions given in the schedule B. The change of scope, if any, will be dealt with in accordance with RFP. Please also refer article 6 of DCA in this regard. Please refer Clause 2.3.of Schedule B, in which Bypass / Realignments are already mentioned.

Kindly provide. 16 Part II Clause & 9.2 Right of Way, Utilities and Trees: We request you to include utility relocation and tree cutting in ROW handover. That is till the completion of utility relocation and tree cutting, the ROW for the particular stretch is not deemed to be handed over. Already available on e-portal of NHAI. Please also refer preamble in this regard. The contractor has to assess the requirement on their own. Please refer Article 6 of draft DCA in this regard. Please refer Article 9 of draft DCA. Existing Carriage way width mention in Clause 3 of Schedule A. Please refer Article 6 of draft DCA in this regard. No change.

5 17 Schedule B Cl Road over bridges (road over rail) shall be provided at the following level crossings, as per GAD drawings attached: Please confirm the status of GAD of ROBs approval from Railways. Please indicate the amount to be deposited by the Concessionaire with the Railways towards the Codal and Maintenance charges for the railway portion of the ROBs. GAD of ROB is approved by Railway Authority. The amount to be deposited in railway department shall be as per demand note/guidelines of railway authorities. 18 Schedule A. Annex- IV 19 Schedule B Cl. 5.4 Reconstruction of Stretches Environment Clearances The following environment clearances have been obtained: Wild Life TTZ The following stretches of the existing road shall be reconstructed. These shall be designed as new pavement. Environmental & Forest/ Wild Life/ Clearances Please give the Status of Environment & Forest clearance at this stage? The proposal has been agreed for clearance by National Wild life board in its meeting held on and minutes of meeting and formal clearance letter is awaited. Forest Clearance - There is no PR/RF, hence FC is not required Please refer corrigendum in this regard. FRLs provided in Plan & Profile (Annex III of Schedule A) drawing are minimum to be maintained satisfying the requirement of Schedule D and in conjunction to the Clause 2.11 of Schedule B. After satisfying the requirement of Clause 5.4 of Schedule B, balance profile correction course, to maintain proposed FRLs, shall be done
