MANN, License Number CONSENT ORDER THS MATTER came on for consideration at a prehearing conference (hereinafter, "conference" pursuant to 21 N.C.A.C This conference was scheduled for June 14, 2010 and, after appropriate notice, was heard on that day at the office of the North Carolina Board of Pharmacy (hereinafter, "Board" by Board member Robert McLaughlin, Jr. Board Counsel and members of the Board's investigative and legal staff were present at this conference. Ms Mann was informed of her right to be present at the conference, in person, and waived that right. FNDNGS OF FACT 1. On February 21, 1990, Respondent Angela Mann was granted license number by the North Carolina Board ofpharmacy. 2. On May 17, 1994, Respondent was granted a license by reciprocity by the Alabama Board ofpharmacy. Respondent subsequently practiced in Alabama. 3. On November 2,2009, Respondent entered into a Monitoring Agreement with the Alabama State Board of Pharmacy's Committee on Rehabilitating mpaired Pharmacists ("CORP". 4. On February 23, 2010, Respondent's Alabama license was disciplined through a Consent Order following an investigation by the Alabama Board ofpharmacy into activities that Respondent undertook while practicing in Alabama.

2 5. The findings of fact in the Consent Order are incorporated herein by reference, and Respondent admits and agrees to those findings of fact. 6. The Consent Order provided for a five-year stayed suspension of Respondent's Alabama license, upon certain conditions, including but not limited to compliance with her CORP Monitoring Agreement. CONCLUSONS OF LAW Based on the above findings, the Board concludes as a matter oflaw: 1. Respondent Angela L. Mann violated N.C. Gen. Stat (a(6. 2. Respondent admits that the conduct in this matter constitutes sufficient grounds for disciplinary action on her license under N.C. Gen. Stat Based upon the foregoing, and with the consent of the parties, T S THEREFORE ORDERED that the license ofrespondent Angela L. Mann is hereby SUSPENDED for a period of FVE (5 YEARS, which suspension shall be stayed until February 23, 2015, upon the following conditions: 1. Respondent shall comply with all recommendations from the Alabama Board of Pharmacy's CORP Program Administrator, who shall be satisfied that Respondent has made satisfactory progress in her treatment to enable her to practice pharmacy with reasonable skill and safety; 2. Respondent shall maintain strict compliance with CORP's Monitoring Agreement. The Monitoring Agreement and all the provisions thereof are specifically made a part ofand are incorporated into this Consent Order as iffully 2

3 set forth herein. Failure to comply with the Monitoring Agreement or any provision thereof shall be deemed a failure to comply with this Order and may, after notice and hearing, result in further disciplinary sanctions; 3. Any positive drug screen may result in revocation or other disciplinary sanction(s upon hearing and proofthereof; 4. Respondent shall maintain full compliance with the Alabama Board of Pharmacy's Consent Order, as well as this Consent Order; 5. Respondent shall not serve as a preceptor during the term of the stayed suspension; 6. Respondent shall cooperate with the Board, its attorneys, investigators and other representatives in any investigation and compliance with the provisions of this 7. Consent Order; Respondent shall violate no laws governing the practice of pharmacy or the distribution ofdevices or medical equipment; 8. Respondent shall violate no rules and regulations ofthe Board; and 9. Respondent shall promptly advise the Board of any changes in address, employer or practice standards, as well as any other factors affecting compliance with this Consent Order. 3

Mann, the holder oflicense number 10722, has full knowledge that she has the right to a hearing, at which she would have the right to be represented at her expense by counsel, in this matter. The undersigned freely, knowingly and voluntarily waives such right by entering into this Consent Order. The undersigned understands and agrees that by entering into this Consent Order, she certifies that she has read the foregoing Consent Order and that she voluntarily consents to the terms and conditions set forth therein and relinquishes any right to judicial review of Board actions which may be taken concerning this matter. The undersigned further understands that should she violate the terms and conditions of this Consent Order, the Board may take additional disciplinary action. The undersigned understands and agrees that this Consent Order will not become effective unless and until approved by the Board. The undersigned understands that she has the right to have counsel of her choice review and advise her with respect to his rights and this Consent Order, and represents that she enters this Consent Order after consultation with his counsel or after knowingly and voluntarily choosing not to consult with counsel.
