2 2 THE DEPARTMENT OF PARLIAMENTARY AFFAIRS AND LEGISLATION ANNUAL REPORT FOR THE YEAR Introduction: The Department of Parliamentary Affairs and Legislation, a Department of the Karnataka Government State Secretariat entrusted with the business enumerated in Schedule XIA of the Karnataka Government (Allocation of Business) Rules, 1977 is now performing its fifteenth year of reporting. Annual Performance is Accounted below: A. Parliamentary Affairs wing B. Legislation wing The Department had to perform with the following staff during the year. G.Sridhar, Assistant Draftsman and Ex-officio Deputy Secretary to Government continued to hold the office during the period under report. Smt. B.G. Shyamala, Assistant Draftsman and Ex-officio Deputy Secretary to Government continued to hold the office during the period under report. Sri. R. Anjini is promoted in this Department as Assistant Draftsman and Exofficio Deputy Secretary to Government w.e.f vide order No.DPAR 18 SA AA SE, dated with.- 1. Legislative wing.- (i) The Drafting wing of the Department is entrusted (a) Preparation of draft Legislative Bills and Ordinances; (b) Scrutiny of the draft rules, notifications and Statutory orders; (c) Co-ordination with the various Secretariat departments in the matters related to Legislation including sub-ordinate Legislation; and (d) Rendering opinion on Legislative issues and Parliamentary Affairs matters. (ii) During the year under report the Department has performed the tasks narrated below: (a) 755 new Legislative proposals were handled culminating in 38 Acts and 3 Ordinance. The list of Acts enacted and Ordinances promulgated are appended to the report at Annexure - 1. (b) 33 Bills were prepared and sent to legislature for introduction.the particulars of the Bills are furnished in Annexure - 2. (c) 328 statutory rules, orders, and notifications have been scrutinized by the department and 854 receipts regarding subordinate Legislation have been processed.

4 4 (iii) The following finance and Money Bills were introduced and passed in both Houses of the State Legislature. 1 The Karnataka Appropriation Bill, 2 The Karnataka Appropriation (Vote on Account) Bill, 3 The Karnataka Value Added Tax (Amendment) Bill, 4 The Karnataka Taxation Laws (Amendment) Bill,. 5 The Karnataka Motor Vehicles Tax (Amendment) Bill,. 6 The Karnataka Stamp (Second Amendment) Bill, 7 The Karnataka Stamp (Amendment) Bill, 8 The Karnataka Appropriation (No.2) Bill, 9 The Karnataka Appropriation (No.3) Bill, (iv) The following matters are being taken up with the Ministry of Justice and Legislative Affairs, Government of India under the Mukyavahini to obtain the assent of the President. 1 The Karnataka Bhu Kabalike (Nishedha) Vidheyaka, The Karnataka Prevention of Dangerous Activities of Bootleggers, Drug offenders, Gamblers, Goondas, Immoral Traffic offenders and Slum Grabbers (Amendment) Bill, The Karnataka Co-operative Societies (Second Amendment) Bill, 4 The Karnataka Prevention Of Cow Slaughter And Cattle Preservation (Amendment) Bill, The Karnataka Rent (Amendment) Bill, The Cr.P.C. (Kar. Amendment) Bill, Indian Penal Code and Criminal Procedure Code (Kar. Amendment) Bill, 2009 (v) Scrutinising committee.- As per the Karnataka Government (Transaction of Business) Rules, 1977 there is a Scrutinizing Committee under the Chairmanship of the Hon`ble Minister of Parliamentary Affairs and Legislation. The said committee is assisted by a Member Secretary i.e. Shri K. Dwarakanath Babu, Additional Draftsman and Ex-officio, Addl. Secretary to Government.

5 5 During the year under report.- The said committee has scrutinized 32 Bills. The details of Bills scrutinized are appended to in Annexure Parliamentary Affairs Wing.- According to the Karnataka Government (Allocation of Business) Rules, 1977, the Department is entrusted with the following works, namely:- (i) Summoning and prorogation of the Houses of Legislature, dissolution of the Legislative Assembly. (ii) Planning and Co-ordination of Legislative and other official-business in both Houses of Legislature. (iii) Allocation of Government time in the houses of Legislature for discussion of motions/notices given by Members. (iv) Functioning of informal Consultative Committees of Members of Legislature for various Departments. (v) Advice to Departments of the Secretariat on procedural and other matters relating to Legislature. (vi) Co-ordination of action by Departments of the Secretariat on the recommendation of general application made by Committee of the Legislature. (vii) Removal of disqualification for membership of the Legislature (viii) Matters connected with the powers, privileges and immunities of Members of the Legislature. Kannada Drafting wing.- Kannada Drafting wing of the department, translates Legislative Bills and Ordinances and other matters from English to Kannada and vice-versa. During the year under report, 35 Legislative Bills, 4 Ordinances and 10 other matters have been translated by the wing, List of matters translated during the year under report are appended at Annexure Receipt and issue section.- This section is entrusted with the work of,- (a) (b) (c) (d) (e) Co-ordination: Service matters relating to the Directorate of Translations; Internal transfers, discipline, attendance, Service and Leave matters of the personnel in the department; Matters related to LA/LC questions, prorogation/summoning of the houses. Right to Information.- In order to bring the provisions of the Right to Information Act effectively Shri. B.B.Pattar, Additional Draftsman and Ex-Officio Additional Secretary to Government, Department of Parliamentary Affairs and Legislation was appointed as the Appellate Authority for this Department Vide Notification-III No, DPAL 82 ADM 2005, dated: Sri. B.B Pattar continued to be the Appellate Authority during the year under report. All Assistant Draftsman and Ex-officio Under Secretary/ Deputy Secretary to Government, Department of Parliamentary Affairs and Legislation were appointed as the State public Information Officers for this Department Vide Notification-I No: DPAL 121 ADM 2007, dated: All Assistant Draftsman and Ex-officio Under Secretary/ Deputy Secretary to Government to be the State public Information Officers during the year under report. All Section Officers, Department of Parliamentary Affairs and Legislation were appointed as the Assistant State Public Information Officers Vide Notification-II No, DPAL 121 ADM 2007, dated: to be the Assistant State public Information Officers during the year under report. 6. Codification Section.- This section,- (a) maintains Master Copies of all Karnataka Acts in force; (b) attends to codification work of all un-repealed Karnataka Acts; and

8 8 (c) prepares repealing and amending Bills of Karnataka Acts. (d) Prepared Karnataka enactments CD and releasing the same for the use of public. (e) updation and printing of codal volumes from time to time. (f) updates in the department s website all un-repealed State Acts; During the year under report,- (1) This section has taken steps to update in the website by incorporating all amendments brought the Karnataka Acts in the year. (2) This section has updated in web site 38 Acts and 3 Ordinances are published in the year. (3) Action is being taken to release CD (2) containing the Karnataka Acts with latest amendments for the use of General Public. (4) Action is being taken to print codal volumes (ten volumes) of Karnataka Acts from 1957 to Said work is in progress. (5) The One-man Committee under the Chairmanship of Shri K.R.Chammaiah retired Vice-Chairman, K.A.T., Was constituted vide G.O No. DPAL 38 ADM 04 dated to codify, update and publish the Regional enactments enacted prior to ,- (1) The Karnataka Repeal and Amendment Bill, 2009 (LC Bill No. 1 of 2009) proposed by the Committee is being placed before the Legislative Council and has been passed by it. At present it is pending in the Legislative Assembly for consideration. (2) The One Man Committee has sent another the Karnataka Repealing and Amending Bill, on and action is being taken to take Cabinet approval as per the Karnataka Government Transaction of Business Rules. (3) The Karnataka Repealing Bill, from 2001 to is being sent to One Man Committee for revision. 7. Publication Section.- The Publication Section publishes,- (a) Annual Volumes of Karnataka Acts and Ordinance; (b) Kannada Translations of the Karnataka Acts under the Official Language Act, 1963 (Karnataka Act 26 of 1963);

9 9 (c) Kannada Translations of the Central Acts under Authoritative Text (Central law) Act, 1973 (Central Act of 1973); (d) Important Acts, Rules and notifications published in the Central Gazette for information of public in the Karnataka Gazette; and (e) Maintains statistical details of all departmental publications in the State and Issue Register. (f) Maintaining the part IV and Part IVA of the stock Gazette in binded Book format in Library. During the year under report,- 1) Action is being taken by this section to publish in the Book Form, the Annual Volume of the Karnataka Acts and Ordinances of the year. 2) 36 Central Acts, 4 Central Ordinances and 52 Statutory Orders and General Statutory Rules have been republished. 12 Central Acts have been translated into Kannada and published in book form. Action is being taken to publish the revised version of The Constitution of India (Diglot) in the book form. 3) One State Act has been prepared and two rules have been translated into Kannada under the Karnataka State Official Language Act, 1963 (Karnataka Act 26 of 1963). One Act, six rules, Annual Volume and the Alphabetical Index for the year 2009 have been published in book form. Action is being taken to publish One Act and the rules made thereunder and the Alphabetical Index in the book form. 4) The register for storage and distribution of departmental publication is maintained. 5) A List of various republications made during the year is appended to the report at Annexure Website of this Department.- The Department of Parliamentary Affairs and Legislation has updated the following Acts, Ordinances, Rules and Notifications and other matters in its website to enable the general public to access these enactments free of cost. (1) Un-repealed State Acts and Ordinances. (2) Annual Volumes of Karnataka Acts and Ordinances.

10 10 (3) Central Acts and Ordinances. (4) Important Acts, Rules and Notifications published in the Central Gazette. (5) Citizen charter of the Department. 9. Youth Parliament Competition.- With a view to strengthen the foundation of democracy by inculcating healthy and noble qualities of discipline and tolerance to difference of opinion expressed by others and also to create an awareness of Parliamentary procedures in the student community, the Dept. of Parliamentary Affairs and Legislation is conducting every yea Youth Parliament Competition among the students of recognized educational Institutions of the State. The Government of India is providing financial assistance to conduct such competition among the recognized schools. All the high schools recognized by the State are considered eligible to participate in this competition. 2. The State Level Youth Parliament Competition for the year -11 was organized at Channabasavappa Hall, KGS Club, Cubbon Park, Bangalore on and This year also during November/December the Department of Parliamentary Affairs and Legislation in co-ordination with the Department of Public Instructions conducted District Level Youth Parliament Competitions for the year -11 in 34 Educational Districts for the students studying in High Schools of the State. 10. Directorate of Translations.- (i) Functions of the Directorate of Translations are as follows: (a) Translations of State Acts and Rules made there under into Kannada and Publications thereof as per Section 5A of the Karnataka Official Language Act, (b) Translation of Central Acts into Kannada and Publication thereof as per Clause (A) Section 2 of the Authoritative Texts (Central Laws) Act, (c) Translation of State Administration Reports, Committee Reports, Enquiry Commission Reports, Annual Reports, CAG Reports, PAC Reports Govt. Orders, Notifications, Official Memorandums etc. into Kannada and English in view of the Official Language Policy of the State.

11 11 (d) Translation of important Government Orders, Notifications, Notices, Rules, Statutory Orders etc., sent by the Secretariat Departments and Heads of Departments into Kannada/English. (e) Translation of SLP matters filed before the Supreme Court of India, i.e. Statement of witnesses. Cross examinations, Statements and other Judicial matters from Kannada to English. During the year under report:- (1) President s assent has been obtained for the Kannada Translation of 01 Central Act and these authorized Kannada texts are published in the official gazette, twelve of which are also published in book form. (Annexure-6) (2) The Authorized Kannada texts of three State Acts, Rules have been published in the Official gazette. (Annexure-7) (ii) During the year, 3001 pages of Administrative matters have been translated into Kannada and sent to the departments concerned. (iii) During the year, 2526 pages of Judicial matters have been translated into English from Kannada and sent to the department concerned (iv) Particulars of Officers and Staff of the Directorate of Translations are as below. 12 12 Details of Budgetary allocation and Expenditure of the Directorate of Translations are as below: Budget allotment for the year Rs.2,03,67,000 Expenditure incurred up to the end of Rs.1,32,81, Website of the Directorate of Translations.- The Directorate of Translations has updated the following Kannada translations in its website to enable the general public to access these Kannada translations free of cost. (a) Authorized Kannada Texts of Central Acts. (b) Authorized Kannada Texts of State Acts. (c) Citizen Charter of the Directorate. 12. The Karnataka Official Language (Legislative) Commission.- (i) The term of office of the Karnataka Official Language (Legislative) Commission constituted under G.O. No. DPAL 18 BHANIVI 2006, dated expired on and a new commission under the Chairmanship of Sri B. Javaraiah with four other members is constituted for a period of 3 years Vide G.O.No. Samvyashayi 52 BHANIVI 2009 dated: Smt. K.N. Jayashree is not working as a member.
