The Court denied in part and granted in part Defendants Motion for Post-Trial Relief Pursuant to Pa. R.C.P Defendants argument that the Court failed to consider affirmative defenses, including equitable estoppel, was without merit. Further, the Court found that it did not improperly allow the admission of certain exhibits under the business records exception to hearsay. In addition, the Court denied in part and granted in part Plaintiff s Motion for Post-Trial Relief. The Court also found that Plaintiff did not provide sufficient evidence to support the award of counsel fees. Michael P. Giles, Esquire, on behalf of the Defendants. MEMORANDUM OPINION Johnson, J., January 26, Before the Court for consideration are the Motion of Defendants, Larry L. Wisser and Cathleen R. Wisser, for Post-Trial Relief Pursuant to Pa. R.C.P filed October 11, 2017 and Plaintiff s Motion for Post- Trial Relief filed October 19, Oral argument was held on December 18, I. FACTUAL BACKGROUND A Non-Jury Trial was held on September 26, 2017 and September 27, The Court entered an Order on September 28, 2017, in which the Court entered a verdict in favor of Plaintiff, and against Defendants, in the amount of Three Hundred Forty-four Thousand Sixty-one Dollars and Sixty-seven Cents ($344,061.67). 7 Lehigh 7-17 op

8 798 Union Community Bank vs. Wisser et ux. II. DISCUSSION A. Motion of Defendants, Larry L. Wisser and Cathleen R. Wisser, for Post-Trial Relief Pursuant to Pa. R.C.P Filed October 11, Defendants argue three (3) distinct issues, which the Court will address separately. 1. Affirmative Defenses Defendants argue that the Court committed an error of law and/or abused its discretion, when it refused to consider the affirmative defenses raised by Defendants in their New Matter to Plaintiff s Complaint, and during the course of the trial, including, but not limited to, the doctrines of payment, estoppel and waiver. 1 The elements of equitable estoppel are (1) an inducement, whether by act, representation, or silence when one ought to speak, that causes one to believe the existence of certain facts; (2) justifiable reliance on that inducement; and (3) prejudice to the one who relies. Zivari v. Willis, 416 Pa. Superior Ct. 432, 611 A.2d 293 (1992). Defendants argue that they were induced to make interest only payments to Plaintiff for the months of January 2016 through June 2016, which they argue they did. They argue that the inducement came in the form of two (2) different actions by Plaintiff: first, according to the testimony of Cathleen Wisser, a telephone conversation between Defendant, Cathleen Wisser, and Plaintiff s representative, Kevin Hersh, at the end of December 2015, whereby the parties agreed to interest only payments; and second, Plaintiff s acceptance of the interest only payments made during that period of time, without objection, and without informing Defendants that the payment was inadequate or insufficient under the loan documents. Defendants argue that Plaintiff s acceptance of Defendants interest only payments and full payments goes 1 Although Defendants argue that the affirmative defenses of waiver and payment apply, Defendants only developed an argument on estoppel. 9 Union Community Bank vs. Wisser et ux. 799 not only to the defense of equitable estoppel, but also to the defenses of payment and waiver, which the Court failed to consider. We disagree. The Court did not fail to consider these affirmative defenses. The Court did not find the testimony of Cathleen Wisser to be credible and, therefore the Defendants failed to establish the elements of said affirmative defenses. The evidence shows that Plaintiff did not receive any monthly payment from Defendants in April 2016 (Exhibits P-23, P-24, P-25) and, additionally, none of the monthly payments made by Defendants during the alleged interest only payment plan period were in an amount equal to or above the total monthly interest being assessed on Defendants account. Thus, Defendants were in default of their loan, and Defendants argument that this Court failed to consider the affirmative defenses raised by Defendants is without merit. Therefore, this portion of Defendants motion is DENIED. 2. Business Records Exception Defendants submit that this Court improperly allowed the admission of certain of Plaintiff s exhibits based solely on the testimony of its witness, Kevin Hersh ( Hersh ), over the objection of Defendants. Subject to certain exceptions, hearsay is inadmissible at trial. Pa. R.E One such exception is found in Rule 803(6), which permits the admission of a recorded act, event or condition if: (A) the record was made at or near the time by or from information transmitted by someone with knowledge; (B) the record was kept in the course of a regularly conducted activity of a business, which term includes business, institution, association, profession, occupation, and calling of every kind, whether or not conducted for profit; (C) making the record was a regular practice of that activity; (D) all these conditions are shown by the testimony of the custodian or another qualified witness, or by a certification that complies with Rule 902(11) or (12) or with a statute permitting certification; and 9 Lehigh 7-17 op

10 800 Union Community Bank vs. Wisser et ux. (E) neither the source of information nor other circumstances indicate a lack of trustworthiness. It is Defendants position that Mr. Hersh was not a qualified witness for Plaintiff to overcome the hearsay nature of several of the exhibits admitted at trial. We disagree. The question of whether documents should be admitted under the business records exception to the hearsay rule is within the discretionary power of the trial court provided such discretion is exercised within the Uniform Business Records as Evidence Act. Thomas v. Allegheny & Eastern Coal Co., 309 Pa. Superior Ct. 333, 340, 455 A.2d 637, 640 (1982). It is not essential under the Uniform Business Records as Evidence Act to produce either the person who made the entries or the custodian of the record at the time the entries were made. In re Indyk s Estate, 488 Pa. 567, 573, 413 A.2d 371, 374 (1979). Moreover, the law does not require that a witness qualifying business records even have a personal knowledge of the facts reported in the business record. Wayne County Board of Assessment v. Federation of Jewish Philanthropies, 43 Pa. Commonwealth Ct. 508, 403 A.2d 613 (1979). As long as the authenticating witness can provide sufficient information relating to the preparation and maintenance of the records to justify a presumption of trustworthiness for the business records of a company, a sufficient basis is provided to offset the hearsay character of the evidence. In re Indyk s Estate, supra at 573, 413 A.2d at 373; see also, Boyle v. Steiman, 429 Pa. Superior Ct. 1, 15, 631 A.2d 1025, (1993). The Court finds that Hersh is a qualified witness under Pa. R.E. 803(6) as he was able to provide sufficient information relating to the preparation and maintenance of Plaintiff s records to justify a presumption of trustworthiness for the business records of Plaintiff. Hersh provided testimony about Plaintiff s normal loan documentation process and how, through his nine (9) years of employment for Plaintiff, has become familiar with Plaintiff s forms, type of documents and letterhead. Hersh has seen documents from Plaintiff from the 1980s through today and noted that they are the same documents that have been prepared for the last twenty (20) to thirty (30) years. Case law is clear that no lack of trustworthiness can exist simply because Hersh started working 10 Lehigh 7-17 op

11 Union Community Bank vs. Wisser et ux. 801 for Plaintiff after the loan was first originated. Instead, Hersh s extensive employment history at Plaintiff s business and in the banking industry and his familiarization with Plaintiff s business practices in preparing and maintaining records qualify him as a business record witness under Pa. R.E. 803(6). If Defendants argument held merit, then countless borrowers could receive an unjustified windfall any time an originating loan officer retired, moved away or died. Accordingly, the Court finds that it did not improperly allow the admission of certain exhibits under the Business Records Exception to Hearsay. Therefore, this portion of Defendants motion is DENIED. 3. Verdict Defendants argue that this Court, in its findings of fact and conclusions of law, did not clearly set forth that its verdict is in rem, rather than in personam, against them. We agree, and the Court will amend the verdict to clarify its ruling. Plaintiff, Union Community Bank, Successor to Union National Community Bank, may proceed to execute upon its judgment in mortgage foreclosure, exercising all appropriate remedies authorized by the Pennsylvania Rules of Civil Procedure, including listing the subject property, 8281 Holbens Valley Road, New Tripoli, Pennsylvania 18066, for judicial sale. Therefore, this portion of Defendants motion is GRANTED. B. Plaintiff s Motion for Post-Trial Relief Filed October 19, 2017 Plaintiff argues two (2) issues, which the Court will address separately. 1. Attorney Fees In its reasons set forth on the record, this Court stated that While the promissory note and mortgage entitle the Plaintiff to recover collection costs and attorney s fees, no proof was provided of this such as statements, bills or the like, and the required testimony, so we find that Plaintiff has not provided sufficient evidence to support being awarded attorney s fees. 12 802 Union Community Bank vs. Wisser et ux. sented the testimony of Hersh, as to the $19, amount of attorney s fees expended by Plaintiff on this matter. Plaintiff also entered into evidence an itemized loan payoff statement which included the $19, amount of legal fees expanded by Plaintiff on this matter. Plaintiff argues that the testimony of Hersh and the loan payoff statement constituted sufficient proof of the $19, amount of attorney s fees expended by Plaintiff on this matter. We disagree. Plaintiff cites the cases of Citicorp Mortgage, Inc. v. Morrisville Hampton Village Realty Limited Partnership, 443 Pa. Superior Ct. 595, 662 A.2d 1120 (1995) and Federal Land Bank of Baltimore v. Fetner, 269 Pa. Superior Ct. 455, 410 A.2d 344 (1979), which indicate that the test for legal fees is reasonableness, which must be determined by the circumstances of each case. See Citicorp, supra at 600, 662 A.2d at Plaintiff argues that the holding in Citicorp, (citing Federal Land Bank), where that court found attorney s fees of 10% to be reasonable, controls the reasonableness of attorney s fees in the case before us. We disagree. In those cases, the relevant mortgage documents contained a clause that entitled the respective plaintiff to a 10% attorney s commission, thus setting forth contractually the amount of attorney s fees to which each was entitled. Id. at 600, 662 A.2d at Unlike the plaintiffs in Citicorp and Federal Land Bank, where the amount of attorney s fees awarded could be calculated mathematically using the 10% attorney commission provision in the mortgage documents, Plaintiff here needed to present evidence to support a specific amount of attorney fees and establish the reasonableness of those fees. Plaintiff argues that, since the alleged amount of legal fees expended was under 10% of the unpaid principal balance, and because of the case history which included preliminary objections, a counterclaim requiring further preliminary objections, briefs for summary judgment, trial preparation and attendance, the amount of legal fees were reasonable under Pennsylvania law. This argument, in essence, is that, since the Citicorp and Federal Land Bank cases found attorney s fees of 10% to be reasonable, the fee in the case at hand should be found reasonable because it is below the 10% threshold. 13 Union Community Bank vs. Wisser et ux. 803 The evidence fails to establish the amount of time that was expended by Plaintiff s attorneys in representing Plaintiff, the rate those attorneys charged Plaintiff for said time, or what services were actually performed. Plaintiff failed to provide any bills, statements, or testimony to describe the legal services provided to Plaintiff; thus, the Court is unable to determine from the evidence whether the figure submitted as attorney s fees is reasonable. Therefore, attorney s fees will not be awarded and this portion of Plaintiff s motion is DENIED. 2. Verdict The Complaint seeks interest at the variable Wall Street Journal Prime Rate plus 1.5% per annum with a minimum rate of 7.0% per annum. The promissory note, Plaintiff s Exhibit 1, states that Upon default... the interest rate on this Note shall be increased to % per annum ( Default Rate ). If judgment is entered in connection with this Note, interest will continue to accrue after the date of judgment at the Default Rate. The Plaintiff did not include a request for the % in the Complaint. Since the amount pled is less than the contract amount, we will award the amount pled. Thus, this portion of Plaintiff s motion is GRANTED. III. CONCLUSION For the foregoing reasons, the Court concludes as follows: 1. The Motion Of Defendants, Larry L. Wisser And Cathleen R. Wisser, For Post-Trial Relief Pursuant To Pa.R.C.P filed October 11, 2017 is DENIED in part and GRANTED in part; and 2. Plaintiff s Motion For Post-Trial Relief filed October 19, 2017 is DENIED in part and GRANTED in part; and 3. The Order entered on September 28, 2017 is amended as follows: a.
