3 Conditions: 1. Interested bidders can download the tender documents online from website & 2. The tenderer will have to deposit earnest money which is to be paid through e-mode online (NEFT/RTGS, Net Banking). Other mode of payment i.e. DD/Manual will not be considered. 3. Bidders have to pay the processing fee through e-mode online (NEFT/RTGS, Net Banking). Other mode of payment will not be considered. 4. Bidders, who wish to submit online tenders, can access tender documents on the website, fill it and submit the complete tender document into Electronic Tender on the website itself. Bidders shall attach scanned copies of all the documents, i.e. Earnest Money & Processing fee etc. as required in the Bid. 5. The tenders without earnest money, processing fee will not be considered. 6. Corrigendum / Addendum / Corrections, if any will be published on the website. 7. If the date of opening of tenders happens to be a holiday then the tenders will be opened on the next working day at the same time or as decided by the Committee. 8. The Tenders will be valid for 30 days from date of opening of Tenders. 9. The bidders are requested to submit the tenders well before the last date and time. 4 Terms & Conditions 1. All the payments regarding purchase of bid document i.e. processing fee of Rs.2361/- & earnest money of Rs required to be deposited through. e-mode/ online(neft/rtgs/net Banking). Other mode of payments DD/Manual will not be considered. The earnest money of the successful bidder shall be treated as security deposit and shall be refunded after satisfactory execution of work as per the purchase order and no interest shall be paid on it. 2. The rates should be F.O.R Sugar Mills including all expenses & freight charges. 3. GST extra as applicable. 4. The price given in the tender must be valid for one crushing season Payment clause :- No advance will be paid to the supplier a. for Items no. 1, 2, 4 & 7, 70% Payment is to be made within 10 days of delivery of material and balance 30% after satisfactory performance within 15 days of close of crushing season b. for item no. 5, 70% Payment is to be made within 10 days of delivery of material and balance 30% after satisfactory performance at the end of crushing season , after getting a certificate from Mfg. Department that Sugar Manufactured in the year is having ICUMSA colour not on higher side than the previous year. Otherwise proportionate deduction will be made from full amount value. ICUMSA test reports from Sri Ram Lab Delhi/Marc Lab Pune / Govt. Lab will be considered. c. for items no. 3, 60% Payment is to be made within 10 days of delivery of material and balance 40% within 10 days after getting the material tested from approved lab & receipt of test report. Testing charges will be borne by the supplier. d. for items no. 6, 60% Payment is to be made within 10 days of delivery of material and balance 40% within 10 days after getting the material tested from approved lab & receipt of test report. Testing charges will be borne by the supplier. ICUMSA of sugar to be below or equal 100 IU for Nawanshahr Coop., Sugar Mills Ltd., and below or equal 90 IU for Gurdaspur & Fazilka Coop. Sugar Mills. One random sample of sugar will be taken in presence of Sugarfed representative and got tested from Marc Lab Pune/Sri Ram Lab Delhi/ Any Other Govt. LAB and Testing expenditure will be borne by the supplier. 6. Supplier will have to attach food grade certificate from Sri Ram Lab Delhi/Marc Lab Pune/ Any Govt. Lab with the Technical Bid. Financial bids of only those bidders shall be considered whose technical bids submitted alongwith required fees & certificates as per this clause. 7. In case the supplier is unable to supply the material in time, the General Manager of concerned CSM shall have absolute powers to purchase the material at the risk & cost of the supplier. 8. Supplier has to give warranty for 12 months from the date of supply of material. If manufacturing defect is found during warranty period the same will be replaced free of cost. 9. No escalation whatsoever in nature will be entertained. 10. The contractor shall be subject to the provision of section 56 of the Indian contract Any dispute in respect of supply shall be in writing and made to the General Manager of Sugar Mills within six months of the date of completion of supply and where such a demand is not made within that period. Claim shall be deemed to have been waived and absolutely barred and the Sugar mill shall be discharged and released of all liabilities under the supply in respect of such claim. Such dispute is to be referred to the sole Arbitration of a person appointed by General Manager within the jurisdiction of courts at CHANDIGARH, UT only, against whose appointment no objection shall be entertained. In the event of Arbitrator's inability to function as 4

5 such, the General Manager of Cooperative Sugar Mills, shall be competent to appoint another person with reference from the stage where it is left by his predecessor. The decision of the Arbitrator so appointed shall be binding in both sides. 12. Tenders should be submitted strictly as per terms & conditions of the NIT. Any deviation shall not be entrained & shall result in rejection of tender. 13. Negotiations, if required will be held with the lowest bidder only. 14. The committee reserves right to reject any or all tenders without assigning any reason. Further committee reserves the right to alter any terms and condition of the tender if required.
