Homes, ) CPA, LLC, ) ) Defendants. ) ) This matter is before the Court on six motions to dismiss (ECF Nos. 18, 19, 21, 22, 39, & 41). For the reasons set forth herein, those motions are granted. BACKGROUND This action arises out of a protracted dispute between Plaintiff Paul Hulsey and Defendants Lawton Limehouse, Sr. and Lawton Limehouse, Jr. First, Hulsey filed suit in this Court on behalf of several of the Limehouses former employees against them and their companies, L&L Services, LLC, and WLL, LLC. See Flores v. Limehouse, No. 2:04-cv-1295-CWH, 2006 WL (D.S.C. May 11, 2006). That suit alleged violations of the Racketeer Influenced and Corrupt Organizations Act ( RICO ) and the Fair Labor Standards Act, among other things. After that case ended, both Limehouse defendants filed separate suits in South Carolina state court against Hulsey and his law firm, Plaintiff Hulsey Law Group, for defamation after Hulsey made comments to the Post and Courier newspaper about the Limehouses business practices. Plaintiffs removed

2 2:17-cv PMD Date Filed 08/02/18 Entry Number 56 Page 2 of 7 those suits to this Court, but Judge C. Weston Houck remanded them back to state court shortly thereafter. Once the cases returned to state court, Plaintiffs failed to file an answer and the Limehouses requested and received an entry of default in both of their cases. Plaintiffs sought to undo the entry of default pursuant to Rule 55 of the South Carolina Rules of Civil Procedure, but were unsuccessful. The state court then held two default damages hearings where the Limehouses were permitted to present evidence of their damages. Plaintiffs were not permitted to present any affirmative evidence and were only allowed to cross-examine the Limehouses witnesses and object to the Limehouses evidence. At the end of the default damages hearings, the Limehouses received substantial verdicts, including punitive damages. Plaintiffs appealed those verdicts to the South Carolina Court of Appeals, which affirmed the trial court. Plaintiffs then appealed to the South Carolina Supreme Court, which reversed the trial court and the Court of Appeals because a certified copy of Judge Houck s remand order was not sent to the state court. Limehouse v. Hulsey, 744 S.E.2d 566, 575 (S.C. 2013). Thus, concluding that the trial court lacked jurisdiction, the South Carolina Supreme Court vacated the default damages verdicts and remanded to the trial court for discovery and new trials. Id. However, that court also concluded that the trial judge s decision limiting Hulsey to cross-examination and objections to evidence was correct in the context of a default damages hearing. Id. at 579. After the verdicts were overturned, the cases returned to state court. The parties were permitted to engage in discovery, and Plaintiffs learned of the IRS levy against the Limehouses businesses through that process. Limehouse, Sr. s defamation case against Plaintiffs was then retried, and Plaintiffs won. Limehouse, Sr. appealed that verdict, and in the meantime the parties turned to Limehouse, Jr. s case. Before that case could be tried, and while Limehouse, Sr. s case 2

Plaintiffs ultimately agreed to pay the Limehouses $500, in installments. 1 Now, Plaintiffs allege that the Limehouses and their companies, with assistance from their lawyer (Frank M. Cisa), their accountant (Richard B. Homes), and their banker (Robert A. Daniel, Jr.), committed additional RICO violations during the course of the Limehouses defamation law suits. Specifically, Hulsey alleges that the Limehouses lawsuits were a sham and that they and their confederates conspired to conceal the existence of an IRS tax levy against the Limehouses. According to Plaintiffs, the tax levy, rather than the defamatory comments, was the true reason for the demise of the Limehouses business. Hulsey also alleges various state law causes of action against the Limehouses and the other defendants arising out of the same conduct. PROCEDURAL HISTORY Lawton Limehouse, Sr. filed his motion to dismiss on December 7, That same day, Defendant Pinnacle Bank and its employee, Robert A. Daniel, Jr., filed their motion to dismiss, as did L&L Services and WLL. Five days later, Cisa and his law firm, Defendant Cisa & Dodds, LLP, filed their motion to dismiss. Then, on December 28, Richard Homes and his firm, Richard B. Homes, CPA, LLC filed their motion to dismiss. Finally, Lawton Limehouse, Jr. filed his motion to dismiss on January 2, After numerous responses, replies, and even several surreplies, these matters are now ripe for consideration. LEGAL STANDARD A motion to dismiss pursuant Rule 12(b)(6) for failure to state a claim upon which relief can be granted challenges the legal sufficiency of a complaint. Francis v. Giacomelli, 588 F.3d 186, 192 (4th Cir. 2009) (citations omitted); see also Republican Party of N.C. v. Martin, 980 F.2d 1. Defendants correctly point out that Plaintiffs were aware of the IRS levy at the time they chose to settle. 3

4 2:17-cv PMD Date Filed 08/02/18 Entry Number 56 Page 4 of 7 943, 952 (4th Cir. 1992) ( A motion to dismiss under Rule 12(b)(6)... does not resolve contests surrounding the facts, the merits of a claim, or the applicability of defenses. ). To be legally sufficient, a pleading must contain a short and plain statement of the claim showing that the pleader is entitled to relief. Fed. R. Civ. P. 8(a)(2). When ruling on a Rule 12(b)(6) motion to dismiss, the trial judge must accept as true all of the facts alleged in the plaintiff s complaint and construe all reasonable inferences in favor of the plaintiff. E.g., E.I. du Pont de Nemours & Co. v. Kolon Indus., Inc., 637 F.3d 435, 440 (4th Cir. 2011). The court must determine whether the allegations give rise to a plausible right to relief, Iqbal, 556 U.S. at 679; however, it should not accept legal conclusions couched as facts or unwarranted inferences, unreasonable conclusions, or arguments, United States ex rel. Nathan v. Takeda Pharm. N. Am., Inc., 707 F.3d 451, 455 (4th Cir. 2013) (quoting Wag More Dogs, LLC v. Cozart, 680 F.3d 359, 365 (4th Cir. 2012)); see also Iqbal, 556 U.S. at 678 ( [T]he tenet that a court must accept as true all of the allegations contained in a complaint is inapplicable to legal conclusions. ). Thus, although the court must accept a plaintiff s well-pleaded factual allegations as true for purposes of ruling on the motion, the complaint must nevertheless satisfy the twopronged test articulated by the Supreme Court. Iqbal, 556 U.S. at 679. DISCUSSION The Rooker-Feldman doctrine is one of a number of doctrines that safeguards our dual system of government from federal judicial erosion. Brown & Root, Inc. v. Breckenridge, 211 F.3d 194, 198 (4th Cir. 2000). Under the Rooker-Feldman doctrine, superior state courts, and ultimately, the United States Supreme Court, have exclusive jurisdiction to review state-court decisions such that the lower federal courts are generally barred from reviewing such decisions. Exxon Mobil Corp. v. Saudi Basic Indus. Corp., 544 U.S. 280, 284 (2005) (holding that the Rooker- Feldman doctrine prevents a federal court from asserting jurisdiction in cases brought by state- 4

5 2:17-cv PMD Date Filed 08/02/18 Entry Number 56 Page 5 of 7 court litigants dissatisfied with state-court judgments and inviting district court review and rejection of those judgments ). The Fourth Circuit has explained that the application of the doctrine turns on whether the state-court loser who files suit in federal district court seeks redress for an injury caused by the state-court decision itself. If he is not challenging the state-court decision, the Rooker-Feldman doctrine does not apply. Davani v. Va. Dep t of Transp., 434 F.3d 712, 718 (4th Cir. 2006). Further, the doctrine applies not only to matters directly decided by the state court but also to claims which are inextricably intertwined with state-court decisions. D.C. Court of Appeals v. Feldman, 460 U.S. 462, (1983). Although Plaintiffs seek to artfully dodge the issue through careful drafting, the crux of their alleged Scheme Two is that Defendants sought to fraudulently conceal the IRS levy in order to successfully prosecute the Limehouses defamation claims against Hulsey and his firm. However, the only reason Plaintiffs did not earlier discover the IRS levy was a direct result of their failure to defend the state court defamation actions after they were remanded from this Court back to state court. 2 Essentially, Plaintiffs are arguing that the state court should have allowed them to discover the IRS levy sooner, and that Scheme Two was enabled by the state court s decision to deny Plaintiffs the opportunity to pursue discovery while they were in default. However, Plaintiffs initial failure to obtain the IRS levy in state court stems entirely from the state court s decision to deny Plaintiffs motion to compel discovery after the entry of default. Although the South Carolina Supreme Court ultimately overturned the defaults in those cases for other reasons, it upheld Judge Young s decision that Plaintiffs were not entitled to discovery after the entry of 2. To the extent that Plaintiffs contend they were entitled to discover the IRS levy independently of discovery in the state court defamation cases, they have presented no authority for that proposition and no alternative method for that disclosure. Plaintiffs baldly contend that Defendants failed to provide them with the IRS levy during discovery in the previous RICO case, but admit that action was settled before it was even conditionally certified. Plaintiff bears the burden of establishing subject-matter jurisdiction at the motion to dismiss stage, Adams v. Bain, 697 F.2d 1213, 1219 (4th Cir. 1982), and has not alleged the requisite facts to support a theory that disclosure of the levy should have been made outside of the ordinary discovery process. 5

Limehouse, 744 S.E.2d at 579 ( we hold that Judge Young correctly precluded Hulsey from engaging in discovery and limited his participation to cross-examination and objection to the plaintiff s evidence. ). Plaintiffs have already litigated the question of whether they were entitled to earlier discover the IRS levy in South Carolina s appellate courts and, having lost that ground of their argument, now seek a holding from this Court that would undermine the South Carolina Supreme Court s decision. As discussed in the background section above, Plaintiffs allegations that the state court defamation cases were sham lawsuits are predicated on their allegations that the IRS levy, rather than the purportedly defamatory statements, was the true cause of the entities demise. As a result, Plaintiffs claim that Defendants committed fraud and RICO violations when they concealed the existence of that IRS levy. In order for Plaintiffs to prevail in their causes of action, the Court would have to conclude, contrary to the decision of the state appellate court, that Plaintiffs were entitled to discover the IRS levy earlier and that Defendants had concealed it from them. However, Plaintiffs have not alleged any method by which they were entitled to earlier discover the levy other than the motion to compel that the state court denied. Since Plaintiffs motion to compel discovery was fully litigated in the state court system, and Plaintiffs claims here are inextricably intertwined with that decision, the Court lacks jurisdiction over this case pursuant to the Rooker-Feldman doctrine. Accordingly, the Court dismisses this action because it lacks subject-matter jurisdiction. 6
