3 B. CONTENTS OF THE SUBJECT 1. Purpose and objectives of the subject: This subject aims to introduce legal and institutional mechanisms by which the punishment of perpetrators of criminal offences with international elements is realized, and to ensure the cooperation between states in the fight against international criminality. The main part of this subject comprises of the treatment of international penal jurisdictions, organization and principles of functioning and decision making of the international criminal courts. Also, a special focus is placed on penal standards regulating the mutual legal assistance and cooperation of the status with those courts for the prevention and punishment of criminal offences with international elements. The content of the subject aims at the introduction to advanced standards of criminalprocedural justice at European level and of key institutions and institutes of the contemporary criminal law of the European countries. It provides the students with skills in a broader meaning of criminal justice and the criminal procedure concepts within a comparative framework. The review will deal with treaties, conventions and statutes as part of the international criminal legislation representing a source for the implementation of the activity of international criminal courts and administration of criminal justice at international level. Simultaneously, it will be addressed the relation of this group of legislation to the domestic legislation in criminal matters. Theoretical aspects will be illustrated with issues of the practice of international and domestic courts, which had a special importance for the provision of criminal justice standards at international level. 2. Key concepts every student should know about the subject Jurisdiction, sovereignty, principles of the exercise of sovereignty, international crime, international court, appointment and qualifications of prosecutors and judges, organization of the prosecutor s office and court, universal jurisdiction, status responsibility, individual responsibility, immunity, international statute, forms of international cooperation in criminal matters, victims protection system. 3. Skills acquired by the student: By the end of the course, the students will have proper knowledge required for deepening the skills about the standards of criminal justice, particularly a deeper knowledge of the criminal legislation in international area, challenges related to the administration of criminal justice, standards of criminal justice, a deeper knowledge of the judicial jurisprudence at international level and standards of the respect of human rights and fundamental freedoms in the criminal process. Through the promotion of individual and research work as part of the methodology, the students will be able to carry out research activities in the area of international penal legislations and judicial jurisprudence. During the course the students will create a perspective and level of necessary knowledge about the activity of international penal jurisdictions as a tool of rendering justice
4 internationally, trends of the harmonization of penal legislation at the international level. This course will train and prepare the students in the labor market in areas such as sectors of administration of criminal justice or law enforcement bodies. 4. Topics of lectures Topic 1. International criminal legislation, overview, need of study, meaning, nature and sources. Topic 2. Evolution of the international criminal legislation, pinnacles of codification, need for punishment of international crimes, historical and political-social grounds. Topic 3. Evolution of the concept of criminal liability at international level, features and characteristics, position and jurisprudence of courts. Topic 4. Contribution of conventions and treaties to guarantee trial standards. Protection of defendant s rights in the criminal process. Topic 5. Development and influence of judicial jurisprudence in the area of the provision of criminal justice standards. Topic 6. Concept, models and prerequisites for the exercise of jurisdiction, provided model for the Military Court of Nuremberg and Hague Tribunal, principle of complementarity, consequences and way of sanctioning in the Rome Statute. Topic 7. Bodies of administration of criminal justice, general aspects about qualifications, organization, recruitment in duty and organizational structure. Topic 8. Punishment of international crimes by the courts of Nuremberg and Tokyo, establishment, organization and aspects of activity implementation. Topic 9. International Tribunal for former Yugoslavia, establishment, organizational structure, composition, exercise of jurisdiction. Topic 10. Jurisprudence of International Tribunal for former Yugoslavia, treatment and analysis of legal concepts as a tool for the development of the international criminal legislation. Topic 11. International Criminal Court, need of establishment, negotiations and preparatory activity. Topic 12. International Criminal Court, establishment, structure, composition, exercise of jurisdiction. Topic 13. Current developments about the activity of the International Criminal Court and its role in the punishment of international crimes. Topic 14. Other jurisdictions with international elements, functioning system, nature, role and importance. Topic 15. Results and challenges in the further activity of international penal jurisdictions and other mechanisms for rendering justice internationally. C. LEARNING METHODS 1.Use of new learning technologies
5 Lectures in power-point, handout, supply with preliminary materials, study of practical cases. 2. Learning methods and techniques The methodology to be used during the course will be focused on the combination of theory with the analysis of practical cases through the jurisprudence of international criminal courts; employment of the interactive method for the promotion of debate and participation of students in lectures and seminars, encouragement of the work in group through the preparation and presentation of course assignments and essays, encouragement of the critical approach through comparative study of the domestic legislation and the international one, as well as acts providing for standards in the area of criminal justice. 3. Forms of learning Lectures, seminars, analysis of the cases of the Strasbourg Court cases and foreign courts, promotion of participation in their discussion, debate about special topics. 4.Assignments/essays, cases of Albanian or foreign practice, to be prepared in writing The students will prepare course assignments/essays. They will be produced in writing and the presentation will be made during the seminars. 5. Local and foreign professors and specialists and personalities of area, invited during the subject cycle External collaborators of the Department of Criminal Matters of the Faculty of Law from foreign faculties, local specialists. 6.Open Lectures A representative of the First Instance Court about the topic of harmonization of the Albanian criminal legislation with the request for cooperation and legal-criminal aid stemming from the international legislation.
