1 LICKING COUNTY MUTUAL AID AGREEMENT THIS AGREEMENT shall be effective as of this 4 th day of February, 2013, by and between the following Law Enforcement Agencies and their respective political subdivisions, corporations, boards, and/or legislative bodies (the Party or Parties ): Alexandria Police Department Buckeye Lake Police Department Granville Police Department Heath Police Department Hebron Police Department Johnstown Police Department Kirkersville Police Department Licking County Sheriff s Office Licking Park District Licking Memorial Health Systems Police Department Newark Division of Police New Albany Police Department Ohio State Highway Patrol-Post 45 Ohio State University Pataskala Police Department Reynoldsburg Police Department St. Louisville Police Department Union Township Police Department Utica Police Department PREAMBLE WHEREAS, the Parties to this Agreement are of the mutual understanding that additional police protection and/or services for citizens within their boundaries may be necessary; and, WHEREAS, the Parties to this Agreement are of the mutual understanding that each is hereby willing and capable of providing additional police protection and/or services for the citizens of the other Parties hereto through mutual aid responses; and, WHEREAS, the Parties to this Agreement are authorized to provide police protection and/or services through mutual aid responses pursuant to Ohio Revised Code Sections 9.482; ; ; ; ; and/or, L i c k i n g C o u n t y M u t u a l A i d F e b r u a r y Page 1

2 NOW, THEREFORE, BE IT AGREED among the Parties hereto as follows: 1. Each Party shall determine who within their agency is authorized to request and terminate mutual aid; and, shall be responsible for providing the name or names of any such person(s) so authorized to the Licking County Prosecutor s Office and to each of the other Parties hereto. Each Party shall also be responsible for updating the Licking County Prosecutor s Office and the other Parties hereto when any authorizations, made pursuant to this Paragraph, are changed, terminated or otherwise updated. 2. Mutual aid may be requested via radio communication, telephone during an emergency or in any form determined and made known to the other Parties by the requesting Party prior to a planned event. The requesting Party shall state the specific manpower and equipment needed, and shall give explicit directions as to the location where mutual aid is required. 3. Each Party shall furnish, upon request by an authorized agent of another Party hereto, such mutual aid, manpower and equipment to the extent it is available. The extent to which any Party shall respond to a request for mutual aid is left to the discretion of the most senior on-duty officer of each Party. 4. Law enforcement officers acting outside of their jurisdiction, specifically pursuant to the terms and conditions of this Mutual Aid Agreement, shall have the same authority to enforce the laws of the State as when acting within their jurisdiction. 5. The most senior officer from the requesting Party that is on scene shall assume any and all responsibility for implementing the terms and conditions of this Mutual Aid Agreement and for the assignment of incoming personnel and equipment. The most senior officer from the requesting Party shall determine the method of radio communication for responding personnel for interoperability purposes. 6. Any personnel/officers requested, pursuant to this Agreement, shall only be utilized for the time during which the need exists, after which time their services will be terminated by the person so authorized by the requesting Party. 7. The execution of this Agreement, by the Parties hereto, shall not give rise to any liability or responsibility whatsoever if a Party fails to respond to, or inadequately or negligently responds to, any request for mutual aid made pursuant to this Agreement. 3 8. Each Party shall assume the risk of liability that may result from its own actions or omissions taken hereunder. Each Party shall also assume the risk of liability that may result from the actions or omissions of its employees and/or agents taken hereunder. No Party agrees to insure, defend, or indemnify any other Party hereto. 9. No Party requesting mutual aid shall be obligated to pay salary reimbursement, overtime or any other compensation in any form or character to a responding Party or to the responding Party s law enforcement members. 10. No Party requesting mutual aid shall be responsible for any loss or damage to the equipment of a responding Party. Each Party shall assume all costs of damage or loss of equipment or apparatus that it may incur while responding to a call made pursuant to this Agreement. 11. Members of the police departments or law enforcement departments acting outside of the political subdivisions, in which they are employed, pursuant to this Agreement, shall be entitled to participate in any indemnity fund established by their employer to the same extent as while acting within the employing subdivision. Such members shall be entitled to all rights and benefits of Chapter 4123 of the Ohio Revised Code (Workers Compensation), to the same extent as while performing service within their employing subdivisions. 12. No Party requesting mutual aid shall be responsible for any indemnity award or premium contribution assessed against a responding Party for Workers Compensation benefits arising by reason of injury or death to a member of the responding Party. 13. Chapters 2743 and 2744 of the Ohio Revised Code, insofar as applicable to the operation of police departments, apply to the contracting Parties and their law enforcement members when the Parties and their members are rendering service outside of their own subdivision pursuant to this Agreement. 14. This Agreement shall be in effect for a period of one (1) year from the effective date and shall automatically renew for successive periods of one (1) year as to all Parties executing the same. However, any Party may withdraw from this Agreement by giving thirty (30) days written notice of its intention to withdraw to the Licking County Prosecutor s Office and to all other Parties to this Agreement. 4 15. This Agreement may be executed in any number of counterparts all of which together shall be considered a single instrument. It shall not be necessary for any counterpart to be signed by more than one party. The Licking County Prosecutor s Office shall be the official depository for this Agreement, along with an instrument executed by each Party stating who is authorized to initiate and/or terminate requests for assistance for that agency. The Licking County Prosecutor s Office shall send to each Party to this Agreement a certificate showing the names of the Parties that have executed this Agreement and a list of the person(s), by Party, authorized to initiate and/or terminate requests for assistance. 16. This Agreement will be reviewed and revisions made as needed by the Licking County Prosecutor s Office every five (5) years from the date that this Agreement is signed into effect. Each Party may also have their designated legal counsel review this Agreement every five (5) years from the effective date, and propose revisions as deemed to be necessary. Revisions that are required by law may be proposed and made at any time. 5 This Agreement shall become binding as to the Parties that have signed upon execution by those authorized by each Party s legislative authority.
