Plaintiffs have previously filed Responses to Motions to dismiss the Complaint, Amended Complaint and Corrected Amended Complaint (DE 66), Affidavit of Steven Bazsuly (DE 76), Affidavit of Steven Bazsuly (DE 105), Affidavit of Steven Bazsuly (DE 106) and Notice of Filing Supplemental authority (DE 102). Rule 56 of the Federal Rules of Civil Procedure entitled Summary Judgment provides in F.R.C.P. 56 ) that a party against whom a Motion for Summary Judgment is filed has until the day prior to the date fixed for a hearing on the Motion for Summary Judgment to file their responsive pleadings. The Court has set no such summary judgment hearing. The time is still ripe for Plaintiffs to file opposing affidavits. Defendants chose to file motions for summary judgment and now must live with their decisions. 3. Rule 6 of the Federal Rules of Civil Procedure entitled Time provides in F.R.C.P. Rule 6 (d) For Motions-Affidavits provides that opposing affidavits may be served not later than 1 day before the hearing, unless the court permits them to be served at some other time. No such hearings have been set by this Court. 4. In the instant case, Plaintiffs have filed their global responses and affidavits in a timely manner. As set forth in the docket entries which are at issue and are cited above, Plaintiffs have responded to every issue raised by all of the various defense motions. The Defendants; Motions (DE 109, 110, 111, 113, and Notice of Joinder dated 03/16/04, DE 117) raise no new issues that have not been previously addressed by the Plaintiffs prior responses and should be denied. 5. The defendants Motions (DE 109, 110, 111 and 113 and Notice of Joinder dated 03/17/04, DE 117) should be deemed frivolous and Plaintiffs should be awarded their attorneys fees and costs for defending against these motions under Rule 11 of the Federal Rules of Civil Procedure.
