5 Census (Jersey) Law 1951 Article 1 CENSUS (JERSEY) LAW A LAW to make provision for the taking from time to time of a census of the population of Jersey Commencement [see endnotes] 1 Definitions In this Law Minister means the Chief Minister; Regulations means Regulations made under this Law. 2 2 Power to make Regulations directing the taking of a census and prescribing procedure in relation thereto (1) Subject as hereinafter provided, the States may make Regulations (a) (b) (c) (d) (e) (f) (g) (h) directing that a census shall be taken for Jersey; prescribing the date on which the census is to be taken; prescribing the persons by whom and with respect to whom the returns for the purpose of the census are to be made; prescribing the particulars to be stated in the returns; providing for the division of Jersey into districts for the purpose of the census and the appointment of persons to act in those districts; requiring persons appointed under the Regulations to perform such duties in connection with the taking of the census as may be prescribed by the Regulations; requiring persons appointed under the Regulations to make an affidavit with respect to the performance of their duties; requiring the chief officers of public or charitable institutions, or of any other institutions prescribed by the Regulations, to make returns with respect to the inmates thereof; Revised Edition 1 January 2017 Page - 5

6 Article 3 Census (Jersey) Law 1951 (i) (j) (k) requiring information to be given to the persons liable to make returns by the persons with respect to whom the returns are to be made; with respect to the forms to be used in the taking of a census; and making provision with respect to any other matters in relation to which it is necessary to make provision for the purpose of carrying the Regulations into effect. (2) Any such Regulations may be repealed, amended or varied by subsequent Regulations. 3 Duties of Minister in connection with census (1) It shall be the duty of the Minister to make such arrangements and do all such things as are necessary for the taking of a census in accordance with the provisions of this Law and of any Regulations, and for that purpose to make arrangements for the preparation and issue of the necessary forms and instructions and for the collection and reception of the forms when filled up. (2) As soon as may be after the taking of a census, the Minister shall (a) (b) prepare a report on the census returns and present the same to the States; and cause a copy of the report to be transmitted to Her Majesty s Government in the United Kingdom. 4 Penalties (1) If any person (a) (b) (c) (d) refuses or neglects to comply with or acts in contravention of any of the provisions of this Law or of any Regulations; being a person required by any Regulations to make an affidavit with respect to the performance of his or her duties, makes a false declaration; being a person required by any Regulations to make, sign, or deliver any document, makes, signs, or delivers, or causes to be made, signed, or delivered, a false document; or being a person required in pursuance of any Regulations to answer any question, refuses to answer or gives a false answer to that question, the person shall for each offence be liable to a fine of level 2 on the standard scale. 3 (2) If any person (a) being a person employed in taking a census, without the authority of the Minister, publishes or communicates to any person otherwise than in the ordinary course of such employment any information acquired by the person in the course of his or her employment; or Page - 6 Revised Edition 1 January 2017

7 Census (Jersey) Law 1951 Article 5 (b) having possession of any information which to his or her knowledge has been disclosed in contravention of this Law, publishes or communicates that information to any other person, the person shall be liable to imprisonment for a term of 2 years and to a fine. 4 5 Expenses 5 6 Citation This Law may be cited as the Census (Jersey) Law Revised Edition 1 January 2017 Page - 7
