1 Romford Market Byelaws 1. In these byelaws, except where the context otherwise requires: "the Council" means the Mayor Aldermen and Burgesses of the London Borough of Havering acting by the Council; "goods" includes provisions, commodities, and articles brought into the Market Place for the purpose of sale; "Market days and hours" means the days and hours appointed by the Council for the holding of a Market; "the Market Place" means that area adjacent to Main Road, Romford together with that part of North Street, Romford allocated by the Council for that purpose from time to time as shown hatched red on a map sealed by the Council, a copy of which is deposited at the Office of the Market Superintendent and available for inspection there on Market days; another copy of the map is deposited at the Town Hall, Romford and is available for inspection on any weekday during the usual office hours; "Market Superintendent" means the person appointed by the Council to exercise general management, supervision and control of the Market, or his duly authorised representative; "sell" and "sale" include exposing and exposure for sale; "stall" includes any building, shop, office, compartment, standing, bench, table, place or space used or intended to be used for the sale of goods; "Vehicle" includes any mechanically propelled vehicle (other than an invalid chair) and any cycle, tricycle, cart, barrow, wagon or trailer. Regulation of Traffic and Prevention of Obstruction 2 (a) No person shall park any vehicle in the Market Place on Market days; PROVIDED THAT this byelaw shall not apply to a vehicle halted in any avenue or passage in the Market Place or in the immediate approaches thereto for such period as is reasonably necessary for the loading or unloading of goods otherwise than between the hours of 10 a.m. and 4.30
2 p.m. (b) No person in charge of any vehicle shall station such vehicle in the Market Place or in the immediate approaches thereto in such manner as to hinder any other vehicle in arriving at or departing from the Market Place and no person shall wilfully or improperly station such a vehicle so as to occupy a position in which the person in charge of any other vehicle is entitled to load or unload goods. 3. No person shall park any vehicle in the Market Place or in the immediate approaches thereto in such a manner as to obstruct the Market Superintendent in the due preparation of the Market Place immediately before Market hours or in the reasonable cleaning and cleansing thereof immediately following Market hours. 4. No person shall wilfully loiter or stand in such a manner or such a position as to cause obstruction in any avenue or passage in the Market Place or in the immediate approaches thereto. 5. No person shall bring animals or goods into the Market Place for the purpose of sale more than two hours before the Market opens or allow them to remain there more than an hour and a half after the Market closes otherwise than with the consent of the Council. 6. No tenant or occupier of a stall in the Market Place shall cause or permit any goods or any receptacle for goods to be placed on any stall so as to project beyond the limits of such stall. Authority to Use Space 7. (a) No person shall, in the Market Place, occupy or take possession of any stall or deposit or cause to be deposited any goods on any stall unless and until such stall has been duly let assigned or otherwise allocated by the Market Superintendent for the use of such person. (b) No person shall erect, place or fix or attempt to erect, place or fix any stall in the Market Place without the previous consent of the Market Superintendent. 8. Where the Council -
3 (a) appropriate any part of the Market Place for the sale of animals or goods, or any class of animals or goods, or for sales by auction, and (b) display in a conspicuous place a public notice to that effect, no person shall sell animals or goods, or hold sales by auction, except in accordance with the terms of that appropriation. For Maintaining Cleanliness 9. Every tenant or occupier of a stall shall: (a) cause the stall to be properly cleansed before and after Market hours, and as often as may be necessary during these hours; (b) cause all refuse from the stall and all refuse arising from the loading and unloading of goods required in connection with the stall to be placed in a receptacle provided by the Council for this purpose. For the Preservation of Order 10. (a) No person shall, in the Market Place, use any fire, stove or other heating or lighting appliance save at such time and in such position as may from time to time be approved by the Market Superintendent. (b) Every tenant or occupier of a stall shall cause every fire, light, stove or other heating or lighting appliance used in connection with the stall to be extinguished not later than an hour and a half after the Market closes. 11. No person shall, to the annoyance of any other person, ring any bell or blow any horn or use any other noisy instrument or loudspeaker to attract the attention or custom of any person to any sale or to any goods intended for sale. 12. Every person who shall offend against any of these byelaws shall be liable on summary conviction to a fine not exceeding 20.
4 B. BYELAW IN RESPECT OF A MARKET AT ROMFORD 1. In this byelaw, except where the context otherwise requires: "the Council" means the Mayor and Burgesses of the London Borough of Havering acting by the Council; "Market days" and "Market hours" means, respectively, the days and hours appointed by the Council for the holding of a market; "the Market Place" means that area adjacent to Main Road, Romford together with that part of North Street, Romford allocated by the Council for that purpose from time to time as shown hatched red on a map sealed by the Council, a copy of which is deposited at the office of the Market Superintendent and available for inspection there on Market days; another copy of the map is deposited at the Town Hall, Romford and is available for inspection on any weekday during the usual office hours; "sell" and "sale" include exposing and exposure for sale. 2. No person other than a pedlar holding a certificate under the Pedlars Act 1871 shall sell in any place in the London Borough of Havering within a distance of 620 metres from the perimeter of the Market Place as shown on the deposited map except in his own dwelling place, or shop or in or at the door of any premises to a person resident therein, on a day appointed for the holding of a market and during market hours any article specified in the Schedule hereto, being articles commonly sold in the Market Place. 3. Any person who offends against this byelaw shall be liable on summary conviction to a fine not exceeding The byelaw with respect of a market which was made by the Mayor, Aldermen and Burgesses of the London borough of Havering acting by the Council on the 6th day of July 1983 and confirmed by the Secretary of State for the Environment on the 23rd day of September 1983 is hereby revoked.
