2 Annexure-I INSTRUCTIONS FOR ONLINE BID SUBMISSION 1. The tender document may be downloaded from the web site Online submission of Bids through Central Public Procurement Portal ( is mandatory. Hence, the tenderers/bidders are requested to submit online bids through Central eprocurement portal Manual/ Offline bids shall not be accepted under any circumstances. Bidders are not required to send the hard copies of the tender bids. 2. The bidders are requested to visit the website regularly. Any changes/modifications in the tender will be intimated by corrigendum through this website only. 3. In case, any holiday is declared by the Government on the day of opening, the tenders will be opened on the next working day at the same time. The Director reserves the right to accept or reject any or all the tenders. 4. The online bids will be accepted under two bid system. 5. The rates are to be quoted in Financial bid as per BOQ in MS Excel format only as given in Annexure-IV while submitting online bid. The name of BOQ file should not be changed by the bidder. 6. a. The bidders are required to upload the scanned copy of Earnest Money Deposit (EMD) and Tender Fee while submitting online bids. b. The bidders need to deposit (in original) the Earnest Money Deposit (EMD) of Rs. 2,00,000/- (Rupees Two Lakhs only) and Tender Fee of Rs. 1,000/- (Rupees One Thousand only) in the form of Demand Draft to be made in favour of ICAR- Unit, NRCSS, Ajmer and to be sent in original to The Asstt. Admn. Officer, ICAR- National Research Centre On Seed Spices, Tabiji, Ajmer (Raj.). c. Only the Earnest Money Deposit (EMD and Tender Fee should be sent by post/in person so as to reach at the Centre before the time of opening of tender/ technical bids. The late received Earnest Money Deposit (EMD and Tender Fee will not be accepted and the online bid submitted will be treated as non responsive. The Centre will not be responsible for any delay in receipt of Earnest Money Deposit (EMD) and Tender Fee by post/any other mode. 7. All the scanned documents, that are required to be uploaded, should be duly signed with seal by the Authorised Signatory. Overwriting & correction(s) should be attested properly. The bidders are required to upload the scanned copies of the following documents while submitting online bids, without which the bids shall not be evaluated and shall be treated as non responsive:- a. The Rates are to be quoted in Indian currency (in Rupees) only, not in percentage. 10. The validity of tender bids shall be 90 days from the date of opening tender/ technical bids. 11. The online bids received up to due date and time will be opened at Central public procurement portal only. 4 Annexure-II (A) TERMS & CONDITIONS OF JOB CONTRACT 1. Only online bids will be accepted under two bid system. 2. The bidders need to deposit (in original) the Earnest Money Deposit (EMD) of Rs. 2,00,000/- (Rupees Two Lakhs only) and Tender Fee of Rs. 1,000/- (Rupees One Thousand only) in the form of Demand Draft to be made in favour of ICAR Unit, NRCSS, Ajmer and to be sent in original to The Asstt. Admn. Officer, ICAR- National Research Centre On Seed Spices, Tabiji, Ajmer (Raj.) so as to reach at the Centre before the time of opening of tender/ technical bids. Except these, no other document should be sent by post. 3. The tender bids should be submitted as per the points/details specified in the tender document. 4. If a firm quotes Nil service charges/ charges/ consideration, the bid shall be treated as unresponsive and will not be considered. (As per Ministry of Finance O.M. no. 29(1) 2014-PPD dated : Clarification in Rule 160(xiv) of General Financial Rules, regarding award of contract to a firm which has quoted Nil consideration in the bid). 5. The tenderer is being permitted to give tenders in consideration of the stipulations on his/her part that after submitting his/her tenders, he/she will not refuse his/her offer or modify the terms and conditions thereof. If the tenderer fail to observe and comply with the foregoing stipulation, the Earnest Money will be forfeited by the ICAR- NRCSS, Ajmer. In the event of the offer made by the tenderer not being accepted, the amount of earnest money deposited by the tenderer will be refunded to him/her after he/she has applied for the same, in the manner prescribed by the ICAR- NRCSS, Ajmer. 6. The tender is liable to be ignored if complete information as required is not given therein or if the particular asked for in the schedules to the tenders is not fully filled in Individual signing the tenders or other documents connected with the contract may specify whether he signs it in the capacity of (i) a sole proprietor of the firm or constituted attorney of such sole proprietor, or (ii) a partner of the firm if it be partnership in which case he must have authority to refer to arbitration dispute concerning the business of the partnership whether by virtue of the partnership agreement or power of attorney or (iii) constituted attorney of the firm if it is a company. 7. In case of partnership firms, where no authority has been given to any partner to execute the contract agreement concerning the business of the partnership, the tenders and all other related documents must be signed by every partner of the firm. A person signing the tenders form or any other documents forming part of the contract on behalf of another shall be deemed to warranty that he was authority to bind such other and if, on enquiry it appears that the persons so signing had no authority to do so, the ICAR- NRCSS, Ajmer shall without prejudice to other civil and criminal remedies cancel the contract and hold the signatory liable for all costs and damages. Each page of the tenders and the schedules to the tenders and annexure, if any, should be signed by the tenderer. 8. In case, the tenderer does not accept the offer, after issue of letter of award by ICAR- NRCSS, Ajmer within 15 days, the offer made shall be deemed to be withdrawn without any notice & the earnest money deposit (EMD) shall be forfeited. 9. The Tender would be evaluated based on the documents & information furnished by the Tenderer in response to the requirements given in the Tender, total monthly liability of technical responsive bidders, the Service Charges quoted and actual amount to be paid to the Labour. 5 10. The rates quoted by firm for job contract in tenders are to be given both in words and figures failing which the same is liable to be rejected. 11. The ICAR- NRCSS, Ajmer is not bound to accept the lowest or any other tenders and also reserve to itself the right of the accepting the tenders in whole or in part. 12. An amount of 10% of total contract value as a performance security/ security deposit for the job contract is to be deposited by the successful agency/ tenderer only after receiving a communication form the ICAR- NRCSS, Ajmer. In the event of non-deposition of the same the earnest money will be forfeited. The performance security/ security deposit will be released after 3 months of expiry of contract, subject to clearance of all dues pending against the contracting agency. 13. Acceptance by the ICAR- NRCSS, Ajmer will be communicated by Speed Post/Fax/ or any other form of communication. Formal letter of acceptance of the tender will be forwarded as soon as possible, but the earlier instructions in the Speed Post/Fax/ etc. should be acted upon immediately. 14. No interest on security deposit and earnest money deposit shall be paid by the ICAR- NRCSS, Ajmer. 15. GST or any other tax applicable or made applicable after awarding the contract in respect of this job contract shall be payable by the contractor and ICAR- NRCSS, Ajmer will not entertain any claim whatsoever in this respect. However any tax or duty which is payable as per the rules of the Govt., shall be deducted at source from monthly bills of the successful tenderer, as per rules/instructions made applicable from time to time. At present, no GST applicable as the agriculture services being under negative list. This Centre (NRCSS, Ajmer) is a unit of ICAR, New Delhi under DARE, Ministry of Agriculture and Farmers Welfare and is a premier institute in scientific research in Agriculture. 16. The job/work is related to Agriculture Operations which is a seasonal nature work. The required no. of job points/labour may increase or decrease to any extent. 17. Successful bidder will have to enter into a detailed contract agreement with Director, ICAR- NRCSS, Ajmer on non-judicial stamp paper of appropriate value for the Job contract. 18. Only those firms will be considered for financial bid who will qualify in the Technical Bid. 19. The scanned copies of the required documents are to be uploaded as specified in the tender document. Incase, the required documents are not uploaded, the bid submitted is liable to be rejected. 20. The Director, ICAR- NRCSS, Ajmer reserves the right to reduce or terminate the period of contract or to extend its duration in the interest of the ICAR- NRCSS, Ajmer, for any justifiable reasons, not mandatory to be communicated to the contracting agency. 21. Decision of Director, ICAR- NRCSS, Ajmer shall be final for any aspect of the contract and binding to all parties. Disputes arising, if any on the contract will be settled at his level by mutual consultation and in case of failure of settlement dispute shall be referred to the sole arbitrator to be appointed by the Director, ICAR- NRCSS, Ajmer. The decision of the sole Arbitrator so appointed shall be final and binding on the parties. Arbitration proceedings shall be governed by the Arbitration & Constitution Act, 1996 & shall be subject to Ajmer jurisdiction. 22. The Director, ICAR- NRCSS, Ajmer reserves the right to accept or reject any or all the bids or cancel the rate contract at any stage without assigning any reason. 6 Annexure-II (B) SCOPE OF JOB/ WORK (SERVICES/ JOB REQUIRED TO BE PERFORMED) 1. JOB JOB-1 Agriculture Work JOB-2 Agriculture Work JOB-3 Agriculture Work JOB-4 Agriculture Work SCOPE OF WORK Un-Skilled Nature of Agriculture Work i.e. Sowing, Harvesting, Threshing, Winowing, Cleaning, Grading, packing, Land Preparation, Manure and fertilizer application, Irrigation, Thinning and hoeing, Weeding of crops, Horticulture operations In farm area of approximate 45 acre area and others un skilled nature of work/helper/support service to agriculture research and extension. (Approximate Job Point: 38 Per Day) Skilled Nature of Agriculture Work i.e. Crop Protection and Watch and Ward of crops building property, Agriculture Machinery and any other item having economic worth, Scavenging and Cleanliness of Agriculture Farm area of 45 acre and Electric work and others skilled nature of work/technical Assistance in the area of agriculture research and extension like, Computer Work (Hindi & English) and record preparation and maintenance. (Approximate Job Point: 20 Per Day/Per Month) High-Skilled Nature of job in Technical Support of Agriculture Research and Extension in Farm/Field/Laboratory, crop management, supervising under different weather conditions, performing lab experiments, collecting data/samples and record preparation. (Approximate Job Point: 11 Per Day/Per Month) Sweeping & Cleaning Nature of job in Scavenging and Cleanliness of Agriculture Farm, Field and surrounding area. (Approximate Job Point: 4 Per Day/Per Month) 2. TOTAL ESTIMATED COST (JOB-1 + JOB-2 + JOB-3 + JOB-4) = Rs. 8,00, PER MONTH 3. It is clarified that the work is related to Agriculture Operations which is a seasonal nature work. The Job Point may be increase or decrease as per requirement to any extent. 4. The Jobs are only illustrative and not exhaustive, additional jobs or modification in the job will be carried out with approval of the authorities of ICAR- NRCSS, Ajmer and have to perform by the agency/contractor. 7 Annexure-II (C) GENERAL INFORMATION AND TERMS & CONDITIONS 1. The Firm has to deploy sufficient/required number of Manpower to perform the job within assigned period. Alternative arrangements are to be made by the agency whenever anyone of deployed worker of the Firm remains absent. 2. The staff deployed should maintain secrecy and discipline in the premises of ICAR- NRCSS, Ajmer. 3. The staff deployed for performing unskilled nature of job should be capable of reading and writing and having experience/knowledge of relevant work for which the farm labourer is deployed. 4. The contractor will also post a whole times Supervisor who will maintain the records of farm labour as per the labour laws i.e. wages slip, muster roll, attendance register etc. and also shall keep a complaint register with his supervisor. All complaints should be immediately attended to by the Contractor/Agency. 5. The Contracting Agency will discharge all legal obligations of their employees in respect of their wages and other service conditions and shall also comply with all the rules and regulations and provisions of law in force that may be applicable to them from time to time viz. statutory obligations, under Contract Labour (Regulation & Abolition) Act 1970, Minimum Wages Act, Workmen's compensation Act, EPF & MP Act, Industrial Dispute Act, Payment of Bonus- Gratuity etc. The Contracting Agency will indemnify and keep indemnified the ICAR- NRCSS, Ajmer from any claim, loss or damages that may be caused to the ICAR- NRCSS, Ajmer on account of the Contracting Agency's failure to comply with their obligations under the various law towards their staff/employees employed by the or any loss or damage to one part due to acts/omissions of other part. The ICAR- NRCSS, Ajmer will not be responsible for any loss caused so. It will be contracting agency fully responsible. 6. The contract agreement is terminable with one month notice on either side. 7. The contractor/agency shall not sublet the work. 8. The contractor or his deployed workers shall not misuse the premises allotted to them for any purpose other than for which the contract is awarded. 9. The selected agency shall deploy the required personnel s for execution of job at ICAR- NRCSS, Ajmer, as per labour acts. The agency shall employ good and reliable persons with robust health of age of not below 18 years. In case any of the provided is not found suitable by the Centre. The Centre shall have the right to ask for his replacement without giving any reason thereof and the agency, on receipt of a written communication, will have to replace such persons immediately. 10. The persons so deployed by the agency for performing the assigned job under this contract will be employee of the Agency/Contractor and will not be the employee of the ICAR- NRCSS, Ajmer and there will be no employer-employee relationship between the Centre and the person so engaged by the contractor in the aforesaid services/job. 11. Payment for service job contract will be made monthly upon submission of pre-receipted bill by the Contractor. 12. After physical inspection of the site, a very detailed assessment/requirements of personnel for providing allied services at the ICAR- NRCSS, Ajmer, shall have to be furnished along with the Tender. However, the Tenders should indicate only the lump-sum amount in respect of all the services covered under this contract and that rates should not be proposed on the basis of manpower to be deployed under the contract. No request for alteration in the rates once quoted will be permitted within one year. 13. The rates to be quoted should include cost of each and every item including material cost if any, transportation cost, manpower cost and taxes etc. The ICAR- NRCSS, Ajmer shall not bear any extra charge on any account whatsoever including EPF/ESI contribution, uniform, Liveries, OTA etc., if any. 14. The Bills will be produced separately as per work/ project by the contractor. 15. Income Tax and Other Taxes etc. will be deducted from the payments due for the work done as per rule. 16. The Contractor must employ adult labour only. Employment of child labour would lead to the termination of the Contract. 17. The contract is subject to the condition that the tenderer will comply with all the laws and acts of Central Govt., State Govt. relating to this contract made applicable from time to time. 8 18. The Contractor will discharge all his legal & statutory obligations in respect of the workers/supervisors to be employed/deployed by him for the execution of the work in respect of their wages and service conditions and shall also comply with all the rules and regulations and provisions of law in force that may be applicable to them from time to time. The contractor will depute one supervisor for marking the attendance of his labours daily. The supervisor will be the employee of the contractor and his wages will be paid by the contractor himself. The supervisor will mark his attendance daily- Morning & Evening. The contractor shall indemnify and keep indemnified the Centre from any claims, loss or damages that may be caused to it on account of any failure to comply with the obligations under various laws. In case of any dispute, the decision of Director, ICAR- NRCSS, Ajmer shall be final and binding on the contractor. 19. The contractor shall pay the wages to the workers engaged by them under this contract through Bank/Epayment. 20. Risk Clause: ICAR- NRCSS, Ajmer reserves the right to discontinue the service at any time, if the services are found unsatisfactory by giving a show-cause to be replied within a week and also has the right to award the contract to any other agency at the risk and cost of current agency and excess expenditure incurred on account of this can be recovered from S.D. or pending bills or by rising a separate claim. 21. LIQUIDATED DAMAGES CLAUSE: i. Any misconduct/misbehavior and un-lawful activity on the part of the manpower deplayed by the agency will not be tolerated and such person(s) will have to be replaced immediately. An amount equivalent to two days of contract amount, subject to a minimum of Rs. 200/- will be levied as liquidated damages per day. Whenever and wherever it is found that the work is not up to the mark, it will be brought to the notice of the supervisory staff of the agency/contractor by ICAR- NRCSS, Ajmer and if no action is taken within one hour, liquidated clause will be invoked. ii. Any misconduct/misbehavior and un-lawful activity on the part of the manpower deployed by the agency will not be tolerated and such person(s) will have to be replaced immediately. iii. If any damage happens in laboratory/ equipments/ assets/ property of ICAR- NRCSS, Ajmer due to carelessness of the labour(s) deployed by the contractor/ agency, then the suitable amount towards this as finalized by the competent authority/ committee constituted for the purpose shall be recovered from the contactor/ agency s monthly bill/ performance security for which the contractor/ agency shall be bound. 22. ELIGIBILITY CONDITION : The financial bid of only those firms will be opened that have been declared responsive in the technical bid evaluation. The bidders are requested to submit the online bids with due care and thorough reading of the tender document and should upload the scanned documents as required in the tender document without overighting and with seal & sign of the authorised signatory, to avoid rejection. 23. TERMS OF THE CONTRACT:- The terms of the contract will be of one year from the date of award of job contract. On the expiry of the contract or on its termination, the ICAR- NRCSS, Ajmer reserves the right to renew the contract on monthly/yearly basis on the terms and conditions that may then be mutually agreed upon. 24. MODE OF PAYMENT:- a) The agency shall submit monthly bills for the job performed during the preceding month on first working day of next month. The proof of contribution made in the form of challan separately for ESI, EPF and GST paid for the Manpower deployed by the Contractor at the ICAR- NRCSS, Ajmer are also to be deposited by the Agency/ Contractor within 08 days of receipt of payment of preceding month. The ICAR- NRCSS, Ajmer shall made payment through e-payment mode to the agency/contractor, in a reasonable period viz. 30 days after completion /fulfillment of all obligations by the Contractor/Agency. b) Income tax and Other Tax etc. as per rules will be deducted by the Centre from each monthly bill. c) The Contractor/Agency shall have to pay the monthly wages to his worker through Bank/Epayment on or before 07th of every month, at his own resources without waiting for clearance/payment of bills submitted to the Institute and documentary proof of having made such payments, ESI & EPF Challan etc. need to be provided to the Institute. 9 25. TERMINATION:- This contract can be terminated by giving one month notice on either side and that any notice required to be served shall be sufficiently served on the parties if delivered to them personally or dispatched by the address herein given under registered post. The ICAR- NRCSS, Ajmer will have no responsibility for any loss/damage caused to them. This also cannot be challenged through any court of law. 26. LOSS AND/OR DAMAGES: Any theft, damage or loss of property (movable or immovable) occurred by the contractor or its deployed manpower or due to negligence of Contractor or its deployed manpower would be recovered from the Contractor and decision of the competent authority of ICAR- NRCSS, Ajmer shall be a binding on agency. 27. SECURITY DEPOSIT:- An amount of 10% of total contract value shall be deposited as performance security money within two weeks from the award of contract to the firm/contractor or as specified in the communicationsletter. The security shall be refunded to the contractor after expiry of 03 months from the date of satisfactory completion of the contract or adjusted against any damages or loss of property etc. caused due to the negligence of the personnel deputed by the agency. No interest will be paid on the security money deposited with the ICAR- NRCSS, Ajmer. 28. The selected Agency/Contractor has to execute an Agreement on Non-judicial Stamp paper, containing all terms/conditions etc. The tender is likely to be cancelled in case the conditions in the agreement are not fulfilled. 29. The contractor is advised to have a complete survey of whole campus of ICAR- NRCSS, Ajmer for on the spot complete assessment of all the sites / location and field conditions, before offering rates. 18 Annexure -VIII AGREEMENT FOR ENTERING INTO JOB CONTRACT (by successful bidder (L1) only) This agreement is made at Ajmer on of between ICAR-National Research Centre on Seed Spices, Tabiji, Ajmer (hereinafter called ICAR- NRCSS, Ajmer) through Director which term shall include its successors, assignees etc. on the first part and (hereinafter called the Agency) which term shall include its authorized representatives, successor, assignees etc on the other part. Whereas the ICAR-National Research Centre on Seed Spices, Tabiji, Ajmer has decided to assign the annual Job work Contract for providing AGRICULTURE LABOUR AND OTHER ALLIED AND INCIDENTAL SERVICES TO AGRICULTURE RESEARCH AND EXTENTION to the agency on the terms and conditions hereinafter contained. NOW IT IS HEREBY AGREED by and between the parties hereto as follows: 1. This agreement shall come into force w.e.f. and will remain in force for a period for one year but can be terminated by ICAR- NRCSS, Ajmer by giving one calendar month s notice in writing of its intentions to terminate the Agreement. 2. The agency shall be responsible for Annual Job Work Contract for providing Job Contract for Agriculture Labour and Other Allied and Incidental Service to Agriculture Research and Extention at ICAR- NRCSS, Ajmer. 3. The contractual labourer should follow strict attendance and alternative arrangements are to be made by the agency whenever any one of labour is on leave under intimation to ICAR- NRCSS, Ajmer. 4. Changing of labourer should be intimated to ICAR- NRCSS, Ajmer. 5. The staff provided should also maintain secrecy and discipline in the premises. 6. The staff provided should be capable of reading and writing Hindi and English. 7. The Contracting agency shall keep a complaint register and it shall be open to verification by authorized officer of ICAR- NRCSS, Ajmer. All complaints should be immediately attended. 8. Uniform with colour specifications and pattern approved by the ICAR- NRCSS, Ajmer should be provided to labourer by the contracting agency at his own cost and it should be ensure that the working staff should be in proper uniform while on duty. 9. If any labourer will be found without uniform at the time of duty, a Rs. 200/- each time will be imposed at the Contracting Agency. 10. The labour deployed must be of the age of not below 18 years. 11. The contract awarded to the agency will not be subleted to other agency/contractors. 12. The labour should not leave their point unless and until the reliever comes for shift duties, the Contractor will maintain all the registers, which are kept at concerned section. 13. The Contracting Agency shall carry out the Job Contract for Agriculture Labour and Other Allied and Incidental Service to Agriculture Research and Extention at ICAR- NRCSS, Ajmer as per the requirements and instructions given to them from time to time for the period of contract. 14. In case, any labourer is found involved in any undesirable/mischievous/misbehavior activities, which adversely affect the ICAR- NRCSS, Ajmer, he will be replaced by the agency with the consent of the ICAR- NRCSS, Ajmer authority & penalty whatsoever decided by the ICAR- NRCSS, Ajmer will be imposed on the Agency. 15. To make proper co-ordination, agency authorities will visit the ICAR- NRCSS, Ajmer campus minimum once in a week, so that discrepancies/irregularities related to security matters may be directly conveyed to the agency. 16. The agency should keep a record of all labours deployed at the Centre viz name of labour deployed, complete address, mobile no., identity and address proof etc. and should verify the genuiness of the labour deployed through verification, antecedent clearance by police etc. of the labour deployed. 19 17. The ICAR- NRCSS, Ajmer will not be responsible either to the agency/contractor or to its labours/workers deployed at this ICAR- NRCSS, Ajmer for any medical assistance/injuries/death or any kind of loss occurred during the course of performing duty. The contractor should take proper safeguards for safety/medical assistance of the labour deployed. 18. In case of Theft cases during the contract period in the ICAR- NRCSS, Ajmer premises, the recovery of such loss(es) will be recovered from the Contracting Agency if its labour involed in such case. 19. A list showing the jobs to be carried out by the Contracting Agency is detailed under scope of work. However, these are only illustrative and not exhaustive, additional jobs or modifications in the job will be carried out with approval of the authorities of ICAR- NRCSS, Ajmer. 20. The Agency shall render the services on JOB CONTRACT basis which includes EPF contribution, ESI contribution and any other statutory provisions and liabilities to be discharged by the Contracting Agency. 21. The labour to be deployed shall be with robust health of the age of not below 18 years. The Job contract work will be 8 hours in a days of the week and shall be changed as per requirement of the ICAR- NRCSS, Ajmer from time to time. In case there is any change in employment of the labourer, such changes shall be intimated to the Agency in writing well in advance. 22. The Agency shall employ labourer as may be required for the purpose of execution of this job contract which shall be subject to the approval of the ICAR- NRCSS, Ajmer. 23. The Contracting Agency will discharge all legal obligations of their employees in respect of their wages and other service conditions and shall also comply with all the rules and regulations and provisions of law in force that may be applicable to them from time to time viz. statutory obligations, under Contract Labour (Regulation & Abolition) Act 1970, Minimum Wages Act, Workmen's compensation Act, EPF & MP Act, Industrial Dispute Act, Payment of Bonus- Gratuity etc. The Contracting Agency will indemnify and keep indemnified the ICAR- NRCSS, Ajmer from any claim, loss or damages that may be caused to the ICAR- NRCSS, Ajmer on account of the Contracting Agency's failure to comply with their obligations under the various law towards their staff/employees employed by the or any loss or damage to one part due to acts/omissions of other part. The ICAR- NRCSS, Ajmer will not be responsible for any loss caused so. It will be contracting agency fully responsible. 24. The material will not be provided by the ICAR- NRCSS, Ajmer. Uniform s (to be supplied by the contracting agency) will not be allowed to wash in the ICAR- NRCSS, Ajmer premises. 25. The Agency shall submit their bills after completion of each month during the first week of the following month of the services rendered previous months to Director, ICAR- NRCSS, Ajmer. The payment of bill after deduction of Income Tax (as per rules), will be made by Bank/E-payment on receipt of confirmation regarding satisfactory execution of services by the ICAR- NRCSS, Ajmer authorized for this purpose. In case the services are not provided up the satisfaction of the authorities, suitable deduction will be made from the payment at the discretion of Director, ICAR- NRCSS, Ajmer whose decision shall be final and binding on the Contracting Agency. 26. The Contracting Agency shall submit the record of payment made to labourer on monthly basis and shall ensure that the payment is made as per Minimum Wages Act. 27. The Contracting Agency agrees to get all their employees insured against any liability arising under the workman's compensation act or under the common law. The Contracting Agency agrees to indemnify against any claim that the ICAR- NRCSS, Ajmer may have to meet in respect of their staff members and or workman/employees on account of any accident or for any other reason. 28. It is further clarified that under no circumstances, the staff member and or the workmen/ employees or the Contracting Agency shall be treated, regarded or considered or deemed be the employees of the ICAR- NRCSS, Ajmer and the Contracting Agency alone shall be responsible for their remuneration, wages etc. 29. The Agency will ensure that the National Flags are hoisted/lowered, at the respectable places on the top of both the building as per the flag code and hence will be completely responsible for the lapse in this regard. Any problem in this regard should be reported in writing to the undersigned or other senior officers. 30. The Agency will ensure that no theft or damages to the ICAR- NRCSS, Ajmer, property should take place during the tenancy of the service contract of the Contracting Agency. In case any theft or damage to the ICAR- NRCSS, Ajmer property occurs during the service contract period with the Contracting Agency due to the negligence of the labourer of the Contracting Agency, the Contracting Agency shall be held responsible for such losses and damages, if after an enquiry, the ICAR- NRCSS, Ajmer comes to the conclusion that the loss is attributable to the negligence on part of security personnel of the Contracting Agency. The Contracting Agency shall register and attend all the police cases from time to time during the contract period and beyond, if required. 20 31. The Contracting Agency will provide the Job contract the work as per the instruction mentioned in the tender documents and work order. In case any lapse in this regard comes to the notice of Director, ICAR- NRCSS, Ajmer or any other officer authorized by Director, ICAR- NRCSS, Ajmer, action as deemed fit will be taken to make suitable deduction from the monthly bill of Contracting Agency. 32. The agency has to submit every month, a proof of payment of statutory obligation such as ESI, EPF, GST and other applicable taxes, if any in respect of personnel engaged by the Contracting Agency for this job contract. The following records/documents in respect of its labourer submitted to the office every month otherwise next bill will not be entertained. i) Statement of wages not less than prescribed minimum wage paid to security guards. ii) All statutory records i.e. ESI, EPF and GST etc. as applicable. 33. The work is related to Agriculture Operations which is a seasonal nature work. The Job Points may be increase or decrease as per requirement to any extent. 34. The contractor shall be abide by all points and terms & conditions contained in the tender document issued for Agricultural Labour And Other Allied And Incidental Services To Agricultural Research And Extention. 35. LIQUIDATED DAMAGES CLAUSE: (a) An amount equivalent to two days of contract amount, subject to a minimum of Rs. 200/- will be levied as liquidated damages per day. Whenever and wherever it is found that the work is not up to the mark, it will be brought to the notice of the supervisory staff of the agency/contractor by ICAR- NRCSS, Ajmer and if no action is taken within one hour, liquidated clause will be invoked. (b) Any misconduct/misbehavior and un-lawful activity on the part of the manpower deployed by the agency will not be tolerated and such person(s) will have to be replaced immediately. (c) If any damage happens in laboratory/ equipments/ assets/ property of ICAR- NRCSS, Ajmer due to carelessness of the labour(s) deployed by the contractor/ agency, then the suitable amount towards this as finalized by the competent authority/ committee constituted for the purpose shall be recovered from the contactor/ agency s monthly bill/ performance security for which the contractor/ agency shall be bound. 36. The Director, ICAR- NRCSS, Ajmer reserves the right to reject any or all Tenders in whole or in part without assigning any reasons therefore. The decision of Director, ICAR- NRCSS, Ajmer shall be final and binding on the contractor/agency in respect of any clause covered under the Contract.
