Description of request submitted as logged on your system Decision When a freedom of information request is made, there is a general obligation on public authorities to confirm or deny whether the requested information is held under section 1(1) (a) FoIA After conducting careful searches for any information relevant to your request, I can confirm that there is information held in relation to your request. I have provided a list of these requests at Disclosure 1 (2015) and Disclosure 2 (2016). Part of the information is to be withheld under section 40(2) FoIA 2000 because it constitutes personal information. The College is committed to openness and transparency, however, we have redacted one piece of personal information because it may be possible to identify that individual from other information that is available in the public domain and as the requests were completed some time ago (November 2016) it would not be practical to ask this individual for their permission to release their personal information. The information which has been redacted is in Disclosure 2 and is marked by a small rectangular black box.

3 Appendix A Refusal Notice Section 40(2) FoIA Personal information. Under section 40(2) by virtue of section 40(3A) (a), personal data of a third party can be withheld if it would breach any of the data protection principles to disclose it. Personal data is defined in section 3(2) of the Data Protection Act 2018 (DPA 2018) as: any information relating to an identified or identifiable living individual Section 3(3) defines an identifiable living individual as a living individual who can be identified, directly or indirectly, in particular by reference to (a) an identifier such as a name, an identification number, location data or an online identifier, or (b) one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of the individual For your information section 40(2) in these circumstances is an absolute exemption and there is no requirement for me to consider the public interest test. The two main elements of personal data are that the information must relate to a living person and that the person must be identifiable. Information will relate to a person if it is about them, linked to them, has some biographical significance for them, is used to inform decisions affecting them, and has them as its main focus or impacts on them in any way. To disclose all the information requested in your request would breach the first principle of the Data Protection Act 2018, namely, any processing of personal data must be lawful and fair. The College of Policing has taken the view that disclosing the name of the individual mentioned at FOIA in this document paired with the fact that the request is asking for specific information from a specific event would make the individual identifiable. For information, a freedom of information response is a response to the public at large and not just to the applicant requesting the information, we routinely publish our responses and any relevant disclosures. Personal data is exempt if either of the conditions set out in sections 40(3A), 40(3B) and 40(4A) of FOIA 2000 are met. The relevant condition in this case is at section 40(3A) (a) of FOIA 2000, where disclosure would breach any of the data protection principles. In this case the College of Policing has considered whether 3

4 disclosure of the personal data would breach the first data protection principle, which states that Personal data shall be processed fairly and lawfully. In order to provide the personal data of a third party we would have to seek their consent and subsequently determine whether it was necessary to process their personal information. Exception is given of course to those who hold senior positions within the College of Policing, the UK police service, and the Police and Crime Commissioner, where there is an expectation that such information would be disclosed with or without consent. We do not have, nor do we consider it reasonable to seek the consent of the individual concerned. In the circumstances your request for disclosure in relation to this particular piece of information given at FOIA in Disclosure 2 is therefore refused under 40(2) by virtue of section 40(3A)(a) FoIA

5 Appendix B Rights If you are dissatisfied with the handling procedures or our decision made under the Freedom of Information Act 2000 (the Act) regarding access to information you have a right to request an internal review by the College of Policing.
