2 Introduction The members of the ACP-EU Joint Parliamentary Assembly (JPA) from the East African Region of the ACP Group, and their European Parliament counterparts, met in Mahé, Seychelles, for the Regional Meeting of the JPA (East Africa). The Meeting was presided over by Mr Elie Hoarau, Acting Co-President (EP) and Mr Odirile Motlhale (ACP), Acting Co-President. This was the fifth regional Meeting of the ACP-EU JPA to be organised under Article 17.3 of the Cotonou Agreement and Article 6 of the JPA Rules of Procedure. The formal opening session of the Meeting heard statements from the Speaker of the National Assembly of Seychelles, Mr Patrick Herminie, the Acting Co-Presidents, and the Vice-President of the Republic of the Seychelles, Hon. Danny Faure, who officially opened the 5 th Regional Meeting. The assembly expressed condolences to the government and people of Uganda and observed a minute of silence in memory of the victims of the terrorist attacks in Kampala, Uganda, on 11 July Members discussed the development, trade and institutional aspects of the Regional Economic Partnership Agreements, regional integration in East Africa, peace, stability and good governance in the Region, fisheries and development, the fight against piracy, climate change and its impact on the region, and the status of the Chagos archipelago. Regional Integration and Cooperation Processes in East Africa Members emphasised that regional integration processes would enable many countries to overcome the obstacles represented by their relatively small domestic markets, by enabling producers to realize greater economies of scale, and benefit from the establishment of regional infrastructures. Members expressed concern at the insufficient level of information regarding the implementation of the EDF at national and regional level in the ACP countries and emphasised the need to invest in greater parliamentary capacity for oversight of the integration process in renewable energies and food security. While commending the efforts by the AU in this field, Members called for the rationalisation of regional integration initiatives in East Africa in order to prevent overlapping institutions, duplicated efforts and dispersed resources, which can limit the effectiveness of regional integration institutions. Members further called for coordination of national policies and regional integration agendas. In this regard, the tripartite arrangements between EAC, COMESA and SADC should be pursued to further reduce the cases of duplication in the implementation of programmes which aim to achieve the same outcomes. 3 Economic Partnership Agreements and the Role of National and Regional Parliaments As the 2010 Revised Cotonou Agreement clearly provides for this, the Regional meeting emphasised the need for Parliamentarians to closely monitor the negotiation, conclusion and implementation of EPAs in order to continuously assess their impact on national economies, people s livelihoods and development priorities. They should also ensure that EPAs contribute to the consolidation of existing regional integration efforts. Members underlined that the EU should, in the ongoing negotiations, enable EPAs to contribute to strengthening regional integration processes and should be flexible in view of the impact of the economic crisis. Members welcomed the new provisions of the Cotonou Agreement calling for complementarity and coherence between the Cotonou institutions and the EPA institutions as well as the reinforced role of the JPA in monitoring EPA implementation. Information was brought in to Members, confirming that in African countries national and regional parliaments have been receiving information about the ongoing EPAs negotiating process. Even if this information has been insufficient, the steps may be regarded as positive and appropriate ones. They also called for the possibility of integrating into the EPA for Eastern and Southern Africa any rule that would be available in other EPAs. At the same time, EPAs must also be compatible with WTO rules and practices. Peace and Security in the Region, Including Governance and Human Rights Members expressed concern that a number of countries in the East African region have been affected by internal and external armed conflicts, violence, border disputes as well as political instability, which has affected the lives of millions of people, especially women and children. In order to strengthen and deepen peace, democracy, and respect for human rights and the rule of law in the East African Region, Members insisted that better developed political, socio-economic, legal and institutional frameworks are required. These demand, above all, continuity and predictability of state structures and actions. Moreover, promoting peace and state building in fragile and failed states and conflictaffected areas is a fundamental precondition for the attainment of the Millennium Development Goals. Member strongly condemned the terrorist attacks in Kampala. They also welcomed the active and indispensable role of the African Union in the region and called on the AU Summit, which should be held in Kampala on July 2010, to enhance the capacity of its members to fully implement coordinated national and regional strategies to fight all kinds of terrorism, thus ensuring peace and security in the region. 3 AP
4 Members had an exchange of views with the Delegation which has been in Madagascar on a fact-finding mission on July and whose report will be presented to the JPA Bureau in September The Fight against Piracy Members expressed concern at the increasing incidences of piracy in the Indian Ocean perpetrated by elements on the Somali mainland, which have adversely affected the maritime activities and trade, tourism and fishing, aid deliveries to Somalia, and have resulted in the loss of numerous of lives, hundreds of millions of euros and security by East African economies. They also emphasised that Somali piracy is part and parcel of the larger crisis resulting from the failed Somali state, a situation which perpetuates poverty, lack of development and political instability in Somalia. A sustainable solution to the problem should address the root causes of piracy. To this end, state structures must be restored in Somali territory and their socio-economic development fostered and intensified. Durable statehood solutions must take into account the realities in Somaliland and Puntland and reflect the aspirations towards unity of Somali federal institutions. Members called on the international community to step up efforts to fight piracy through more robust and comprehensive measures that should include not only operations against pirates, but also actions against the international network of arms suppliers and money laundering that are behind these pirate activities. It was also clearly stated that piracy is causing serious damage both to European interests (mainly in the field of fisheries) and above all to a number of countries in the area. The courage and solidarity of African countries and their readiness to articulate measures against piracy, as it has been the case for Seychelles and other countries, was commended by Members. In this respect, a recommendation was made to the EU to open a permanent Delegation in Victoria, Mahe, Seychelles. Members expressed support for AMISOM and institution-building in Somalia and called on the EU and the UN to provide AMISOM and the TFG with the necessary financial and logistical support. In this regard, they paid tribute to African countries that have contributed military personnel to AMISOM and called on other African countries to provide troops. They also called on the Atalanta mission to establish operational relations with AMISOM. Members also called on the international community to find other non-military solutions and work for an all-inclusive political process to guarantee durable peace in Somalia. Members strongly condemned the actions of some firms that have taken advantage of the lawlessness of Somalia to illegally fish in its waters, as well as dump toxic waste in its territory, and, in this regard, called on the United Nations and the European Commission to investigate the dumping of toxic and nuclear waste, illegal fishing, illegal weapons and illegal funds, perpetrated by EU and Asian registered firms along the Somali coast. 5 Climate Change Members expressed concern that the countries in East Africa are prone to extreme climatic events such as droughts, floods, coastal erosion and global warming which have the potential to undermine development, jeopardise the attainment of the Millennium Development Goals and cause economic hardship through their effects on water availability, agricultural production, fisheries, energy resources, biodiversity, tourism and ultimately, livelihoods. Members called on the European Commission to explore how to use solar, wind and other renewable energy in East Africa for its development and to encourage this practice. The consequences of climate change could in turn lead to conflicts over decreased resources such as water and grazing land for livestock, as well as conflicts between human habitats and wildlife. These could have consequences for economic and political stability within and between States. It was noted that the special vulnerability of small islands should to be taken into account. To this end, a special adaptation and mitigation strategy should be elaborated in Cancun at the UN climate change conference. Members called for additional resources, as agreed in the Copenhagen Accord, and innovative financing mechanisms to assist developing countries, particularly the poorest and most exposed, in adapting to, and mitigating the effects of climate change. Fisheries and Development It was noted that fish and aquacultural products are the most internationally traded food commodity, and that fishery-related activities provide an important source of employment, export revenue and food security, and livelihoods for urban, rural and coastal communities in many ACP States. Members stressed the need to encourage a sustainable development of fisheries through a cautious exploitation of sea resources. Members expressed the need to respect sanitary and phytosanitary (SPS) measures, because if not properly and flexibly implemented, especially with regard to EU temporary bans, this could undermine the potential of the fishery sector to contribute to the development of East African economies. They also called on the EU to speed up the process of facilitating the tuna derogation as per the EC decision of regulation 1528/2007 to ACP countries which have applied and to make it retroactive. Members also pointed out that in order to address the issue of preference erosion, the EU should help countries to build up competitiveness through capacity-building by the provision of accompanying measure, as now contained in the 2 nd revised Cotonou Agreement, as well by flexible rules of origin and support to meet the SPS requirements. 5 AP
6 The Status of the Chagos Archipelago Members affirmed the right of return of the Chagossians to their homeland and encouraged the pursuit of dialogue between Mauritian and British authorities in order to solve the question of the exercise of sovereignty in compliance with UN resolutions and international law. Conclusion Members expressed gratitude to the Government and Parliament and the people of Seychelles for the warm welcome and for facilitating, in East Africa, the 5 th Regional Meeting of the ACP-EU Joint Parliamentary Assembly. They noted with satisfaction its perfect organisation and commended the success of its work. Finally, Members called on the Co-Presidents to present the conclusions of this Regional Meeting both at the next meeting of the Bureau and the 20 th Session of the ACP-EU JPA in Kinshasa and to forward them to the European Commission, the COMESA, EAC, IGAD and IOC Secretariats, EALA, the European Parliament, the ACP Parliamentary Assembly, the Pan-African Parliament, the East African Governments and the National Parliaments of East Africa and EU Member States.
