3 Who? Who are they? An Irregular Migrant is: Someone who, owing to illegal entry or the expiry of his or her visa, lacks legal status in a transit or host country. The term applies to migrants who infringe a country s admission rules and any other person not authorized to remain in the host country Glossary on Migration, IOM 3

23 The Crime of Trafficking in Persons Art 3(a): Trafficking in persons shall mean the recruitment, transportation, transfer, harbouring or receipt of persons by means of force or other forms of coercion, of abduction, of fraud, of deception, of the abuse of power or of a position of vulnerability or of the giving or receiving of payments or benefits to achieve the consent of a person having control over another person, for the purpose of exploitation. 3 key elements: Action Means Purpose 23
24 The Crime of Trafficking in Persons a. Exploitation shall include, at a minimum, the exploitation of the prostitution of others, or other forms of sexual exploitation, forced labour or services, slavery or practices similar to slavery, servitude or the removal of organs... 24
25 Forced Labour? forced or compulsory labour shall mean All work or service which is exacted from any person under the menace of any penalty and for which the said person has not offered himself voluntarily. (Art. 2, Forced Labour Convention) 25
26 Slavery? Slavery: is the status or condition of a person over whom any or all of the powers attaching to the right of ownership are exercised. (Slavery Convention, 1926) 26
27 b. The consent of a victim of trafficking in persons to the intended exploitation set forth in subparagraph (a) of this article shall be irrelevant where any of the means set forth in subparagraph (a) have been used; The Crime of Trafficking in Persons 27

The recruitment, transportation, transfer, harbouring or receipt of a child for the purposes of exploitation shall be considered trafficking in persons even if this does not involve any of the means set forth in subparagraph (a) of this article; d. 30 Protocol against Smuggling Smuggling of migrants shall mean the procurement, in order to obtain, directly or indirectly, a financial or other material benefit, of the illegal entry of a person into a State Party of which the person is not a national or a permanent resident; Illegal entry shall mean crossing borders without complying with the necessary requirements for legal entry into the receiving State. 30
