2 The Commission on Human Rights is waging a hampered combat against the problem of desaparecidos because it is allowed by the Constitution to only investigate violations of human rights and not to adjudicate on them like quasi-judicial bodies such as the SEC and NLRC. 3 What is or should be the role of the Commission on Human Rights of the Philippines (CHRP) in addressing human rights in general; extrajudicial killings and enforced disappearances in particular? How can CHRP be made more effective component of the justice system in addressing human rights issues?

4 CREATION OF THE COMMISSION Section 17(1). Article XIII, 1987 Philippine Constitution There shall be an independent office called the Commission on Human Rights Executive Order No. 8 (18 March 1986) Creating the Presidential Committee on Human Rights Executive Order No. 163 (5 May 1987) Declaring the effectivity of the creation of the Commission on Human Rights as provided for in the 1987 Constitution, providing guidelines for the operation thereof, and for other purposes

15 CHRP AS ADVISER-MONITOR ON GOVERNMENT S CPR POLICY On 25 April 2006, the Supreme Court upheld the CHR s stand, that the CPR policy has no place in our legal firmament and must be struck down that shrouds freedom. 16 CHRP AS ADVISER-MONITOR ON EXPRESS LANE FOR HR CASES On 3 October 2006, the CHR Chair appeared before the Melo Commission as Resource Person where she suggested that there is a need to fast track cases of extrajudicial killings such as the creation of special courts to try human rights cases ROLE OF CHRP On 5 January 2007, CHR s meeting with the Security Cluster of the Cabinet, the Commission en banc urged the executive branch to communicate to the judiciary the creation of special hr courts

17 ROLE OF CHRP CHRP AS ADVISER-MONITOR ON SPECIAL COURTS The whole justice system will have to make a niche for these human rights cases The SC should designate special courts to handle these cases. We already have special courts for heinous crimes, for children. Why can t there be a special court for human rights? Victims go to the Commission on Human Rights because they see it as an agency of last resort.the fact that victims to the Commission is a symptom of impunity, usually feeling that cases are neglected, whitewashed or ignored. CHRP noted a pattern of acquiescence and complacency on the killings of journalists The Philippines is only second to Iraq as the most dangerous place for journalists EXTRAJUDICIAL KILLINGS

32 KILLINGS AND IMPUNITY The Advisory called attention to IMPUNITY that indicates the absence of the rule of law... breeds brazen acts of violation of human rights.. and is an obstacle to development and the advancement of a democratic system. 37 The pattern of complaints that come to us show members of the Armed Forces and the PNP as suspects. That has to be addressed and we call on the military to do something about it Not everybody is to be blamed but if a commander has killings in his area happening, even if he s not really involved, it is his responsibility.
