Telephone COUNTR: SLOVENIA Short introduction Most of the s of the were transposed by the ZTuj. This is the only statute that was explicitly enacted with the aim of transposing 2004/38/EC. ZTuj is a general act regulating aliens and their rights and obligations. Thus, EU s and their rights are only a small part of the law - the most important section of ZTuj for Union citizens is Chapter XII, which contains articles 93.a to 93.ac). On the basis of ZTuj, two implementing rules were issued by the Minister of Internal Affairs regulating some aspects of the : Prav2 (Rules on the content, form, issuing and termination of certificates and permits on the residence of the EU citizens, their family members, and family members of Slovenian citizens) regulates the content, form, issuing and termination of certificates and permits on the residence, and Navod ( Instructions concerning the refusal of entry to the Republic of Slovenia of EU citizens) regulates the refusal of entry of EU citizens to Slovenia. Some substantive aspects of the transposition of the 2004/38 are covered by other legislation. ZZDT (The Law on the Employment and Work of Foreign Citizens) enables equal rights of EU s at workplace. The same is true to Prav1( Rules on the method of determining the right to free access to the labour market with regard to s of the EU and the EEA and their family members) which regulates free access to the labour market with regard to s of the EU and the EEA and their family members. The majority of the procedural s of the were not specifically transposed by the Ztuj. The Ztuj refers to the existing framework laws that regulate the administrative and judicial procedures. ZUP ( The Administrative Procedure Act) and ZUS-1(The Administrative Disputes Act) regulate the administrative procedure and judicial review of administrative decisions in general; all decisions, issued by state and local administrations have to adhere to these two laws. The ZK (Criminal Code) prescribes the crimes and their sanctions. ZP-1 (The Minor Offences Act) is a statute that regulates the misdemeanours. GENERAL PROVISIONS. 2.1 Definitions For the purposes of this : 1) "Union citizen" means any person having the ity of a Member State; ZTuj 2(1) point 1and (2) ZTuj 93.a(2) Complete text of (in language of - Državljan EU je tujec z državljanstvom druge države članice Evropske unije. ZTuj. 2 defines alien as anyone who does not have the citizenship of the Republic of Slovenia. Therefore any alien with an EU member state citizenship is an EU citizen. Note: For no apparent reason, the definition is repeated twice in ZTuj, each time in a slightly different wording. Incomplete - it only mentions children and not other direct descendants; - it only mentions unmarried (and not married) children. Also, the definition of the dependency is based on the Member state they come from. However, notice that it refers to maintenance which seems to follow the ECJ definition in Lebon and Jia. Incomplete transposition Transposition is incomplete in the following: only parents and not other dependent relatives in the ascending line are mentioned. See comments above. Regarding dependency, see comments above. From the perspective of ZTuj, the host member state is the Republic of Slovenia, which is the term that is used in the statute. Milieu Ltd SLOVENIA 4/68

5 2004/38/EC on the right of citizens of the Union and their family members. 3.1 Beneficiaries This shall apply to all Union citizens who move to or reside in a Member State other than that of which they are a, and to their family members as defined in point 2 of icle 2 who accompany or join them. Other Chapters of ZTuj regulate the rights of those aliens that are not Union citizens or their family members. ZTuj was adopted in 1999 before the Slovenian accession to EU. Chapter XII.a was added after the Slovenian accession. Such piecemeal approach may be the reason of many problems encountered in the transposition of the. There are a few s of ZTuj apart from those in Ch. XII.a that transpose the : s. 12, 47 and 63. ZTuj also applies to family members of Slovenian s be it that they are Union citizens of aliens from other countries. This effectively means that the spouses and other family members of Slovenian citizens have the same rights that the Union citizens or their family members. This will avoid reverse discrimination and will also help to cover family members of a returning Slovenian. Notice that the law here does not refer to family members accompanying or joining the Union citizen. It talks about that in other relevant s (i.e. 93.k(3), although in other terms (family reunifications, joining the family etc.). See below. Slovenian authorities do not demand lawful prior residence with the EU citizen in another MS before arriving to Slovenia. Family members derive their right to enter and stay in Slovenia from the fact that they are family members it is not important if they arrived to Milieu Ltd SLOVENIA 5/68

6 . 3.2 (a). 3.2 (b) Without prejudice to any right to free movement and residence the persons concerned may have in their own right, the host Member State shall, in accordance with its legislation, facilitate entry and residence for the following persons: (a) any other family members, irrespective of their ity, not falling under the definition in point 2 of icle 2 who, in the country from which they have come, are dependants or members of the household of the Union citizen having the primary right of residence, or where serious health grounds strictly require the personal care of the family member by the Union citizen; (b) the partner with whom the Union citizen has a durable relationship, duly attested. 2004/38/EC on the right of citizens of the Union and their family members Complete text of (in language of ZTuj. 93.k(1) (1) [...] Izjemoma lahko pristojni organ, po prostem preudarku, za družinskega člana šteje tudi drugega sorodnika, če posebne okoliščine govorijo v prid združitvi družine v Republiki Sloveniji. (1) [...] By way of an exception the competent body may, at its discretion, regard other relatives as family members if special circumstances justify family reunification in the Republic of Slovenia. Milieu Ltd SLOVENIA 6/68 Incomplete NT Slovenia independently of the EU citizen and married him/her only later; from that moment onwards, they are family members with their right in accordance to ZTuj. Incomplete transposition ZTuj does not provide any standards for entry and residence of 3.2. persons except mentioning special circumstance that justify family reunification. This leaves the decision in a complete discretion of the responsible authority. Not transposed The is not transposed. This is quite strange since the Slovenian family law recognises the unregistered durable partners as equal to spouses (The marital and family relations act, Zakon o zakonski zvezi in družinskih razmerjih), which is a much more liberal system than in most other EU member states which only recognise the equal status to registered partners, if at all. Since Slovenian legal order recognise unregistered durable partners as equal to spouses, the system of registration does not exist, though.

Chapter II. RIGHT OF EXIT AND ENTR. 4.1 Right of Exit. 4.2 Without prejudice to the s on travel documents applicable to border controls, all Union citizens with a valid identity card or passport and their family members who are not s of a Member State and who hold a valid passport shall have the right to leave the territory of a Member State to travel to another Member State. No exit visa or equivalent formality may be imposed on the persons to whom paragraph 1 applies. They may exit the Republic of In effect this means that although it is more liberal towards its own citizens than the majority of EU member states, Slovenia: - does not recognise registered partners as family members (see comment to 2.2.) - and at the same time does not grant a benefit of the doubt to alien durablerelationship partners. As a consequence it does not facilitate entry and residence. The is not transposed. Milieu Ltd SLOVENIA 7/68 NT. ZTuj does not contain any special s for the exit of family members and therefore equals them to other aliens (ZTuj. 12). In general, aliens can enter or exit Slovenia with a passport, if not otherwise prescribed by law (ZTuj 7). Since no visa requirements are prescribed for the exit from Slovenia in general, this omission does not impose visa requirements for the exit of family members. This has not been transposed; however, the Slovenian legislation does not require any exit visas, only ID and passport.

(1) The passport is a public document intended to allow a citizen of the Republic of Slovenia ( citizen ) to cross the border and to demonstrate his or her identity and ity. (1) A citizen with a permanent residence in the Republic of Slovenia has a right to an identity card. In the strictest sense, the renewal of a passport of ID card is not foreseen by law: after it expires, the holder must apply for a new passport or identity card. The effect is the same as with the renewal, though. Passports are issued for 10 years (five years for those under the age of 18, and three years for those under the age of 3). ZPLD 14. The validity of identity cards is ten years (and five years for those under the age of 18). Where the law of a Member State does not provide for identity cards to be issued, the period of validity of any passport on being issued or renewed shall be not less than five years. This, however, is not a subject - matter of Slovenian legislation and is therefore not explicitly transposed. Slovenia applies Council Resolution of 23 June 1980 and Regulation 2522/2004. Transposition of the second sentence: not relevant, since the identity cards are issued. See above 4.3.

Without prejudice to the s on travel documents applicable to border controls, Member States shall grant Union citizens leave to enter their territory with a valid identity card or passport and shall grant family members who are not s of a Member State leave to enter their territory with a valid passport. No entry visa or equivalent formality may be imposed on Union citizens. (2) A family member who is an EU citizen may enter the Republic of Slovenia with a valid identity card or a valid passport without an entry permit irrespective of the purpose of residing in the Republic of Slovenia. (3) A family member who is not an EU citizen may, for the purposes of family reunification with an EU citizen or Slovene, enter the Republic of Slovenia with a valid passport containing a visa, unless he or she is the of a state for which the Republic of Slovenia has cancelled visas, or with a valid travel document and residence permit issued by another EU Member State, unless otherwise stipulated by inter agreement. (1) EU citizens shall not require any entry permit, i.e. a visa or residence permit, for entry into the Republic of Slovenia. ZTuj. 93.k(2) is in effect the same as 93.b so the same approach is followed for Union citizens (regardless whether they are the primary subjects of the right of residence or their family members). This does perhaps cause some confusion but does not influence the transposition.. 93,k(3) enables family members to enter Slovenia only for the purpose of family reunification. Such condition does not appear anywhere in the, but it would have the same meaning as the Dir. 3.1 phrase who accompany or join them. Both phrases imply that family member must come with or follow a Union citizen and not on his/her own. Therefore we tentatively judge this to be in accord. The requirement to have a visa is in accord with icle 5(2) of the. See comments below. The legislation does not require that the family member comes from another MS. Milieu Ltd SLOVENIA 9/68

10 Family members who are not s of a Member State shall only be required to have an entry visa in accordance with Regulation (EC) No 539/2001 or, where appropriate, with law. For the purposes of this, possession of the valid residence card referred to in icle 10 shall exempt such family members from the visa requirement. Member States shall grant such persons every facility to obtain the necessary visas. Such visas shall be issued free of charge as soon as possible and on the basis of an accelerated procedure. 3. (3) A family member who is not an EU citizen may, for the purposes of family reunification with an EU citizen or Slovene, enter the Republic of Slovenia with a valid passport containing a visa, unless he or she is the of a state for which the Republic of Slovenia has cancelled visas, or with a valid travel document and residence permit issued by another EU Member State, unless otherwise stipulated by inter agreement. 2. The travel documents of s of third countries who are members of the family of a Union citizen to whom Ambiguous Ambiguous transposition Sentence 2 of this paragraph has been transposed by reference to a residence permit issued by another MS. The legislation refers to residence permits instead of residence cards. However, no residence permits will be issued but only residence cards. This may create confusion in the practical implementation. Also, ZTuj refers to a state for which the Republic of Slovenia has cancelled visas in accordance to Reg. 539/2001, a member state cannot cancel visas on its own (it can only provide exceptions for particular types of aliens diplomats, pupils etc.). In any case, notice that Slovenia became a Schengen country on 21 December 2007 and therefore the legislation applicable is the Schengen regulations, inter alia Regulation 539/2001 and Regulation 562/2006 and therefore no visa can be imposed and residence cards will be enough to enter the country. The Slovenian legislation does not seem to have taken into account those changes in the status of Slovenia. Although the legislation is confusing, it will not have practical consequences because the Regulations are directly applicable. The has not been transposed. Although express transposition of the right would have been better, the effect is the same. Apart from that, Dir. art 7.1.(a) to (c) is effectively transposed into the Slovenian legislation. ZTuj uses a different method than the : it enumerates conditions for a longer than three-month stay in 93.c(3) and later elaborates on every one of these conditions in separate articles. Note on the use of a term may in Slovenian legislation. The use of a term may be issued in paragraph 3 instead of mentioning a right of residence or instead of using a shall or must is in itself not problematic. In Slovenian legal use the term may does not normally denote a discretion; it rather means that a certificate or a permit issued on the basis of an application from the applicant and not on the own initiative of the competent authority. (3) Residence registration certificates may be issued to EU citizens for the following reasons: - employment or work; - self-employment; - of services; - study or other forms of education; - other reasons. one of the five preconditions. 93.g states that the person wishing to reside in Slovenia for other reasons must have sufficient means of subsistence and medical insurance. In effect: other reasons mean the same as Dir. 7.1.(b). requires sufficient resources for family members too. However notice that below for family members to have the right of residence, the family member has to show to have sufficient resources. Regarding the way Slovenia has transposed sufficient resources see below at icle 8(4). The "appropriate medical insurance" is not defined further in ZTuj. In practice, any kind of insurance that covers medical treatment in Slovenia is sufficient. By other forms of education any legally recognised type of education is meant, including vocational training (which is regulated in Trade Law, art. 21 (Obrtni zakon). Notice also that the legislation allows the entry of EU citizens for family reunification. This creates a very ambiguous system. Clarification is needed with the competent authorities Incorrect transposition ZTuj seems to prescribe stricter conditions for the extended stay of family members who are not EU citizens. Since the right of residence is granted by law and not by an administrative decision, a registration certificate and not a residence permit should be issued to a family member. However the law also estates that the permit shall be issued in the form of a card. This is a confusing transposition of the. See comments on icle 9 of the. Sufficient means and medical insurance should not be prescribed as a condition for family members (points 3 and 4). In practice, the responsible authorities do not demand that the family members should themselves have sufficient means of existence and health insurance.
