4 Dear all Allow me to give my commends on the issuance of the first number of the Bulletin of the Victims Advocacy and Assistance Office, which will inform the public and State Institutions about the work and achievements of this Office that functions within the Office of Chief State Prosecutor. Rights of the victims of crime are rights that are guaranteed by the Constitution and Law in the Republic of Kosovo. Rights of Victims are part of basic rights, and as such the same shall be protected by the State through its mechanisms. Office of Chief State Prosecutor has established the legal infrastructure and has increased human resources in order to have victims of crime treated with dignity and respect they deserve, through their inclusion in all judicial procedures and within the legal deadline. In this regard Chief State Prosecutor together with the Victims Advocacy and Assistance Office has reorganized Offices of VAs throughout all Basic Prosecutions, and has approved the Regulation on the Mandate, Structure of the VAAO, in full compliance with the Criminal Code and Criminal Procedure Code of the Republic of Kosovo, in order to enable victims of crime to have access in support and assistance provided by Victim Advocates, either in relation to Police, State Prosecution or Courts. Chief State Prosecutor confirms and ensures citizens of the Republic of Kosovo that it will undertake all necessary actions to have victims of crime treated with respected and dignity as they deserve, always by applying highest standards in order to respect and protect rights of victims of crime.

5 Introduction speech of former-chief State Prosecutor, Mr. Ismet Kabashi in the event of opening solemn ceremony of Crime Victims` Rights Week Dear attendees, Allow me to cordially thank you on behalf of State Prosecutor for your participation in this significant event for the rights of Crime Victims, with the motto 1 week awareness and 365 service Dear all Crime Victims` Rights are rights that are guaranteed with the Constitution and legislation of the Republic of Kosovo. Victims` Rights are part of the basic rights, and as such they shall be protected by the State. Crime Victims` Rights are recognized by international instruments as well, including the United Nations Declaration of Basic Principles of Justice for Victims of Crime and Abuse of Powers, which presents best international practices for treatment of Crime Victims. International community has acknowledged that victims of crime enjoy the rights for proper treatment and access in the justice mechanisms, and it also recognizes the liability of the perpetrator to provide the fair restitution for the victim. In this regard as well, Kosovo has established tracking mechanisms for ensuring that the advocacy of human rights, namely right of victims of crime in Kosovo, have the proper and effective treatment. In Kosovo, Victim Advocacy Service was initially focused in victims of traffic, as provided by UNMIK Regulation No. 200/14, and later on it was committed to provide active advocacy for victims of domestic violence and victims of sexual abuse. During 2011, Ministry of Justice has transferred the Division for Victims Advocacy and Assistance in the Office of Chief State Prosecutor. In the respective capacity, role of the Victim Advocate has expanded in order to be in compliance with the new Criminal Procedure Code of Kosovo, which has entered into force in January, State Prosecutor, in order to adjust the new competencies as provided by the Criminal Code of Kosovo, and in order to provide more effective advocacy of the rights of victims and providing access to justice, has undertaken concrete actions in order to have the transfer of these competencies, including the approval of the new Regulation on Internal Organization of the Office, approval of Standard Operating Procedures, upon which is defined the unique practical implementation of the Standard Procedures throughout all territory of Kosovo; and it has also prepared Declaration of Damages for victims of crime, in compliance with article 218 of CPC, where during the investigation stage or within sixty (60) days of the filing of the indictment, the injured party may file a simple declaration of damage from the charged criminal offence. Victim Advocate may support the injured party in submitting the Declaration of Damage.

6 State Prosecutor in accordance with the competencies has the readiness to fairly represent victims of crime in the justice system in Kosovo. Thank you for your attention Introduction: Mr.Basri KASTRATI, Manager of the Victims Advocacy and Assistance Office After the war, Kosovo did not have any particular mechanism that would deal with representation of the interests of the victims of crime in the justice system during the judicial procedure; until 2002 in Kosovo were working only some Non-Governmental Organizations that were representing the interests of the victims of crime in the justice system during the judicial procedure, but their access was pretty limited and there was no institutional mechanism that would deal with interests of victims. Therefore, within the Department of Justice of that time and with the support of the American Office and OSCE, in 2002, and later with the establishment of local institutions, in the Ministry of Justice was established the Division for Victims Advocacy and Assistance, in order to represent victims of crime [domestic violence, human trafficking, sexual abuses, rapes, etc.], in the judicial procedures. In the beginning of the respective work there was trained the first generation by international staff in 2002/2003 with a modest staff from 11 Victim Advocates, and 8 resident Victim Advocates who were assigned to work in the high risk shelter for cases of human trafficking. Afterwards, number of cases was increasing more and more and there emerged the need to have additional prepared staff, so in 2004/2005 there were two more new generations of locals who obtained knowledge on best local and international practices, and representation of cases, and most of those are still working for VAAOs.

7 Within the office functions the Assisting Line as well, which is in the service free of charge for all parties and possible victims seeking any advice or information for their rights, and the respective free of charge line is: , accessible from VALA and IPKO. In 2011 upon a Memorandum of Understanding between Ministry of Justice and Chief State Prosecutor, Victims Advocate Office was transferred in the State Prosecutor, and now it functions as a central Office with 7 Regional Offices, with a staff from a total from 37 Officers; and now with the new amendments of the Criminal Procedure Code of the Republic of Kosovo, as well as upon the organizing and legal structure, Victim Advocate has a meritorious place in the criminal justice system in Kosovo, and this has taken place thanks to the readiness of the Chief State Prosecutor with the managerial staff of the Office of State Prosecutor, as well as representatives of American Embassy in Kosovo, who have assisted with the drafting of the Regulation on the Mandate, Structure and Function of VAAOs, and Guideline on Standard Operating Procedures in order to have this Office as professional and active in the proper treatment and representation of victims in the procedure, in accordance with their mandate. Therefore, VAAO shall be the strongest voice in serving crime victims; in order to have them treated with respect and dignity during all judicial procedures. VAAO works for a brighter future, for not having violence and crime. History of the VICTIMS ADVOCACY AND ASSISTANCE OFFICE [VAAO] Establishment of the Victims Advocacy and Assistance Office derives from the authority and mandate of Human Rights as provided by the UNMIK Regulation no. 1999/01 issued on 25 th of July, 1999, which was amended by the Provisional Authority of Kosovo and UNMIK Regulation no. 2000/15 regarding the Establishment of the Administrative Department of Justice, which has monitored the Coordinator`s Office for Assistance of Victims that was established by the UNMIK Regulation no. 2001/4 on Preventing Human Trafficking in Kosovo, UNMIK Regulation no. 2003/12 on Protection against Domestic Violence. The Office, that was initially called Victims Advocacy and Assistance Unit [VAAOU], functioning within the Department of Justice, has started to be functional from 2002 within UNMIK, and was the only one of such character in the region, afterwards upon the establishment of Kosovo Institutions, the Office has started to function within the Ministry of Justice of the Republic of Kosovo, as a Department for Access to Justice [DAJ], until November, 2011, when Chief State Prosecutor Mr. Ismet Kabashi and Minister of Justice, Mr. Hajredin Kuqi have signed a Memorandum of Understanding for transferring the Victims Advocacy and Assistance Office to the Office of State Prosecutor. Victims Advocacy and Assistance Office [VAAO] functions independently within the Office of Chief State Prosecutor. The Office is in charge of ensuring that VAAO policies are in accordance with the policies of the Office of State Prosecutor and Kosovo Prosecutorial Council. Victims Advocacy and Assistance Office has the mandate to institutionalize the rights of victims of crime and to provide for them representation, counselling and support for access in the justice system. Victims Advocacy and Assistance Office is a reflection of success in providing assistance and advocating for rights of victims of crime, providing professional service, as well as establishment of a safer environment for society and its future.

8 Victims Advocacy and Assistance Office functions as a central office in Prishtina and it has seven Offices functioning as regional Offices located in Basic Prosecutions. Victim Advocacy and Assistance Office Staff - year 2012 The component of the Victim Advocate within VAAO Duties and Responsibilities: Within the Victim Advocate and Assistance Office functions and the component of Victim Advocates [VA] as well, available 24/7, 7 days a week, covering the whole territory of the Republic of Kosovo. Victims Advocates support and represent the victims of domestic violence, human trafficking, child abuse cases, rapes, homicide, as well as other victims of crime. Victim Advocate is the authorized person, based on article 63, point 2 of CPCK. Victim Advocate intervenes on behalf of the victims, in order to advocate for the rights of the victim during the investigation procedure, prosecution and penal punishment. Victim Advocate supports victims of crime for seeking support from the State. This includes filing requests for Protection Orders, investigation measures, and intervention of the Court for preserving the interests of victims in matters deriving from the criminal offence. Victim Advocate advises victims of crime about their rights. Victim Advocate advises victims of crime about available state services and instructs the victims to the adequate authority for receiving the respective services, and provides support in coordination of those activities.

Victim Advocate informs and instructs victim concerning other health, psycho-social and rehabilitation services that are available for victims of crime. Victim Advocate has official competencies for drafting Request for Order of Protection for victims of Domestic Violence, and also provides legal support in all judicial sessions held regarding for the Request for Order of Protection, and s/he also monitors the progress of the judicial process. Victim Advocate also has official competencies to assist the victim in drafting the Declaration of Damage, in accordance with article 218 of the Criminal Procedure Code. 17 Helpline Staff during a lecture held in gymnasium Sami Frasheri in Pristine-year 2013 CURRENT LEGAL MECHANISMS: According to the legislation in power, legal basis of the local legislation is based on a series international documents and conventions. In the Republic of Kosovo are into force numerous legal acts that guarantee freedoms and rights for all citizens regardless race, religion, gender and status background, as are: 1. Constitution of the Republic of Kosovo approved by Kosovo Assembly, which guarantees direct implementation of International Agreements and Instruments [article 22] 2. Administrative Directive on Health, on the Treatment Procedures of perpetrators of domestic violence against who is imposed protective measure for mandatory medical treatment, alcohol addiction and psycho-tropic substance addiction. 3. National Strategy against Human Trafficking Kosovo Program against Domestic Violence and Action Plan CURRENT OPERATIONAL MECHANISMS: There are in place Standard Operating Procedures for foreign and local victims and minimum standards for providing care for victims of traffic, which are approved and are being implemented in full coordination with all actors dealing with identification, protection and referring victims of human trafficking. SOPs for domestic violence are approved, and have also entered into force, as well as Standard Operating Procedures for VAAO, signed by State Prosecutor. SOPs define respective roles and responsibilities of the actors for a better coordination and cooperation for inter-institutional actions.

19 VAAO staff during a training of Judgment skills-year 2014 INTER_INSTITUTIONAL COOPERATION LOCAL, INTERNATIONAL and THROUGH NGOS: Victims Advocacy and Assistance Office is a mechanism that has a good cooperation with other Institutions that provide support for victims of crime. This cooperation is found in different segments and it includes lots of actors. Among cooperative actors to whom we are grateful we shall mention: Embassy of United State of America [ICITAP, OPDAT, DEPARTMENT OF JUSTICE - USA], Kosovo Police (KP), Center for the Protection of Women and Children throughout all main cities of Kosovo [CPWC], Free Legal Aid Agency [FLAA], Social Welfare Center [SWC], Ministry of Education, Science and Technology [MEST], NGO Cllard, as well as other NGOs that provide free of charge support for victims of crime. A special thanking goes for the Embassy of United State of America that has continuously supported Victims Advocacy and Assistance Office [VAAO] through providing support in the area of trainings, seminars, debates and workshops, lectures from which VAAO staff has gained new knowledge on the area of victims` advocacy, always hoping that this cooperation will carry on in the future as well.

20 VAAO Staff during a lecture held in Primary School Selman Riza in Fushë-Kosovë, within the Crime Victims` Rights Week year Inter-institutional cooperation consists in the deepening of positive relations of providing best support for providing services for victims of crime institutionally, in compliance with the laws into force, emphasizing strengthening of VAAO and NGOs that have continuously provided support for victims of crime, with a special emphasize for victims of domestic violence and human trafficking; inter-institutional capacity building was not lacked as well. These Institutions through organizing courses, trainings, seminars, roundtables, workshops and lectures have enabled capacity building of the network that provides different forms of support for victims of crime in compliance with the laws into force.

21 Participation of VAAO Staff in an international workshop - year 2014 CRIME VICTIMS` RIGHTS WEEK: In order to increase the awareness of the public, especially for having the most dignified treatment for the rights of victims of crime, Office of Chief State Prosecutor in a close cooperation with USA Embassy in Prishtina, and with the support from the Office of the President of Kosovo and under the patronage of Chief State Prosecutor, has perceived reasonable to organize Week of Rights of Victims of Crime, which was organized for the first time in 2010, through organizing a solemn ceremony, in which ceremony was disclosed the multi-year work of local and international institutions in the area of advocacy and support for the rights of victims of crime.

22 Organized Ceremony of the Victims Rights Weeks Year 2013 This week serves for increasing the awareness of Institutions and public for advocacy and respect of the rights of victims of crime, and the possibility for supporting victims for having direct access to Justice Institutions. This week shall also serve and for subliming the work results and annual engagements regarding the support provided for victims of crime. This year there will be held the fifth edition of the Week for Crime Victims Rights, which shall disclose achievements of Institutions in the area of advocacy and support for the rights of victims.

23 Former-Chief State Prosecutor Mr. Ismet Kabashi in the opening of the solemn ceremony of the Crime Victims` Rights Week. There is worth of mentioning that at the end of the last year with the engagement of the Office of Chief State Prosecutor, Victims Advocacy and Assistance Office and in a close cooperation with the Embassy if United States in Prishtina, and upon the approval of Kosovo Prosecutorial Council, there was drafted the new Regulation on the Mandate, Structure and Function of the Victims Advocacy and Assistance Office, based on which were clearly defined duties and responsibilities based on the legislation into force for the Mandate of the Victims Advocacy and Assistance Office, and in particular for the Victim Advocates and Helpline, particularly regarding a more expanded engagement and responsibilities of those actors as provided by the new Criminal Procedure Code. Within this we shall mention and the Working Group composed of representatives of State Prosecutor, VAAO and American Embassy, who gave valuable contribution in drafting the new Regulation for VAAO, which started to be implemented from 1 st of January, 2014, and among the main newness of this Regulation for VAAO was engagement of VAAO in the management of violent crime cases, such as robbery and representation of the interests and advocating for the rights of the family members of homicide victims as well, as a new category of the victims recognized by the new EU Directive on defining the minimum standards on the rights, support and protection of victims of crime, approved at the end of 2012.

24 Brochure from the Crime Victims` Rights Week Year 2012 A practical case from the work of Victim Advocate from Region of Peja: On from the Police Station in Peja, namely Regional Investigation Unit of Domestic Violence, I have been informed through the stand-by phone line that a victim N.N. has went to the Police Station for reporting a domestic violence case. Following the call, Victim Advocate has contacted the Driver of VAAO through the stand-by phone line, and has arrived at the Police Station. As soon as the Victim Advocate has arrived in the respective place, the introduction to the victim N.N has taken place and afterward the Victim Advocate has carried on with explaining to the victim services we provide, and the victims` rights that are guaranteed from the applicable legislation in the Republic of Kosovo. Following our explanations, victim N.N. upon her own free will has declared about the bitter experience of hers, caused by her husband, and then she has freely stated that she does not feel safe to return at her house, where she has lived before. Afterwards, with her consent CPWC in Peja has been contacted, and with Officers in charge in the named Center, have taken place discussions about the temporary accommodation of the victim in the shelter, and with ours and Police escort, victim N.N. was accommodated in the shelter in Peja. Afterwards, Victim Advocate has visited the victim N.N. in the shelter and has talked to her about providing our legal services, the Law on Domestic Violence was explained, as well as protective measures incorporated in the latest, and then the victim upon her free will has decided that she wants to have the Request for Protection Order. Victim Advocate has drafted the request for Protection Order and the same was submitted to the Basic Court in Peja. The Court, by respecting the legal deadline has summoned the main trial, and has invited respective parties for the hearing session, and following the closure of the main trial the Court has issued the Decision on Protection Order, upon which for the Victim and her juvenile

25 daughter was allowed the returning at the joint spousal residence, where they have lived before. After receiving the decision, the victim has tried with the Police escort to return to live in the joint spousal residence, but she has encountered with a resistance from her husband who was refusing her return at home. Police arrested her husband and kept him in 48 hours detention, but the victim with her daughter were afraid to return at their home where they have lived before, because as the victim stated, the house was registered on behalf of the brother of her husband, whereas at the same house were living a brotherin-law with her husband`s sister, and with the Police escort the victim returned to the Police Station, and afterwards through the Center for protection of Women and Children in Peja, she has returned to the shelter to stay there until a more suitable solution for her would be found. Seeing this situation, Victim Advocate in the following days has contacted Municipal Bodies of Peja and has discussed with them, explaining the situation in which the victim was, as well as her needs. Discussions of the Victim Advocate with the Municipal Bodies of Peja have resulted successful, in which case Municipal Assembly has ensured a donation in amount from 100 Euros per month, for paying the rent of the apartment for the domestic violence victim N.N., rented through Habitat. Victim Advocate in the continuation has instructed and accompanied the victim in the Free Legal Assistance Agency as well, through which Agency and its Officers in charge, namely the Lawyer recruited by Kosovo Chamber of Advocates, was drafted the divorce claim for the victim, while the Victim Advocate has accompanied the victim in the divorce session, too, providing thus legal assistance, whereas later the victim N.N. was accompanied and in Social Welfare Center, too, for preparing the respective social documents, which has ended successfully for the victim, as provided by the Law on enjoying social aids.
