3 Written Statements 10 July 2017 Page 1 Written Statements Monday, 10 July 2017 Environment Council: June [HLWS33] Lord Prior of Brampton: My honourable Friend the Minister of State for the Department of Business, Energy and Industrial Strategy (Claire Perry) has today made the following statement: I attended the EU Environment Council in Luxembourg on 19 June along with my Hon Friend, Thérèse Coffey MP, Parliamentary Under Secretary of State for the Environment and Rural Life Opportunities, Department for Environment, Food and Rural Affairs. I wish to update the House on the matters discussed. The Effort Sharing Regulation (ESR) and Land Use, Land Use Change and Forestry Regulation (LULUCF) The Maltese Presidency introduced an exchange of views on these two Regulations which, alongside the EU Emissions Trading System, will implement the EU s 2030 emissions reduction target under the Paris Agreement. On the Effort Sharing Regulation (ESR), views were sought on the idea of a safety reserve put forward by the Presidency to address concerns from some Member States on the starting point for the emissions trajectory. On the Land Use, Land Use Change and Forestry (LULUCF) regulation, views were sought on how to account for forest reference levels. Member State views remain divided on the best way to balance fairness, environmental integrity and cost efficiency across the dossiers. However, delegations reiterated the importance of making progress in order to reach agreement at October s Environment Council. This in turn would help reinforce EU climate leadership ahead of the next UN Framework Convention on Climate Change Conference of the Parties in November. On both dossiers, the UK spoke in support of the Commission s original proposals, highlighting the importance of environmental integrity and appropriate flexibility, but recognised the concerns of other Member States and indicated a willingness to work constructively with others to reach an agreement. On the ESR, the UK noted some concerns with the current design of the proposed safety reserve, but was open to it in principle. On LULUCF, we spoke alongside several other Member States in expressing a preference for forest reference levels to be based on historic policies, to help ensure biomass emissions are fully reflected in LULUCF accounting. US decision to withdraw from the Paris Agreement Environment Ministers debated the United States announcement of its intention to withdraw from the Paris Agreement, noting that the Foreign Affairs Council (FAC) had adopted Council conclusions on the same subject earlier in the day. There was full support of the FAC position, with many Member States, including the UK expressing deep regret at the US decision and reaffirming that the Paris Agreement cannot be renegotiated. While underscoring that the Paris Agreement was irreversible, the UK also noted that the EU should leave the door open for the US to review its decision. The Netherlands called on Member States to provide funding to make up the shortfall in funding to the Intergovernmental Panel on Climate Change (IPCC) and the UK, along with other Member States, responded positively towards this suggestion. EU Action Plan for Nature, People and the Economy Council adopted Council Conclusions on the Action Plan, which seeks to improve the practical implementation of the Habitats and Birds Directive and boost their contribution towards reaching the EU's biodiversity targets for AOB items AOB Waste Package State of Play The Presidency updated Council on the Waste (Circular Economy) package. Many Member States, UK included, noted that further discussion on the file would be welcome, particularly on the achievability of targets across all Member States. The UK highlighted the variance of current municipal recycling rates across England, the challenge faced in urban areas and recognised the success in Wales. AOB Urban Adaptation Plans for cities with more than 100,000 inhabitants in Poland Information The Polish delegation presented information on the climate implications of their Urban Adaptation Plans. AOB Member State ratification of the Kigali Amendment to the Montreal Protocol Information The Commission presented information on the Kigali Amendment to the Montreal Protocol. AOB Basel, Rotterdam and Stockholm Conferences of the Parties Information The Presidency and the Commission together updated the Council on the outcomes of the international meeting on the Basel, Rotterdam and Stockholm Conventions. AOB Role of Women in Mountain Regions Information The Austrian delegation presented information on the role of women in mountain regions. AOB UN Oceans Conference Information The Swedish delegation presented information on the outcome of the UN Oceans Conference. AOB 11th Nano-Authorities Dialogue Information The Luxembourg, Austrian and German delegations together presented information on the recommendations adopted at the 11 th Nano-Authorities Dialogue. AOB Estonian Presidency Work Programme Information The incoming Estonian Presidency set out the Council work programme for the next 6 months.

4 Page 2 10 July 2017 Written Statements Supply and Appropriation (Main Estimates) Bill [HLWS34] Lord Bates: I have made a statement under Section 19(1)(a) of the Human Rights Act 1998 that, in my view, the provisions of the Supply and Appropriation (Main Estimates) Bill are compatible with the convention rights. A copy of the statement has been placed in the Library of the House. Teacher Update [HLWS35] Lord Nash: My right honourable friend the Secretary of State for Education and Minister for Women and Equalities (Justine Greening) has made the following Written Ministerial Statement. The 27 th report of the School Teachers Review Body (STRB) is being published today. Its recommendations cover the remit that I issued in October The report contains recommendations on the pay award for teachers that is due to be implemented from September 2017, which are consistent with the Government s 1% public sector pay policy. Copies of the STRB s 27th Report are available in the Vote Office, the Printed Paper Office and the Libraries of the House, and online at The STRB has recommended an uplift of 1% to the minima and maxima of all pay ranges and allowances in the national pay framework, other than the minimum and maximum of the main pay range, to which they have recommended a 2% uplift. Following previous reforms, schools already have significant flexibility, within the pay ranges, to set pay for individual teachers, taking account of performance and retention. Nevertheless, those at the bottom of the main pay scale will receive an automatic 2% increase, a small proportion of teachers. As such it is consistent with the Government s public sector 1% pay policy. A full list of the recommendations is attached as an annex. My officials will write to all of the statutory consultees of the STRB to invite them to contribute to a consultation on my acceptance of these recommendations and on a revised School Teachers Pay and Conditions Document and Pay Order. The consultation will last for three weeks. I am grateful to the STRB for these recommendations and, subject to the views of consultees, I intend to accept all the key recommendations. My detailed response contains further information on these matters. 5 Written Answers 10 July 2017 Page 3 Written Answers Monday, 10 July 2017 Affordable Housing Asked by Baroness McGregor-Smith To ask Her Majesty s Government, what steps they are taking to ensure key workers are able to afford to buy their own homes. [HL227] Lord Bourne of Aberystwyth: This Government wants to support everybody, including key workers, by making homes more affordable with steps outlined in the Housing White Paper to increase supply. Currently the Government funds a range of home ownership schemes including Help to Buy Equity Loans and Shared Ownership to support all who might need it, including key workers, to buy a home where they are unable to afford market prices locally. Agriculture: Subsidies Asked by Lord Steel of Aikwood To ask Her Majesty s Government, why additional EU funding for farmers granted to the UK in 2014 was distributed across the UK, given that that funding arose because of low area payments in Scotland. [HL170] Lord Gardiner of Kimble: Following agreement of the European Council on the EU Budget for 2014 to 2020, the Government decided in 2013 to maintain the historic split of the UK s CAP direct payments budget between England, Scotland, Northern Ireland and Wales. This decision followed consultation with key stakeholders in each part of the UK and each of the devolved administrations. The decision recognised that not all parts of the UK had yet completed the transition to area based payments, making comparisons difficult. Scotland received less funding per hectare than other parts of the UK because of its mountainous, and therefore less productive, areas. Scotland has, on average, larger farms than the rest of the UK meaning Scottish farmers received higher than average payments. Asylum Asked by Lord Oates To ask Her Majesty s Government, what is the average time between receipt of a claim for asylum and determination of that claim. [HL232] Baroness Williams of Trafford: Our records indicate that the average time between asylum claim and decision in each of the last five years is as follows: Year of Claim Average Time (In Days) from Claim to Decision Notes i) The data relates to the (mean) average time from date of claim for asylum to date of initial decision. The data does not include cases that have not yet had a decision. ii) A case may be for a single claimant or for more than one person (the main asylum claimant and their dependants). iii) The data relates to asylum cases where the application was raised between 1 January 2011 and 31 December 2016 iv) Data taken from Case Information Database on 7 April v) These statistics have been taken from a live operational database. As such numbers may change as information on that system is updated. Brexit intend to allow (1) UK citizens, and (2) EU citizens resident in the UK, to have direct access to any judicial body which may oversee the withdrawal agreement. [HL203] Baroness Anelay of St Johns: The arrangements agreed in the Withdrawal Agreement, which will have status of international law, will be enshrined in UK law and enforceable through the UK judicial system, up to and including the Supreme Court. This will allow all UK and EU citizens resident in the UK to access the UK legal system for purposes of the withdrawal agreement. The UK has an international reputation for our independent legal system, adherence to the rule of law and respect for our obligations arising in international agreements. We have been clear that, after withdrawal, the jurisdiction of the European Court of Justice in the United Kingdom will end. Asked by Lord Taylor of Warwick intend to negotiate to enable UK citizens to keep their EU citizenship and rights following Brexit. [HL466] Baroness Anelay of St Johns: Our aim is to ensure people can broadly live their lives as they do now. At every step of negotiations we will work to ensure the best possible outcome for UK Citizens. We are proposing a reciprocal deal which is fair and serious, and we are approaching these negotiations constructively and respectfully, with a determination to secure a deal that works for both the UK and the EU.

6 Page 4 10 July 2017 Written Answers Brexit: Gibraltar Asked by Lord Hoyle To ask Her Majesty s Government, whether it remains their intention to ensure that they do not reach a deal on Brexit without Gibraltar being fully included in that final deal. [HL506] Baroness Anelay of St Johns: The Government is clear that Gibraltar is covered by our exit negotiations and we have committed to fully involve them as we prepare for the process of exiting the EU. We will negotiate as one United Kingdom, and leave as one United Kingdom. The PM has been clear that we are seeking a deal that works for Britain not an off the peg solution. That deal must work for Gibraltar too. British Nationals Abroad: EU Countries To ask Her Majesty s Government, what assessment they have made of the different rights granted to UK citizens resident in the EU post-brexit under their proposals compared with those of the European Commission. [HL199] Baroness Anelay of St Johns: On Monday 26th June, the UK published the paper The United Kingdom s exit from the European Union: safeguarding the position of EU citizens living in the UK and UK nationals living in the EU. This paper sets out a fair and serious offer of what we want to achieve on citizens rights, on a reciprocal basis, from the negotiations with the European Union. have any plans to recognise the status of associate citizenship, proposed by Guy Verhofstadt, for UK citizens who wish to avail themselves of that status in the EU in future. [HL201] Baroness Anelay of St Johns: We want to reach a reciprocal agreement for EU citizens in Britain and UK nationals in Europe as quickly as possible. That is why we have published our policy paper to outline our offer for EU citizens, in the expectation that the EU will offer reciprocal treatment for UK nationals resident in its member states. Corruption Asked by Lord Myners intend to review the law on bribery and improper inducements. [HL213] Lord Keen of Elie: The Government has no current plans to review the law on bribery and improper inducements. Developing Countries: Females Asked by Baroness Goudie To ask Her Majesty s Government, how they are implementing the recommendations of the UN Secretary General's High Level Panel on women's economic empowerment. [HL344] Lord Bates: The UK is a founding member of the UN Secretary General s High Level Panel on Women s Economic Empowerment. In response to the Panel, DFID is working to deliver better jobs and working conditions across supply chains, increase access to finance and rights to land and tackle legal barriers and discrimination. For example, DFID s new Work and Opportunities for Women (WOW) programme, will work with businesses in some of the poorest countries to improve job opportunities and working conditions for at least 300,000 women in global supply chains. The UK has a strong domestic story. In April this year the UK became one of the first countries to introduce mandatory gender pay gap reporting for businesses over 250 employees. We are also working with business to achieve 33% of women on boards by 2020 and eliminate all-male boards in the FTSE 350. Asked by Baroness Goudie To ask Her Majesty s Government, how the Department for International Development's strategic vision and plans reflect the specific recommendations of the UN High Level Panel (1) to support informal women workers, and (2) to invest in the recognition, redistribution and reduction of women's unpaid care work. [HL345] Lord Bates: In January 2017 the Department for International Development launched an Economic Development Strategy which includes a strong emphasis on supporting women workers to overcome barriers to opportunities; including unpaid care. DFID is already supporting informal women workers to secure property rights and increase their access to finance and markets. In the Niger Delta DFID is working with women farmers and entrepreneurs to increase yields and sales from cassava, palm oil and fisheries. New partnerships with business under the Work and Opportunities for Women programme, will improve job opportunities and working conditions for informal women workers in supply chains, with the intention of also addressing the burden of unpaid care. In addition, the Department s research on women s economic empowerment has increased global recognition and commitments on the importance of an increased focus on care.

7 Written Answers 10 July 2017 Page 5 Educational Exchanges: USA Asked by Baroness Deech To ask Her Majesty s Government, what representations they have made to the government of the US in relation to its proposal to cut funding of the Fulbright Program by 47 per cent. [HL190] Viscount Younger of Leckie: The Fulbright programme provides important opportunities for education exchanges between the UK and the US. We have received no communication from the US government to inform us of any proposal to cut funding of the Fulbright Programme. EU Nationals intend citizens of the EU-27, lawfully resident in the UK when the UK leaves the EU, to retain their rights as European citizens as protected by the EU Treaties and the European Court of Justice. [HL176] Baroness Anelay of St Johns: The government has been clear that rights of citizens of the EU-27 when the UK leaves the EU will be enshrined into UK, not EU, law, enforceable through the UK judicial system. EU nationals will be able to rely on those rights in the UK legal system. We are also ready to make commitments in the Withdrawal Agreement which will have the status of international law. To ask Her Majesty s Government, what assessment they have made of the possible changes to the rights granted to EU citizens resident in the UK post-brexit, particularly in relation to rights granted to family members. [HL202] Baroness Anelay of St Johns: For mutual recognition of professional qualifications, the UK will seek to ensure that professional qualifications obtained prior to the date of the UK s withdrawal from the EU continue to be recognised after the UK s exit from the EU. The UK will also seek to ensure that where a person has begun an associated process that has not concluded by the withdrawal date, arrangements will be made to allow that process to continue. The UK will also give due regard to these professionals ability to practise without unfair detriment or discrimination. Exhibitions: Palestinians Asked by Lord Warner To ask Her Majesty s Government, whether any Minister has taken, or is considering taking, action to prevent the Palestine Expo 2017 taking place at the Queen Elizabeth II Conference Centre in July; and if so, why. [HL204] Lord Bourne of Aberystwyth: We have worked with the QEII Centre to consider the concerns raised about Palestine Expo Following consideration, we have agreed that the event can take place as planned. That said, we have emphasised to the organisers the need for all events at the centre to maintain good community relations and for them to ensure that the event is conducted in a lawful manner and in line with fundamental British values. Exports: Finance Asked by Viscount Waverley To ask Her Majesty s Government, what was the total value of export finance available by country, together with the amount that was allocated to projects, for each of the last four years. [HL171] Lord Price: Measures introduced in the 2016 Autumn Statement enable UKEF to increase export finance capacity for individual countries by up to 100%, subject to country reviews. UKEF's public expression of current risk appetite for new business for each country is available on its website. It does not hold historical information about its public expression of risk appetite for each country, but the website notes where the risk appetite has been increased following the Autumn Statement. UKEF publishes details of the support it provides by country on an annual basis on its website. Details of its support for the last year will be published once its Annual Report and Accounts are laid before Parliament. Asked by Viscount Waverley To ask Her Majesty s Government, what was the total export finance facility available by country as at 1 June. [HL172] Baroness Chisholm of Owlpen: UK Export Finance covers over 200 countries and it details the amount of export finance available (market risk appetite) for each country on its website.

8 Page 6 10 July 2017 Written Answers Asked by Viscount Waverley To ask Her Majesty s Government, what criteria they apply for allocating export finance facilities. [HL173] Lord Price: UK Export Finance sets its total risk appetite for each country by taking into account the size of that country's economy and the level of risk. Its assessment framework is aligned with that used by the credit rating agency, Standard & Poor's (S&P), but is additionally informed by cross-whitehall forums, local UK diplomatic representatives, OECD country risk expert meetings and country visits, where appropriate. Fire Prevention Asked by Baroness Jones of Moulsecoomb To ask Her Majesty s Government, whether the independent expert advisory panel appointed to advise an immediate safety action following the Grenfell fire will consider whether the presence of disabled and vulnerable people should be given more weight in the fire risk assessment of premises, and especially of day-care centres. [HL229] Lord Bourne of Aberystwyth: The Prime Minister has announced that a full independent public inquiry will consider the causes of the Grenfell Tower fire. The inquiry will be chaired by Sir Martin Moore-Bick and conducted under the Inquiries Act 2005 including the power to compel the production of documents, and to summon witnesses to give evidence on oath. We expect the inquiry to produce an interim report as early as possible. The Metropolitan Police launched a criminal investigation into the fire on 15 June, which is ongoing. High Rise Flats: Fire Extinguishers Asked by Baroness Jones of Moulsecoomb To ask Her Majesty s Government, what action they have taken to implement the Lakanal House fire inquest recommendation to "encourage providers of housing in high rise residential buildings...to consider the retrofitting of sprinkler systems". [HL290] Lord Bourne of Aberystwyth: The Department wrote to all social housing providers in 2013 following the recommendations in a Coroner s report into firefighter deaths which occurred at Shirley Towers in Southampton in April That letter encouraged providers to consider the retrofitting of sprinklers in older residential tower blocks. [ Coroners Rules Letter - HL290.pdf] The material can be viewed online at: Immigration Asked by Baroness Hamwee To ask Her Majesty s Government, how notifications of the refusal of (1) visas, and (2) deportations, are served; and whether, for those purposes, there is routine use of mail that is not recorded in any way. [HL193] Baroness Williams of Trafford: UKVI uses commercial partners to manage the visa application process. The decision to refuse a visa is recorded on our case working system, Proviso, a separate record is created when the decision is dispatched. Individuals have access to an online tracking service through the commercial partner which informs them when a decision has been made on their visa application and is available for collection or delivery. The Visa Application Centre is not privy to the justification to issue or refuse a visa. The primary method of service of any visa decision, whether issue or refusal, is via the Visa Application Centre unless they have requested another route, such as a courier service. There is no routine use of mail that is not recorded in any manner. The service of a deportation decision is dependent on the location of the individual on which the decision is being served. Where the individual is detained in prison or an immigration removal centre, the deportation decision is served directly on the individual by officials in the prison or immigration removal centre. Where the individual is not detained a deportation decision is sent by recorded delivery to the individuals last notified address

9 Written Answers 10 July 2017 Page 7 and a copy sent to their legal representative. The Home Office records the service of deportation decisions electronically on the case information database. Munchausen's Syndrome Asked by The Countess of Mar To ask Her Majesty s Government, how many cases of (1) Munchausen's syndrome by proxy, and (2) fabricated or induced illness, have been prosecuted against parents of children diagnosed with myalgic encephalomyelitis or chronic fatigue syndrome in each year since 2010 for which figures are available; how many of those cases were successful; how many were withdrawn; and how many resulted in an acquittal. [HL274] Lord Keen of Elie: Munchausen's syndrome by proxy and fabricated or induced illness are not of themselves criminal offences so cannot be prosecuted as such. They may, however, be of relevance to criminal offences which can be prosecuted. The Crown Prosecution Service (CPS) does not maintain a central record of prosecutions where Munchausen s syndrome by proxy or fabricated or induced illnesses may have been relevant. Such information could only be obtained through a manual search of records which would incur disproportionate cost. Pool Re Asked by Lord Myners have discussed with PoolRe extending cover for acts of terrorism to forms of damage other than property damage; and if so, what support they intend to offer. [HL212] Lord Bates: There is nothing in law that prevents insurers from providing cover for other types of terrorism risks, for example where no physical damage occurs. However, Government understands that these policies are not commonly offered or bought. Treasury is in active discussions with Pool Re in relation to the evolving nature of the terrorism threat. Refugees: Greece Asked by Lord Hylton To ask Her Majesty s Government, what is their assessment of action being taken to ensure the wellbeing of unaccompanied refugee children in Greece; and what steps they are taking to establish whether any such children are qualified to come to the UK by reason of extreme vulnerability or close family connection. [HL258] Baroness Williams of Trafford: The UK recognises the pressures on European countries most affected by the migration crisis, and has committed over 100 million to the Mediterranean migration response. This includes 10million for a Refugee Children s Fund for Europe which prioritises the needs of unaccompanied and separated children travelling through Greece and the Balkans. This support provides safe accommodation, educational activities, family reunification, psychosocial support, translation and legal advice. In addition, the UK is fully committed to identifying and transferring unaccompanied children in Greece who may qualify for transfer to the UK under the Dublin III Regulation or section 67 of the Immigration Act We have a secondee in Greece who works with a network of partners including the Greek authorities, British Embassies, UNHCR, the International Organization for Migration (IOM) and NGOs to support this process. Uganda: Refugees Asked by The Earl of Sandwich To ask Her Majesty s Government, what assistance, if any, they have given to the government of Uganda in its work supporting refugees from South Sudan in the past two years; and to what projects and regions this assistance has been directed. [HL279] Lord Bates: In the last two years, her Majesty s Government has supported the Government of Uganda in its efforts to host refugees from South Sudan by delivering food or a cash equivalent to 1 million refugees; vaccination and nutritional support to 350,000 children; and clean water for 150,000 refugees. This support is delivered by UN agencies and nongovernmental organisations. Support has been directed to the 12 refugee hosting Districts in Uganda.
