1 OCTOBER 2017 INTERNATIONAL ORGANIZATION FOR MIGRATION Supplemental Input t the UN Secretary General s Reprt n the Glbal Cmpact fr Safe, Orderly and Regular Migratin: Actinable Cmmitments The Internatinal Organizatin fr Migratin (IOM) is pleased t prvide this supplemental respnse t the request f the United Natins Special Representative f the Secretary-General (SRSG) n Internatinal Migratin fr input t the UN Secretary General s reprt n the glbal cmpact fr safe, rderly and regular migratin (GCM). IOM s submissin f 20 September 2017 included recmmendatins n the structure and elements f the GCM and the means f implementatin and framewrk fr fllw up and review f implementatin, plus general cnsideratins n actinable cmmitments. This submissin includes additinal recmmendatins n actinable cmmitments, in line with the mandate in the mdalities reslutin fr IOM t prvide technical and plicy supprt t Member States in develping the GCM. This submissin draws n IOM s wrk with gvernments and ther actrs n migratin gvernance and management thrugh plicy, research and peratins, at glbal, reginal, natinal and lcal levels. It draws, in particular, n the utcmes f plicy discussins held since 2001 with gvernments in cllabratin with ther stakehlders thrugh the IOM Internatinal Dialgue n Migratin. It als makes regular reference t and draws n the Sutherland Reprt, in line with IOM s strategic visin fr wellmanaged migratin. Brief Summary: IOM s Recmmendatins n Structure/Elements and Implementatin/Fllw-up/Review Structure and elements: In its 20 September submissin, IOM prpsed that the cmpact emphasize that human rights and peple are at its centre; that migratin is bth inevitable and largely psitive fr migrants and scieties; and that discriminatin and intlerance tward migrants must be cuntered. IOM suggested that key principles underpinning the GCM include that states have the svereign right t determine which nn-natinals may enter and remain in their cuntries, cnsistent with internatinal law; that peple have the right t return t their wn cuntries; that states must accept the return f their natinals; and that gvernments must wrk tgether, and with nn-state actrs, t share the respnsibility t realize the psitive benefits f migratin and address its challenges in a spirit f genuine slidarity. Implementatin, fllw-up, and review: IOM s 20 September input prpsed a framewrk fr GCM fllwup and review in which an inclusive, transparent, inter-gvernmental frum based in Geneva (where the bulk f migratin expertise lies) wuld undertake regular prgress reviews f GCM cmmitments. This fllw-up mechanism wuld: Build n existing systems and mechanisms. Optins identified include IOM s Gverning Bdy, namely the IOM Cuncil; IOM s Internatinal Dialgue n Migratin (IDM); and the Glbal Frum n Migratin and Develpment.

2 Include significant participatin by UN and reginal partners, civil sciety, the private sectr, academia, migrants and diaspra and ther stakehlders, ensuring balanced gegraphic, thematic and gender representatin. Build in ways t reach dwn t reginal and natinal actrs and fr thse actrs t reach up t the glbal level, as much f GCM implementatin will necessarily take place at natinal and reginal levels. Link t implementatin and review f the 2030 Agenda fr Sustainable Develpment (SDGs), at glbal, reginal and natinal levels, as implementatin f the GCM and the migratin-related SDGs will be mutually reinfrcing. Priritize identifying and delivering capacity develpment fr states and ther stakehlders n migratin plicy, legislatin and institutins, and in a hst f technical areas. Incrprate rbust interagency crdinatin at glbal, reginal, and natinal levels, including partnerships with lcal stakehlders, fllwing review f existing crdinatin structures like the Glbal Migratin Grup and the results f UN refrm effrts, leveraging the entry f IOM int the UN system, including by leading interagency crdinatin, as well as wrking grups n migratin at natinal and reginal levels. Include a financing mechanism fr funding, inter alia, data cllectin/analysis, prcesses and multi-stakehlder dialgues launched by the GCM, review f GCM cmmitments with a view t identifying barriers and gaps and prviding dedicated capacity building where needed. Be supprted by a dedicated secretariat, which IOM is well-psitined and prepared t lead. Recmmendatins fr Actinable Cmmitments IOM suggests that actinable cmmitments fall under the fllwing thematic clusters, which tgether frm the necessary fundatin fr safe, rderly, and regular -- that is, well-gverned -- migratin: 1. Adherence t internatinal standards and prtectin f migrants human rights; 2. Inclusive, balanced and well-functining natinal systems f migratin management; 3. Sciecnmic well-being f migrants and sciety; 4. Mbility dimensins f crises; and 5. Internatinal cperatin n and gvernance f migratin. 1. Observe internatinal standards and prtect migrants rights Cmpliance with applicable nrms and standards f internatinal human rights, refugee, humanitarian, labur, transnatinal rganized crime and diplmatic and cnsular law, fr migrants and in the cntext f migratin, is essential t well-gverned natinal migratin management systems. The implementatin and enfrcement f laws, plicies and prcedures must be in cnfrmity with and ensure full respect and prtectin f migrants human rights and fundamental freedms. 2

3 Internatinal Standards: Align natinal legislatin with bligatins and standards n the prtectin f the rights f migrants in relevant internatinal law, including nrms aimed at cmbatting discriminatin, xenphbia and racism, and ensuring migrants access t justice. Build capacity t implement such legislatin. Train fficials wh cme in cntact with migrants (custms/brder fficials, health and scial service prviders, teachers, plice fficers, judges, and thers) n internatinal human rights, transnatinal rganized crime, labur and ther relevant law and n hw t identify, screen, refer, and assist migrants with particular prtectin needs. Target high-risk areas like brder crssing pints and ther strategic lcatins alng migratin rutes, crisis-affected areas, and industries where the risk f abuse is high, such as dmestic wrk, the sex industry, cnstructin, manufacturing, agriculture and fishing. Identity: Establish natinal civil registratin systems. Prvide all persns with prf f their legal identity. Develp cmmn understandings n and standardize the essential parameters fr rbust identificatin dcuments and identity management systems (such as the scpe f infrmatin t be included, security features fr dcuments, bimetric infrmatin, ther technlgy t cnfirm identity mre quickly and accurately, etc.), with apprpriate attentin t privacy cncerns. Imprve identity management capacity, thrugh enhanced natinal identity and readmissin systems, including thrugh peer t peer learning and dedicated capacity develpment. Prvide fr the prmpt and cmprehensive registratin f new arrivals t ensure apprpriate referrals, t infrm integratin and sustainable slutins, and t supprt data cllectin and analysis. Special Prtectin Cnsideratins: Infrm migrants f their rights and respnsibilities, and f legal migratin pathways, thrugh materials prvided in cuntries f rigin and upn arrival by cnsular ffices, immigratin agencies, migrant assistance centres and entities, health and educatin prviders, law enfrcement, and thers. Prvide emergency and lifesaving services in transit and n arrival. Establish receptin systems that prvide essential needs n a nn-discriminatry basis fr migrants arriving irregularly r in large flws, including fd, ptable water, decent shelter and health care. Establish and reinfrce referral mechanisms t relevant authrities and service prviders, fr example fr persns claiming asylum, children, ptential victims f trafficking, persns with disabilities, and thers with special rights and needs. 3

4 Screen fr increased risks and vulnerabilities, such as gender, age, health and ther factrs, and cntinued attentin t gender-based vilence and related explitatin and abuse, particularly in crisis cntexts and situatins f heightened vulnerability, while als taking accunt f individual migrant resilience and agency. Reduce the risk f explitatin and abuse by regulating wrk that can be hidden, such as dmestic wrk, and limiting the use f and prviding alternatives t single-emplyer spnsrship systems, such as sectr-based spnsrship, emplyee mbility, and flexible visa schemes. Develp, thrugh a state-led prcess, nn-binding guiding principles fr the prtectin f migrants in vulnerable situatins, building n, amngst thers, the Migrants in Cuntries in Crisis and Nansen Initiatives, GMG principles, Safe and Sund, Inter-Agency Wrking Grup t end child detentin, and the IOM Handbk n Prtectin and Assistance t Migrants in Vulnerable Situatins. The guiding principles wuld include cmmn understandings and effective practices n the types f vulnerabilities and vulnerable situatins requiring prtectin, beynd the scpe f refugee prtectin. States wuld cmmit t natinal interagency reviews f their prtectin plicies and encurage multi-stakehlder participatin in the develpment and subsequent implementatin f the guiding principles. Immigratin Detentin: Identify and strengthen alternatives t immigratin detentin fr administrative ffenses, particularly upn arrival and expulsin, such as (semi-)pen receptin centers r cmmunitybased accmmdatin, with reprting bligatins and case-management t limit enfrcement risks. Ensure peridic judicial review f immigratin detentin, including time limits. End the immigratin detentin f children; ensure adequate receptin systems and care ptins fr migrant children, including in natinal child prtectin systems. Trafficking in Persns and Smuggling f Migrants Establish mechanisms t identify, prtect and assist victims f trafficking and ther explited migrants, and ensure their access t assistance and remedies, including thrugh the establishment f htlines fr victims and supprting IOM s Glbal Assistance Fund fr victims f trafficking and ther migrants in vulnerable situatins, which facilitates emergency assistance t trafficked persns r thse in ther vulnerable situatins, including safe accmmdatin, medical care, psychscial supprt, legal assistance, and assisted vluntary return and reintegratin. Engage and supprt effrts by the private sectr t ensure decent wages and wrk cnditins fr all wrkers in their supply chains, at natinal, reginal and glbal levels, including fair and ethical recruitment. Eliminate child labur and take cncrete measures t reduce the demand fr gds and services prduced by trafficked persns and explited migrants, such as educating the public n the explitative cnditins in which sme gds and services may be prduced t enable cnsumers t make infrmed decisins abut the cnsumptin f such items. 4

5 Reduce the incidence f and risks assciated with trafficking in persns and smuggling f migrants thrugh targeted infrmatin campaigns in cuntries f rigin and transit t prevent such crimes and in cuntries f destinatin t prtect victims and prsecute ffenders. Build capacity f states t mre effectively cmbat and prsecute the crimes f migrant smuggling and trafficking in persns thrugh prvisin f technical assistance in areas such as internatinal law and practice, intelligence gathering, risk analysis, investigative skills and interviewing. Develp and implement legislatin cnsistent with internatinal standards and strengthen enfrcement t target rganized criminal grups, including thrugh peer t peer learning, sharing f effective practices, and dedicated capacity develpment such as that prvided thrugh the Reginal Cnsultative Prcesses n migratin and ther reginal and inter-reginal cperatin mechanisms. Set up bilateral and multilateral mechanisms amng judicial authrities, law enfrcement, brder cntrl agencies and ther relevant actrs t share infrmatin, crdinate peratinal activities, ensure prtectin f individuals and supprt prsecutin effrts. Expand and build n the Cunter-Trafficking Data Cllabrative (CTDC) glbal data repsitry f human trafficking data by cntributing relevant datasets (such as victim case data) t this multistakehlder, pen surce, nline platfrm which currently cntains infrmatin abut mre than 60,000 survivrs f human trafficking, and prmting the analytic use f the data fr targeted evidence-based plicy-making and prgramming. 2. Emply whle f gvernment and whle f sciety appraches t create inclusive, balanced and wellfunctining migratin management systems As migratin is relevant t a wide range f plicy areas including human rights, develpment, labur, envirnment, health, educatin, crime and many thers, dialgue between and cperatin amngst the varius parts f gvernment --whle f gvernment -- is essential. Further, because human beings are at the cre f migratin plicy, gvernment engagement with ther actrs (internatinal and reginal rganizatins, nn-gvernmental rganizatins, emplyer and wrker rganizatins, the media and migrants themselves) whle f sciety -- is critical fr effective, cmprehensive, and wellbalanced migratin plicies. Ensure that natinal and lcal plicies n sustainable develpment and climate change adaptatin, as well as sectral plicies (e.g. educatin, emplyment, health, scial prtectin), include a review f their sensitivity t migratin dynamics ( migratin marker ) and ensure prper incrpratin f migrants and migratin, including the drivers f migratin migratin mainstreaming ; supprt the expansin f pilt prjects n mainstreaming migratin int natinal and lcal develpment planning, and in climate change adaptatin strategies, by IOM and ther relevant entities, drawing n existing methdlgies and lessns learned. Ensure that migratin plicies are develped and implemented fllwing analysis f their ptential impact n sustainable develpment and sectral plicies and ensure plicy cherence, synergies and cmplementarity. Using guidance and benchmarks n well-managed migratin such as the Migratin Gvernance Framewrk and Migratin Gvernance Indicatrs, assess the adequacy f natinal migratin plicies and structures. 5

6 Institute and maintain regular inter-ministerial r interdepartmental crdinatin systems t ensure whle f gvernment appraches: Crdinatin shuld include thse invlved in plicy n immigratin, develpment, human rights, educatin, health, plicing, labur, envirnment, disaster respnse, and ther relevant sectrs t ensure that migrants and migratin are apprpriately factred int plicies acrss all sectrs. Institute and maintain regular cnsultatins with lcal authrities n migratin issues and plicies, including at the natinal and transnatinal levels, cnsistent with the recmmendatins in the New Urban Agenda. Institute and maintain regular cnsultatins and partnerships between gvernment actrs, civil sciety and the private sectr n migratin plicy develpment and implementatin t ensure whle f sciety appraches that bring balance, predictability, and scial chesin. Strengthen reginal, natinal and lcal capacities n migratin management, thrugh dedicated capacity develpment, including peer t peer learning and the sharing f best practices, such as thrugh the Reginal Cnsultative Prcesses and inter-state cperatin mechanisms n migratin. 3. Enhance the sciecnmic well-being f migrants and sciety Welcming newcmers and helping them adapt t their new hmes results in enrmus benefits t bth migrants and the cmmunities they jin. Measures that allw migrants t wrk, g t schl, btain health and scial services, and have their family members jin them maximize the cntributins that migrants make and reduce instances f discriminatin and xenphbia, which in turn fsters mutual understanding and respect, scial chesin and plitical stability. Legal pathways: Utilizing a whle f sciety apprach, regularly assess the effectiveness f migratin plices t further natinal develpment agendas, addressing nt nly shrt term bjectives (e.g. reducing unemplyment amng natinals; filling labur gaps) but als addressing lnger-term pririties. Recncile pririties and plicies in labur, educatin, demgraphic trends, changes in the wrld f wrk, innvatin, develpment f strategic ecnmic sectrs and supprt t glbal cmpetitiveness, including legal migratin channels at all skills levels, as part f natinal plicy tlkits. Establish apprpriate and accessible legal migratin pathways t: ensure balanced labur pls acrss all skill levels s cuntries and cmpanies get the wrkers they need and address demgraphic trends, and peple mve t lcatins where there are jbs that fit their skills, whether high, medium r lwer skilled; facilitate student mbility, including pprtunities fr vcatinal training, ICT technlgy, technical, engineering and scientific prgrammes, cnsistent with SDG target 4.b; enhance scial chesin thrugh family reunin plicies, including thrugh facilitated measures such as the Family Assistance Prgramme t expeditiusly reunite refugee families, and reduce the pressure fr nward irregular mvements; 6

7 prvide humanitarian and/r temprary prtectin thrugh visas, private spnsrship r ther measures fr migrants wh are nt prtected by refugee law t enter r remain and wrk (as apprpriate) in hst cmmunities, such as victims f trafficking, children wh are unaccmpanied r therwise in need f prtectin, and migrants whse cuntry f rigin is in crisis, including due t natural disaster, based n clear, cnsistent and predictable criteria; and explre avenues fr migratin as an adaptatin strategy t the effects f climate change. Establish and ensure adequate resurces fr dedicated natinal institutins, laws, plicies and practices t prepare migrants fr verseas life and wrk, including prviding pre-departure infrmatin and rientatin, skills training and certificatin, and infrmatin abut legal rights and respnsibilities, including cnsular assistance and prtectin. Establish bilateral and reginal cperatin mechanisms between cuntries f rigin and destinatin cuntries, and with recruiters and emplyers t facilitate fair, ethical, efficient and rights-based migratin. Enhance peratinal efficiencies and transparency in visa prcessing, including wait times, and assistance in native languages. Private Sectr: Supprt and expand measures such as the CREST Initiative Crprate Respnsibility in Eliminating Slavery and Trafficking -- recently launched by IOM, which prvides a cmprehensive peratinal framewrk t engage with the private sectr t: a) Frge strategic and actin-riented partnerships with businesses t maximize impact in the fight against frced labur and trafficking; b) Prvide a range f practical slutins including training and research t help businesses better understand the risks that they face, and t enhance transparency and cmpliance within their supply chains; and c) Facilitate cllabratin and crdinatin between different stakehlders, including gvernments, civil sciety, industries and business; including measures t: Train n ways t reduce the risk f slavery and trafficking in their daily peratins and supply chains, including guidance n hw t cmply with new anti-slavery legislatin and trade requirements, as well as practical tips n hw t implement ethical recruitment practices and better mnitr lwer tier suppliers; Prvide pre-departure and pst-arrival rientatin training fr migrant wrkers, t help emplyers develp mechanisms t prvide prspective wrkers with accurate infrmatin abut living and wrking cnditins, cntract terms and human and labur rights awareness, t better adapt t new wrk envirnments away frm hme; and Cnduct supply chain mapping and ethical recruitment supprt, fllwing the Internatinal Recruitment Integrity System (IRIS), a vluntary, multi-stakehlder certificatin system fr labur recruiters t help cmpanies identify ptential risks within their labur supply chains and develp risk mitigatin strategies in cmpliance 7

8 Scial inclusin: with the ILO Fair Recruitment Guidelines, and supprt cmpanies in reviewing their plicies and cdes f cnduct t clearly articulate cmpany standards and expectatins fr all suppliers. Prvide migrants access t educatin, health (cnsistent with the Framewrk f pririties and guiding principles adpted by the Wrld Health Assembly 70/15), and ther scial services n a nn-discriminatry basis, withut regard t immigratin status, t fster successful integratin and scial inclusin, cnsistent with the SDG imperative t leave n ne behind. Prvide tailred, gender-sensitive integratin services, including targeted language and vcatinal skills trainings and ther labur market and scial supprt services, based n specific characteristics and needs f different migrant grups. Establish mechanisms fr certificatin and mutual recgnitin f skills. Extend the basic labur rights enshrined in the ILO Cnventins t all persns regardless f immigratin status and ensure ethical recruitment practices and decent wrking cnditins fr all migrants. Adpt internatinal benchmarks n ethical recruitment, such as the Internatinal Recruitment Integrity System (IRIS) develped by IOM with a multistakehlder calitin and the ILO General Principles and Operatinal Guidelines fr Fair recruitment. Supprt the cnclusin and implementatin f bilateral and reginal agreements that set minimum standards fr migrant wrkers in terms f regulatins and emplyment cnditins. Enter int recruitment agreements between cuntries f rigin and destinatin, at bilateral and multilateral levels, as well as the develpment f cdes f ethical recruitment building upn, fr example, principles fr the internatinal recruitment f health persnnel develped by the WHO, t ensure ethical recruitment that takes accunt f the human capital needs f cuntries f rigin and facilitates migrants cntributins back hme. Wrk with lcal media t develp means fr regular transmissin f psitive narratives abut migrants and migratin t cunteract discriminatin, racism and xenphbia. Empwering migrants as develpment actrs: Explre the expansin f pprtunities fr dual and multiple natinality as well as multiple entry visas as links t cuntries f rigin enhance the cntributins f migrants t bth hme and hst cuntries, fr example ut-f-cuntry vting and ther frms f diaspra engagement. Establish mechanisms fr the recgnitin f skills and qualificatins, including pssible skills passprts, t reduce de-skilling and brain waste, including thrugh bilateral, reginal and glbal qualificatins/recgnitin standards and agreements. Cnsider establishing mechanisms fr migrants t upgrade their skills and qualificatins while abrad, and have thse skills recgnized and utilized upn their return hme, including thrugh skills partnerships and cperatin agreements between hme and hst cuntries and industries. Develp mechanisms fr effective cmmunicatins and partnerships with migrants and diaspra grups, including thrugh the establishment f dedicated diaspra ministries and regular 8

9 utreach, skills mapping, facilitatin f temprary, virtual and permanent return f diaspra members and investment in hme cuntry jb creatin and develpment. Encurage the prtability f scial security, pensin, and ther earned benefits, including thrugh bilateral and reginal prtability agreements. Review and revise regulatry restrictins n financial transfers that negatively affect migrant investment and remittance transfers, while ensuring the security f transfers and preventing abuse. Facilitate access f migrants and their families t banking services and financial instruments, with particular attentin t the needs f lwer-incme and vulnerable husehlds. Accmpany returns with rbust reintegratin measures, addressing the individual needs f returning migrants (especially thse in vulnerable situatins), their families and cmmunities f rigin, thus cntributing bth t the sustainability f reintegratin and t lcal develpment. Invest in hst cmmunity capacity, particularly in situatins f prtracted crisis, thrugh targeted develpment and stability initiatives and supprt fr the delivery f services. 4. Address the mbility dimensins f crises States shuld adpt, implement and incrprate int natinal practice the relevant cmmitments, initiatives and measures that supprt ppulatins and cmmunities at-risk f, and thse affected by r recvering frm, crisis, and respnd t them if they ccur, in a way that supprts sustainable and develpment-riented recvery. In additin t the 2030 Agenda fr Sustainable Develpment, which has a key rle in addressing drivers f frced and irregular migratin, these include the recmmendatins f the Guidelines t Prtect Migrants in Cuntries Experiencing Cnflict r Natural Disasters (MICIC); the recmmendatins f the Nansen Initiative Agenda fr the Prtectin f Crss- Brder Displaced Persns in the Cntext f Disasters and Climate Change, and the pririties established by the Platfrm n Disaster Displacement (PDD); the Paris Climate Change Agreement; the Warsaw Internatinal Mechanism n Lss and Damage; the Prgram f Wrk f the Task Frce n Displacement under the United Natins Framewrk Cnventin n Climate Change (UNFCCC); and the Sendai Framewrk fr Disaster Risk Reductin and ther internatinal and reginal instruments n cnflict preventin, peacebuilding, eradicating extreme pverty, amng thers. Include migrants in natinal and lcal disaster risk reductin measures and emergency respnse systems, as well as in climate change adaptatin plans. Eliminate the barriers migrants face in situatins f crisis that natinals d nt, such as ensuring that emergency infrmatin is published and widely available in freign languages. Incrprate rights-based brder management guidelines in natinal plicies t build gvernment capacity t prcess migrants mre quickly and effectively in emergencies, including using targeted technlgy. Take steps t reduce mrbidity, mrtality and health risks assciated with crises and human mbility fr migrants and cmmunities; and enhance resilience thrugh the utilizatin f migratin and mbility infrmatin fr public health preparedness and respnse. Ensure access t cnsular assistance in transit and at destinatin, including thrugh bilateral r reginal cnsular cperatin agreements and capacity develpment fr cuntries that d nt 9

10 have cnsulates everywhere their natinals are lcated r where situatins f crisis might arise; adpt the recmmendatin in the Sutherland Reprt fr crdinatin with the state-led Glbal Cnsular Frum. T mitigate the requirement t flee acrss brders, undertake planned, fair and vluntary (internal) relcatins in areas prne t envirnmental disasters and climate change, including drughts, flds, regular crp failure, desertificatin, degradatin and impacts related theret. Prvide equitable access t livelihd pprtunities and services fr ppulatins vulnerable t the drivers that result in irregular migratin, displacement and envirnmental degradatin and climate-related mvement. Prvide early prtectin t natinals wh have been frced r bliged t flee r t leave their hmes r places f habitual residence as a result f r t avid the effects f armed cnflict, situatins f generalized vilence, vilatins f human rights r natural r human-made disasters, befre they crss an internatinal brder as a means t reduce irregular migratin. 5. Enhance internatinal cperatin n and gvernance f migratin Internatinal migratin by its very nature invlves mre than ne state - and ften mre than tw, as migrants may transit thrugh many states en rute t their destinatin. All states share a cmmn interest in ensuring that migrants are prtected frm harm; that their rights are respected; and that bth migrants and scieties benefit frm migratin. Strengthened bilateral, reginal, inter-reginal, and glbal cperatin is necessary t achieve this. All persns have the right t return t their cuntry f rigin and states have an bligatin t accept the returns f their natinals and t prtect, respect and fulfil the rights and dignity f returnees. General principles: Reaffirm/frmally adpt the Berne Initiative Internatinal Agenda fr Migratin Management, cntaining cmmn understandings and effective practices fr cmprehensive and balanced migratin management. The UN General Assembly has fr sme time called fr reliable, disaggregated data and indicatrs that are natinally relevant and 11

Prmte the sharing f migratin data, which cntinues t be scattered and difficult t access r interpret, by supprting and develping existing initiatives, such as the Glbal Migratin Data Prtal being develped by IOM, in partnership with ther agencies.
