1 TRANSLATION FROM CROATIAN INTO ENGLISH: THE FIRST PAGE: TO SIMPLIFY ORIENTATION ON ENTERING THE COUNTRY, WE PRESENT SOME IMPORTANT EXTRACTS FROM THE LAWS AND REGULATIONS OF THE REPUBLIC OF CROATIA: Official Gazette of the Republic of Croatia, Narodne novine, No.97/96 published 26 September 1996 BORDER CROSSING REGULATIONS OF THE REPUBLIC OF CROATIA Article 2 There are two types of border crossings which are designated as first and second categories. Border crossing of the first category involves the entry of the international traffic under the supervision of regular police and customs officers. Sanitary, veterinary, phytosanitary, commercial and motor vehicle/vessel inspections are carried out in accordance with applicable laws and trans-national agreements. Border crossing of the second category involves the entry of the international traffic under the supervision of regular police and customs officers while inspections from the paragraph 2 of this article are done according to the type of the crossing and traffic that is done on the border, in accordance with the paragraph 2 of this article. At ports of entry and border crossings on rivers, the authority of the resident Harbour Master s Office and its branch offices is applicable. Article 15 Permanent international ports of entry of the first category in the Republic of Croatia are: Umag, Pula, Rijeka, Mali Lošinj, Zadar, Šibenik, Split, Ploče, Korčula, Dubrovnik, Senj, Maslenica. Ports of entry of the second category are: Poreč, Rovinj, Raša-Bršica, Metković. Article 16 Seasonal international ports of entry of the second category are: - 1 -
2 Novigrad, Sali, Božava, Primošten, Ravni Žakanj, Ubli (Lastovo), Komiža, Hvar, Vis, Vela Luka, Kanegra, Umag ACI Marina. Article 21 Seasonal ports of entry specified by articles 14 and 16 of this regulation are open for international traffic from 1 April to 31 October every calendar year. If, in the calendar year, Easter holidays start before 1 April, border crossings are opened for international traffic seven days before the beginning of the holidays. THE SECOND PAGE EXTRACTS FROM THE NATIONAL LAW ON BORDER CONTROL Official Gazette of the Republic of Croatia, Narodne novine, No.173/2003 published 31 October 2003 Article 12 National border crossings are places defined for entry by road, rail, air and maritime and river transport where border control is done permanently, seasonally or temporarily. Border crossings can be open for international and frontier trade. Border crossings, timings and methods of crossing are defined by regulations issued by Government of the Republic of Croatia. Obligations of the master or skipper of a vessel Article 20 The master of a yacht or boat intended for leisure or sport entering the territorial waters of the Republic of Croatia, is obliged to enter the nearest port designated as a port of entry by the most direct navigable course except in the case of random passage. Masters of vessels entering territorial waters with the intention of putting ashore on Croatian soil are also subject to the requirement to report to the nearest port of entry. Entry of the vessels of international registry out of the maritime or river border crossing (through places that are not maritime or river border crossing), except in the case of Act of God, is approved by an authorized police officer with the agreement of the authorized Harbour Master s office and customs authorities. Upon entry, masters shall present to the border police a crew list and passenger list, unless exempt by bone fide contract or other regulations, and their documents necessary for crossing of the national border. Masters of passenger (cruise) ships shall submit to the border police a crew list and passenger manifest (list) a minimum of 24 hours before reporting to border control
3 Obligations of the master, skipper of a vessel or boat owner upon entering the port Article 21 Upon entering, the master or skipper of the vessel must report to the closest police station the names of every person embarked who does not possess valid travel documents. All persons found to be stowed away (without ticket) or without permission of master or skipper must also be reported. Masters are responsible to ensure that such persons (specified by paragraph 1 of this article) or the person whose entry into the Republic of Croatia is forbidden, do not disembark onto Croatian soil without the permission of the border police. In the event of an unauthorized disembarkation (specified by paragraph 1 and 2 of this article), the master shall be financially responsible for the cost of any illegal entrant s living expenses and all costs entailed in their removal from the Republic of Croatia. THE THIRD PAGE:. Embarkation in the vessel out of the Port of Entry Article 22 With the exception of persons rescued on the open sea (who shall be immediately reported to the nearest police station), masters and skippers of vessels are permitted neither to embark nor disembark unauthorized persons out of the port of entry. Obligatory submission to border control Article 26 Any foreign national who intends to enter or who has already crossed the border line, (except the line on the internal border after claiming status under the Schengen implementation agreement) must present the documents required for entry, submit themselves to the provisions of border control and cannot depart the area of the border crossing until border control measures are complete or evade in any other way border control processing. Any person seeking entry must explain relevant circumstances to a police officer fulfill all condition to be eligible to cross over the border and act in accordance with warrants and directions of border control officials. Article 48 Any apprehended offender is liable for a sentence of 30 days of detention or a fine ranging in amount from 2.000,00 to ,00 kn for following contraventions: - 3 -
4 1. illegal entry or attempted entry out of border crossing, outside of the normal hours of operation of crossing points or contrary to the directions of border crossing officials (article 8, paragraph 2.). 2. illegal crossing or attempted crossing of the internal border, contrary to the regulations for crossing over national borders (article 9, paragraph 3.) 3. evasion of border control or unauthorized departure from the area of border crossing without submission to border control or some other form of evasion of border control (article 26, paragraph 1). Article 49 Any apprehended offender is liable for the award of a fine ranging in amount from 1.000,00 to 5.000,00 kn for following contraventions: 1. disturbance of the border control function in any way (article 7, paragraph 2), 2. failure to inform border control in a timely manner any event of entry due to an Act of God (article 8, paragraph 3), 4. loitering in the area of a border crossing with no intention of crossing over the border or submitting to the border control and lacking other reasonable grounds (article 18, paragraph 1), 5. failure in the area of border crossings to heed the warnings and directions of border control officials (article 18, paragraph 2), 7. failure to present a valid identity card on demand while attending the area of a border crossing THE FOURTH PAGE 9. as a master (captain) of a cargo ship or passenger ship within the territorial waters or on the internal waterways of the Republic of Croatia, fails to proceed to a port of entry by the most direct navigable course to submit to border control processing and he doesn t fulfill on that way his duty (obligation) as a master (article 20, paragraph 1 and 3) 10. as a skipper of a yacht or boat intended for leisure and sport within the territorial waters or on the internal waters of the Republic of Croatia, fails to proceed to the nearest port of entry by the most direct navigable course to submit to border control processing and doesn t fulfill on that way his duty as a skipper (article 20, paragraphs 2 and 3), 11. as a master or skipper of a vessel, except in the case of Act of God, in the international traffic puts ashore out of maritime or river border crossing without necessary authorization (article No.20, paragraph 4), - 4 -
5 12. as a master or skipper of a vessel, upon arrival from abroad or before going abroad, fails to provide to the border police a crew list and passenger list, and fails to provide travel documents for inspection (article 20, paragraph 5) 13. as master of passenger ship, fails to provide a crew list and passenger list a minimum of 24 hours prior to (before) reporting to border control (article 20, paragraph 6), 14. as master, skipper or boat owner fails to fulfill requisite obligations upon arrival at a port of entry (article 21, paragraphs 1, 2, 3), 15. as a master or skipper of a vessel in international traffic, except in the case of persons rescued at sea, embarks or disembarks a person without authority from border control out of border crossing (article 22, paragraph 1) 16. as a master or skipper of a vessel, in the event of rescuing a person, embarks or disembarks the person and fails to report it in a timely manner to the nearest police station (article 22, paragraph 2), 17. as a crew member of a foreign cargo ship or passenger ship remains ashore without authorization, or during processing of the ship at border control or in the port of entry (article 23, paragraph 1), 20. failure to present to border control those documents necessary for entry (article 26, paragraph 1), 21. failure to explain the relevant circumstances applicable to entry or fails to heed the warrants and directions of the border control officials (article 26, paragraph 2), 22. tampering or defacement of signs in the area of border control establishments (article 35, paragraph 4), 23. unauthorized navigation, hunting, fishing, over-flight, settlement or loitering in the immediate vicinity of the border line, contrary to the regulations of the Government of the Republic of Croatia (article 36, paragraph 2),.
